The target date of completion of all schemes is by July, 2019 as fixed by Transformation & Development Department except the project - Improvement of Roads in Biswanath Chariali Town in which, the target date of completion is 31.03.2020 .

The Project Officers of the respective projects as detailed above shall assess the present status of the projects and draw /prepare the work programme, fix the milestones for completion of different components of the project as per the target mentioned above in consultation with the Executing Agency. The Project Officer shall be responsible for timely completion of the project and also report the progress of the work as well as the constraints/ difficulties faced if any on a fortnightly basis to the Director , Town and Country Planning, Assam who is the Nodal Officer of the NLCPR projects of the Ministry of DoNER, Government of India.

In respect of constraints/difficulties facedby the Project Officers while implementing the various components of a particular project, he / she may apprise the same to the concerned Deputy Commissioner to sort out the bottlenecks in implementing the projects so that the date of completion can be achieved within the fixed deadline .

On the basis of the report received from Project Officers , the Nodal Officer should submit a consolidated report to this Department on various issues/progress and milestones achieved in respect of the aforesaid projects.

This will come into force with immediate effect .

3. Wherever it is necessary to print and publish a notification on a specified date ( excluding such Notification or communicate as are to be published in Gazette extraordinary) clear instruction ofthat effect must be given to the Deputy Director , Assam Government Press , both on the body of such notification within the indication at the top in the red ink and is a separate covering .

4. To achieve the objective in papers 2 and 3 , it is essential that proper discretion should be exercised by the concerned officers in the Department or office and all matters for publication in the Gazette should scrutinised and sent to the Press after careful application .

5. As for publication of any matters in a Gazette , Extraordinary, the existing procedure whereby the prior approval of the General Administration Department is to be obtained will continue .

No. FRE . 50 / 2012/Pt/ 149.- Whereas , on receipt of draft charges with statement ofAllegations from the Conservator of Forests ( SFM ) , O/ o the PCCF and HoFF, Assam against Shri Muklesh Ali , the then DFO , Goalpara Division , Goalpara vide letter no . PG. 335 /Pt dated 23rd May 2012 , showcause notice was issued to Shri Muklesh Ali vide letter no . FRE . 50 / 2012 / Pt/ 25 dated 27th October 2016 , and Shri Muklesh Ali , DO submitted his reply to the showcause notice on 21st November 2016 ; and

Whereas, vide letter no . FRE.50/ 2012/ Pt/ 53 , dtd . 15/6/2017 , the then Principal Chief Conservator of Forests (SEO) , O/o the PCCF , Shri J.M. Kouli , IFS, was appointed as IO and the then Conservator of Forests , CSASFS , Basistha , Guwahati Shri S.K. Dalia , IFS , was nominated as PO, and

Whereas , IO has submitted the enquiry report vide letter No. PG.335/Pt, dated 27/11/2017; and Whereas , enquiry report was served to Shri Muklesh Ali , Forest Utilization Officer (FUO ) vide letter no.FRE . 50/ 2012/ Pt/ 132 dated 16/07/2018; and

Whereas , Shri Muklesh Ali , FUO submitted his comments on the enquiry report and findings submitted by the IO regarding the Departmental Proceeding against him vide letter dtd . 14/8/2018; and

Whereas, on the basis of the enquiry report and after examining all facts and circumstances , Environment & Forest Department , Govt. of Assam was pleased to impose a minor penalty of ' Censure' as per Rule 7 ( i ) of the Assam Services (Disciplinary & Appeal ) Rules , 1964; and

Whereas, as per Rule 9 ( 11 ) b (i) ( ii ) of Assam Services (Disciplinary & Appeal ) Rules , 1964

i) The Government servant is informed in writing of the proposal to take action against him and of the allegations on which it is proposed to be taken and given an opportunity to make any representation he may wish to make ; and

ii) Such representation , if any, is taken into consideration by the Disciplinary Authority .

Whereas , due to oversight the order No. FRE.50 /2012/Pt /143 , dtd . 4/2/2019 was issued without any prior intimation to the DO ; and

Whereas , Shri Muklesh Ali , FUO has submitted a appeal petition vide letter dtd . 20.02.2019 praying for setting aside the penalty so imposed upon him issued vide this office order No. FRE.50/ 2012/Pt/143 dtd . 04.02.2019 .

Therefore, Environment & Forest Department, Govt . of Assam after considering the above fact , the penalty of ' Censure' so imposed upon Shri Muklesh Ali , FUO vide letter No. FRE.50 / 2012 /Pt / 143 , dtd. 4/2/2019 is hereby cancelled and decided to give an opportunity to Shri Muklesh Ali , FUO to make any representation he may wish and directed him to submit his written representation , if any, within ten days from the date of receipt of this order that a minor penalty of 'Censure ' would be imposed upon him under Rule 7( i ) of the Assam Services (Disciplinary & Appeal ) Rules , 1964 for his involvement in financial irregularities for drawal of an amount of Rs . 3 lakhs from the DDO's current account without obtaining ex- post facto approval from the authority as mentioned by IO in charge no.2
