No. WR ( CON) 12/ 2017/ 115 -Whereas on the basis of report of the then Chief Engineer , Quality Control , Water Resources Department submitted vide letter No. CE/ QC/ NOW- 31/2017/2 dtd . 18-08-2017, Departmental Proceeding was drawn up against Shri Mukut Kumar Deka , the then Executive Engineer , Nagaon W. R. Division (now Executive Engineer , Soil Research W.R. Division ) vide letter No. WR (CON ) 12/2017/14 dated 19/08/2017 for negligence in duty and loss of public property due to the breach occurred in the Brahmaputra Dyke near Hatimura ( at Ch.3.112 KM ) on 13th August 2017 under Nagaon W.R. Division ; and Whereas the delinquent officer vide his representation No. MKD / 2017 / 1 dated 30-08-2017 denied the charges leveled against him; and Whereas after careful consideration/examination of the defence statement submitted by Shri Mukut Kumar Deka , it has been decided to enquire into the matter by appointing Shri Dilip Kumar Sarma , the then Additional Chief Engineer, Lower Assam (WR) Zone, Chandmari , Guwahati as Inquiry Officer and Shri Kishor Kumar Baishya , Superintending Engineer, Mukalmua Protection (WR) Circle, Mukalmua as Presenting Officer respectively vide notification no . WR ( CON ) 12/2017/34 dated 17-05-2018 ; and Whereas the Enquiry Officer has submitted his enquiry report vide letter No. WR / ACE / LAZ /CON/ 193 /4 Dated 24-12-2018 where the charges leveled against Shri Mukut Kumar Deka have been stated to be not tenable ; and Whereas considering all aspects of the matter and having regard to the findings of the Enquiry Officer and defence statement of Shri Mukut Kumar Deka, the Governor of Assam is pleased to exonerate Shri Mukut Kumar Deka, the then Executive Engineer , Nagaon W. R. Division (now Executive Engineer, Soil Research W.R. Division ) from the charges leveled against him vide this Department's letter No. WR ( CON) 12/2017/14 dated 19-08-2017 . The officer is advised to be careful so that no such incident occurs in future . With the above order the proceeding is concluded .

No. GLR. 33 / 2019 / 79 -Whereas an Industrial dispute has arisen in the matter specified in the Schedule below between the Management of SARDA Plywood Industries Ltd. , Joypore - Vs - workers " Union ( SPSU ) and staffs' Union ( SPKKS) .
Whereas it is considered expedient by the Government of Assam to refer the dispute for adjudication to Presiding Officer, Industrial Tribunal , Dibrugarh constituted under Section 7 - A of the Industrial Dispute Act, 1947 ( Act XIV of 1947) .
Now, therefore , in exercise of the powers conferred by Clause ( c) / ( d )Sub- Section( 1 ) of Section 10 of the Industrial Disputes Act , 1947 (Act - XIV of 1947) as amended , the Governor of Assam is pleased to refer the said dispute to the Presiding Officer, Industrial Tribunal , Dibrugarh appointed under the provisions of the said act.

1. Whether the Management /Unions are justified in signing the Minutes of agreement dated 23-04-2018 , in the first place and letting the employees to tender their voluntary resignations in the second , without the knowledge of the Conciliation Officer during pendency of concilliation proceedings .
2. Whether the Workers / Staff are entitled to get their Wages/ Salaries etc. for the period of temporary closure , as claimed, or whether they are entitled for any kind of Notice Period payments instead.
