सा.का.नि. 41 (अ) .- औषधि और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए कतिपय नियमों का प्रारूप, जिसे केन्द्रीय सरकार औषधि और प्रसाधन सामग्री अधिनियम, 1940 ( 1940 का 23 ) की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, औषधि तकनीकी सलाहकार बोर्ड से परामर्श करने के पश्चात् बनाना चाहती है , उक्त धाराओं की अपेक्षानुसार ऐसे सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है , प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर, उस तारीख से जिसकों भारत के उस राजपत्र की प्रतियां, जिसमें यह अधिसूचना प्रकाशित की जाती है, जनता को उपलब्ध करा दी जाती है, पैंतालीस दिन की समाप्ति के पश्चात् विचार किया जाएगा;
आक्षेप या सुझाष, सचिव, स्वास्थ्य और परिवार कल्याण मंत्रालय, भारत सरकार, निर्माण भवन, नई दिल्ली -110011 को भेजे जा सकते हैं;
किसी ऐसे आक्षेपों या सुझावों पर जो उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से ऊपर विनिर्दिष्ट अवधि की समाप्ति से पूर्व प्राप्त हों, केन्द्रीय सरकार विचार करेगी ।
प्रारूप नियम
1. ( 1 ) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री ( संशोधन ) नियम , 2001 है ।
( 11) ये राजपत्र में उनके अन्तिम प्रकाशन की तारीख को प्रवृत्त होंगे ।

[PART II- SEC . 3 ( i ) ] 2. औषधि और प्रसाधन सामग्री नियम , 1945 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 59 में,- (
1) उर्पानयम ( 2 ) में , " यथास्थिति " शब्द से प्रारम्भ होने वाले और " फीस होगी " शब्दों पर समाप्त होने वाले भाग के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: -
" यथास्थिति, दो हज़ार पांच सौ रुपए की फीस और पांच सौ रुपए की निरीक्षण फीस के साथ प्ररूप 19 में या एक हजार रुपए कीफीस और दो सौ पचास रुपए की निरीक्षण फीस के साथ प्ररूप 19 - क में अथवा अनुसूची भ में सम्मिलित औषधियों की दशा में पांच सौ रुपए की फीस के साथ प्ररूप 19 - ग में अनुज्ञापन प्राधिकारी को किया जाएगाः " ;
(ii ) उपनियम ( 3 ) में, " छह रुपए " शब्दों के स्थान पर " दो सौ पचास रुपए " शब्द रखे जाएंगे ;

111) उपनियम (4 ) में, " तो उसके साथ " से प्रारम्भ होने वाले और " फीस होगी " शब्दों पर समाप्त होने वाले भाग के स्थान पर निम्नलिखित शब्द, अंक और अक्षर रखे जाएंगे , अर्थात्:-
" तो उसके साथ प्ररूप 19 सहित दो हज़ार पांच सौ रुपए की फीस तथा पांच सौ रुपए की निरीक्षण फीस और प्रत्येक मास तथा उसके भाग के लिए पांच सौ रुपए की दर से अतिरिक्त फीस, प्ररूप 19 - क सहित एक हज़ार रुपए और दो सौ पचास रुपए की निरीक्षण फीस और प्रत्येक मास या उसके भाग के लिए दो सौ पचास रुपए की दर से अतिरिक्त फीस और प्ररूप 19 -ग सहित पांच सौ रुपए और प्रत्येक मास या उसके भाग के लिए दो सौ पचास रुपए की दर से अत्तिरिक्त फीस होगी : " । 3. उक्त नियमों के नियम 62 - ग में,
( 1 ) उपनियम ( 1 ) में ,
(क) " बीस रुपए फीस होगी " शब्दों के स्थान पर " एक हजार रुपए की अनुज्ञप्ति फीस और दो सौ पचास रुपए की निरीक्षण फीस होगी " शब्द रखे जाएंगे;
( ख ) परन्तुक में, " बीस रुपए तथा प्रत्येक मास या उसके भाग के लिए बीस रुपये की दर से अतिरिक्त फीस होगी " शब्दों के स्थान पर, " एक हज़ार रुपए तथा दो सौ पचास रुपए की निरीक्षण फीस और प्रत्येक मास या उसके भाग के लिए दो सौ पचास रुपए की दर से अतिरिक्त फीस होगी " शब्द रखे जाएंगे;
(11 ) उपनियम ( 2 ) में, " पांच रुपए " शब्दों के स्थान पर " दो सौ पचास रुपए " शब्द रखे जाएंगे ।
4. उक्त नियमों के नियम 63 में, " उस वर्ष के, जिसमें वह दी गई या नवीकृत की गई हो, आगामी वर्ष के 31 दिसम्बर तक विधिमान्य होगी : " शब्दों और अंकों तथा अक्षरों के स्थान पर, " उस तारीख से जिसको वह दी गई या नवीकृत की गई हो, पांच वर्ष की अवधि के लिए विधिमान्य होगी : " शब्द रखे जाएंगे ।
