No. HLA.78176/432.- Whereas, Shri Jugal Baruah, Inspector of Drugs, Dhemaji, was put under suspension w.e.f 13th July, 2018, vide notification No.HLA.559/2018/10 dated 14th September, 2018, on grounds of being arrested by officers of Directorate of Vigilance & Anti- Corruption, Assam, while accepting bribe on 13th July, 2018 and being in police custody for 5 (five) days in connection with ACB Case No. 15/2018, during his tenure as Inspector of Drugs, Jorhat (subsequently reinstated into service as Inspector of Drugs, Dhemaji);
Whereas, Shri Jugal Baruah was issued show cause notice vide letter No. HLA.559/2018/192 dated 7th August, 2019, charging the delinquent officer with gross misconduct and violation of Rule 3(1) (i) and Rule 3(1) (iii) of the Assam Civil Services (Conduct) Rules, 1965;
Whereas, Shri Jugal Baruah, vide letter dated 12th October, 2020 submitted his written statement in defence explaining the circumstances of the case, wherein the officer denied all the charges framed against him;
Whereas, after careful examination of the written statement in defence submitted by Shri Jugal Baruah and the materials on record, it was considered to get the charges enquired into by the Inquiry Officer with Presenting Officer;
Whereas, the Inquiry Officer, after conducting the Disciplinary Proceedings, submitted the Inquiry Report vide letter dated 28th January, 2021, wherein it was concluded that the charges of gross misconduct and violation of Rule 3(1) (i) and Rule 3(1) (iii) of the Assam Civil Services (Conduct) Rules, 1965 are well established;
Whereas, after perusal of the Inquiry Report and the materials on record, the Government of Assam in Health & Family Welfare Department, in view of the magnitude and nature of the offence, decided to inflict the penalty of compulsory retirement upon the delinquent officer under Rule 7(v) of the Assam Services (Discipline and Appeal) Rules, 1964;
Whereas, the Inquiry Report was furnished to Shri Jugal Baruah vide letter No.HLA.559/2018/ 302 dated 6th March, 2021 thereby giving him the opportunity of submission of representation, if any;
Whereas, the delinquent officer submitted his representation vide letter dated 22nd March, 2021, expressing his disagreement with the findings of the Inquiry Officer in the Inquiry Report;
Whereas, on examination, it was found that the representation of Shri Jugal Baruah did not contain any new facts which warranted review of the Inquiry Report or the Disciplinary Proceeding;
Whereas, the matter was also referred to the Ld. Advocate General, Government of Assam, upon which it was opined that the authority may proceed with the Departmental Proceeding for imposition of proposed penalty after obtaining necessary permission from the Assam Public Service Commission;
Whereas, on consultation under Rule 10 of the Assam Services (Discipline and Appeal) Rules, 1964, the Assam Public Service Commission (APSC) has agreed to the Government's decision of imposing penalty of compulsory retirement with regard to the Disciplinary Proceedings drawn up against the delinquent officer vide U/O Issue No. 1666 dated 11th October, 2022;
PART-II A ] THE ASSAM GAZETTE, OCTOBER 18, 2023 725Whereas, the Government of Assam in Health & Family Welfare Department is satisfied that the penalty under Rule 7(v) of the Assam Services (Discipline and Appeal) Rules, 1964, shall be at the ends of justice, keeping in view the serious misconduct and moral turpitude on the part of the delinquent officer;
Now, therefore, the Government of Assam in Health & Family Welfare hereby imposes the penalty of Compulsory Retirement upon Shri Jugal Baruah, Inspector of Drugs, Dhernaji, under Rule 7 (v) of the Assam Service (Discipline & Appeal) Rules, 1964, with immediate effect.
Further, the Government of Assam is pleased to order that the salary for the period under suspension of Shri Jugal Baruah shall be limited to the subsistence allowance only, as entitled.
The Disciplinary Proceeding drawn up against Shri Jugal Baruah is thus disposed of.
