No. HLA 573/2018/141.- Whereas, Disciplinary Proceedings were started against Shri Bhabesh Bhuyan, Senior Food Safety Officer, Lakhimpur, vide letter No H LA 532/2019/14 dated 3rd September, 2019, on the charges of negligence, in subordination, gross misconduct and violation of Assam Civil Services (Conduct) Rules, 1965 during his tenure as Senior Food Safety Officer, Kamrup;

Whereas, Government in Health & Family Welfare Department imposed the penalty of withholding 2 (two) incremenls with cumulative effect upon Shri Bhabesh Bhuyan under the provision of Rule 7 (ii) of the Assam Sevice (Discipline & Appeal) Rules, 1964, vide notification No,HLA.532/2019/291 dated 11th February, 2021, and thus disposed off the Disciplinary Proceedings;

Whereas, Shri Bhabesh Bhuyan appealed before the Hon'ble Governor of Assam against the notification No.HLA.532/2019/291 dated 11th February, 2021;

Whereas, the Hon'ble Governor's Secretariat. vide order No GSA 38/2021/232 dated 10th January, 2022, cancelled the notification dated 11th February, 2021 under provisions of Rule 23 of the Assam Service (Discipline & Appeal) Rules, 1964, and instead imposed a penalty of withholding two increments for two years without cumulative effect with effect from 8th August, 2019, as per clause 3.5.2 of the Manual of Departmental Proceedings;

Whereas, the penalty period against Shri Bhabesh Bhuyan is thus deemed to be over by 8th August, 2021;

Whereas, a meeting of the Selection Committee for consideration of promotion to the posts of Designated Officers and Senior Food Safety Officers was held on 24th December, 2020, wherein the promotion of Shri Bhuyan was kept under abeyance, although otherwise eligible, due to the pendency of the Disciplinary Proceedings against him then;

Whereas, as per decisions of the meeting of the Selection Committee, the Health & Family Welfare Department granted promotion to the eligible incumbents to the vacant posts of Designated Officer and Senior Food Safety Officer vide notification No. HLA.573/2018/102 dated 26th October, 2021;

Now, therefore, in pursuance of the Hon'ble Governor's Secretariat order No,GSA,38/2021/232 dated 10th January, 2022, in continuation to this Department's notification No, HLA 573/2018/102 dated 26th October, 2021, and in the interest of public service, Shri Bhabesh Bhuyan, Senior Food Safety Officer, Lakhimpur, is hereby promoted to officiate as Designated Officer, under Rule 10(ii) of the Assam Food Safety (Enforcement) organization Service Rules, 2019, in the scale of pay of Rs. 22000-970000/-, with Grade Pay of Rs. 11500/-, with effect from the date of taking over charge and until further orders.

On promotion, Shri Bhabesh Bhuyan shall be posted as Designated Officer, Sivasagar (HQ:

Sivasagar), and he shall exercise the powers under Section 36(3) of the Food Safety & Standards Act, 2006, within the jurisdiction of the areas demarcated against the said post, which include the districts of Sivasagar, Charaideo, Jorhat, Majuli and Golaghat.

Further, Shri Bhabesh Bhuyan shall also hold the additional charge of Designated Officer, Tinsukia (HQ: Tinsukia), the jurisdiction of which include the districts of Tinsukia and Dibrugarh.

1. In the first instance, it has to be noted that the printing of the weekly Gazette must be completed by the end of every Tuesday so that it may be duly published on every Wednesday.

If this is not done it is infructuous requesting the Director, Assam Government Press to publish such notification or other matter in the next issue of the Gazette, the expression usually inserted in all endorsements made to the Director.

3. Wherever it is necessary to print and publish a notification on a specified date (excluding such Notification or communicate as are to be published in Gazette extraordinary) clear instruction of that effect must be given to the Director, Assam Government Press, both on the body of such notification within the indication at the top in the red ink and is a separate covering.

4. To achieve the objective in papers 2 and 3, it is essential that proper discretion should be exercised by the concerned officers in the Department or office and all matters for publication in the Gazette should scrutinised and sent to the Press after careful application.

5. As for publication of any matters in a Gazette, Extraordinary, the existing procedure whereby the prior approval of the General Administration Department is to be obtained will continue.
