No.PEL.58 / 2018 /191.- The Governor of Assam under Section 82 (5 ) of the Electricity Act , 2003 is pleased to appoint Shri Satyendra Nath Kalita, Managing Director, AEGCL as Member (Technical) of the Multi Member, Assam Electricity Regulatory Commission (AERC ) to exercise the powers and functions conferred under Section 86 of the said Act. Shri Satyendra Nath Kalita as Member ( Technical) shall hold Office from the date on which he enters upon his office and would continue for 5 ( five ) years or the day he attains the age of 65 (sixty five ) years , whichever is earlier. During this period, the pay, allowances and perquisites of Shri Satyendra Nath Kalita would be governed by the Assam Electricity Regulatory Commission (Salaries , Allowances and conditions of service of Chairperson and other Members and subscribing to oath of office and secrecy by Chairperson and other Members ) Rules , 2017 already gazetted and notified vide No.PEL.261 /2016 / 67 , dtd.11.01.2018 and also subject to any further instructions issued by Government from time to time.

Terms of reference of the Committee
1. The Committee shall scrutinize the application /s and to approve the deserving proposals to issuance of Eligibility Certificate for all the fiscal and tax incentives under the policy. The Committeealso scrutinizes and approved the proposals for fiscal incentives .
2. The Committee shall meet as and when necessary an at least once in a quarter .
3. The Chairman of the Committee may co - opt any expert/ s , Officer for specific proposals .
4. At least five members including Chairman , Member Secretary and Commissioner Taxes shall be necessary for any sitting of the committee. 5. The Member Secretary shall submit a report to the Government about the holding of meeting/s.
6. The Committee may also review the implementation of various incentives in the State and may suggest remedial measures to the higher authority as and when felt necessary.

No.UDD ( M) 151/ 2009/358.- Pursuant to the enquiry report of Deputy Commissioner, Dibrugarh vide No. DCM / 1 / 2018 / 517 dated 25.10.2018 and the report of the Director, Municipal Administration , Assam vide No. DMA 268/2018/1 dated 14.11.2018 regarding alleged allegations against Dibrugarh Municipal Board for the following charges viz .
i. Financial misappropriation .
ii . Improper maintenance of main cash book / log books for office vehicle .
iii. Improper maintenance of records of the assets of Dibrugarh Municipal Board .
iv. Irregularities in leasing out of municipal parking places and advertisements .
V. Allotment of markets / parking / hoarding through illegal tendering process .
In response to this Department's letter No. UDD ( M ) 151/2009/313 dated 11.04.2019 , the Chairperson , Dibrugarh Municipal Board has submitted her reply to this Department vide her letter No. DM/ EST/ 01 / 2015 / 1165-67 dated 08.07.2019 . and her replies were not found to be satisfactory. Hence Smti . Soma Chakraborty, the Chairperson of Dibrugarh Municipal Board was asked to appear in person before the Secretary to the Government of Assam, Urban Development Department, Dispur, Guwahati - 6 for a hearing on 04.11.2019 to give the Board an opportunity of being heard as per the provision of the Assam Municipal Act , 1956 vide Department's letter No. UDD ( M ) 151/2009/355 dated 24.10.2019.
Accordingly, Smti . Chakraborty, Chairperson , Dibrugarh Municipal Board appeared in person and a statement on oath was taken where she admitted that the charges were true .
In view of the facts stated above , it is seen that Dibrugarh Municipal Board has persistently failed to perform its duties and responsibilities to the satisfaction of all concerned and therefore , the Governor of Assam . in exercise of his powers under Section 298 of the Assam Municipal Act , 1956 is pleasedto dissolve Dibrugarh Municipal Board with immediate effect and direct the Deputy Commissioner, Dibrugarh to take the charge of the said Municipal Board immediately.

No.IPRD.30/2011 /254.- Whereas , Sri R. Gogoi has been placed under suspension vide notification No.IPRD . 107/2017/246 , dtd. 14/11/2017 w.e.f. 07/11/2017 , the date of his arrest in connection with vigilance SP Case No.08 /17. After the report/ consent received from Inspector General of Police, CM'sSpecial Vigilance Cell in regards to sharing of enquiry report , Departmental Proceeding against Shri R. Gogoi and other accused has been initiated . The Judicial Department has also advised to review the suspension of the charged officer and thereafter passed a Reason Order extending the suspension order by stating the grounds and the review exercise is to be carried out everythree months and a decision either to lift or continue the suspension must be taken upon due application of mind on each occasion . Accordingly, the suspension of Sri Ranjit Gogoi was reviewed and decided to continue the suspension of Sri Gogoi vide Govt. Order No. IPRD.30/2011 / 253 Dated Dispur , the 27th August , 2019 ; and
Whereas , after due consideration of all facts and circumstances relating to this matter it is seen that the DP drawn up against Shri R. Gogoi is yet to come to its logical conclusion . The entire Departmental Proceeding against the charged officer is based on official records pertaining to the officeShri R. Gogoi held before the suspension and the period of his incumbency as DIPR . All the relevant documents containing evidence against Shri R. Gogoi is in public domain and is accessible by officer of the DIPR. Thus , it is considered expedient to ensure that confidentiality of the relevant document and ensuring measures to avoid any tempering what so ever is prime important for judicious objective and fact based conclusion of Departmental Proceeding instituted : and
Whereas , re - instatement of charged officer may influence such material witnesses which will result in less than judicious and objective conclusion of the matter. Further, intimidation or coercion of witnesses against the charged officer also cannot be ruled out ; and
Whereas , on careful examination it is decided that Shri R. Gogoi may not be re -instated in service till such time as the Departmental Proceeding drawn up against him is brought to logical conclusion.

Whereas Shri Mrigen Haloi , Agricultural Development Officer, Bentol , Chirang , was placed under suspension vide Govt . order No.AGA.235 /2019116 dated 15th June , 2019 .
Whereas , a Prosecution Sanction was issued vide Govt . order No.AGA.235/2019 / 64 - A, dated 24th October , 2019 .
Whereas , suspension period of Shri Mrigen Haloi was extended for 3 months with effect from 9th August , 2019 .
Whereas , it is decided by the appointing authority that reinstatement of Shri Mrigen Haloi , Agricultural Development Officer , Bentol , Chirang , BTAD , Assam at this stage may not be in the interest of the public service .
Now, therefore , the Governor of Assam is pleased to give ex - post facto approval for extension of the period of suspension in respect of Shri Mrigen Haloi , Agricultural Development Officer, Bentol , Chirang , BT AD, Assam who is under suspension for another period of 3 ( three ) months with effect from 9th November , 2019 .

5. The Member Secretary shall submit a report to the Government about the holding of meeting/s .
