No.IPRD.88 /2002/385.- Whereas , the Hon'ble Chief Minister , Assam visited Silchar on4th June , 2020 to take stock of the situation arising out of landslide and held a very important meeting in the office of the Deputy Commissioner , Cachar , Silchar , but at that time Smti . Indrani Goswami , DDIPR , Cachar was not available in the said meeting.
Whereas , as per the report of the Director of Information and Public Relations , Assam , Smti . Indrani Goswami , Deputy Director of Information and Public Relations , Barak Valley Region ( now under suspension ) was found absent from duty without obtaining prior permission of the competent authority and therefore serious mismanagement took place regarding media persons who came to cover the programme of the Hon'ble Chief Minister , Assam . As a result a number of media persons got agitated and left the venue causing much embarrassment to the Govt .;
Whereas , the Government has considered this as a serious misconduct and gross negligence of duty on the part of Smti . Indrani Goswami for causing an embarrassing position to the Government ;
Whereas , pending drawal of Departmental Proceeding , Smti . Indrani Goswami , Deputy Director of Information and Public Relations , Barak Valley Region was placed under suspension under Rule 6 ( 1 ) ( a ) of the Assam Services (Disciplinary & Appeal ) Rules , 1964 vide Govt . Notification No.IPRD.88 /2002/ 340 dated 15/06/2020 ;
Whereas , a show cause notice was issued to Smti . Indrani Goswami , Deputy Director of Information and Public Relations , Barak Valley Region (now under suspension ) vide Govt . letter No.IPRD.23 /2020 /53 dated 26/08/2020 for her gross indiscipline , serious negligence of her official duties etc. to which she submitted her replies in defence vide letter dated 04/09/2020;
Whereas , Smti . Indrani Goswami submitted her written statement stating that she is suffering from some illness and has applied for commuted leave w.e.f. 14/04/2020 to 14/06/2020 on medical ground and requested to withdraw her suspension order.
Therefore , after careful examination , the Governor of Assam is pleased accept her reply and revoke the suspension order which was issued vide Govt . Notification No.IPRD.88 /2002/340 dated 15/06/2020 and also pleased to exonerate her from the charges levelled against her. Her period of absence w.e.f. 14/04/2020 to till date be treated as on leave as due and admissible to her .
Thus , the Departmental Proceeding drawn up against Smti . Indrani Goswami , Deputy Director of Information and Public Relations , Barak Valley Region is hereby disposed of.

No.IPRD.91 / 2012/ pt /31.- Whereas , an advertisement relating to paying homage in memory of Swahid Birangana Kanaklata Barua on her death anniversary by the Hon'ble ChiefMinister, Assam , was published on 20th September , 2018 , in a number of daily newspapers of Assam . But it appears that the advertisement should have carried also the name of Swahid Mukunda Kakati and a numbers of other Swahids who also sacrificed their lives for the country on the same day. But , due to total negligence on the part Sri Kanakeswar Borgohain , Joint Director of Information and Public Relations , Assam, the newspapers carried the name of only Swahid Birangana Kanaklata Barua for which Sri Kanakeswar Borgohain had admitted his fault in his explanation letter and therefore Sri Kanakeswar Borgohain was warned not to indulge in such practices in near future and to be careful before releasing any advertisement in future , otherwise the Govt . will be compelled to take stern action against Sri Kanakeswar Borgohain ;
Whereas , the Display Advertisement issued and published in a number of dailies on the occasion of Silpi Divas on 17th January, 2019 to pay respect and tribute in memory of Rupkonwar Jyotiprasad Agarwala by the Hon'ble Chief Minister , Assam, carried major errors . This had also occurred due to total negligence on the part of Sri Kanakeswar Borgohain , Joint Director of Information and Public Relations . This had led to severe criticism in both the print and electronic media;
Whereas , the Government had considered this as a serious misconduct on the part of Sri Kanakeswar Borgohain by repeating the same practice even after he was warned not to indulge in such practices in near future vide Govt . letter No.IPRD.91/2012/39 Dtd . 12/10/2018 ; and
Whereas , pending drawal of Departmental Proceeding , Sri Kanakeswar Borgohain , Joint Director of Information and Public Relations , Assam was placed under suspension under Rule 6 ( 1 ) ( a) of the Assam Services ( Disciplinary & Appeal ) Rules, 1964 vide Govt . Notification No.IPRD.91 /2012/58 , dated . 28.02.2019 ;
Whereas , a show cause notice was issued to Sri Kanakeswar Borgohain , Joint Director of Information and Public Relations , Assam vide Govt . Notification No.IPRD.91/ 2012 / 67 , dated. 29.06.2019 , for his gross indiscipline , serious negligence of his official duties etc. to which he submitted his replies in defence vide letter dated.03.07.2019;
Whereas , the written statement submitted by Sri Kanakeswar Borgohain in defence was not found satisfactory at all ;