5. उक्त नियमों के नियम 65 में, शर्त ( 15 ) में, उप - शर्त ( ग ) के पश्चात् और स्पष्टीकरण से पूर्व निम्नलिखित शर्तें अन्तः स्थापित की जाएंगी, अर्थात्:-
" ( ग ) अनुज्ञप्तिधारी यह सुनिश्चित करेगा कि फुटकर दुकान या परिसरों का भारसाधक रजिस्ट्रीकृत भेषजज्ञ अपने कर्त्तव्यों का निर्वहन करते समय " सफेद एप्रान " ( लैब कोट ) पहनता है । "
उक्त नियमों के नियम 67 - क में, 6
(1 ) उपनियम ( 2 ) में,
( क ) " दस रुपए फीस " शब्दों के स्थान पर, " दो सौ पचास रुपए की फीस " शब्द रखे जाएंगे ;
(ख ) परन्तुक में, " दस रुपए तथा प्रत्येक मास या उसके भाग के लिए आठ रुपए की दर से अतिरिक्त फीस होगी " शब्दों के स्थान पर " दो सौ पचास रुपए तथा प्रत्येक मास तथा उसके भाग के लिए पचास रुपए की दर से अतिरिक्त फीस होगी " शब्द रखे जाएंगे;
(11 ) उपनियम (3 ) में, " एक रुपये पच्चीस पैसे फीस " शब्दों के स्थान पर " पच्चास रुपए की फीस " शब्द रखे जाएंगे । 7. उक्त नियमों के नियम 67 -ङ में , " उस वर्ष के, जिसमें वह दी गई है या उसका मवीकरण किया गया है, आगामी वर्ष के 31 दिसम्बर तक विधिमान्य रहेगी : " शब्दों के स्थान पर " उस तारीख से जिसको वह दी गई है या उसका नवीकरण किया गया है, पांच वर्ष की अवधि के लिए विधिमान्य रहेगी " शब्द रखे जाएंगे । 3

8. उक्त नियमों के नियम 69 में,
(1) उपनियम ( 2 ) में, खण्ड ( क ) , खण्ड ( ख) और खण्ड ( ग ) के स्थान पर निम्नलिखित खण्ड क्रमशः रखे जाएंगे , अर्थात्: - " ( क) प्ररूप 24 ख में प्रत्येक आवेदन अनुसूची ड में प्रवर्गीकृत औषधियों के प्रत्येक नाम के लिए दस मदों तक होगा और उसके साथ पांच सौ रुपए की अनुज्ञप्ति फीस तथा प्ररुप निरीक्षण के लिए और प्रत्येक पश्चात्वर्ती निरीक्षण या अनुज्ञप्ति के नवीकरण के प्रयोजन के लिए दो सौ रुपए की निरीक्षण फीस होगी ।
(ख) प्ररुप 24च में प्रत्येक आवेदन अनुसूची ड में प्रवर्गीकृत औषधियों के प्रत्येक नाम के लिए दस मदों तक होगा और उसके साथ छह हज़ार रुपए की अनुज्ञप्ति फीस और प्रथम निरीक्षण तथा प्रत्येक पश्वात्वर्ती निरीक्षण या अनुज्ञप्ति के नवीकरण के प्रयोजन के लिए एक हजार पांच सौ रुपए की निरीक्षण फीस होगी ।
(ग) प्ररुप 24 में प्रत्येक आवेदन अनुसूची ड और अनुसूची ड-3 में प्रवर्गीकृत औषधियों के प्रत्येक नाम के लिए दस मदों तक होगा और उसके साथ छह हजार रुपए की अनुज्ञप्ति फीस तथा प्रथम निरीक्षण और प्रत्येक पश्चात्वर्ती निरीक्षण या अनुज्ञप्ति के नषीकरण के प्रयोजन के लिए एक हजार पांच सौ रुपए की निरीक्षण फीस होगी । "
( 11 ) उपनियम ( 3 ) में , खण्ड ( 1 ) , खण्ड ( ii ) और खण्ड ( 111 ) के स्थान पर निम्नलिखित खण्ड रखे जाएंगे , अर्थात्: - " (1 ) प्ररुप 24- ख की दशा में, पांच सौ रुपए की अनुज्ञप्ति फीस तथा दो सौ रुपए की निरीक्षण फीस के अतिरिक्त प्रत्येक मास या उसके भाग के लिए दौ सौ पचास रुपए की दर से अतिरिक्त फीस;
(11) प्ररुप 24- च की दशा में, छह हज़ार रुपए की अनुज्ञप्ति फीस तथा एक हजार रुपए की निरीक्षण फीस के अतिरिक्त प्रत्येक मास या उसके भाग के लिए, एक हजार रुपए की दर से अतिरिक्त फीस ;
(111) प्ररुप 24 की दशा में, छह हजार रुपए की अनुज्ञप्ति फीस तथा एक हजार पांच सौ रुपए की निरीक्षण फीस के अतिरिक्त प्रत्येक मास या उसके भाग के लिए एक हज़ार रुपए की दर से अतिरिक्त फीस । " ।
(111) उपनियम (4 ) में, " क्रमशः पन्द्रह , दो सौ या पैंसठ रुपए फीस का संदाय किया जाएगा " शब्दों के स्थान पर, " एक हज़ार रुपए कीफीस का संदाय किया जाएगा " शब्द रखे जाएंगे;
(iv ) उपनियम ( 5 ) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्:---
