No. WR (CON) 7/2018/95.- Whereas the erstwhile Chief Engineer, Quality Control, W.R. Department had informed that some very serious cases of forgery of official documents of Quality Control have come to notice where the signatures of the then Chief Engineer, Executive Engineer and Assistant Engineer of Quality Control have been forged along with note sheets of concerning files and on enquiry of matter Shri Debashis Acharjee, A.E. was found to be involved; and

Whereas, Water Resources Department suspended Shri Debashis Acharjee, AE. vide Notification No. WR(CON)7/2018/35 dtd. 6th December, 2018 and has drawn up D.P. against Shri Debashis Acharjee, A.E. by issuing Show-caused notice vide No. WR(CON)7 /2018/36 dtd. 12th February, 2019; and

Whereas, after receipt of his reply to the Show-caused notice, Water Resources Department decided to conduct an enquiry of the matter by appointing 1.0. & P.O. Accordingly, Shri Borsing Rongpi, Chief Engineer, Water Resources Department was appointed as Inquiry Officer and Shri Palashjyoti Goswami, the then S.E., Northern Assam WR Circle was appointed as Presenting Officer vide notification No. WR(CON)7/2018/50 dtd. 4th June, 2019; and

Whereas, the D.O. Shri Debashis Acharjee, A.E. was reinstated in service vide Notification No. WR(CON)7 /2018/69 dtd. 19th August, 2020; and

Whereas, Shri Borsing Rongpi, Chief Engineer, Water Resources Department cum Inquiry Officer has submitted his enquiry report vide letter No. CEWR(Con.)25/2019/14 dated 15th December, 2020.

The Inquiry Officer has found that the charges against Shri Debashis Acharjee, A.E. are partially established.

The Inquiry officer has concluded his report with the following remarks :-

"After verifying all the documents and statements it is seen that the Karimganj and

Dhakuakhana Division have received the feedback information through Debashis Acharjee. So

Debashis Acharjee was involved handing over the reports which were not genuine as per record.

Debashis Acharjee was not officially dealing the matter of preparation of the concerned feedback

reports. His involvement in preparation of forged documents cannot be ruled out since he was involved

handing over the documents, but cannot be fully established without any forensic investigation.

The charges made in the allegation against Sri Debashis Acharjee are partially established."; and Whereas, as per Rule 9(A) of the Assam Services (Discipline & Appeal) Rules, 1964 as amended, a copy of enquiry report was furnished to Shri Debashis Acharjee and requested him to submit his representation (if any) on the report. In reply, Shri Acharjee has submitted his representation vide No. NIL dated 5th February, 2021 where he denied the charges and the findings of the enquiry report; and

Whereas considering all aspects of the matter, complaint petition submitted by the erstwhile Chief Engineer, Quality Control, W.R. Department, the reply of the D.O. Sri Debashis Acharjee, A.E. to the show-caused notice, enquiry report submitted by Shri Borsing Rongpi, Chief Engineer, WRD cum Inquiry Officer and representation submitted by the D.O. Sri Debashis Acharjee, A.E., it was proposed to inflict punishment of withholding of 2 (two) increments with cumulative effect as prescribed in Rule 7 of the Assam Services (Discipline and Appeal) Rules, 1964 in respect of Shri Debashis Acharjee; and

Whereas the Water Resources Department sought the views of Assam Public Service Commission regarding the proposed penalty against the delinquent officer and the Commission vide there U/o No. 1626/ 2018, dated 28th March, 2022 agrees to the proposed penalty against the delinquent officer Sri Debashis Acharjee, A.E.; and

Therefore, the Governor of Assam is pleased to impose a penalty of withholding of two increments with cumulative effect under Rule 7(ii) of the Assam Services (Discipline & Appeal) Rules, 1964 against Sri Debashis Acharjee, A.E., Silchar WR Division (the then Assistant Engineer, Office of the Chief Engineer, Quality Control, W.R. Department).

The period of suspension w.e.f. 6th December, 2018 to 19th August, 2020 is treated as on duty for all purposes.

The undersigned is directed to refer to Finance Department's O.M. No.FEG.8/2017/108 dated 6th December, 2021 and to say that Governor of Assam is pleased to decide that the Dearness Allowance/ Dearness Relief (DA/DR) to the State Government employees and the pensioners who are entitled to draw pay & pension as per A.S. (ROP) Rules, 2017 shall be admissible as per rate shown below:

In case of the former, pay for the purpose of D.A. will be as defined in F.R. 9(21) (a) (i) including stagnation increment. Those Govt. employees who exercised option to retain the scale of pay that existed prior to 1st April, 2016 shall continue to draw the D.A. as is appropriate to the pay scales in force on 31st March, 2016.