Whereas , Government decided to hold an Inquiry into the charges levelled against him by appointing Smti . Arundhati Chakraborty , ACS , Joint Secretary , now Addl .
Secretary to the Govt . of Assam, Information and Public Relations as Inquiry Officer vide Govt . Notification No. IPRD.91 /2012 / pt/ 10, dated . 07.10.2020 ;
Whereas , subsequently , the order of suspension in respect of Sri Kanakeswar Borgohain , Joint Director of Information and Public Relations , Assam was revoked and he was reinstated in his service vide Govt . Notification No. IPRD.91 / 2012 / 75 , dated .
21.08.2019;
Whereas , the Inquiry Officer vide her letter No. IPRD.91 / 2012 / pt/ 16 , dated .
07.10.2020, submitted her Inquiry report to the Governemnt with the findings , where it appears that the charges levelled against him were clearly established ;
And whereas , after careful consideration of the Inquiry report , the material on record and the submission made by Sri Kanakeswar Borgohain on the enquiry report and also keeping in view his past sincerity , unstinted cooperation towards achieving goals as well as dedication towards his works , it has been decided to accept the enquiry report and impose penalty of censure as per clause ( i ) under Rule 7 ( 3.3.2) of the Assam Services ( Disciplinary & Appeal ) Rules , 1964 .
Therefore , the Governor of Assam is pleased to accept the Inquiry report submitted by the Inquiry Officer and to impose the penalty of censure as per clause ( i ) under Rule 7 of the Assam Services ( Disciplinary & Appeal ) Rules , 1964 upon Sri Kanakeswar Borgohain , Joint Director of Information and Public Relations , Assam , with a direction not to repeat such acts in future. For the period of suspension w.e.f. 28.02.2019 to 21.08.2019 he shall not be entitled for anything else except the subsistence allowance for the period of his suspension . However , the period of his suspension shall be counted towards pension purposes and other pensionary benefits .
Thus , the Departmental Proceeding drawn up against Sri Kanakeswar Borgohain , Joint Director of Information and Public Relations , Assam is hereby disposed of.

