No. FRS 158/2018/36.-Whereas , the Govt . of india had accorded in - Principle approval for use of 108.162 hectare of forest land of Komarakata Reserve Forest in Nagaon South Division ( 8.399 Ha. ) , Krungming Reserve Forest (29.694 Ha) , Panimur PRF ( 11.954 Ha) in Dima Hasao West Division Rongkhong Reserve Forest ( 7.037Ha ) . Charchim DCRF ( 36.802 Ha) Kolonga DCRF ( 14.276 Ha) in Hamren Division in favour of NER- II Transmission Limited for construction of 400 KV D /C Silchar -Misa Transmission line in the state of Assam vide their letter No.3 - AS A 042/2018 - SHI/ 1879-80 , dated 29.08.2018 subject to fulfilment of certain conditions .
Whereas , the NER - II Transmission Ltd. in response has already complied with all the conditions as laid down in the Govt. of India letter dated 29.08.2018 .
Nowtherefore, with a view to expedite the construction process the Governor of Assam is pleased to authorise the Divisional Forest Officers . Nagaon South Division , Hojai , Dima Hasao West Division , Haflong and Hamren Division for cutting of the trees falling within the proposed diversion area and allow the NER -II Transmission Limited to commence their work which is a liner Project in the forest area, subject to fulfilment of the following conditions:
1. An agreement shall have to be executed by the User Agency i.e. NER - II Transmission Limited with the Divisional Forest Officers Nagaon South Division, Hojai , Dima Hasao West Division, Haflong and Hamren Division , Hamren that they shall abide and comply all the conditions stipulated in the In- Principle Approval granted by the Govt. of India . All the conditions laid down for grant of the In- Principle Approval should be incorporated in the agreement and any violation of the conditions and rules of the Forest Conservation Act 1980 , during the pendency of the working permission , the order allowing the commencement of work are liable to be cancelled .
However , on grant of the Final Approval by Govt . of India a separate/additional agreement shall have to be executed by the Divisional Forest Officers , Nagaon South Division , Hojai , Dima Hasao West Division , Haflong and Hamren Divisions , Hamren with the user agency as was being done earlier.
2. The Divisional Forest Officers , Nagaon South Division , Hojai , Dima Hasao West Division , Haflong and Hamren Division , Hamren shall take requisite measures to carry out felling of trees departmentally , as expeditiously as possible, in the forest land for which In - Principle Approval has been granted as per law, as per the proposal approved by Govt . of India , Ministry of Environment , Forest & Climate Change. The felling of trees on the said forest land shall be carried out departmentally, in view of the Supreme Court's orderdtd. 12.12.1996, in respect of logging in forest area, in writ petion number 202/1995.
3. The Divisional Forest Officers , Nagaon South Division , Hojai , Dima Hasao West Division , Halflong and Hamren Division , Hamren shall monitor the marking and felling of trees and tree felling shouldbe restricted to the minimum.

( A subsidiary of Assam Industrial Development Corporation Limited ) AIDC Complex , R.G. Baruah Road , Guwahati - 24 and Sri Gopal ch . Barua and other 50 workers.

No.GLR.107/2018 / 31 : Whereas a Departmental Proceeding was drawn up against Shri Dilip Dutta, APS , the then Inspector of CID , Assam now retired vide letter No.HMA.320/ 2014 /24 dated 16/08/2016 for serious misconduct and gross negligence of duty in his part ; and ,
Whereas Shri Dilip Dutta , APS ( Retd ) submitted his written statement in defence vide his letter dated 23/09/2016 and denied the charges framed against him and;
Whereas having not been satisfied with the written statement in defence submitted by Shri Dilip Dutta , APS (Retd ) and after careful consideration of all aspects , the Govt. decidedto enquire into the allegations and therefore appointed Shri Diganta Choudhury , APS , Supdt. of Police , SB (G) , Assam , Kahilipara, Guwahati as Inquiry Officer to enquire into the charges framed against Shri Dilip Dutta, APS vide Notification No. HMA.320/2014 /34 dated 09/11/2016 , and;
Whereas, the Inquiry Officer after causing an enquiry into the charges submitted his report to the Disciplinary Authority vide letter No.SP( BSN ) /DP - 1/ 2016/57 dated 26/12/2017 wherein the Inquiry Officer concluded that the charges for serious misconduct and gross negligence of duty in his part is proved beyond reasonable doubt .
Now, therefore , after careful examination of the report of the Inquiry Officer and materials on records and also in consideration of the facts and circumstances of the case , the Governor of Assam is picased to order the penalty of " deduction of 9 % of monthly pension for a period of 12 ( twelve) months" as provided under the Assam Services (Pension ) Rules, 1969 .
The Governor of Assam is therefore pleased to deduct 9 % of monthly pension for a period of 12 (twelve) months from Shri Dilip Dutta, APS , the then Inspector of CID, Assam now retired and the Departmental Proceedings drawn up against Shri Dilip Dutta, APS , are thus finally disposed off.

He shall hold office for a period of 5 ( five ) years or till he attains the age of 70(seventy) years whichever is earlier as per provision under Sub - Section (3 ) of Section10 of the Bodoland University Act, 2009. The emoluments and other terms and conditions of service shall be as per existing norms and be governed by the provisions of Section 10 (4) of the aforesaid Act .
This appointment of Prof. Laishram Ladu Singh as Vice Chancellor of Bodoland University shall be subject to the result of the final outcome of Case No. WP ( C) 7698/2018 in the Hon'ble Gauhati High Court.
