सं. 310-1 ( 5 )/टी आर ए आई- 2000.- भारतीय दूरसंचार विनियामक प्राधिकरण अधिनियम, 1997 र्को धारा 11 की उप- धारा (2 ) के अंतर्गत प्राधिकरण को प्रदत्त शक्तियों का प्रयोग करते हुए कि, भारत और भारत के बाहर , जिन टेरिफों पर दूरसंचार सेवाएं उपलब्ध कराई जाएंगी उन्हें, शासकीय राजपत्र में आदेश द्वारा अधिसूचित किया जाएगा , भारतीय दूरसंचार विनियामक प्राधिकरण, एतद्वारा निम्नलिखित आदेश जारी करता है ।
दूरसंचार टैरिफ (11 वां संशोधन ) आदेश , 2001 (2001 का कमांक 1)
खण्ड - I
शीर्षक , विस्तार और प्रारंभ
1. लघु शीर्षक , विस्तार और प्रारंभ:
(i) इस आदेश को " दूरसंचार टैरिफ (11 वां संशोधन) आदेश 2001 " कहा जाएगा ।
( ii ) यह आदेश शासकीय राजपत्र में इसकी अधिसूचना की तारीख से लागू होगा ।

खण्ड - II
दूरसंचार टेरिफ आदेश 1999 की अनुसूची I (आइ एस डी एन से इतर बुनियादी सेवाएं ) में, मद 12 (क) के लिए टिप्पणियों के अंतर्गत, अर्थात् " एस टी डी दूरवर्ती कालों " के संबंध में, अतिरिक्त मद (5) शामिल की जाएगी, जो निम्न प्रकार है:
(5) "दो फिक्स्ड आपरेटरों के नेटवर्को पर की जाने वाली दूरवर्ती पी एस टी एन काल के संबंध में पल्ज रेट वही होगी जो उतनी ही दूरी की इंटरा नेटवर्क काल के लिए लागू निम्नतम टेरिफ के तद्नुरूप पल्स रेट है । फिक्स्ड नेटवर्क में उद्भूत हाने वाली और माबाइल नेटवर्क पर समाप्त होने वाली काल के फिकस्ड लैग के संबंध में पल्स रेट वही होगी जो मूल एस डी सी सी के वास्ते एक समान कैरिज हेतु इन्टरा - नेटवर्क कालों के लिए सेवा प्रदाता द्वारा लागू न्यूनतम टेरिफ के तद्नुरूप पल्स रेट है । "
खण्ड - III
इस आदेश में, संलग्नक " क " में एक व्याख्यात्मक ज्ञापन दिया गया है ताकि इस आदेश में विनिर्दिष्ट टेरिफों में स्पष्टता ओर परदर्शिता हो सके ।

व्याख्यात्मक ज्ञापन
1. दिनांक 29-12-2000 के एक पत्र में बी एस एन एल ने प्राधिकरण को टेरिफों की रिपोर्ट की थी जिसमें, बुनियादी सेवाओं के लिए टी आर ए आई मानक टेरिफ पैकेज की तुलना में, 50 से 200 कि0 मी० दूरवर्ती श्रेणियों के संबंध में उच्चतम पल्स दरों की अवधि विस्तारित करके , 26 जनवरी , 2001 से एस टी डी काल चार्ज कम कने की बात कही गई [ भाग III- खण्ड 4]
है । तथापि, पत्र के अनुसार, बी एस एन एल की च सशोधित पल्स दरें केवल " बी एस एन एल के टेलीफोन अभिदाता द्वारा उदभूत होने वाली भोर बुनियादी सेवा नेटवर्क में समाप्त होने वाली इन्दा- सर्किल कालों " पर लागू होंगी ।
2. प्राधिकरण को सी ओ ए आई और ए बी टी ओ से अभ्यावेदन प्राप्त हुए जिसमें बी एस एन एल के प्रस्ताव के कार्यक्षेत्र को बढाकर उस इन्टर नेटवर्क के संबंध मे से लागू करने के वास्ते प्राधिकरण से हस्तक्षेप करने का अनुरोध किया गया था । उन्होंने प्राधिकरण के हस्तक्षेप की मांग की ओर अनुरोध किया कि लेवल प्लेइंग फील्ड के हित में:
(क) संशोधित पलस दरें (अथवा टेरिफ) फिक्स्ड नेटवर्क से सेलुलर मोबाइल तक कालों पर भी लागू होनी चाहिए ,
(ख) संशोधित पल्स दरें सेलुलर मोबाइल नेटवर्क द्वारा फिक्स्ड नेटवर्क केलिए अदा किए जाने वाले कैरिज प्रभार के परिकलन के संबंध में भी लागू की जानी चाहिए , (ग) संशोधित पल्स दरें , प्राइवेट बुनियादी सेवा प्रदाता द्वारा बी एस एन एल को इन्दा- सर्किल फिक्स्ड से फिक्स्ड नेटवर्क कालों के सबंध में अदा किए जाने वाले कैरिज प्रभार पर लागू की जानी चाहिए ।
3. प्राधिकरण ने उपरोक्त अनुरोध पर गहराई से विचार किया और यह सुनिश्चित किया है वर्णित कि " गैर -विभेदक" और " लेवल प्लेइंग फिल्ड" सुनिश्चित करने के वास्ते, और उपभोक्ताओं के हित में भी बी एस एन एल की संशोधित पल्स दरें , उपर मद 2 (क), 2(ख ), और 2 (ग ) में मामलों में इंटर - नेटवर्क कालों पर भी लागू होंगी । तथापि 2 (ख) , और 2 (ग ) द्वारा कवर किए गए मुद्दों का समाधान, टी आर ए आई अधिनियम 1997 की धार 13 के अंतर्गत एक ' निर्देश ' द्वारा किया गया है , यह आदेश उपर 2 (क) पर वर्णित परिदृश्य से संबंधित है । 4. यह सुनिश्चित करने के उद्देश्य से कि बी एस एन एल द्वारा प्रस्तावित निम्न टेरिफ का लाभ वास्तव में प्राइवेट बुनियादी सेवा आपरेटरों कके अभिदाताओं को प्रापत हो , उन आपरेटरों को अपने नेटवर्क से उदभूत होने वाली इन्टर- नेटवर्क कालों के संबंध में अपनी चार्जिंग व्यवस्था को संशोधित करने केलिए निर्देश दिया जा रहा है ताकि बी एस एन एल द्वारा प्रस्तावित टेरिफ परिवर्तन पूर्णतः परिलक्षित हो सके । अन्तर्निहित सिद्धान्त यह है किप्रयुक्त एक समान नेटवर्क तत्वों के संबंध में एक समान टेरिफ आरोपित किया जाना 4