" ( 5 ) अनुज्ञप्तिधारियों द्वारा औषधियों की अतिरिक्त मदों के विनिर्माण के लिए आवेदन, पुनः पैकिग के लिए और अनुसूची ग और अनुसूची ग ( 1 ) में विनिर्दिष्ट औषधियों से भिन्न औषधियों के विक्रय और वितरण के लिए विनिर्माण की अनुज्ञप्ति के मामले में, अनुज्ञापन प्राधिकारी को किए जाएंगे । ऐसे आवेदनों के साथ , यदि आवेदित औषधियों की अतिरिक्त मदें ऐसे प्रवर्गों की हैं जो अनुज्ञप्ति में पहले से ही सम्मिलित नहीं हैं तो पुनः पैकिंग के लिए औषधि की प्रत्येक अतिरिक्त मद के लिए एक सौ रुपए की दर से और अनुसूची ड तथा अनुसूची ड-3 में प्रवर्गीकृत औषधियों के प्रत्येक नाम के लिए प्रत्येक अतिरिक्त मद के लिए तीन सौ रुपए की अतिरिक्त फीस होगी । " ।
9 उक्त नियमों के नियम 69 - क में,
(1 ) उपनियम ( 1 ) के स्थान पर निम्नलिखित उपनियम रखा जाएगा , अर्थात्:-
" (1 ) अनुसूची ग, ग (1 ) और भ में विनिर्दिष्ट ओषधियो से भिन्न आषधिया क विक्रय के लिए या वितरण के लिए विनिर्माण करने की उधार अनुज्ञप्तियां दिए जाने या उनके नवीकरण के लिए आवेदन अनुसूची ड और अनुसूची 5-3 मे प्रवर्गीकृत ओषधियो के प्रत्येक नाम क लिए दस मदो तक अनुज्ञापन प्राधिकारी का प्ररूप 24 में किया जाएगा और उसक साथ छह हजार रुपए की अनुज्ञाप्ते फीस तथा एक हजार पाच सौ रुपए की निरीक्षण फीस हागी :
परंतु यदि आवेदक अनुज्ञप्ति के नवीकरण के लिए आवेदन उसक अवसान के पश्चात किन्तु ऐसे अवसान से छह मास के भीतर करता है तो ऐसी अनुज्ञप्ति के नवीकरण क लिए सदय फीस के साथ छह हजार रुपए की अनुज्ञप्ति फीस और एक हजार पांच सौ रुपए की निरीक्षण फीस तथा प्रत्येक मास या उसका भाग के लिए एक हजार रुपए की दर से अतिरिक्त फीस होगी । ", (ii) उपनियम (3) के स्थान पर निम्नलिखित उपनियम रखा जाएगा, अर्थात् :-
" (3) उपनियम (2) क उपबंधों के अधीन रहते हुए, किसी उधार अनुज्ञप्ति पर प्रत्यक प्रवर्ग की ओषधि के लिए दस मदो से अधिक के विनिर्माण के लिए आवेदन क साथ अनुसूची ड और अनुसूची ड-3 में विनिर्दिष्ट प्रति अतिरिक्त मद के लिए तीन सौ रुपए की अतिरिक्त फीस हागी । THE GAZETTE OF INDIA EXTRAORDINARY
[ PART II- SEC . 3 ( i) ] (iii) उपनियम (4) में, " तीस रुपए फीस" शब्दो के स्थान पर " एक हजार रुपए की फीस" शब्द रखे जाएंगे ।
10. उक्त नियमो के नियम 72 मे, " उस वर्ष के जिसमे वह दी गई है या उसका नवीकरण किया गया है , आगामी वर्ष के 31 दिसम्बर तक विधिमान्य होगीः " शब्दो के स्थान पर " उस तारीख से जिसको वह दी गई है या उसका नवीकरण किया गया है , पांच वर्ष की अवधि के लिए विधिमान्य होगी" शब्द रखे जाएंगे । 11. उक्त नियमो के नियम 73- कक मे, " उस वर्ष के जिसमे वह दी गई है या उसका नवीकरण किया गया है आगामी वर्ष के 31 दिसम्बर तक विधिमान्य होगी" शब्दो और अंको के स्थान पर " उस तारीख से जिसको वह दी गई है या उसका नवीकरण किया गया है, पांच वर्ष की अवधि के लिए विधिमान्य होगी." शब्द रखे जाएंगे
12. उक्त नियमो के नियम 75 मे, -
उपनियम (1 ) में, -
(i)
(क) " उसके साथ छह सौ रुपए फीस तथा प्रथम निरीक्षण के लिए चार सौ रुपए निरीक्षण फीस या अनुज्ञप्तियो के नवीकरण के लिए निरीक्षण के मामले में, दो सौ रुपए निरीक्षण फीस होगी. " शब्दो के स्थान पर , "अनुसूची उ और अनुसूची 3-3 में प्रवर्गीकृत ओषधियो के प्रत्येक नाम के लिए दस मदो तक किया जाएगा और उसके साथ छह हजार रुपए की अनुज्ञप्ति फीस तथा एक हजार रुपए की निरीक्षण फीस और प्रथम निरीक्षण के लिए या प्रत्येक पश्वात्वर्ती निरीक्षण के लिए अथवा अनुङ्क्षप्तियो के नवीकरण के प्रयोजनो के लिए एक हजार पांच सौ रुपए की निरीक्षण फास हागी" शब्द रखे जाएंगे;
(ख) परन्तुक मे. " छह सौ रुपए तथा निरीक्षण फीस के अतिरिक्त प्रति मास या उसके भाग के लिए तीन सौ रुपए की दर से अतिरिक्त फीस होगी " शब्दो के स्थान पर " छह हजार रुपए तथा एक हजार पांच सौ रुपए की निरीक्षण फीस के अतिरिक्त प्रतिमास या उसके भाग के लिए एक हजार रुपए की अतिरिक्त फीस होगी " शब्द रखे जाएंगे ।
(ii) उपनियम (2) मे-
