No.GLR.131 / 2018/18. - Whereas an Industrial dispute has arisen in the matter specified in the Schedule below between the Management of GVK EMRI , Sarusajai Sports Complex , Express Highway - 37 , Lokhra , Guwahati - 34 and their workers reperesented by All Assam 108 Mrityunjoy Employees association over the issue of non- fulfillment of their demands .

Whereas it is considered expedient by the Government of Assam to refer the dispute for adjudication to Presiding Officer , Industrial Tribunal , Guwahati constituted under Section 7 / 7 - A of the Industrial Disputes Act , 1947 ( Act XIV of 1947).

Now, therefore , in exercise of the powers conferred by Clause (c) / ( d) Sub- Section( 1 ) of Section 10 of the Industrial Disputes Act , 1947 (Act- XIV of 1947) as amended , the Governor of Assam is pleased to refer the said Dispute to the Presiding Officer , Industrial Tribunal , Guwahati as appointed under the provisions of the said act.

-SCHEDULE-

1. Whether the management of GVK EMRI is justified in not releasing the salary increment of its employees for the year 2016-2017 and 2017-2018.

2. If not, whether the management is liable to pay salary increment to its employees for the year 2016-2017 and 2017-2018 or any other relief in lieu thereof.

3. Whether the management of GVK EMRI is justified in engaging the workers beyond 8( eight) hours of duty per day .

Purushothaman -vs- Union of India & others ) and in pursuance of the Guideline of Government of India regarding "Reducing the Load of School Bags/Materials /Workbooks in Primary , Upper Primary & High Schools " communicated vide D.O. letter No. 1-4/2018 - IS - 3 dated 5/10/2018, received from Shri Maneesh Garg, Joint Secretary ( SE - 1 ) , Ministry of Human Resource Development, Department of School Education & Literacy , New Delhi , the Governor of Assam is pleased to notify the following Guidelines for effective implementation in all schools under Elementary Education Department , Govt . of Assam and Secondary Education Department , Govt . of Assam from the Academic year 2018-19 onwards :

1. Home work shall not be assigned to the students of Class I & II .

2. Every School should not prescribe any other subject except Language and Mathematics for Class I & II students and Language , Environmental Science & Mathematics for Class III to V students as prescribed by NCERT/ SCERT .

3. Schools prescribing homework and non -prescribed subject for Class I & II students and Class III to V students , will be disaffiliated .

4. The maximum total weight of the school bag should not exceed the following limit:

A Inform the students and parents regarding appropriate kind of School Bags i.e. which have broad padded straps for symmetrical distribution of weight .

The students should always use both straps for carrying the School Bag and should not sling the Bags over one shoulder .

A The students should keep the Bag down while waiting for the school conveyance or in the school Assembly.

A The school must ensure that students carry books only according to the time table .

School Head should counsel the parents and teachers about the health issues arising out of carrying heavy School Bags to school .

School should not prescribe additional and supplementary textbooks those are voluminous , costly and designed in a pedagogically unsound manner other than prescribed by SCERT.

A Students should be encouraged to repack their Bags on daily basis and avoid carrying unnecessary articles , textbooks and workbooks those are not needed.

A The school must frequently check the School Bags to ensure that the students are not carrying heavy Bags with unnecessary materials .

No. IPRD.30/ 2011/251.- Where as , Shri Ranjit Gogoi , DIPR ( under suspension) filed writ petition bearing W.P. (C) No.7047/ 2018 before the Hon'ble High Court ; and

Whereas, the Hon'ble Gauhati High Court vide its order dated 03/10/2018 passes in W.P. (C) No.7047/2018 has directed Additional Chief Secretary to the Govt. of Assam , Information & Public Relations Department to consider the representation of Shri Ranjit Gogoi , after taking all aspects into consideration and take a decision thereon in accordance with law within a period of one month ; and Whereas , Shri R. Gogoi vide his letter dtd. 11/05/2018 has submitted an appeal praying to withdraw the suspension order and re - instating him back into service ; and