2) The orders shall also be applicable to work charged employees and to those paid from contingencies and holding posts carrying identical pay scales as applicable to the employees of the regular establishments of corresponding categories.

3) The amount sanctioned shall be classified as D.A./ D.R. and the expenditure for the purpose will be debitable to the detailed head of Salary, Wages or Pension under respective head of account from which Govt. employees draw their pay and the Pensioners draw their pension.

4) (i) The current enhanced rate of 34% DA/ DR shall be paid along with monthly pay/pension from the month of April, 2022 .

(ii) The arrear D.A/D.R. with effect from 1st January, 2022 to 31st March, 2022 shall be paid in a single installment through Bank Accounts of the Employees/Pensioners.

No. FRE.103/2013/Pt/772.- Whereas, a preliminary enquiry was conducted against Shri Aniruddha Dey, AFS, the then Divisional Forests Officer, Sonitpur East Division, Biswanath Chariali, on the basis of allegations published in Assamese Daily 'Asomiya Protidin' and has been reported that Shri Dey had committed a gross irregularity of drawing huge amount of money to the tune of approximate Rs.57.80 lakhs in violation of the existing financial rules and regulations.

Whereas Shri Aniruddha Dey, AFS, was placed under suspension vide order No.FRE.103/2013/ Pt/158, dated 21st May, 2014, and a departmental proceeding was drawn up against him, vide a show cause notice issued vide Letter No. FRE.I03/2013/Pt/197, dated 2nd August, 2014 along with Statement of Allegation of charges, List of Exhibits, to Shri Dey in respect of the following charges:

1. Charge No.1 : Irregular drawl of Govt. Fund in cash in violation of existing rules and regulations.

2. Charge No.2 : Complete failure in discharge of Government duty resulting in huge loss of Government money to the tune of Rs.57.80 lakhs,

3. Charge No.3 : Non-Intimation to the higher authority of the matter of break-in of strong room in violation of existing rules and regulations

4. Charge No.4: Unauthorised opening of a bank account in violation of existing rules and regulations

5. Charge No.5: Gross negligence in discharge of Government duty resulting in loss of important records like cash book, bank cheques books from his custody and lapses in subsequent action taken by him.

The defence statement submitted by the delinquent officer has been received in the Department vide letter No.AD/PF/SCN/2015/05, dated 5th March, 2015.

Whereas, on being not satisfied with the defence statement submitted by the Delinquent Officer, the Environment & Forests Department instituted a Departmental enquiry by appointment a Presenting officer vide Letter No. FRE.I03/2013/Pt/291, dated 2151 May, 2015 and Inquiry Officers vide Letter No. FRE.103/ 2013/Pt/291-A, dated 21st May, 2015.

Whereas, the enquiry officer, Shri C.M.Sharma, IFS, Additional Principal Chief Conservator of Forest (SEO), 010 Principal Chief Conservator of Forest, Assam, submitted his enquiry report and findings on dated 2lst April, 2016. The enquiry report was forwarded to Delinquent officer for his representation vide letter FRE.103/2013/Pt/547, dated 21st July 2016. A written representation on the enquiry report was submitted by the delinquent officer vide his letter No.AD/PF/SCN/2016/33, dated 5th October, 2016.

Therefore, upon perusal of all charges framed, connected papers, documents etc. and hearing of the person concerned and the submission of delinquent officer, the undersigned arrived upon conclusion which was very unambiguously stated in the enquiry report, reproduced as below-

1. Charge No.1 : Irregular drawl of Govt. Fund in cash in violation of existing rules and regulations : Proved

2. Charge No.2 : Complete failure in discharge of Government duty resulting in huge loss of Government money to the tune of Rs.57.80 lakhs, : Proved

3. Charge No.3 : Non-Intimation to the higher authority of the matter of break-in of strong room in violation of existing rules and regulations: Proved

4. Charge No.4 : Unauthorised opening of a bank account in violation of existing rules and regulations : Proved

Whereas, meanwhile Shri Aniruddha Dey, AFS, the then Divisional Forests Officer, Sonitpur East Division, Biswanath Chariali., has superannuated on 31st May, 2021. As such the departmental proceedings initiated against him, upon his superannuation, is maintainable under Rule 21 of the Assam Services (Pension) Rules, 1969.

After careful examination of the findings of the Inquiry Officer, it reveals that all the 5(five) charges are proved. Therefore, the Governor of Assam is pleased to conclude the departmental proceeding drawn up against Shri Aniruddha Dey, AFS, the then Divisional Forests Officer, Sonitpur East Division, Biswanath Chariali, by imposing penalty of recovery of Rs.57.80 Lakhs (Rupees Fifty Seven Lakhs and Eighty Thousand only) under Rule 21 of the Assam Services (Pension) Rules, 1969,