(क) " उसके साथ बारह सौ रुपए फीस तथा प्रथम निरीक्षण के लिए चार सौ रुपए निरीक्षण फीस या दूसरे या प्रत्येक पश्चात्वर्ती या अनुज्ञप्ति के नवीकरण के प्रयोजन के लिए निरीक्षण की दशा में दो सौ रुपए फीस होगी, " शब्दो के स्थान पर " अनुसूची ड और अनुसूची ङ-3 मे प्रवर्गीकृत आंषधियो के प्रत्येक नाम के लिए दस मदो तक किया जाएगा और उसके साथ छह हजार रुपए की अनुज्ञप्ति फीस और प्रथम निरीक्षण के लिए या प्रत्येक पश्चात्वर्ती निरीक्षण के लिए अथवा अनुज्ञप्तियो के नवीकरण के प्रयोजनो के लिए एक हजार पांच सौ रुपए की निरीक्षण फीस होगी " शब्द रखे जाएगे;
(ख) दूसरे परन्तुक मे, " बारह सौ रुपए तथा निरीक्षण फीस के अतिरिक्त प्रति मास या उसके भाग के लिए छह सौ रुपए अतिरिक्त फीस होगी, " शब्दो के स्थान पर "छह हजार रुपए तथा एक हजार पांच सौ रुपए की निरीक्षण फीस के अतिरिक्त प्रति मास या उसके भाग के लिए एक हजार रुपए की अतिरिक्त फीस होगी " शब्द रखे जाएंगे ;
(iii) उपनियम (3 ) मे-
(क) " उसके साथ छह सौ रुपए अनुज्ञप्ति फीस तथा प्रथम निरीक्षण के लिए चार सौ रुपए निरीक्षण फीस या दूसरे या प्रत्येक पश्चात्वर्ती निरीक्षण की दशा में या अनुज्ञप्ति के नवीकरण के प्रयोजन के लिए दो सौ रुपए निरीक्षण फीस होगी " शब्दो के स्थान पर " अनुसूची ड में प्रवर्गीकृत ओषधियो कं प्रत्येक नाम के लिए दस मदो तक किया जाएगा और उसके साथ छह हजार रुपए की अनुज्ञप्ति फीस तथा प्रथम निरीक्षण के लिए और प्रत्येक पश्चात्वर्ती निरीक्षण के लिए या अनुज्ञप्तियो के नवीकरण के प्रयोजनों के लिए एक हजार पांच सौ रुपए की निरीक्षण फीस होगी" शब्द रखे जाएंगे;

(ख) परन्तुक में " छह सौ रुपए तथा निरीक्षण फीस के अतिरिक्त प्रति मास या उसके भाग के लिए तीन सौ रुपए अतिरिक्त फीस होगी, " शब्दो के स्थान पर निम्नलिखित शब्द रखे जाएंगे, अर्थात्: - " छह हजार रुपए तथा एक हजार पांच सौ रुपए की निरीक्षण फीस के अतिरिक्त प्रतिमास या उसके भाग के लिए एक हजार रुपए की अतिरिक्ति फीस होगी," ;
(iv) उपनियम (4) और उपनियम (5) के स्थान पर निम्नलिखित उपनियम क्रमशः रखे जाएंगे, अर्थात्:-
" (4) यथास्थिति, उपनियम (1 ) , उपनियम (2) या उपनियम ( 3) के अधीन जारी की गई मूल अनुज्ञप्ति विरुपित, क्षतिग्रस्त हो जाने या खो जाने की दशा में उसकी दूसरी प्रति प्राप्त करने के लिए एक हजार रुपए की फीस संदत्त की जाएगी ।"
(5) यदि अनुज्ञप्तिधारी ओषधियो के प्रत्येक वर्ग के दस मदों से अधिक के विनिर्माण के लिए आवेदन करता है तो आवेदन के साथ अनुसूची ड और अनुसूची ङ-३ मे प्रवर्गीकृत ओषधियो की प्रत्येक अतिरिक्त मद के लिए तीन सौ रुपए की दर से अतिरिक्त फीस होगी ।"
13. उक्त नियमो के नियम 75-क मे, -
(i) उप नियम (1 )मे.-
(क) " उनके साथ छह सौ रुपए फीस होगी " शब्दो के स्थान पर " अनुसूची ड और अनुसूची ङ-3 मे प्रवर्गीकृत ओषधियो के प्रत्येक नाम के लिए दस मदो तक किया जाएगा औरउसके साथ छह हजार रुपए की अनुज्ञप्ति फीस और प्रथम निरीक्षण के लिए या प्रत्येक पश्चात्वर्ती निरीक्षण के लिए अथवा अनुज्ञप्ति के नवीकरण के प्रयोजनो के लिए एक हजार पांच सौ रुपए की निरीक्षण फीस होगी, " शब्द रखे जाएंगे;
(ख) परन्तुक में " छह सौ रुपए तथा प्रत्येक मास या उसके भाग के लिए तीन सौ रुपए की दर से अतिरिक्त फीस होगी" शब्दो के स्थान पर निम्नलिख्त शब्द रखे जाएंगे, अर्थात् :-
"छह हजार रुपए और एक हजार पांच सौ रुपए की निरीक्षण फीस तथा प्रत्येक मास या उसके भाग के लिए एक हजार रुपए की दर से अतिरिक्त फीस होगी" ;
(ii) उप नियम (3)और (4) के स्थान पर निम्नलिखित उपनियम क्रमशः रखे जाएंगे, अर्थात् : - "(3) उपनियम (2) के उपबंधो के अधीन रहते हुए उधार अनुज्ञप्ति पर ओषधियो के प्रत्येक वर्ग की दस मदो से अधिक के विनिर्माण के लिए आवेदन के साथ ओषधियों की प्रत्येक अतिरिक्त मद के लिए तीन सौ रुपए की दर से अतिरिक्त फीस होगी ।"
(4) यदि अनुज्ञापन प्राधिकारी का यह समाधान हो जाता है कि कोई उधार अनुज्ञप्ति विरुपित , क्षतिग्रस्त हो जाती है या खो जाती है तो वह एक हजार रुपए की फीस का सदाय किए जाने पर उधार अनुप्ति की दूसरी प्रति जारी कर सकेगा। " 6

