Whereas, departmental proceeding was drawn up against Shri Anupam Choudhury, ACS (U/S) vide Show Cause Notice No. AAP.173/2022/22 dated 3rd December, 2022;

Whereas considering the seriousness of the charge, the period of suspension of Shri Anupam Choudhury, ACS(U/S) was extended for a period of 3 (three) months w.e.f. 29th December, 2022 vide Order No: AAP. AAP .173/2022/24 dated 31st December, 2022;

Whereas the period of suspension of Shri Anupam Choudhury, ACS (U/S) was further extended for a period of 3 (three) months w.e.f. 29th March, 2023 vide Order No: AAP.173/2022/32 dated 31st March, 2023;

Whereas a Review Committee has been constituted to review this case of suspension and after examining the records of the case against Shri Anupam Choudhury, ACS (U/S), and considering the grave nature of the charge against Shri Anupam Choudhury, ACS (U/S), which included tarnishing of the image of the Government of Assam, the Review Committee has recommended for extension of his suspension period. The Disciplinary Authority has hence decided that re-instatement at this stage may not be in the interest of public service;

Now, therefore, the Governor of Assam, is pleased to extend the period of suspension in respect of Shri Anupam Choudhury, ACS (U/S), for another period of 3 months w.e.f. 29th June, 2023 or till further order.

    12. Two Persons with Disabilities as defined in clause(s) of   :- Member
         Section 2 of the Act out of which one shall be a woman.

         Nomination against Sl. No.6,11 and 12 will be done by the Chairperson. The Chairperson
         may invite any other person(s) as expert(s) as deemed fit.
Functions of the Committee :
The District Level Committee on disability shall perform the following functions namely:-
    1.   Advise the District authorities on matters relating to rehabilitation and empowerment of
         persons with disabilities.
    2.   Monitor the implementation of the provisions of the Act and the rules made there under by
         the District authorities.
    3.   Assist  the  District  authorities  in  implementation  of  schemes  and  programmes  of  the
         Government for empowerment of persons with disabilities.
    4.   Perform as district level authority for appointment of limited guardianship for persons with
         disabilities as provided in rule 8 of the Assam State RPwD Rules.
    5.   Look into the complaints relating to non implementation of the provisions of the Act by the
         District authorities and recommend suitable remedial measures to the concerned authority
         to redress such complaints.
    6.   Look into the appeal made by the employees of Government establishments aggrieved with
         the action taken by the District level establishments under Sub-section (4) of section 23 of
         the Act and recommend appropriate measures.
    7.   Hold minimum of one meeting in a month.
    8.   Submit progress reports to the Social Justice & Empowerment Department for action taken
         in every month in Form X.
    9.   An Assessment Board shall be formed with the following members, namely,-
         i.   The Joint Director Health Services of the District or his representative not below the
              rank of Senior Medical and Health Officer - Chairman
         ii.  One Social Worker or representative of a registered organization under the Act - Member
         iii. District Social Welfare Officer or his or her representative - Member Secretary.
    10. Any other functions as may be assigned by the State Government.

No. AAP.174/2022/38.- Whereas Shri Roktim Baruah, ACS (U/S), the then Additional Deputy Commissioner, Hojai, was placed under suspension w.e.f. 29th September, 2022 vide Notification No. AAP.174/2022/1 dated 29th September, 2022, for physically assaulting general public in Hojai on 28th September, 2022;

Whereas, departmental proceeding was drawn up against Shri Roktim Baruah, ACS (U/S) vide Show Cause Notice No. AAP.174/2022/22 dated 6th December, 2022;

Whereas considering the seriousness of the charge, the period of suspension of Shri Roktim Baruah, ACS (U/S) was extended for a period of 3 (three) months w.e.f. 29th December, 2022 vide Order No: AAP. AAP.174/2022/26 dated 31st December, 2022;

Whereas the period of suspension of Shri Roktim Baruah, ACS (U/S) was further extended for a period of 3 (three) months w.e.f. 29th March, 2023 vide Order No: AAP.174/2022/33 dated 3rd April, 2023;

Whereas a Review Committee has been constituted to review this case of suspension and after examining the records of the case against Shri Roktim Baruah, ACS (U/S), and considering the grave nature of the charge against Shri Roktim Baruah, ACS (U/S), which included tarnishing of the image of the Government of Assam, the Review Committee has recommended for extension of his suspension period. The Disciplinary Authority has hence decided that re-instatement at this stage may not be in the interest of public service;

Now, therefore, the Governor of Assam, is pleased to extend the period of suspension in respect of Shri Roktim Baruah, ACS (U/S), for another period of 3 months w.e.f. 29th June, 2023 or till further order.

