सा.का.नि. 40(अ). औषधि और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए कतिपय नियमों का प्रारूप, औषधि और प्रसाधन सामग्री अधिनियम, 1940 ( 1940 का 23 ) की धारा 12 और धारा 33 की अपेक्षानुसार भारत के राजपत्र, असाधारण भाग II, खंड 3 , उपखंड ( 1 ) , तारीख 18 जुलाई, 2000 में पृष्ठ 2 और 3 पर भारत सरकार के स्वास्थ्य और परिवार कल्याण मंत्रालय ( स्वास्थ्य विभाग ) की अधिसूचना सं. सा.का नि. 619 (अ ) तारीख 18 जुलाई, 2000 के अधीन प्रकाशित किया गया था जिसमें उन व्यक्तियों से, उस तारीख से जिसको उक्त अधिसूचना से युक्त राजपत्र की प्रतियां जनता को उपलब्ध करा दी जाती हैं, 45 दिन की अवधि के अवसान से पूर्व आक्षेप और सुझाव मांगे गए थे जिनके उससे प्रभावित होने की संभावना थी ।
और उक्त राजपत्र की प्रतियां तारीख 19-7-2000 को जनता को उपलब्ध करा दी गई थी;
और उक्त प्रारूप नियमों पर जनता से प्राप्त आक्षेपों और सुझावों पर केन्द्रीय सरकार ने विचार कर लिया है;
अतः अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, औपधि तकनीकी मलाहकार बोर्ड से परामर्श करने के पश्चात् औषधि और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1 ( 1) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री ( द्वितीय संशोधन) नियम , 2001 है ।
(2) ये 1 जून, 2001 को प्रवृत्त होंगे ।
2. औपधि और प्रसाधन सामग्री नियम , 1945 की अनुसूची च में, -
( 1 ) भाग 12 ख में, -
" 1. रक्त बैंक/घटक " शीर्षक के अधीन,-

[ PART II- SEC 3 ( 1) ] (क ) " ज. रक्त दान के लिए मानदंड उपशीर्षक के अधीन शर्त ( 3 ) में, मद " च " के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्: -
" च. यकृतशोथ संक्रमण " ;
(ख ) " ट पूर्ण रक्त का परीक्षण " उप शीर्षक के अधीन, खंड ( 3 ) में " यकृतशोथ बी सतह प्रतिजन " शब्दों और अक्षर के स्थान पर " यकृतशोथ बी सरफेस एंटीजन और यकृतशोथ भी वायरस एंटीबाडी" शब्द और अक्षर रखे आएंगे ;
(ग ) " ठ अभिलेख " उप शीर्षक के अधीन, खंड ( 2 ) में " यकृतशोथ बी सतह प्रतिजन " शब्दों और अक्षर के स्थान पर " यकृतशोथ बी सरफेस एंटीजन और यकृतशोथ सी वायरस एंटीबाडी" शब्द और अक्षर रखे जाएंगे;
( घ) " ड़ लेबल " उप शीर्षक के अधीन, खंड ( 7 ) में " यकृतशोथ बी सतह प्रतिजन " शब्दों और अक्षर के स्थान पर " यकृतशोथ बी सरफेस एंटीजन और यकृतशोथ सी वायरस एंटीबाडी" शब्द और अक्षर रखे जाएंगे;
( ii ) " III किसी रक्त बैंक द्वारा संपूर्ण रक्त से रक्त संघटकों का संसाधन " शीर्षक के अधीन " ( ड ) परीक्षण सुविधाएं " उपशीर्षक के अधीन " यकृतशोथ बी सतह प्रतिजन " शब्दों और अक्षर के स्थान पर " यकृतशोथ की सरफेस एंटीजन और यकृतशोथ सी वायरस एंटीबाडी " शब्द और अक्षर रखे जाएंगे ।
(II ) भाग 12 ग में, " 1. रक्त उत्पादों के विनिर्माण के लिए अपेक्षाएं " शीर्षक के अधीन, -
(क) " अ. साधारण अपेक्षाएं " उप शीर्षक के अधीन खंड 2 के उपखंड ( ii ) में, " यकृतशोथ बी " शब्द और अक्षर के स्थान पर " यकृतशोथ बी सरफेस एंटीजन और यकृतशोथ सी वायरस एंटीबाडी " शब्द और अक्षर रखे जाएंगे;
(ख) " आ. प्रभाजन के लिए प्लाज्मा का संग्रहण और भंडारण " उप शीर्षक के अधीन खंड ( क) में उपखंड ( 2 ) और उपखंड ( 3 ) में, " यकृतशोथ बी उपदंश " शब्दों और अक्षर के स्थान पर जहाँ- जहाँ वे आते हैं, " यकृतशोथ बी और यकृतशोथ मी वायरस एंटीबाडी" शब्द और अक्षर रखे जाएंगे;
(ग ) " ड़. निवारण निष्क्रियता प्रक्रिया " उप शीर्षक के अधीन " यकृतशोथ बी प्रतिजन " शब्दों और अक्षर के स्थान पर " यकृतशोथ बी सरफेस एंटीजन और यकृतशोथ सी वायरस एंटीबाडी" शब्द और अक्षर रखे जाएंगे;
( घ ) " छ. रक्त उत्पादों का परीक्षण " उप शीर्षक के अधीन " यकृतशोथ बी पृष्ठीय प्रतिजन " शब्दों और अक्षरों के स्थान पर " यकृतशोथ बी सरफेस एंटीजन और यकृतशोथ सी वायरस एंटीबाडी " शब्द और अक्षर रखे जाएंगे;
( ड़) " झ. लेबल लगाना " उप शीर्षक में " यकृतशोथ बी प्रतिजन " शब्दों और अक्षर के स्थान पर " यकृतशोथ बी सरफेस एंटीजन और यकृतशोथ सी वायरस एंटीबाडी " शब्द और अक्षर रखे जाएंगे;