[PART II- SEC . 3 (1) ] 14. उक्त नियमों के नियम 77 में , " उस वर्ष के जिसमें वह दी गई है या उसका नवीकरण किया गया है, आगामी वर्ष के 31 दिसम्बर तक विधिमान्य होगी" शब्दों, अंकों और अक्षरों के स्थान पर " उस तारीख से जिसको वह दी गई है या उसका नवीकरण किया गया है, पांच वर्ष की अवधि के लिए विधिमान्य होगी " शब्द रखे जाएंगे ।
15. उक्त नियमों के नियम 82 में, " पचास रूपए " शब्दों के स्थान पर " दो सौ पचास रूपए " शब्द रखे जाएंगे । 16. उक्त नियमों के नियम 83 कक में, " उस वर्ष के जिसमें वह दी गई है या उसका नवीकरण किया गया है, आगामी वर्ष के 31 दिसम्बर तक विधिमान्य होगी " शब्दों के स्थान पर, " उस तारीख से जिसको वह दी गई है या उसका नवीकरण किया गया है, पांच वर्ष की अवधि के लिए विधिमान्य होगी" शब्द रखे जाएंगे ।
17. उक्त नियमो के नियम 85ख में, -
(क) उपनियम (1 ) में, " होमियोपैथिक ओषधियों " शब्दों से आरंभ होने वाले और " प्ररूप 24ग में किया जाएगा " पर समाप्त होने वाले भाग के स्थान पर निम्नलिखित शब्द, अक्षर और अंक रखे जाएंगे, अर्थात् : -
" अनुसूची ड-1 में विनिर्दिष्ट होमियोपैथिक ओषधियों के प्रत्येक वर्ग के लिए दस मदों तक के विक्रश्च के लिए विनिर्माण की अनुज्ञप्तियां दिए जाने या उनके नवीकरण के लिए आवेदन राज्य सरकार द्वारा इस भाग के प्रयोजन के लिए नियुक्त अनुज्ञापन प्राधिकारी को (जिसे इस भाग में इसके पश्चात् अनुज्ञापन प्राधिकारी कहा गया है) प्ररूप 24 ग में किया जाएगा । " । (ख) उपनियम (2) में, -
(i) खंड (क) में , " अस्सी रूपए " , "बीस रूपए " और "दस रूपए" शब्दों के स्थान पर, क्रमशः "दो सौ रूपए " , "सौ रूपए" तथा " पचास रूपए" शब्द रखे जाएंगे ;
(ii) खंड (ख) में, "चालीस रूपए " , "दस रूपए " और "पांच रूपए " शब्दों के स्थान पर, क्रमशः "दो सौ रूपए " , "सौ रूपए" तथा "पचास रूपए" शब्द रखे जाएंगे ;
(iii
) खंड (ग ) में, "चालीस रूपए ", "दस रूपए" और "पांच रूपए " शब्दों के स्थान पर, क्रमशः "दो सौ रूपए ", " सौ रूपए " तथा "पचास रूपए " शब्द रखे जाएंगे ;
(ग) उपनियम (3) में, -
(i) खंड (क) में, रूपए" तथा "अस्सी रूपए " , "तीस रूपए " और "दस रूपए " शब्दों के स्थान पर, क्रमशः "दो सौ रूपए " , "सौ " पचास रूपए" शब्द रखे जाएंगे ;
(ii
) खंड ( ख) में, " चालीस रूपए " , "तीस रूपए" और " पांच रूपए " शब्दों के स्थान पर, क्रमशः "दो सौ रूपए ", "सौ रूपए" तथा " पचास रूपए " शब्द रखे जाएंगे ;
( iii) खंड (ग) में, "चालीस रूपए ", "पंद्रह रूपए " और "पांच रूपए " शब्दों के स्थान पर, क्रमशः "दो सौ रूपए" , "सौ रूपए " तथा " पचास रूपए " शब्द रखे जाएंगे ;
(घ) उपनियम (4) में, "पंद्रह रूपए" और "दस रूपए " शब्दों के स्थान पर "पचास रूपए " शब्द रखे जाएंगे ;
(ङ) उपनियम (5) में, "पांच रूपए " शब्दों के स्थान पर "पचास रूपए " शब्द रखे जाएंगे ।
18. उक्तनियमों के नियम 85ङघ में "पचास रूपए " शब्दों के स्थान पर "दो सौ पचास रूपए " शब्द रखे जाएंगे । 19. उक्त नियमों के नियम 85च में , " उस वर्ष के जिसमें वह दी गई है या उसका नवीकरण किया गया है, आगामी वर्ष के 31 दिसम्बर तक विधिमान्य रहेगी " शब्दों के स्थान पर, " उस तारीख से जिसको वह दी गई है या उसका नवीकरण किया गया है, पांच वर्ष की अवधि के लिए विधिमान्य रहेगी " शब्द रखे जाएंगे ।
20 . उक्त नियमो के नियम 90 के उपनियम (2) में "पंद्रह रूपए फीस" शब्दों के स्थान पर "दो सौ पचास रूपए की फीस " शब्द रखे जाएंगे । भारत का राजपत्र असाधारण

21. उक्त नियमों के नियम 122च में,
(i) उपनियम (1) में, -
(क) "छह सौ रूपए की अनुज्ञप्ति फीस और प्रथम निरीक्षण के लिए चार सौ रूपए की निरीक्षण फीस या दूसरे या प्रत्येक पश्चातवर्ती निरीक्षण की दशा में अथवा अनुज्ञप्ति के नवीकरण के प्रयोजनों के लिए दो सौ रूपए की निरीक्षण फीस होगी" शब्दों के स्थान पर "छह हजार रूपए की अनुज्ञप्ति फीस और प्रथम निरीक्षण या उसके प्रत्येक पश्चातवर्ती निरीक्षण के लिए अथवा अनुज्ञप्ति के नवीकरण के प्रयोजनों के लिए एक हजार पांच सौ रूपए की निरीक्षण फीस होगी " शब्द रखे जाएंगे ;
