No.204168/139.- Whereas, Shri Birinchi Kumar Karjee, Designated Officer (Food Safety), Nagaon, was put under suspension w.e.f. 29th April, 2022, vide this Department's order No.HLA.450/ 2022/11, dated 20th May, 2022, on grounds of being arrested by officers of Directorate of Vigilance & Anti- Corruption, Assam, while accepting bribe on 29th April, 2022 in connection with ACB Case No. 10/2022, during his tenure as Designated Officer, Nagaon;

Whereas, this Department, vide order No.HLA.450/2022/40 dated 27th June, 2022, had accorded sanction under section 19 of the PC Act, 1988 (as amended in 2018), to prosecute Shri Birinchi Kumar Karjee for commission of offences U/S 7(a) of the Prevention of Corruption Act, 1988 (as amended in 2018), and for any other offence/offences arising out of the said facts and for taking cognizance of the said offence/offences by the Court having competent jurisdiction;

Whereas, Shri Karjee was issued show cause notice vide letter No. HLA.450/2022/42 dated 6th July, 2022, charging the delinquent officer with gross misconduct and violation of Rule 3(1) (i) and Rule 3(1) (iii) of the Assam Civil Services (Conduct) Rules, 1965;

Whereas, Shri Karjee, vide letter dated 12th August, 2022, submitted his written statement in defence explaining the circumstances of the case, wherein the officer denied all the charges framed against him;

Whereas, after careful examination of the written statement in defence submitted by Shri Karjee and the materials on record, it was considered to get the charges enquired into by the Inquiry Officer with Presenting Officer;

Whereas, the Inquiry Officer, after conducting the Disciplinary Proceedings, submitted the Inquiry Report vide letter dated 17th January, 2023, wherein it was concluded that the charges of gross misconduct and violation of Rule 3(1 )(i) and Rule 3(1 )(iii) of the Assam Civil Services (Conduct) Rules, 1965 are well established;

Whereas, the Inquiry Report was furnished to Shri Karjee vide letter No.204168/114 dated 11th July, 2023 thereby giving him the opportunity of submission of representation, if any;

Whereas, the delinquent officer submitted his representation vide letter dated 17th July, 2023, expressing his disagreement with the findings of the Inquiry Officer in the Inquiry Report;

Whereas, on examination, it was found that the representation of Shri Karjee did not contain any new facts which warranted review of the Inquiry Report or the Disciplinary Proceeding;

Whereas, after perusal of the Inquiry Report and the materials on record, the Government of Assam in Health & Family Welfare Department, decided to inflict the penalty of withholding of 2(two) increments with cumulative effect upon the delinquent officer under Rule 7 of the Assam Services (Discipline and Appeal) Rules, 1964;

Now, therefore, the Government of Assam in Health & Family Welfare hereby imposes the penalty of withholding of 2(two) increments with cumulative effect upon Shri Birinchi Kumar Karjee, Designated Officer, Nagaon, under Rule 7 of the Assam Service (Discipline & Appeal) Rules, 1964.

Further, the period of suspension of Shri Birinchi Kumar Karjee shall be treated as on duty for all purposes, including pensionary benefits. However, the salary for the period under suspension of Shri Karjee shall be limited to the subsistence allowance only, as entitled.

The Disciplinary Proceeding drawn up against Shri Birinchi Kumar Karjee is thus disposed of.

Term of Office:

The Term of office of the Chairperson and members (other than ex-officio members) shall be 3 (three) years.

Power, function and responsibilities:

Without prejudice to the provision of the Biological Diversity Act, 2002 (Act 18 of 2003) the Assam State Biodiversity Board shall exercise powers, perform function and discharge responsibilities as laid down and mandated under the" Assam Biodiversity Rules, 2010".

Powers and responsibilities of the Chairperson:

The Chairperson shall exercise such powers and discharge such responsibilities as laid down and mandatory under Section-15 of the "Assam Biodiversity Rules, 2010" .

Function of the Member Secretary:

The Member Secretary of the Assam State Biodiversity Board shall perform such function as laid down and mandatory under Section-11 of the "Assam Biodiversity Rules, 2010".

Terms of Reference of the Assam State Bio-diversity Board:

1. The Activities of the Assam State Biodiversity Board shall be essential and strictly governed by the provisions of the Assam Biodiversity Rules, 2010.

2. The Assam State Biodiversity Board shall consult the National Bio-diversity Authority (NBA) and the Biodiversity Management Committees, as and when required, while taking decision relating to use of biological resources of the state and traditional knowledge associated with such resources.

3. The Assam State Biodiversity Board shall, in the discharge of its functions and responsibilities under the Assam Bio-diversity Rules, 2010 be bound by such direction on question of policy as the state Government may give of it writing from time to time under sub-sections (1) of Section-49 of the Biological Diversity Act, 2010. Provided that the Assam Biodiversity shall as far as practicable be given an opportunity to express its views before any direction is given under the said provision.

4. The Principal Chief Conservator of Forests (Biodiversity) will function as the Member Secretary of the Assam State Biodiversity Board.

5. The Assam State Biodiversity Board would meet from time to time as required.

6. TA/DA of non-official members would be born out of funds provided by the State Government for the purpose/State Biodiversity Fund. TA/DA of officials members would be borne by their respective parent Departments.