No. FRE.16 /2018 / 115.- Whereas vide Govt . Order No. FRE.10/ 2018 / 163 dated 10.06.2020 , Shri Motiur Rahman , AFS , ACF , the then in charge Northern Range , Salona under Nagaon Division , now ACF , attached to the office of the Director , Assam Forest School , Jalukbari was exonerated from all the charges leveled against him vide Show Cause Notice No. FRE.10 / 2018 / 44 dated 12.11.2018 and accordingly the Departmental Proceeding was disposed off; and
Whereas the Selection Committee for selection of officers for promotion from Assistant Conservator Forests ( ACF) to Deputy Conservator Forests ( DCF) held on 19.12.2019 decided to keep the recommendation in respect of Shri Motiur Rahman , AFS , ACF in Sealed Cover until finalization of the Departmental Proceeding drawn against him . The Committee also decided to keep vacant post of DCF to accommodate Shri Motiur Rahman , ACF ( Roster PointUR - 2 ) ; and
Whereas , Shri Bhanu Sinha , the then ACF, Office of the DFO , Karimgang Division, immediate junior to Shri Motiur Rahman , ACF was promoted to the rank of DCF and posted as DCF , attached to the CCF , Southern Assam Circle , Silchar vide Govt . Notification No. FRE.16 / 2018 / 83 dated 17.02.2020 and accordingly the officer took over the charge of the promotional post on 25.02.2020 ; and
Whereas on exoneration from all the charges upon conclusion of the Departmental Proceeding , the recommendation of the Selection Committee held on 19.12.2019 in Sealed Cover in respect of Shri Motiur Rahman , AFS , ACF was placed before the authority on 08.09.2020 . The authority observed that Shri Motiur Rahman , AFS , ACF has been recommended for promotion without loss of seniority upon exoneration from all the charges drawn against him .
Now therefore , the Governor of Assam is pleased to promote retrospectively Shri Motiur Rahman , AFS , ACF to the rank of DCF in the Pay Scale of Pay Band - 4 , Rs . 30,000- 1,10,000/ - with Grade Pay Rs . 14,500/- under ROP 2017 under Rule- 4 ( C ) of Assam Forest Service , Class - I , Rule , 1942 with effect from 25.02.2020 i.e. , the date of joining of his immediate junior Shri Bhanu Sinha , to the promotional post of DCF .

Terms of reference :
1. The Committee shall review the IFS Officers in respect of : -

(a) An officer should have completed minimum 15 years of qualifying service ;
(b) In the case of the State Service Officers appointed to an all Indian Service by promotion or by selection , they should have completed minimum of 5 years of actual service in the respective All India Service .
2. In case there are Officers who have completed 16 years or more of qualifying service but their review was not carried out as the rule has been amended recently . Therefore , a review is required to be carried out by the State government in respect of the officers who have completed qualifying service of 16-23 years and recommendations of the respective State governments may be sent to the Central Government for further necessary action .

Das to the rank of Assistant Conservator of Forests subject to disposal of Departmental Proceeding . The Committee also recommended thatif he is fully exonerated from charges , he will get his promotion without loss his seniority .

Whereas the Hon'ble Gauhati High Court vide order dtd . 10.01.2019 in V'P ( C ) No. 6115/2018 in the matter of Shri Pradip Kr . Das- Vs- State of Assam & 5 Ors . , observed that in the event the petitioner , whose case was under Sealed Cover , was recommended for the promotion, the petitioner shall be given promotion w.e.f. the date of when others who were recommended by the same DPC was given promotion and directed to pass appropriate order in terms of recommendation made by the DPC held on 25.01.2012 .

The Chairman , Vice- Chairman and Members of the Sub Divisional OBC Development Board shall hold their position in the Board at the pleasure of the State Govt . The State Govt. may change the Chairman/Vice Chairman/Member of the board at any time . Moreover , the term of office of the board shall not exceed 3 years .
Functions of the Sub Divisional OBC Dev . Board :
1. To select and approve list of schemes / beneficiaries under various developmental programmes funded by the Government .
2. To oversee implementation of development schemes executed by various Sectoral Departments of the State Government for the benefit of relevant community .
3. To ensure progress of implementation of schemes and proper utilization of grants sanctioned under WPT & BC Department .
4. To review the OBC schemes and offer suggestions on proper implementation of the same to the State Government .
5. The Board shall sit at least 3 (three ) times in a financial year .
6. The Board shall monitor the implementation of schemes and report to the Government through SDWO .
The Governor of Assam is pleased to order that any of the members may preside over the meetings in absence of the Chairman/Vice- Chairman on being unanimously agreed upon and one third of the total members of the board shall form quorum for holding ameeting.