(ख) परंतुक में "छह सौ रूपए तथा निरीक्षण फीस के अतिरिक्त प्रत्येक मास या उसके भाग के लिए तीन सौ रूपए की दर से अतिरिक्त फीस होगी " शब्दों के स्थान पर "छह हजार रूपए और एक हजार पांच सौ रूपए की निरीक्षण फीस तथा निरीक्षण फीस के अतिरिक्त प्रत्येक मास या उसके भाग के लिए एक हजार रूपए की दर से अतिरिक्त फीस होगी " शब्द रखे जाएंगे ;
ii) उपनियम (2) में, "सौ रूपए " शब्दों के स्थान पर "पांच सौ रूपए " शब्द रखे जाएंगे ;
(
(iii) उपनियम (3 ) में, "पचास रूपए " शब्दों के स्थान पर "एक सौ रूपए " शब्द रखे जाएंगे ।
22. उक्त नियमों के नियम 122 ज में, " उस वर्ष के जिसमें वह दी गई है या उसका नवीकरण किया गया है, आगामी वर्ष के 31 दिसम्बर तक विधिमान्य रहेगी " शब्दों, अंकों और अक्षरों के स्थान पर, " उस तारीख से जिसको वह दी गई है या उसका नवीकरण किया गया है, पांच वर्ष की अवधि के लिए विधिमान्य रहेगी" शब्द रखे जाएंगे ।
23. उक्त नियमों के नियम 122 ट में "पचास रूपए " शब्दों के स्थान पर "दो सौ पचास रूपए " शब्द रखे जाएंगे । 24. उक्त नियमों के नियम 138 में,-
(i) उपनियम (1 ) में, "प्रसाधन सामग्रियों " शब्दों से आरंभ होने वाले और "निरीक्षण फीस होगी " शब्दों पर समाप्त होने वाले भाग के स्थान पर निम्नलिखित रखा जाएगा, अर्थात् : -
" अनुसूची ड-2 में प्रवर्गीकृत प्रसाधन सामग्रियों के प्रत्येक नाम के दस मदों तक के विक्रय के लिए विनिर्माण की अनुज्ञप्ति दिए जाने या उसके नवीकरण के लिए आवेदन इस भाग के प्रयोजन के लिए राज्य सरकार द्वारा अनुज्ञापन प्राधिकारी को (जिसे इस भाग में इसके पश्चात् अनुज्ञापन प्राधिकारी कहा गया है) प्ररूप 31 में किया जाएगा और उसके साथ दो हजार पांच सौ रूपए की अनुज्ञप्ति फीस और प्रथम निरीक्षण के लिए या प्रत्येक पश्चातवर्ती निरीक्षण के लिए अथवा अनुज्ञप्ति के नवीकरण के प्रयोजनों के लिए एक हजार रूपए की निरीक्षण फीस होगी" ।
(ii) उपनियम (2) में, " चार सौ रूपए तथा प्रत्येक मास या उसके भाग के लिए एक सौ रूपए की दर से अतिरिक्त फीस और पचास रूपए निरीक्षण फीस होगी " शब्दों के स्थान पर " दो हजार पांच सौ रूपए तथा एक हजार रूपए की निरीक्षण फीस के अतिरिक्त प्रत्येक मास या उसके भाग के लिए चार सौ रूपए की दर से अतिरिक्त फीस होगी " शब्द रखे जाएंगे ;
(iii) उपनियम (3 ) में, "प्रत्येक मद के लिए पांच रूपए फीस होगी " शब्दों के स्थान पर " प्रत्येक उत्पाद के लिए, प्रत्येक आवेदन के लिए अधिकतम तीन हजार रूपए के अधीन रहते हुए, एक सौ रूपए की फीस होगी " शब्द रखे जाएंगे ;
iv) उपनियम (4) में, " पचास रूपए " शब्दों के स्थान पर " दो सौ पचास रूपए " शब्द रखे जाएंगे ।

25. उक्त नियमों के नियम 138 क में, -
(i ) उपनियम (1 ) में, "प्रसाधन सामग्रियों" शब्दों से आरंभ होने वाले और "फीस होगी " शब्दों पर समाप्त होने वाले भाग के स्थान पर निम्नलिखित रखा जाएगा, अर्थात् : -
"अनुसूची ङ-2 में प्रवर्गीकृत प्रसाधन सामग्रियों के प्रत्येक नाम के दस मदों तक के विक्रय के लिए विनिर्माण करने की उधार अनुज्ञप्ति दिए जाने या उसके नवीकरण के लिए आवेदन अनुज्ञापन प्राधिकारी को प्ररूप 31 में किया जाएगा और उसके 8

(PART II-SEC . 3 (i ) ] साथ दो हजार पांच सौ रूपए की अनुज्ञप्ति फीस और प्रथम निरीक्षण के लिए या प्रत्येक पश्चातवर्ती निरीक्षण के लिए एक हजार रूपए की निरीक्षण फीस होगी" ।
(ii) उपनियम (2) में, होगी" शब्दों के स्थान पर "दो सौ रूपए तथा प्रत्येक मास या उसके भाग के लिए पचहत्तर रूपए की दर से अतिरिक्त फीस "दो हजार पांच सौ रूपए तथा प्रत्येक मास या उसके भाग के लिए चार सौ रूपए की दर से अतिरिक्त फीस होगी " शब्द रखे जाएंगे ;
