Whereas , Shri Paragjyoti Baruah , APS did not submitted his written statement in defence , and;
Shri Paragjyoti Baruah , APS , the then Superintendent ofPolice ( S) to C.M. , Assam, now Superintendent of(River) Police Organisation vide letter No.HMA.430/2010/Pt ./8 , dated 11th July, 2016 on the charges of gross indiscipline and misconduct on his part , and ; Whereas having not been satisfied with the intention of the delinquent office and after careful consideration of all aspects , the Government decided to enquire into the allegations and therefore appointed Shri Debajit Hazarika , IPS , Deputy Inspector General of Police( CID) , Assam , as an Inquiry Officer to enquire into the charges framed against Shri Paragjyoti Baruah , APS vide Notification No.HMA.430/2010/Pt ./ 15 , dated 25th April , 2018 , and;
Whereas the Inquiry Officer after causing an enquiry into the charges submitted his report to the Disciplinary Authority vide Memo No.CBII / CID / D.Enq / 3 / 18 / 61 , dated 18th September , 2018, wherein the Inquiry Officer concluded that the charges of gross indiscipline and misconduct could not be proved beyond reasonable doubt. However, it is a fact that the officer should have intimated his superiors about the payment he had made in compliance to the instructions of senior officers , and ;
Now therefore, after careful examination of the report of the Inquiry Officer and materials on records and also in consideration of the facts and circumstances of the case and lapses committed by Shri Paragjyoti Baruah , APS , the Governor of Assam is pleased to decides that the infliction ofminor penalty of "Censure " will meet the end ofjustice .
The Governor of Assam is therefore pleased to order " Censure " Shri Paragjyoti Baruah , APS , the then Superintendent of Police ( S ) to C.M. , Assam . He is censured to be more careful and alert in dealing such matter in future .
Departmental proceeding is accordingly disposed off.

OFFICE MEMORANDUM
Subject: Revised Guidelines for selection of Principal of Provincialised Higher Secondary School Awarding Marks .
No. ASE .. 82/2014/Pt/ 116.- In supersession of the earlier Office Memorandum (OM) vide No. ASE.82/0-14/Pt/100 dated. 01.08.2017 and in partial modification of the said OM, with a view to ensure proper selection of Principal in Higher Secondary Schools purely on the basis of qualities such as leadership skills , Administrative ability, integrity and commanding personality , academic career etc. as stipulated under rule 13 of the Assam Secondary Education ( Privincialised ) Service Rules, 2003 , the School Selection Committee as constituted under rule 8 ( 4 ) shall award total 30 marks to the candidate for the post of Principal of Higher Secondary School as follows:
( i) Up to 59% pass - 1 marks 1. Leadership Skills = 4 marks
(ii) 60-79% pass - 2 marks

No. FEA 9SFC0 179/2017/88.- In continuation of this Department's Notification No. FEA(SFC ) 179/2017/74 dated 9th November 2018 , constituting Sixth Assam State Finance Commission under Chair of Smti . T.Y. Das , IAS ( Retd .) , former Chief Secretary of Assam, the Governor of Assam is pleasedto notify Dr. Mrinal Kanti Dutta, Professor and Head, Department of Humanities and Social Science , IIT, Guwahati as the Member (non- official part time) of Sixth Assam State Finance Commission .
2. The Commission shall make recommendation as to the following matters:
(a) The principles , which should govern-
i) the distribution between the State of Assam and the Panchayats and Municipalities of the net proceeds of the taxes and duties , levied and collected by the State;
ii) the determination of the taxes , duties , tolls and fees , which may be assigned to , or appropriated by, the Panchayats and Municipalities ;
iii ) the grants - in- aid to the Panchayats /Municipalities from the Consolidated Fund of the State;
(b) The measures needed to improve the financial position of the Panchayats and Municipalities with special references to : -
i) the potential for Local Governments to raise funds from financial institutions and the market , and to suggest a mechanism and framework for realizing the potential;
ii) improving the quality of upkeep of assets owned by Local Governments as well as those transferred to Local Governments ;
iii) improving the financial position of the Panchayats and Municipalities with special emphasis on rationalization of taxes and revenues and user charges collected by Local Governments with innovative methods .
iv) achieving economy and efficiency in expenditure by Local Governments ;
v) providing incentives for higher mobilization of own resources by the Local Governments;
vi) maintaining a proper fiscal data base relating to Local Governments ;
vii ) putting in place measures required for improving the capacity of financial management by Local Governments ;
viii) improving monitoring of the fiscal performance of the Local Governments ;
ix) improving the measures for quality of service delivery of Local Governments in respect of State Government as well as Local Government programmes;
Examine the feasibility and make recommendations on creation of urban infrastructure and other civic amenities by the Urban Local Bodies through Public- Private partnership and exploring avenues of viability gap funding . x)
(c) Any other matter referred to the State Finance Commission by the Governor in the interests of sound financial position of the Panchayats and Municipalities .
3. In making its recommendations the Commission shall have regard , among other Considerations , to: -
i ) the objective of balancing the receipts and expenditure on revenue account of both the Local Bodies as a whole and the State Government and each Local Body;

