The following ABSIs of different Districts / Units selected by the Departmental Selection Board are allowed to officiate in the rank of Inspector ( AB) temporarily in the revised Pay Band of Rs . 22000-87000 + Grade Pay and other allowances as admissible under the rule and are posted to different Dist's / Unit's subject to the condition that there should be no Court case/ Departmental Proceeding etc. pending or contemplated against any one of them and the period of punishment or Court Case if any he/ she is not operative now.
The promotion is considered based on seniority cum merit basis and taking into account of the provision of the " Assam SC & ST Reservation Rules 1983 " as ammended in Oct 2012 and also as per " Post Based Roster" in pursuance of the order of the Hon'ble Supreme Court of India and Govt . instruction thereon .

AGA . 279 / 2010/330.- Read the order passed by Hon'ble Gauhati High Court , Guwahati in Case No : WP(C) . 6524/2019 dated 16-09-2019 wherein the Govt . of Assam , Agriculture Department was directed to pass a fresh order after taking note of the materials on record and, Read the order passed by Hon'ble Gauhati High Court , Guwahati also in WP( C) No . 8521 / 2018 , dated 24-06-2019 wherein the Commissioner & Secretary to the Govt . of Assam , Agriculture Department was directed to give a final consideration on the resolution dated 25-01-2018 and pass a final order thereon.
Also read the resolution passed in the meeting on 25-1-2018 on the matter of no confidence against the Chairman of the Guwahati Sub - Divisional Market Committee .
Also read the report of Deputy Commissioner , Kamrup vide letter No: KDP/Agriculture/35 / 2015-16/ 2015 / 316 dated 26th Feb , 2018 .
Whereas the Chairman Guwahati Sub- Divisional Regulated Market Committee was asked to submit an explanation vide letter No.AGA.279 / 2010/Pt . / 273 , dated 05-05-2018 against the charges framed against him . The Chairman , Shri Ataur Rahman submitted his reply to the Department on 15.05.2018 .
Whereas on examiniation of the reply submitted by Shri Ataur Rahman , it is seen that Shri Rahman had explained his position on the first three points of the no - confidence resolution. With respect to the allegation on point No : 4 on pending of criminal case at the time of filing nomination, Shri Ataur Rahman , did not submit any reply/clarification.
However , the report received from Deputy Commissioner , Kamrup , reveals that at the time of filing nomination paper in the month of July , 2017 , there was a criminal case pending against Shri Ataur Rahman . Moreover , as per the report of Deputy Commissioner there was also financial liability pending against him at the time of filing nominations .
Though , acquitted later on by the H'ble Court , it is a fact that a criminal case and financial liability were pending against Shri Ataur Rahman , at the time of election.
Further , non- submission of reply to the allegation shows suppression of facts by Shri Ataur Rahman .
This suppression of facts by Shri Ataur Rahman displays lack of integrity on the part of Shri Ataur Rahman , Therefore , it is considered that continuation of Shri Ataur Rahman in the post of Chairman of the Guwahati Sub - Divisional Regulated Market Committee will dilute the credibility of the Market Committee .
That apart , in the Agenda No. 4 of the Minutes on the no confidence motion held on 25-01- 2018, it appears that all the 8 members voted in favour of the no confidence motion against Shri Ataur Rahman.
In consideration of the above , Shri Ataur Rahman, Chairman of the Guwahati Sub - Divisional Regulated Market Committee is hereby removed from the post of Chairman of the said Committee as provided under Section 11 (2 ) of AAPM Act , 1972 with immediate effect .