(iii) उपनियम (5) में, "प्रत्येक मद के लिए पांच रूपए फीस होगी " शब्दों के स्थान पर "प्रत्येक उत्पाद के लिए , प्रत्येक आवेदन के लिए अधिकतम तीन हजार रूपए के अधीन रहते हुए , एक सौ रूपए की फीस होगी " शब्द रखे जाएंगे ;
(iv) उपनियम (6) में, " तीस रूपए " शब्दों के स्थान पर " दो सौ पचास रूपए " शब्द रखे जाएंगे ।
26 . उक्त नियमों के नियम 139 कध में, "पचास रूपए " शब्दों के स्थान पर "दो सौ पचास रूपए " शब्द रखे जाएंगे । 27. उक्त नियमों के नियम 140 में, "उस वर्ष के जिसमें वह दी गई है या उसका नवीकरण किया गया है , आगामी वर्ष के 31 दिसम्बर तक विधिमान्य होगी" शब्दों के स्थान पर, " उस तारीख से जिसको वह दी गई है या उसका नवीकरण किया गया है, पांच वर्ष की अवधि के लिए विधिमान्य होगी " शब्द रखे जाएंगे ।
28. उक्त नियमों के नियम 141 कक में, " उस वर्ष के जिसमें वह दी गई है या उसका नवीकरण किया गया है, आगामी वर्ष के 31 दिसम्बर तक विधिमान्य होगी " शब्दों के स्थान पर, " उस तारीख से जिसको वह दी गई है या उसका नवीकरण किया गया है, पांच वर्ष की अवधि के लिए विधिमान्य होगी " शब्द रखे जाएंगे ।
29. उक्त नियमों के नियम 150ख में, -
(i) उपनियम (1 ) में, -
(क) "पांच सौ रूपए " और " तीन सौ रूपए " शब्दों के स्थान पर क्रमशः "छह हजार रूपए " और "एक हजार पांच सौ रूपए" शब्द रखे जाएंगे ;
(ख) दूसरे परंतुक के स्थान पर निम्नलिखित परंतुक रखा जाएगा, अर्थात् :-
"परंतु यह और कि यदि आवेदक अनुमोदन के नवीकरण के लिए आवेदन, उसके अवसान के पश्चात् किन्तु ऐसे अवसान के छह मास के भीतर करता है तो संदेय निरीक्षण फीस अनुसूची ग और ग (1 ) में विनिर्दिष्ट ओषधियों की परख की दशा में छह हजार रूपए और अनुसूची ग तथा ग (1 ) में विनिर्दिष्ट ओषधियों से भिन्न ओषधियों, होमियोपैथिक ओषधियों और प्रसाधन सामग्रियों की परख की दशा में एक हजार पांच सौ रूपए तथा प्रत्येक मास एक हजार रूपए की दर से अतिरिक्त फीस होगी ।";
(ii) उपनियम (2) के स्थान पर निम्नलिखित उपनियम रखा जाएगा, अर्थात् : -
" (2) ओषधियों के अतिरिक्त प्रवर्गों या प्रसाधन सामग्रियों के अतिरिक्त मदों की परख करने के लिए अनुमोदन दिए जाने के लिए पृथक आवेदन किया जाएगा और उसके साथ अनुसूची ग और ग (1 ) में विनिर्दिष्ट ओषधियों की दशा में एक हजार पांच सौ रूपए तथा अनुसूची ग और ग ( 1 ) में विनिर्दिष्ट ओषधियों से भिन्न ओषधियों , होमियोपैथिक ओषधियों और प्रसाधन सामग्रियों की दशा में प्रत्येक के लिए नौ सौ रूपए की निरीक्षण फीस होगी ।
स्पष्टीकरण :- इस प्रयोजन के लिए , ' ओषधियां' ' प्रसाधन सामग्री ' शब्दों से ओषधियों के विनिर्माण में जिनके अंतर्गत , यथास्थिति, होमियोपैथिक ओषधियां या प्रसाधन सामग्रियां भी है, प्रयुक्त कच्ची सामग्री भी अभिप्रेत है और उसमें सम्मिलित है । " 30. उक्त नियमों के नियम 150 घ में, "उस वर्ष के जिसमें वह अनुदत्त किया गया है या नवीकरण किया गया है, आगामी वर्ष के 31 दिसम्बर तक विधिमान्य होगा " शब्दों के स्थान पर, " उस तारीख से जिसको वह अनुदत्त किया गया है या नवीकरण किया गया है, पांच वर्ष की अवधि के लिए विधिमान्य होगा " शब्द रखे जाएंगे । 9

The following draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945 , which the Central Government proposes to make after consultation with the Drugs Technical Advisory Board , in exercise of the powers conferred by sections 12 and 33 of the Drugs and Cosmetics Act , 1940 ( 23 of 1940 ) , is hereby published as requiredby the said sections for the information of all persons likely to be affected thereby , and notice is hereby given that the said draft rules will he taken into consideration after the expiry of forty- five days from the date on which the copies of the Official Gazette in which this notification is published are made available to the public ,