Whereas , Sri R. Gogoi has been placed under suspension vide notification No.IPRD.107/2017/246, dtd.14/ 11/2017 w.e.f. 07/11/2017 , the date of his arrest in connection with vigilance SP Case No.08 /17. After the report/consent received from Inspector General of Police , CM's Special Vigilance Cell in regards to sharing of enquiry report , Departmental Proceeding against Shri R. Gogoi and other accused has been initiated. The Hon'ble Gauhati High Court has also directed to undertake an exercise on the desirability of continuing the suspension of Shri R. Gogoi , on the basis of advice of the Personnel Department within a period of one month and Personnel Department viewed to consult Judicial Department on action to be taken as per the judgement of Hon'ble Supreme Court of India passed in Civil Appeal No.1912 of 2015 (Arising out of SLP ( C) No.31761 of 2013 decided on 16/2/2015 ) and Judicial Department advised to review the suspension of the charged officer and thereafter passed a Reason Order extending the suspension order by stating the grounds ; and

Whereas , after due consideration of all facts and circumstances relating to this matter it is seen that the DP drawn up against Shri R. Gogoi is yet to come to its logical conclusion. The entire Departmental Proceeding against the charged officer is based on official records pertaining to the office Shri R. Gogoi held before the suspension and the period of his incumbency as DIPR . All the relvant documents containing evidence against Shri R. Gogoi is in public domain and is accessible by officer of the DIPR. Thus , it is considered expedient to ensure that confidentiality of the relevant document and ensuring measures to avoid any tempering what so ever is prime important for judicious objective and fact based conclusion of Departmental Proceeding instituted ; and

Whereas , re- instatement of charged officer may influence such material witnesses which will result in less than judicious and objective conclusion of the matter . Further , intimidation or coercion of witnesses against the charged officer also cannot be ruled out ; and

Whereas , on careful examination of the said representation it is decided that Shri R. Gogoi may not be re - instated in service till such time as the Departmental Proceeding drawn up against him is brought to logical conclusion.

No. HMA . 320 /2014/ 57. -Whereas a Departmental Proceeding was drawn up against Shri Dilip Dutta , APS , the then Inspector of CID , Assam now retired vide letter No.HMA.320/2014/24 dated 16/08/2016 for serious misconduct and gross negligence of duty in his part ; and ,

Whereas Shri Dilip Dutta, APS ( Retd) submitted his written statement in defence vide his letter dated 23/09/2016 and denied the charges framed against him and ;

Whereas having not been satisfied with the written statement in defence submitted by Shri Dilip Dutta, APS ( Retd) and after careful consideration of all aspects , the Govt . decided to enquire into the allegations and therefore appointed Shri Diganta Choudhury , APS , Supdt . of Police , SB(G ), Assam, Kahilipara , Guwahati as Inquiry Officer to enquire into the charges framed against Shri Dilip Dutta , APS vide Notification No. HMA.320/2014/34 dated 09/11/2016 , and ;

Whereas, the Inquiry Officer after causing an enquiry into the charges submitted his report to the Disciplinary Authority vide letter No.SP ( BSN ) /DP - I/ 2016/ 57 dated 26/12/2017 wherein the Inquiry Officer concluded that the charges for serious misconduct and gross negligence of duty in his part is proved beyond reasonable doubt .

Now, therefore , after careful examination of the report of the Inquiry Officer and materials on records and also in consideration of the facts and circumstances of the case , the Governor of assaltis pleased to order the penalty of " deduction of 9 % of monthly pension for a period of 12 ( twelve ) months " as provided under the Assam Services (Pension ) Rules , 1969 .

The Governor of Assam is therefore pleased to deduct 9 % of monthly pension for a period of 12 (twelve) months from Shri Dilip Dutta, APS , the then Inspector of CID , Assam now retired and the Departmental Proceedings drawn up against Shri Dilip Dutta , APS , are thus finally disposed off.

3. Wherever it is necessary to print and publish a notification on a specified date ( excluding such Notification or communicate as are to be published in Gazette extraordinary) clear instruction ofthat effect must be given to the Deputy Director , Assam Government Press , both on the body of such notification within the indication at the top in the red ink and is a separate covering .

4. To achieve the objective in papers 2 and 3 , it is essential that proper discretion should be exercised by the concerned officers in the Department or office and all matters for publication in the Gazette should scrutinised and sent to the Press after careful application .

5. As for publication of any matters in a Gazette , Extraordinary , the existing procedure whereby the prior approval of the General Administration Department is to be obtained will continue .

The Childrens Wing at Belvedere remains open on all working days from 3 p . m. to 6 p . m. and Sundays and Holidays from 10 a . m . to 5 p . m . for the children between 5 and 14 years .

The Library is entirely closed on the Republic Day, Independence Day and Mahatma Gandhi's birth day on the 26th January, 15th August and 2nd October every year respectively.
