Whereas, Dr. Dwipendra Kr. Deka, Medical Officer (Homoeo), SJN Homoeopathic Medical College, Guwahati and Deputy Director(in-charge) has been posted to the post of Joint Director of AYUSH as regular basis with pay band Rs. 30,000-1,10,000 with grade pay of Rs. 15,700/- PM vide this Notification No. HLB.165/2020/226 dated.29th April, 2022.

Whereas, in 2015 advertisement was given by the APSC, inviting applications for posts of Director/ Joint Director/Deputy Director. However, some Homoeopathic doctors working under the Health & Family Welfare Department aggrieved with eligibility criteria of the advertisement having not minimum grade pay filed two court cases in Gauhati High Court in the year 2015 vide No. W.P(C) 663/2015 and W.P(C) 664/ 2015. Hon'ble Gauhati High Court on 10th December, 2020 has given the verdict on both cases and dismissed the cases as being rendered infructuous. The minimum grade pay requirement of the above mentioned post were Rs.5,900/- whereas as per R.O.P the corresponding grade pay of M.O (Homoeo) were Rs 4,300/- which make them in-eligible to apply for the post.

Whereas, a petition jointly signed by President / General Secretary of Govt. Ayurvedic College Teachers Association / Assam Ayurvedic Doctors Service Association / Ayurvedic Doctors Association, NHM, Assam has received vide letter dated 13th May, 2022. In this petition they have stated the following points:-

1) "Posting of Dr. Dwipendra Kr. Deka as Joint Director on regular basis is contrary to the judgement of Hon'ble Gauhati High Court vide No. WPC - 663/2015 and WPC - 664/2015 and APSC advertisement No. 03/2015.

2) Without disposing the pending in force advertisement of APSC dated 09/01/2015, Joint Director post cannot be filled up on regular basis.

3) Dr. Dwipendra Kr. Deka, Medical Officer (Homeo) availing present pay structure is as PB- 3, Basic Pay - 22,000-87,000/- and Grade Pay of Rs. 9100/- has been jumped at one go to PB- 4 and also jumped 10 slab at per ROP, Assam 2017 at one go. It is a gross violation of existing financial norms".

Whereas, AG, Assam raised queries on the matter of posting of regular Joint Director in the office of the Director, AYUSH.

Whereas, Dr. Dwipendra Kr. Deka, Medical Officer (Homoeo), SJN Homoeopathic, Medical College, Guwahati retired from service on 30/04/2022.

In view of above, after careful examination of the matter in all aspects, the Government of Assam in Health & Family Welfare Department for the greater interest of public hereby comes to the conclusion that the notification issued vide this departments No.HLB.165/2020/226 Dated.29/04/2022 is hereby cancelled with immediate effect.

1. In the first instance, it has to be noted that the printing of the weekly Gazette must be completed by the end of every Tuesday so that it may be duly published on every Wednesday.

Every notification and every other matter which is required to be printed and published in a particular issue of the Official Gazette must, therefore, reach the Director, Assam Government Press on the Monday of the week preceding the week in which it is required to be published. If this is not done it is infructuous requesting the Director, Assam Government Press to publish such notification or other matter in the next issue of the Gazette, the expression usually inserted in all endorsements made to the Director.

3. Wherever it is necessary to print and publish a notification on a specified date (excluding such Notification or communicate as are to be published in Gazette extraordinary) clear instruction of that effect must be given to the Director, Assam Government Press, both on the body of such notification within the indication at the top in the red ink and is a separate covering.