दीपक गुप्ता, संयुक्त सचिव पाद टिप्पण: मुख्य नियम अधिसूचना सं . एफ- 28-10/45 - एच ( 1 ) , दिनांक 21-12-1945 द्वारा राजपत्र में प्रकाशित किए गए थे और उनमें अंतिम बार सा.का.नि. 6 (अ ) , दिनांक4-1-2001 द्वारा संशोधन किया गया था । 1-5 ~ 1979 तक यथा संशोधित औषधि एवं प्रसाधन सामग्री नियम , 1945 , स्वास्थ्य एवं परिवार कल्याण मंत्रालय ( स्वास्थ्य विभाग ) के औषधि एवं प्रसाधन सामग्री अधिनियम, 1940 (पीडीजीएचएस -61 ) वाले प्रकाशन में अंतर्विष्ट है ।

NOTIFICATION
New Delhi , the 29th January, 2001
G.S.R. 40 (E) . Whereas a draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945 , was published as required by sections 12 and 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940 ) at page 2 and 3 in the Gazette of India, Extraordinary Part II , Section 3 , Sub section (1 ) , dated the 18th July, 2000 under the notification of the Government of India in the Ministry of Health and Family Welfare (Department of Health ) , No G.SR 619 (E ) dated the 18th July, 2000 inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of forty- five days from the date on which the copies of the Official Gazette containing the said notification werc made available to the public , भारत का राजपत्र असाधारण

And whereas copies of the said Gazette were made available to the public on 19-7-2000 .
And whereas objections and suggestions received from the public on the said draft rules have been considered by the Central Government ;
Now, therefore, in exercise of the powers conferred by Sections 12 and 33 of the said Act , the Central Government, after consultation with Drugs Technical Advisory Board, hereby makes the following rules further to amend the Drugs and Cosmetics Rules , 1945, namely:--
1 ( 1 ) These rules may be called the Drugs and Cosmetics ( Second Amendment) Rules , 2001.
(2) They shall come into force on the 1st June, 2001 .
2. in the Drugs and Cosmetics Rules , 1945 , in Schedule F.-
(1) In Part XII В , -
(1) under the heading " I BLOOD BANKS /BLOOD COMPONENTS " ,-
(a) under sub - heading " H. CRITERIA FOR BLOOD DONATION " , in condition (3 ) , for the item f, the following shall be substituted, namely.-
" f. Hepatitis infection" ;
(b ) under sub -heading " K. TESTING OF WHOLE BLOOD " , in clause (3 ) , for the words and letter "Hepatitis B surface antigen" , the words and letters " Hepatitis B surface antigen and Hepatitis C Virus antibody " shall be substituted;
(c) under sub - heading " L. RECORDS " , clause (2) , for the words and letter " Hepatitis B surface antigen " , the words and letters " Hepatitis B surface antigen and Hepatitis C Virus autibody " shall be substituted,
(d) under sub - heading "M LABELS " , in clause ( 7) , for the words and letter "Hepatitis B surface antigen" , the words and letters " Hepatitis B surface antigen and Hepatitis C Virus antibody" shall be substituted;
(11) under the heading " III . PROCESSING OF BLOOD COMPONENTS FROM WHOLE BLOOD BY A BLOOD BANK " , under sub -heading " D. TESTING FACILITIES " , for the words and letter "Hepatitis B surface antigen " , the words and letters "Hepatitis B surfacc antigen and Hepatitis C Virus antibody " shall be substituted;
(II ) in Part XII C , under the heading " I. REQUIREMENTS FOR MANUFACTURE OF BLOOD PRODUCTS ",-
(a) under sub - heading " A. GENERAL REQUIREMENTS " , in clause 2, in sub -clause ( ii ) , for the word and letter "Hepatitis B " , the words and letters " Hepatitis B surface antigen and Hepatitis C Virus antibody " shall be substituted;
(b) under sub - heading " B. COLLECTION AND STORAGE OF PLASMA FOR FRACTIONATION " , in clause ( a) , of sub -clause (2 ) and in sub -clause (3 ) , for the letters "HBsAg " , where they occur , the words and letters "Hepatitis B and Hepatitis C Virus antibody " shall be substituted;
(c) under sub -heading " E. VIRAL INACTIVATION PROCESS " , for the words and letter "Hepatitis B surface antigens " , the words and letters " Hepatitis B surface antigens and Hepatitis C Virus antibody" shall be substituted;
(d) under sub -heading " G. TESTING OF BLOOD PRODUCTS " , for the words and letter " Hepatitis B surface antigen " , the words and letters " Hepatitis B surface antigen and Hepatitis C Virus antibody" shall be substituted;
(e) under sub -heading " I. LABELLING " , for the words and letter "Hepatitis B surface antigen " , the words and letters "Hepatitis B surface antigen and Hepatitis C Virus antibody " shall be substituted;

Foot Note : The Principal Rules were published in the Official Gazette vide notification No. F.28-10/45 - H ( 1 ) dated 21-12-1945 and last amended vide GSR . 6 (E) dated 4-1-2001. The Drugs and Cosmetics Rules, 1945 as amended upto 1-5-1979 is contained in the publication of the Ministry of Health and Family Welfare (Department of Health) containing the Drugs and Cosmetics Act, 1940 (PDGHS -61 ) .
