PART-II A ] THE ASSAM GAZETTE, JULY 5, 2023 397PROSECUTION SANCTION ORDER
The 6th June, 2023
No. E-286428/39.- Perused the report received from the Deputy Superintendent of Police, CID, Assam, Ulubari dated 17th May, 2023, which has been forwarded by the Superintendent of Police, CID, Assam, Ulubari, Guwahati vide Memo No.CID/Cell-XIV/CID P.S/C. No. 03- 2023/ 2023/3016 dated 17th May, 2023, whereby a request has been made to accord prosecution sanction against Smti. Jyoti Rekha Borgohain, Joint Director, Department of Women & Child Development and the then i/c Principal Bhauri Devi Sarawgi (BDS) Govt. H.S. School for Hearing Impaired in connection with CID PS Case No.03/2023 dated 13th March, 2023 U/S 120(B)/420/427 IPC.
From a perusal of the report submitted by the Deputy Superintendent of Police, CID, Assam, the following points emerge:
Whereas, complainant Sri Nayan Jyoti Sarmah, Controller of Examination, Board of Secondary Education, Assam lodged an FIR on 13th March, 2023 stating that a news had appeared regarding leakage of hand written question paper of HLSC examination 2023 of General Science (C3) subject, which was to be held on 13th March, 2023 and these were available in the hands of some candidates and was being circulated in social media. The authority found similarity with the question paper prepared by SEBA. As a result, the examination of the General Science had to be cancelled.
Smti. Jyoti Rekha Borgohain, W/o Shri Bodon Ch. Phukon and i/c Principal, Bhauri Devi Sarawgi (BDS) Govt. H.S School for Hearing Impaired was designated as Officer in-charge of the HSLC Examination-2023 Centre of Bhauri Devi Sarawgi (BDS) Govt. H.S. School for Hearing Impaired. The SEBA issued instruction that "the Officer-in-Charge will receive the confidential packets in presence of the assigned Police Officer and he/ she will ensure that the question papers received as per Form 200 (requisition of subject wise question papers) i.e., there is no shortage of question paper". Further instruction was that "At any cost, Centre-in-Charge must collect the packets of Question Papers from P.S./O.P. directly. Authorization to collect the Q.P. of any person is strictly prohibited." But, in the instant case Sri Herambo Kumar Das, Teacher of the School as well as Sri Chittaranjan Roy, Casual Employee of the school accompanied Smti. Jyoti Rekha Borgohain to the store room of Dispur P.S. and received and sorted the packets of question papers violating the directives of the SEBA's instructions. Hence, she was arrested in connection with CID PS Case No.03/2023.
The CID has informed that from the investigation carried out so far, it has been found that Smti. Jyoti Rekha Borgohain, Principal, Bhauri Devi Sarawgi (BDS) Govt. H.S School for Hearing Impaired has informed Shri Nayan Jyoti Sarmah, Controller of Examination, SEBA, Assam on 21st February, 2023 that they had received one extra packet of question paper of Computer Science subject of HSLC Examination, 2023. It has also been confirmed by the Controller of Examination, SEBA that during investigation that Smti. Jyoti Rekha Borgohain, Principal, Bhauri Devi Sarawgi (BDS) Govt. H.S School for Hearing Impaired had sent a message to him using whatsapp informing him that they had received one extra packet of question paper of Computer Science subject of HSLC Examination, 2023.
398 THE ASSAM GAZETTE, JULY 5, 2023 [ PART-II AThe CID has further informed that question papers of HSLC Examination, 2023 for Bhauri Devi Sarawgi Govt. H.S School for Hearing Impaired, Kahilipara, Guwahati were kept at Dispur PS under CCTV surveillance and the lock as well as key of the Almirah/Box where the sealed packets of question papers had been kept was under the custody of the Centre in-charge of the school, who was Smti. Jyoti Rekha Borgohain. When the examination for General Science subject of HSLC Examination, 2023 was cancelled due to leakage of question paper, the afore-mentioned case was registered and investigated into. Upon physical verification of the number of sealed packets of question papers of General Science subject of HSLC Examination, 2023 at the respective PSs to detect whether any packet(s) was/were missing from the assigned lot of packet of question papers to any centre in presence of all the Centre-in-charges under the jurisdiction of Dispur PS, it was found that in Bhauri Devi Sarawgi Govt. H.S School for Hearing Impaired, Kahilipara, Guwahati, the total number of sealed packets of General Science subject was 41 (forty one), which should be 42 (forty two) as per records. Smti. Jyoti Rekha Borgohain, the Officer-in-Charge of Bhauri Devi Sarawgi Govt. H.S School for Hearing Impaired, Kahilipara Guwahati did not inform the Controller, SEBA, Assam that one packet of question paper of General Science subject of HSLC Examination, 2023 was missing from the assigned lot of question papers allotted to the centre. She neither informed Controller, SEBA (Assam) nor sent him any communication (written or electronic) regarding the missing packet of question paper of General Science subject which tantamount to 'Public servant framing incorrect records'.