ii ) pension, debt servicing including the debt servicing on behalf of Local Bodies and other committed expenditure and need to generate adequate surplus on revenue account for capital outlay and the commitment for maintaining fiscal targets as per Assam FRBM (Amendment) Act 2011;
iii ) the revenue of the resources of the Local Bodies for the five years commencing on 1st April , 2020 on the basis of the level of collection made during 2016-17 from taxes , duties , tolls , fees , cess etc. levied by the them ;
iv) The impact of the GST , including payment of compensation for possible loss of revenue for 5 years and abolition of a number of cesse , earmarking thereof for compensation and other structural reforms programme , on the finances of Centre and States;
v) The commission may consider proposing measurable performance -based incentives for Local Bodies and councils .
4. In making its recommendations on the various matters aforesaid, the Commission shall adopt the population figures of that Census for which PRI - wise and ULB - wise figures are available in all cases where population is regarded as a factor for determination of devolution of taxes and duties and grants - in- aid .
5. The Commission shall indicate the basis on which it has arrived at its finding and make available the Local Body - wise estimates of receipts and expenditure .
6. The Commission shall prepare its report on the basis of the Templates of the 13th Finance Commission of Government of India , with such modifications as may be necessary .
7. While making assessment of the resources of the Local Governments , the Commission shall also make recommendation devolution and grant- in - aid for the Local Bodies of the three Autonomous Councils under the Sixth Schedule .
8. The Commission shall make its report available to the Governor of Assam by 30th October, 2019 on each of the matters aforesaid, covering a period of five years commencing on the 1st April , 2020.

No. FSC 14 / 2018/67.- Upon receipt of report from the Food Analyst to the Govt . of Assam & also the Certificate ofanalysis from the Director , Referral Food Laboratory , Kolkata and upon consideration of the same, it reveals that the sample of Bailley Soda is unsafe in terms of the provisions of Section 3 ( 1) ( zz ) of the Food Safety and Standards Act, 2006.
Whereas, the sample of Bailley Soda does not conform to Fluoride content as per standards laid down in Regulation 2.10.6.1 ( Read with 2.10.8 ) of Food Safety and Standards ( Food Products Standards and Additives) Regulations, 2011 and declared un - safe according to Section 3 ( 1 ) (zz ) of Food Safety and Standards Act , 2006 by the Food Analyst to the Govt. of Assam vide Report No. FSS/G/50/18 dtd . 17/04/2018 thereof .
And whereas, one part of the said sample was sent to the Referral Food Laboratory, Kolkata for re- analysis as per appeal made by the Food Business Operator ( FBO) under FSS Act , 2006 wherein the Director , Referral Food Laboratory , Kolkata has given his opinion that the sample does not conform to the standards laid down under Regulation No. 2.10.6 ( 1 ) & 2.10.8 of Food Safety and Standards(Food Products and Food Additive ) Regulations , 2011 as it shows low in ' pH' value and high in' Fluoride' content than the prescribed limit in it and declared the sample as substandard and unsafe under section 3 ( 1 ) ( zx ) & 3 ( 1 ) ( zz ) ( v ) respectively of Food Safety and Standards Act , 2006 thereof vide Certificate No. G.14-1/D.O/2018-291 dated 07.09.2018 .
Therefore, in exercise of power conferred under Section 30( 2) (a ) of Food Safety and Standards Act , 2006, the undersigned hereby in the interest of public health prohibit the manufacture, storage , distribution and sale of Bailley Soda manufactured by M/ s Padmesh Beverages , Satgaon . Udayan Vihar , Village- Kahilakuchi , Guwahati - 7 , Kamrup Metropolitan District , Assam in the State of Assam with immediate effect for a period of 30 (thirty) days .
Nothing in this order shall bar the manufacturer from producing Bailley Soda for the purposeof testing and analysis towards improvement during the period of prohibition , in the presence oftheFood Safety Officer.
The Designated Officers, Food Safety of the districts are hereby directed to strictly enforce this prohibition Notification and furnish the reports thereof accordingly without fail .
TheDesignated Officer, Food Safety, Kamrup Metropolitan District is also hereby directed to serve improvement notice under Section 32 of Food Safety and Standards Act , 2006 to secure compliance with the improvement notice within the specified period .

No. FSC . 16/2018/83.- Upon receipt of report from the Food Analyst to the Govt . of Assam & also the Certificate of analysis from the Director , Referral Food Laboratory, Kolkata and upon consideration of the same, it reveals that the sample of Packaged Drinking Water ( Bailley Brand ) is unsafe in terms of the provisions ofSection 3 (1 ) ( zz ) of Food Safety and Standards Act, 2006.
Whereas, the sample of Packaged Drinking Water ( Bailley Brand) does not conform to parameters viz Fluoride content and total viable colony count at 37 ° C on agar agar as per standards laid down in Regulation 2.10.8 of Food Safety and Standards ( Food Products Standards and Additives) Regulations , 2011 and declared un - safe according to Section 3 ( 1 ) ( zz ) of Food Safety and Standards Act, 2006. as per report of the Food Analyst to the Govt . of Assam vide Report No. FSS/G/51/18 dtd . 17/04/2018 thereof.
And whereas, one part of the said sample was sent to the Referral Food Laboratory, Kolkata for analysis as per an appeal made by the Food Business Operator ( FBO) under FSS Act , 2006 wherein the Director, Referral Food Laboratory , Kolkata has given his opinion that the sample does not conform to thestandard laid down under Regulation No. 2.10.8 of Food Safety and Standards ( Food Products and Food Additive) Regulations , 2011 as it shows the presence of microbial contaminants as : Yeast & Mould count, Aerobic plate count at 22 ° C & Aerobic microbial count 37 ° C higher than the prescribed limit . Fluoridecontent was found higher than the prescribed limit . * It also contravenes reg . 2.2.1 ( Packaging & Labelling) 2011, for not fulfilling general requirements of Packaging & Labelling , 2011 and declared the sample as unsafe and misbranded as per section 3( 1) ( zz) ( v) ( x) and 3 ( 1) ( zf) (A) ( i ) of Food Safety and Standards Act , 2006 respectively thereof vide Certificate No. G.14-1/D.O/2018-290 dated 06.09.2018 .
