No. JDJ/236/2010/23.- On being transferred and posted by the Hon'ble Gauhati High Court vide NotificationNo. HC.VII -5/2021 / 2322 / A, dated 30-04-2021 , the Governor of Assam, is pleased to appoint Shri Bidyut Medhi , presently Secretary, District Legal Services Authority, Kokrajhar , a Grade - II Officer in the Assam Judicial Service , as Deputy Secretary to the Government ofAssam , Judicial Department , in the Grade- II oftheAssam Legal Service , with effect from the date of taking over charge on the following terms and conditions as per existing Rules -
1. During the period of is service as Deputy Secretary, he will draw the scale of pay in the post held by him last in Judicial Service as personal pay to him during his tenure .
2. No deputation allowance shall be allowed as the arrangement is placement of service and not a case ofdeputation .
3. He shall also draw such allowances at per rates as were drawn by him in the last post in terms ofGovernment ofAssam direction in implementing the Shetty Commission's recommendations .
4. The other parks and allowances in relation to performance of duty will be governed by the post which he will hold under Rules of Executive Business .

Court No.3 , Chandmri , Guwahati in Spceial Case No.13/2013 arising out of CBI Case No.RC5A2011SHG and sentenced to suffer simple imprisonment (SI ) for 1 ( one)year and a fine of Rs.5000 /. in default SI for another 3 months for the offence committed U/ S 120B, 468 , 471 & 409 of IPC and to suffer SI for 1 year and a fine of Rs.20,000/ - , in default SI for another 3 months for offence U / S 13 ( 1 ) ( c ) r / w section 13(2) of P.C Act .
Whereas Prosecution Sanction Order had been issued on 30/05/2013 against Sri Anjan Haphila , JE in CBI Case No.RC5A2011SHG due to his entering in to criminal conspiracy with the then Block Development Officer, Diyungbra & others and in pursuance thereof had shown false execution of works by preparing, and passing false Vouchers in the matter of execution of works under Mahatma Gandhi National Rural Employment Guarantee Act ( in short MGNREGS) Scheme during 2006-07 in Diyungbra Development Block in N.C. Hills District thereby causing huge wrongful loss to the Govt . of India and corresponding wrongful gain to themselves while working as Junior Engineer in the office of Block Development Officer , Diyungbra Development Block , N.C Hills , Assam during October , 2006 to December , 2006 .
And whereas disciplinary proceedings have been contemplated against Sri Anjan Haphila , JE ( C ) for the aforesaid act ;
Now, in exercise of the powers conferred under rule 6 (1 ) of the Assam Services (Discipline & Appeal ) Rules , 1964, Sri Anjan Haphila , JE (C) , PWRD , Haflong ( R &B ) Division , Dima Hasao , Assam is placed under suspension with immediate effect pending drawal of Departmental Proceedings against him.
Itisnot permissible for him without previous sanction of the Govt . to accept private employment or to do business whil eunder suspension in view of the provision of Rule 12 of the Assam Civil Service (Conduct) Rules , 1965. If while under suspension he accepts private employment , does business in violation of Rule 12 of the Assam Civil Services ( Conduct ) Rules, 1965, he will be guilty of misconduct and will be liable to be dealt with accordingly. He is also liable in that case to forfeit his claim for subsistence allowance TheHead Quarter of Sri Anjan Haphila during the period of suspension will be Haflong , Dima Hasao . He will not leave the Head Quarter without prior written permission of the competent authority .

