Whereas the Government of Assam has notified the Assam Solar Energy Policy , 2017 to leverage solar energy potential of the State of Assam for augmenting the installed Solar power capacity by developing resources provisioned under State and Central Schemes , policies and programme .

Whereas the Government of Assam aims to fulfill its commitments under Sustainable Development Goals by promoting clean , accessible . affordable and equitable solar energy availability to ensure energy security for its citizens , as well as facilitate meeting of renewable energy obligations .

Whereas the State of Assam requires powers from every possible alternative source to meet the deficit and whereas the Solar Power Projects are sustainable and environment friendly and whereas the solar power can be consumed for a variety of purposes like residential commercial , industrial , irrigation facilities etc.

Whereas , the Department of Power . Government of Assam has requested the Revenue & Disaster Management Department for getting special exemption from the provision of the Assam Fixation of Ceiling on Land Holdings Act . 1956 ( Assam Act No.1 of 1957 ) and the Assam Agricultural Land ( Regulation of Re - classification and Transfer for Non- Agricultural Purpose ) Act , 2015 ( Assam Act No. XXVI of 2015 ) in respect of land for the purpose of setting up of Solar Power Projects .

Therefore , in exercise of the provision of Section 16 ( i ) of the Assam Agricultural Land (Regulation of Re - classification and Transfer for Non- Agricultural Purpose ) Act , 2015 , the Governor of Assam is pleased to exempt land used or intended to be used for Solar Power Projects duly approved by the APDCL from the purview of the Assam Agricultural Land (Regulation of Re - classification and Transfer for Non Agricultural Purpose ) Act , 2015.

The land used or intended to be used for Solar Power Projects shall be re - classified before effecting any transfer /lease as per provisions of Section 3 - A of the Assam Land Revenue Re- assessment Act , 1936 ( Assam Act VII of 1936 ) and the Assam Land Records Manual .

In case of transfer or leasing out of land for Solar Power Projects , the provisions of the Registration Act , 1908 and the Indian Stamp Act, 1889 shall be applicable .

The land so transferred/ leased out for setting up of Solar Power Projects shall be utilized only for Solar Power Projects within 3 years from the date of such transfer/ lease failing which the exemption under notification from application of the Assam Agricultural Land ( Regulation of Re- classification and Transfer for Non- Agricultural Purpose ) Aet . 2015 shall be deemed to be withdrawn .

Division ; and Whereas Shri Gautam Bora , Executive Engineer , Dhubri W.R. During the period of incumbency as Muslim Marriage Registrar , he will not be allowed to hold any other salaried appointment without permission from the District Registrar .

The above order of temporary license will stay in force till appointment of a permanent Muslim Marriage Registrar and Kazi for North Lakhimpur ( Sadar ) by the Govt . as per recommendation of ' The Permanent Committee ' or until it is revoked or suspended by the Government under Rule 9 ( 3 ) of the Assam Muslim Marriages and Divorces Registration Rules, 1935 whichever is earlier .

No. FRS . 165 / 2018 /34.- Whereas, the Govt . of India had accorded In - Principle Approval for use of 23.782 hectare of forest land in Gohpur Reserve Forest for construction of 132 KV D/ C Biswanath Chariali to Itanagar Transmission Line with Lilo of one circuit at Gohpur Sub- Station by NER - II Transmission Ltd. in Sonitpur East Division in the state of Assam vide their letter No.3 AS A 055 / 2018 - SHI 2605-06 dated 12/10/2018 subject to fulfilment of certain conditions.

Whereas , the NER- II Transmission Ltd. in response has already complied with all conditions as laid down in the Govt . of India letter dated 12/10/2018 .

Now therefore , with a view to expedite the construction process the Govt . of Assam is pleased to authorise the Divisional Forest Officers , Sonitpur East Division , Biswanath Chariali for cutting of the trees falling within the proposed diversion area and allow the NER -II Transmission Limited to commence their work in the forest area for a period of one ( 1 ) year , subject to the fulfilment of following conditions ,

1. An agreement shall have to be executed by the User Agency i.e. NER - II Transmission Limited with the Divisional Forest Officer , Sonitpur East Division , Biswanath Chariali that they shall abide and comply all the conditions stipulated in the In- Principle Approval granted by the Govt . of India . All the conditions laid down for grant of the In- Principle Approval should be incorporated in the agreement and any violation of the conditions and rules of the Forest Conservation Act , 1980 , during the pendency of the working permission , the order allowing the commencement of work are liable to be cancelled .

However, on grant of Final Approval by Govt . of India a separate/additional agreement shall have to be executed by the Divisional Forest Officer , Sonitpur East Division, Biswanath Chariali with the User Agency as was being done earlier .

2. The Divisional Forest Officer , Sonitpur East Division , Biswanath Chariali shall take requisite measures to carry out felling of trees departmentally , as expeditiously as possible, in the forest land for which In - Principle Approval has been granted as per law as per the proposal approved by Govt . of India , Ministry of Environment , Forest & Climate Change. The felling of trees on the said forest land shall be carried out departmentally, in view of the Hon'ble Supreme Court's order dtd . 12.12.1996 , in respect of logging in forest area, in writ petition number 202/1995 .

3. The Divisional Forest Officer , Sonitpur East Division , Biswanath Chariali shall monitor the marking and felling of trees and tree felling should be restricted to the minimum .

Wherever it is necessary to print and publish a notification on a specified date ( excluding suchNotification or communicate as are to be published in Gazette extraordinary ) clear instruction ofthat effect must be given to the Deputy Director, Assam Government Press , both on the body of such notification within the indication at the top in the red ink and is a separate covering .

4. To achieve the objective in papers 2 and 3 , it is essential that proper discretion should be exercised by the concerned officers in the Department or office and all matters for publication in the Gazette should scrutinised and sent to the Press after careful application .

5. As for publication of any matters in a Gazette , Extraordinary, the existing procedure whereby the prior approval of the General Administration Department is to be obtained will continue .
