NOTIFICATIONS

The 19th January , 2021

No. WR ( CON) 19/ 2008/ 68.- Whereas , Deputy Commissioner, Dhemaji reported that a breach in the cofferdam /Jiadhal embankment took place at Tekjuri on 28/05/2008 which caused disruption in NH - 52 and also reported that the works done at Matmara were not of permanent quality and were no solution to long term problem . They are completed on to the extent of 30% and permanent works should be started only in November through reputed contractors to maintain good quality of work; and

Whereas, as per order of the erstwhile Chief Minister, Assam vide notification No. WR ( E) 54/2008/5 , dtd . 11/06/2008 constituted a two man enquiry committee to inquire into the irregularities committed during execution ofworks at Matmora and Jiadhal embankment under W.R. Department. The two members were Shri P.P. Verma, the thenAdditional Chief Secretary , Govt . of Assam , as Chairman , Enquiry Committee and Shri A.K. Dutta , the then Chairman, Pollution Control Board as Member, Enquiry Committee ; and

Whereas, the committee submitted its report vide letter No. ACS/ P & D ( INQ ) 6/2008/21 , dtd . 29th July, 2008 where they have found prima - facie case against 12 nos . of officers from the rank of Superintending Engineer to Sub- Engineer including Shri Hemanta Kumar Deuri . Based on the report Shri Deuri was placed under suspension vide notification No. WR ( E ) 54/2008/65, dtd. 29th August , 2008. Thereafter, Departmental Proceedings against Shri Hemanta Kumar Deuri was initiated by issuing show caused notice vide letter No. WR ( CON ) 19/2008/2 , dtd. 11th Dec,2008. After receipt of reply from the DO , the Department carefully examined his reply and decided to appoint an Inquiry Officer as per rule 9 (4 ) of Assam Services (Discipline & Appeal ) Rule 1964. Accordingly , Shri Tapan Kumar Roy, the then Additional Chief Engineer , Kokrajhar W.R. Zone was appointed as Inquiry Officer ; and

Whereas, the Inquiry Officer submitted his report vide letter No. ACE / KZ / ENQ / 12 , dtd . 24/08/2009 in respect of Shri Hemanta Kumar Deuri ; and

As per the report of the preliminary enquiry ( i.e. enquiry conducted by Shri P.P. Verma , the then Additional Chief Secretary , and Shri Arun Dutta, the then Chairman , Assam Pollution Control Board) , a number of Govt . Servants including Shri Hemanta Kumar Deuri , Shri Kamal Bezbaruah , Late H.N. Talukdar , Shri Hari Prasad Mili were found guilty of grave misconduct and negligence of duty . Whereas in the Departmental enquiry (i.e. enquiry conducted by Shri T.K. Roy , the then Additional Chief Engineer , Kokrajhar W.R. Zone ) no one was found guilty. On this , after thorough consideration of both the reports and with the approval of erstwhile Chief Minister of Assam , Govt . decided to inflict penalty in the tune of withholding of increments and APSC also agreed to such decision in case of Shri Kamai Bezbaruah , Shri Hari Prasad Mili etc. In the same line the Department proposed punishment of withholding of pension for 6 (six ) months to Shri Hemanta Kumar Deuri under Rule 21 of Pension Rules as he has already retired from Govt. service on 30/11/2017 ; and

Whereas, APSC concurred the proposal of punishment of withholding of pension for 6 (six) months in respect of Shri Hemanta Kumar Deuri under Rule 21 of Pension Rules vide their U /O No. 1415 dtd . 30/08/2018.

Therefore, the Governor of Assam is pleased to impose a penalty of withholding of pension for 6 ( six ) months to Shri Hemanta Kumar Deuri under Rule 21 of Pension Rules against Shri Hemanta Kumar Deuri , Retd . Deputy Director, Water Resources Department .

Theperiod of suspension w.e.f. 29-08-2008 to 24-03-2009 is treated as on duty for all purposes . It is also decided to pay proportionate pay under the provision of Sub - rule 8 of the F.R. 54 (B ) which is restricted to the subsistence allowance already paid to Shri Hemanta Kumar Deuri for the period of suspension . With the above order the proceeding is concluded .

Whereas , Shri Mrigen Baruah , AFS , ACF , submitted his defense statement vide his letter dated 19.12.2020 wherein he has denied the charges framed against him; and Whereas Shri Mrigen Baruah has also submitted copy of order dated 11.12.2020 in the matter of writ petition No. WP ( C ) / 5093 / 2020 , filed by him in the Gauhati high Court , wherein the Hon'ble court has ordered that the respondent shall forthwith reinstate the petitioner to his post and also take steps to make such payment as admissible and payable to the petitioner on and from the date when he was under suspension ; and

Whereas after careful examination of the written statement and the Gauhati High Court's order dated 11.12.2020 , the Government have decided to drop the Departmental Proceeding drawn against Shri Mrigen Baruah , AFS , ACF and regularize the suspension period of his service w.e.f 30.11.2015 till the date of his suspension.

Modeof selection:

i) Four Candidates will be selected against each vacancy notified on the basis of aggregate marks obtained in the written test to appear in the computer proficiency test ( Practical ) .

Candidate shall have to exercise their choice of language i.e. Bengali / Alternative Englishat the time submission of application itself and the choice once exercised shall be final .

TheSelection Committee shall have the right to accept or reject the candidature after proper scrutiny of the documents/testimonials , etc. with regards to the modalities of selections . The decision of the selection committee shall be final and binding . The selected candidates will haveto submit an undertaking to the appointing authority that they will abide by the new pension rules of Government issued vide Finance Department's Order No. BW.03 / 2003 / PT/1 , Dated 25/01/2005 .

v) Rejected list of applications will be uploaded on the Official website www.cachar.gov.in .

Theappointment will be made after necessary Police verification and Medical Examination, etc. as per procedure .

vii) Appointment will be made in accordance with the provision of AFRBM Act 2005 .

viii) The Candidate qualifying in the written test must produce all certificates and testimonials in original for verification at the time of computer proficiency test.

Ix) Admit Card /Call Letter for written test and computer proficiency test will be uploaded/ notified through the website of this office www.cachar.gov.in and the candidates will be able to download their individual call card/Admit Card / letter from the said website.

x) All information/announcement regarding the recruitment would be uploaded at the aforesaid official website and no individual communication would be made and accordingly thecandidates must follow/ refer the website time to time / regularly .

xi) No. TA/DA will be admissible to the candidates for appearing in written test / computer proficiency test or any other such .

xii) There will be no viva voce interview .

xiii) Canvassing /lobbying directly or indirectly will lead to immediate disqualification of the candidature.

Written Test of 35 marks will be held for the post of Driver to test the candidate's knowledge of driving, road signals , mechanical / technical knowledge including General Knowledgeand General English .