No.AGA.217/ 2019/302.- Read the order passed by Hon'ble Gauhati High Court , in case No : WP ( C ) No: 1748/2021 ( Smti Geetanjali Kalita & 3 Ors - vs - State of Assam ) dated 17-03-2021 pertaining to the matter of age relaxation of candidates viz Smti Geetanjali Kalita . Shri Kuntal Kalita , Shri Haramohan Das and Shri Kamaleswar Bhattacharjee who had already applied for the post of Village Level Extension Worker ( VLEW ) pursuant to earlier advertisements dated 24-12-2013 and 13-09-2014 issued by Agriculture Department for condoning the upper age limit and to allow them to participate in the selection process for the post of Agriculture Extension Assistant ( AEA earlier known as VLEW ) pursuant to advertisement dated 26-02- 2021 issued by agriculture department .
-AND-
Whereas , a total of 2,16,996 nos . of application were received in response to the advertisement published on 24/12/2013 & 13/09/2014 for 858 nos . VLEW ( now AEA ) post . Out of these , a good numbers of applicant including the petitioners had applied for condonation of upper age limit for applying for the advertised VLEW posts and accordingly , condonation was done by the Directorate of Agriculture . Assam as per rule ile based on the Govt. OM No. ABP.73/89/17 . dated 04/01/1992 .
-AND-
Whereas, in accordance with theGovt . O.M. No. ABP.73 / 89 / 17 , dated 04/01/1992 upper age limit may be granted up to the age of 45 years and therefore , the candidates who had availed relaxation of upper age limit during 2013 & 2014 cannot be considered for further relaxation during 2020-21 since their age has already crossed well over 45 years .
-AND-
Whereas , in compliance of the Hon'ble Guwahati High Court's common judgment dated 03/03/2016 passed in WP ( C ) .No . 6187/2015 and WP ( C ) .No . 6205/2015 a fresh advertisement has already been issued & published on 26/02/2021 for the post of AEA (then VLEW ) along with other posts and in doing so earlier advertisements dated 24/12/2013 & 13/09/2014 had to be cancelled and it has been mentioned in the fresh advertisement published on 26/02/2021 Therefore , admit cards issued pertaining to earlier advertisements seem to have no effect towards age relaxation of over aged candidates with reference to fresh advertisement .
-AND-
Whereas , pertaining to the earlier advertisement admit cards were generated by the Assam Agricultural University . Jorhat and the database related to this is not available with this Directorate in order to authenticate the admit cards submitted by the petitioners .
-AND-
Whereas , however , last date of online submission of application for the posts has already been extended to 5th April . 2021 .
After perusal and consideration of all above facts , this department is of view that in the greater interest of public , the age relaxation in respect of the petitioners is not feasible as per Govt . Rules . Also this may invite further complicacies in the recruitment process which is of utmost importance for the Agriculture Department . Hence , the prayer petition of the petitioners cannot be considered .

Sarma was held responsible for misappropriation / embezzlement/misuse of State Exchequer amounting to Rs 18,00,000 / - ( Rupees Eighteen lacs ) released under RKVY Scheme . As per the enquiry report . Sri Amal Kr. Sarma was also held responsible for doubtful integrity , misconduct and negligence of duty . Shri Amal Kr Sarma was detained in Police custody for more than 48 hours w.e.l 26.10.2012 and subsequently was placed under suspension vide notification No. AGA. 475/2010/356 , dated 26-11-2012.

Whereas . a Departmental Proceeding ( DP ) was initiated against Shri Amal Kr . Sarma issuing show cause notice vide no . AGA 25/2013 ( 5 ) / 17 , dated 20/11/2014 on charges of gross misconduct . misappropriation of Govt . money . dereliction to allotted duty and gross violation of the Govt . procedures .

Whereas , in pursuance of judgement and order dated 03/06/16 passed by Hon'ble High Court in WP ( C ) No : 3080/2016 and pending drawal of DP . Shri Amal Kr . Whereas . Shri Amal Kr . Sarma, the then ADO ( under suspension ) has submitted his written reply in defense to the show cause vide letter no . Nil dated 5/12/2014 , wherein he categorically denied the charges leveled against him .

Whereas , not being satisfied with the written reply submitted by the Delinquent Officer . the disciplinary authority further decided to enquire into the matter and accordingly the State Enquiry Officer . Assam , was appointed as the Enquiry Officer under the provision of Rule 9 (4 ) of the Assam Services ( Discipline and Appeal ) , Rules 1964 , vide letter No. AGA.25 / 2013 ( 5 ) / 80 dated . 09/05/2017 .
As per the findings of enquiry report , the allegations against Shri Amal Kr . Sarma could notbe proved . -AND-
Whereas , after careful examination of the Enquiry report of the State Enquiry Officer. Assam and on the basis of all other relevant supporting documents and having regard to evidences and circumstances appearing in the case . the Disciplinary Authority is pleasedto accept the findings of the State Enquiry Officer . Assam and is of the opinion that the Departmental Proceeding drawn up against the Delinquent Official is to be dropped. Accordingly , the Governor of Assam is pleased to conclude the departmental proceeding drawn up against Shri Amal Kr Sarma , the then ADO . Bongshor circle . Kamrup and i / e ADO . Gerua Circle. Kamrup . now Sr. ADO ( PP ) . Hailakandi by dropping the charges leveled against him.
With this above order the case is finally disposed off.