[PART III- SEC . 4] चाहिए । इसलिए , उन सभी फिक्स्ड लैग के संबंध में वही टेरिफ आरोपित किया जाना चाहिए जो फिक्स्ड नेटवर्क पर एकसमान दूरी तय करती है, चाहे वे फिक्स्ड अथवा मोबाइल नेटवर्क पर समाप्त हों ।

No. 310-1 (5) /TRAI-2000.- In exercise of the powers conferred upon it under sub - section (2) of Section 11 of the Telecom Regulatory Authority of India Act , 1997 to notify , by an Order in the Official Gazette, tariffs at which Telecommunication Services within India and outside India shall be provided , the Telecom Regulatory Authority of India hereby makes the following Order .

Section I
Title, Extent and Commencement
1. Short title , extent and commencement :
i) This Order shall be called " Telecommunication Tariff (Eleventh Amendment) Order 2001 ".
ii) The Order shall come into force from the date of its Notification in the Official Gazette .

Section II
In Schedule- I (Basic Services other than ISDN) of the Telecommunication Tariff Order , 1999 under notes for the item 12( a) i.e. for ' STD long distance calls ' an additional item (5) shall be inserted as follows :
(5). "The pulse rate for a long distance PSTN call carried on the networks of two fixed operators will be the same as the pulse rate corresponding to the lowest tariff applicable for the same distance intra - network call . The pulse rate for the fixed leg of a call originating in the fixed network and terminating in mobile network shall be the same as pulse rate corresponding to the lowest tariff applied by the service provider , for intra- network calls for identical carriage from the originating SDCC to the SDCC in which the POI is located . "
Section III
This Order contains at Annex A, an Explanatory Memorandum to provide clarity and transparency to the tariffs specifed in this Order.

Annex A
EXPLANATORY MEMORANDUM
1. In a letter dated 29.12.2000 BSNL reported tariffs to the Authority seeking to reduce the STD call charge from 26th January , 2001 , by extending the duration of peak pulse rates for distance categories 50 to 200 kms compared to the TRAI standard tariff package for basic services . According to the letter , these revised pulse rates of BSNL, however, would apply only to "intra- circle calls originated by the telephone subscribers of BSNL , and terminating in the basic service network" .
2. The Authority has received representations from COAI and ABTO that sought the Authority's intervention to enlarge the scope of BSNL's proposal in respect of inter-network calls also. They sought the Authority's intervention and requested that in the interest of level playing field:
(a) the revised pulse rates (or tariffs ) should apply also to calls from fixed network to cellular mobile ;
(b) the revised pulse rates should also apply for calculating the carriage charge to be paid by cellular mobile network to the fixed network;
(c) the revised pulse rates should apply for the carriage charge paid by private basic service providers to BSNL on intra- circle fixed to fixed network calls.
3 The Authority has examined the above requests at length and has determined that to ensure ' non- discrimination ' and a ' level playing field ' , and also in the interest of consumers BSNL's revised pulse rates should also apply to the inter - network calls in cases detailed at items 2 (a), 2 (b) and 2 (c) above While the issues covered by 2(b) and 2(c) are addressed by a Direction under Section 13 of the TRAI Act 1997 , this Order relates to inter network call scenario described at 2(a) above.

4. In order to ensure that the benefit of the lower tariff offered by BSNL actually passes on to the subscribers of the private basic service operators , the latter is being directed to modify his charging regime in respect of inter - network calls originating on his network to fully reflect the tariff changes proposed by BSNL . The underlying principle is that the same tariff should be levied for same network elements used . As such, the same tariff should be applied for the fixed leg of an inter network call that traverse the same distance on the fixed network, irrespective of its termination in a fixed or a mobile network .