The CID also states that as per the directives/instructions circulated by SEBA (Assam) to all Centre-in-charges of HSLC Examination, 2023 for maintaining secrecy as well as for smooth conduct of HSLC Examination, 2023, it is envisaged in S1. No. (G) Para (iv) (5) of the aforesaid directives/ instructions that the respective in-charge of the centre would invariably be present at the time of opening of the almirah/Box containing the question papers, which was not followed explicitly in this instant case as it was found that Shri Herambo Kumar Das, Teacher of the School as well as Chittaranjan Roy, casual employee of the school had not only accompanied Smti. Jyoti Rekha Borgohain to the store room of Dispur PS where the packets of question papers were kept, but also received as well as sorted the packets of question papers. This is a blatant violation of the directives/instructions of SEBA, Assam which read as "At any cost, Centre-in-charge must collect the packet of Question Papers from the P.S/P.O.P directly, authorization to collect Q.P of any other persons is strictly prohibited".
Accordingly, the CID during investigation of the matter found that a prima-facie case u/s- 120(B)218/409 IPC is well established against the arrested accused Jyoti Rekha Borgohain, Joint Director, Directorate of Women & Child Development, Assam and i/c Principal, Bhauri Devi Sarawgi Govt. H.S School for Hearing Impaired, Kahilipara, Guwahati.
And whereas, after considering the report submitted by the CID, Assam, the Department of Women & Child Development, being the competent authority to approve the prosecution sanction and whereas after fully and carefully examining the material in regard to the said allegations and the circumstances of the case, consider that the said Smti. Jyoti Rekha Borgohain, should be prosecuted in a Court of Law for the aforesaid offence/offences.
PART-II A ] THE ASSAM GAZETTE, JULY 5, 2023 399Now, therefore, I, Shri Partha Pratim Majumdar, IAS, Secretary to the Govt. of Assam, Department of Women & Child Development, Dispur, do hereby accord sanction on behalf of Department of Women & Child Development for the prosecution of the said Smti. Jyoti Rekha Borgohain under Section 197 Cr.P.c., for the offence u/s 120B/218/409 IPC in connection with CID Police Station Case No.03/2023 u/s-120(B)/420/427 IPC R/W Sec. 66(B) of the Information Technology Act added section 201/218/409 IPC of the law and for taking of cognizance of the said offences by a Court of competent jurisdiction.
PARTHA PRATIM MAJUMDAR, Secretary to the Government of Assam, Department of Women & Child Development.

SUBJECT :- Timely publication of Government Notifications and other important matters in the weekly Official Gazette.
I am directed to say that it has come to the notice of Government that important notification having bearing on statutes and matters of immediate public interest are sometimes published in the Official Gazette on date much later than prescribed. Government have decided, therefore, to introduce the following system with immediate effect, which must be strictly adhered to in sending notice to the Assam Government Press for publication in the Official Gazette.
1. In the first instance, it has to be noted that the printing of the weekly Gazette must be completed by the end of every Tuesday so that it may be duly published on every Wednesday.
298 THE ASSAM GAZETTE, JULY 5, 2023 [PART IX2. Every notification and every other matter which is required to be printed and published in a particular issue of the Official Gazette must, therefore, reach the Director, Assam Government Press on the Monday of the week preceding the week in which it is required to be published. If this is not done it is infructuous requesting the Director, Assam Government Press to publish such notification or other matter in the next issue of the Gazette, the expression usually inserted in all endorsements made to the Director.
3. Wherever it is necessary to print and publish a notification on a specified date (excluding such Notification or communicate as are to be published in Gazette extraordinary) clear instruction of that effect must be given to the Director, Assam Government Press, both on the body of such notification within the indication at the top in the red ink and is a separate covering.
4. To achieve the objective in papers 2 and 3, it is essential that proper discretion should be exercised by the concerned officers in the Department or office and all matters for publication in the Gazette should scrutinised and sent to the Press after careful application.
5. As for publication of any matters in a Gazette, Extraordinary, the existing procedure whereby the prior approval of the General Administration Department is to be obtained will continue.
I am to request you to acknowledge the receipt of this letter and confirmed that the instructions have been duly voted. If you have suggestion on this behalf they may please be communicated.
