No. E- 577527/37.- Whereas, Report had been received from the Chief Engineer, PWD (Building), Assam on the arrest of Sri Sunil Doley, Assistant Excutive Engineer, Dhemaji Territoal Bulding Sub Division in connection with Dhemaji P.S. case No. 149/23/US 120B/ 420 406 409 IPC and remaining in Police Custody for a period of two days (48 Hours) and forwarded to Judicial Custody on 18th December, 2023; and

Wheres Sri Sunil Doley, Assistant Excutive Engineer was placed under suspension; and Wheres, show Cause was issued to the charged officer; and

Wheres, as per request of Superintendent of Police, Chief Minister's Special Vigilance Cell dated 6th August 2024, Prosection Sanction has been accorded in respect of Sri Sunil Doley, Assistant Excutive Engineer vied Ecf. No. 537622/480 dated 14th November 2024.

Wheres, Suspension order Ecf. No. 392862/137 dated 9th January, 202 was reviewed and extended vide order Ecf. no. 392862/203 dated 3rd April, 2024 & Ecf. No. 577527/28 dated. 18th November, 2024& Ecf. No. 577527/31 dated 3rd Febuary, 2025; and

Wheres, after careful consideration of the Enquary Report submitted by the Inquary Officer & Presenting Officer, and considering all other aspect including negligence of the Delinquent Officer, department proposed to inflict penalties upon Sri Sunil Doley, the then AEE(C), PWD Dhemaji District Territorial Building Sub Division as per Rule 7 of the Assam Services (Discipline & Appeal) Rules, 1964 wherein it has been assessed that there is need for a detailed report with through assesment of the overall excess compensation made in case of Asom Mala Project from Telijan to Dhakuakhana and to consult the Revenue & Disastar Management Department; and

Whreas, Personnel Department's views has been sought for on reinstatement of Sri Sunil Doley , the than Assistant Excutive Engineer (under suspension), Dhemaji Territorial Bulding Sub Division wherein personal Department viewd that the appointing Authority is the competent authority to take a decision regarding his reinstatment in service; and

Whereas, based on the Inquiry report, pending disciplinary prociding and considering the grave nature of charge against Sri Sunil Doley, the then Assistant Excutive Engineer (under suspension), DhemajiTerritorial Bulding Sub Division, the Disciplinary Authority has decided that re-instatement at this sage may not be inthe interest of public service; and204 THE ASSAM GAZETTE, APRIL 30, 2025 [ PART-II A Now, therefore, the Governor of Assam is plesed to extend the suspension period of Sri Sunil Doley, the than Assistant Excutive Engineer (under suspension), Dhemaji Territorial Bulding Sub Division by another 90 (Ninety) days with effect from 16th March, 2025 or until further order.