Jahnabi Kalita, Inspector of Drugs, Jorhat (Under Suspension), was put under suspension w.e.f. 19th September, 2022, vide this Department's order No.HLA.244234/4, dated 5th November, 2022, on grounds of being arrested by officers of Directorate of Vigilance & Anti- Corruption, Assam, while accepting bribe, in connection with ACB PS Case No. 40/2022;

Whereas, this Department, vide order No.HLA.244126/62 dated 17th November, 2022, had accorded sanction under section 19 of the Prevention of Corruption Act, 1988 (as amended in 2018), to prosecute Smti. Jahnabi Kalita for commission of offences U/S 7(a) of the Prevention of Corruption Act, 1988 (as amended in 2018), and for any other offence/ offences arising out of the said facts and for taking cognizance of the said offence/offences by the Court having competent jurisdiction;

Whereas, Smti. Jahnabi Kalita was issued show cause notice vide letter No. HLA.229799/63 dated 10th November, 2022, charging the delinquent officer with gross misconduct and violation of Rule 3(1)(i), 3(1 )(ii) and 3(1)(iii) of the Assam Civil Services (Conduct) Rules, 1965;

Whereas, Smti. Jahnabi Kalita, vide letter dated 25th November, 2022, submitted her written statement in defence explaining the circumstances of the case, wherein the officer denied all the charges framed against her;

Whereas, after careful examination of the written statement in defence submitted by Smti. Jahnabi Kalita and the materials on record, it was considered to get the charges enquired into by an Inquiry Officer with Presenting Officer;

Whereas, the Inquiry Officer, after conducting the Disciplinary Proceedings, submitted the Inquiry Report vide letter dated 2nd May, 2023, wherein it was concluded that the charges of gross misconduct and violation of Rule 3(1)(i), 3(1 )(ii) and 3(1)(iii) of the Assam Civil Services (Conduct) Rules, 1965 are well established;

Whereas, after perusal of the Inquiry Report and the materials on record, the Government of Assam in Health & Family Welfare Department, decided to inflict the penalty of withholding of one increment without cumulative effect upon the delinquent officer under Rule 7(ii) of the Assam Services (Discipline and Appeal) Rules, 1964;

Whereas, the Inquiry Report was furnished to Smti. Jahnabi Kalita vide letter No.229799/117 dated 4th July, 2023 thereby giving her the opportunity of submission of representation, if any;

Whereas, Smti. Jahnabi Kalita submitted her representation vide letter dated 7th July, 2023, expressing her disagreement with the findings of the Inquiry Officer in the Inquiry Report;

Whereas, on examination, it was found that the representation of Smti. Jahnabi Kalita did not contain any new facts which warranted review of the Inquiry Report or the Disciplinary Proceeding;

Now, therefore, the Government of Assam in Health & Family Welfare hereby imposes the penalty of withholding of one increment without cumulative effect upon Smti. Jahnabi Kalita, under Rule 7 (ii) of the Assam Service (Discipline & Appeal) Rules, 1964.

Further, the period of suspension of Smti. Jahnabi Kalita shall be treated as on duty for all purposes, including pensionary benefits. However, salary for the period under suspension of Smti. Jahnabi Kalita shall be limited to the subsistence allowance only, as entitled.

The Disciplinary Proceeding drawn up against Smti. Jahnabi Kalita is thus disposed of, subject to the condition that the penalty shall be reviewed again later on, in case Smti. Jahnabi Kalita is convicted by the Hon'ble Court in connection with ACB PS Case No. 40/2022.

No. 229799/122-A.- On disposal of the Disciplinary Proceedings, Smti. Jahnabi Kalita is hereby reinstated into service and posted as Inspector of Drugs, Sivasagar.
