No. HMA . 309/ 2017/53. - Whereas a Departmental Proceeding was drawn up against Shri Kanak Saikia , APS, the then Officer-in- charge, Udalguri P.S now retired vide letter No.HMA.309 /2017 /27 dated 19/07/2017 for gross negligence and cereliction and misconduct of duty in his part; and , Whereas Shri Kanak Saikia , APS ( Retd. ) submitted his written statement in defence vide his letter dated 21/06/2018 and denied the charges framed against him and ; Whereas having not been satisfied with the written statement in defence submitted by Shri Kanak Saikia , APS ( Retd. ) and after careful consideration of all aspects , the Govt . decided to enquire into the allegations and therefore appointed Shri Ainul Haque , IPS , the then CO. , 3rd APTF Bn . , Khajuabeel , Udalguri (now retired ) as Inquiring Officer to enquire into the charges framed against Shri Kanak Saikia , APS vide Notification Νο . ΗΜΑ.309/2017/42 dated 03/07/2018 , and ;
Whereas , the Inquiring Officer after causing an enquiry into the charges submitted his report to the Disciplinary Authority vide letter No.Bn.3 /APTF/ C/ D.P / 1843 dated 20/09/2018 wherein the Inquiry Officer concluded that the charges for gross negligence and dereliction and misconduct of duty in his part is proved beyond reasonable doubt.
Now , therefore , after careful examination of the report of the Inquiring Officer and materials on records and also in consideration of the facts and circumstances of the case , the Governor of Assam is pleased to order the penalty of "deduction of 3% of monthly pension for a period of 12 ( twelve) months " as provided under the AssamServices(Pension ) Rules ,1969.
The Governor of Assam is therefore pleased to deduct 3% of monthly pension for a period of 12 (twelve) onths from Shri Kanak Saikia , APS , the then Officer - in-charge, Udalguri P.S now retired and the Departmental oceedings drawn up against Shri Kanak Saikia , APS , are thus finally disposed off .

The term of reference of the Technical cum Administrative Committee shall be as follows:
i) The Committee shall recommend the State Government to set up a State level corpus fund with appropriate initial resource allocation and shall further seek the release of the Central Government's share of fund in appropriate ratio applicable to the state of Assam in the pattern outlined in thePolicy.
ii ) The Committee shall meet once in 03 ( three ) months to review the progress .
iii ) The Committee shall identify and categorize the rare diseases in context of State of Assam defining all its treatment procedurals and shall refer all such approved cases for the Central Committee's assistance .
iv) The Committee shall operate at the state level under the oversight of the Central Committee .
v) The Committee will identify and accredit institutions within the State to carry - out diagnosis and provide treatment of rare diseases .
vi ) The State Committee shall review the applications and shall decide on the proportion and extent of amount to be funded with respect to the specific case on the basis of the details entered, as well as , the criteria developed by the Central Committee .
vii) The State Committee shall review the progress of the Case and evaluate the clinical conditions of the patient as per the criteria developed by the Central Committee .

HC.XI - 03/2018/ 10/RC.- The Gauhati High Court has been pleased to amend the Gaugati High Court Criminal Rules and Orders by incorporating the following provisions in connection with the destruction of Motor Vehicle Act case records and Excise Act case records in the Criminal Courts subordinate to the Gauhati High Court , as "RULE 48" in Chapter 4 of the said Rules:
Rule. 48 .
( i ) After recording of the respective proceedings in a Register , the format of which is shown below, to be maintained by the Office ; the records pertaining to Motor Vehicle Act cases and Excise Act cases will be destroyed on expiry of 1 ( one) year from the date of final Order by the Court of first instance .

(iv) To enable the parties who have filed documents in Court to withdraw the same before destruction , a final notice shall be published (similar to 468

Form ( P) 57 of the Civil Rules and Orders) on the Notice Board of the concerned Court in January and July of each year stating that . all documents filed in this Case (to be therein enumerated) will , unless previously reclaimed, be destroyed after 1 (one ) month of the date of notice . Such notice shall contain the name of the Court, the number of the case in which the document was filed , and the names of the parties and the pleaders . If the document was originally filed in any outlying Court, the notice should be sent for publication in the Court's office as well as at the District Judges's office.
(v) On the expiration of one month from the date of publication of the aforesaid notice, all unreturned documents will be destroyed without fail and the date of destruction should be noted in the remarks coloumn of theRegister at Sl . No. 1 :
Provided that documents produced in Courts by Government officials or sent for from other Courts or offices shall not be destroyed , but shall , if not previously returned , be transmitted to Courts or offices from which they came.
(vi) Destruction of records should be carried out quarterly, and the Office shall in the first month of each quarter , should cause the cases records , as per the Register mentioned in Sl . No. (1) , which are due for destruction to removed from their shelves for the purpose and submit a report to the Judge- in-charge who , on being satisfied that the work has been properly done , should give order as to the date of destruction . As each record is destroyed , the necessary entries should be made in the Register . Entries as regards the class of records destroyed during the quarter should also be made simultaneously in the Register .
(vii) Useless records may be sold un - torn , but confidential records or private documents, such as exhibits , not taken back or returned , should be destroyed by shredding in a shredder machine in the presence of the Record Keeper.
