eCF No. 457118/479.- Whereas a Departmental Proceeding was drawn up against Sri Nirupam Borthakur, Superintending Engineer, PWD, Silchar Building Circle under Public Works (Buildg. & NH) Department vide Show Cause Notice ECF. No. 457118/74 dated 22nd March, 2024 under Rule 9 of Assam Services (Discipline & Appeal) rules, 1964, read with Article 311 of the Constitution of India for violating the Rule 3 of the Assam Civil Services (Conduct) Rules, 1965; and

Whereas, Sri Nirupam Borthakur, Superintending Engineer, PWD, Silchar Building Circle was placed under suspension vide Notification No. Ecf. No. 457118/70 dated 12th March, 2024 and was subsequently reinstated on 19th August, 2024 vide Notification No. Ecf. No. 457118/474; and

Whereas, a Preliminary Enquiry No. PEO 172024A000 1 has been registered at CBI, Anti Corruption Branch, Guwahati on the matter; and

Whereas, Sri Nirupam Borthakur, Superintending Engineer, PWD, Silchar Building Circle has submitted his written statement in defence explaining the case and the circumstances of his case vide letter dated 15th April, 2024 and 20th April, 2024 wherein he has denied the charges framed against him; and

Whereas, after careful examination of the written statement in defence submitted by Sri Nirupam Borthakur, Superintending Engineer, PWD, Silchar Building Circle and the materials on record, it was considered to get the charges enquired into and accordingly an Inquiry Authority was appointed vide Notification Ecf.No. 481683/61 dated 23rd April, 2024; and

Whereas, the Inquiry Authority had furnished the Inquiry Report vide No. 481801/3 dated 30th May, 2024 and the enquiry report has been concluded that the charges have been proved;and

Whereas, a copy of the enquiry report was served to the Delinquent Official vide ECF No. 457118/ 341 dated 4th July, 2024 and the Delinquent Official submitted his views on 16th July, 2024; and Whereas, after careful consideration of the Inquiry Report of the Inquiring Officer together with the representation submitted by the Delinquent official on enquiry report and the materials on record, the Government of Assam proposed to inflict punishment of withholding of 1 (one) increment with cumulative effect under Rule 7 (ii) of the Assam Services (Discipline & Appeal) Rules, 1964 and the matter was accordingly consulted with the Assam Public Service Commission vide No. 457118/409 dated 9th August, 2024; and

Whereas, on consideration of the inquiry report and having regard to the circumstances appearing in the departmental proceeding, the Assam Public Service Commission agreed to the proposed penalty as conveyed vide its Letter No. 117PSC/Dp-26/6/2024-25 dated 21st August, 2024; and

Whereas, the Governor of Assam is satisfied that the proposed penalty under Rule 7 (ii) of the Assam Services (Discipline & Appeal) Rules, 1964 shall be at the end of the justice; and

Now, therefore, the Governor of Assam is pleased to withhold 1 (one) increment with cumulative effect in respect of Sri Nirupam Borthakur, Superintending Engineer, PWD, Silchar Building Circle, under Public Works (Buildg. & NH) Department under Rule 7 (ii) of the Assam Services (Discipline & Appeal) Rules, 1964.

Further, the Government of Assam is pleased to order that the period under suspension of the said Sri Nirupam Borthakur, Superintending Engineer, PWD, Silchar Building Circle, Public Works (Buildg. & NH) Department shall qualify for pension and pensionary benefits only and the pay and allowances for the suspension period shall be limited to the subsistence allowance paid to him or ordered to be paid to him.

The Departmental Proceeding drawn against Sri Nirupam Borthakur, Superintending Engineer, PWD, Silchar Building Circle, Public Works (Buildg. & NH) Department is hereby finally disposed of.