2 In the Drugs and Cosmetics Rules , 1945 ( hereinafter referred to as the said rules) , in rule 59, -
(i) in sub - rule ( 2), for the portion beginning with the words " shall be made " and ending with the words " rupees forty " , the following words , figures and letters shall be substituted , namely -
"shall be made in Form 19 accompanied by a fee of rupees two thousand and five hundred and an inspection fee of rupees five hundred or in Form 19 - A accompanied by a fee of rupees one thousand and an inspection fee of rupees two hundred and fifty , as the case may be , or in the case of drugs included in Schedule X shall be made in Form 19 - C accompanied by a fee of rupees five hundred , to the licensing authority "
(ii) in sub - rule ( 3 ), for the words " rupees six " , the words " rupees two hundred and fifty " shall be substituted ,
(ii) in sub - rule (4) , for the portion beginning with the words "shall be accompanied by " and ending with the words " rupees thirty per month or partthereof :" the following words , figures and letters shall be substituted , namely:-
"shall be accompanied by a fee of rupees two thousand and five hundred , an inspection fee of rupees five hundred plus an additional fee at the rate of rupees five hundred per month or part thereof with Form 19 , rupees one thousand , an inspection fee of rupees two hundred and fifty plus an additional fee at the rate of rupees two hundred fifty per month or part thereof with Form 19 -A and rupees five hundred plus an additional fee at the rate of rupees two hundred and fifty per month or part thereof with Form 19 - C "
3. In rule 62- C of the said rules,
(i) in sub - rule ( 1 ) , -
(a) for the words " a fee of rupees twenty " , the words " a licence fee of rupees one thousand and an inspection fee of rupees two hundred and fifty " shall be substituted, भारत का राजपत्र असाधारण

(b) in the proviso , for the words " rupees twenty plus an additional fee at the rate of rupees twenty" , the words " rupees one thousand and an inspection fee of rupees two hundred and fifty plus an additional fee at the rate of rupees two hundred and fifty " shall be substituted;
(ii) in sub - rule (2 ) , for the words " rupees five " , the words " rupees two hundred and fifty" shall be substituted.
4. In rule 63 of the said rules , for the words and figures and letters " valid up to the 31st December of the year following the year in which " , the words " valid for a period of five years from the date on which " shall be substituted .
5. In rule 65 of the said rule , in condition ( 15 ) , after sub condition ( c ) and before the Explanation , the following condition shall be inserted , namely: -
"(d) The licensee shall ensure that the registered Pharmacist in -charge of the retail shop or premises puts on a ' white apron ' ( Lab coat ) at the time of discharging his duties. "
6. In rule 67 -A of the said rules ,_
in sub - rule ( 2) , - (i)
(a) for the words " a fee of rupees ten " , the words " à fee of rupees two hundred and fifty " shall be substituted ;
(b) in the proviso , for the words " rupees ten plus an additional fee at the rate of rupees eight " , the words " two hundred fifty plus' an additional fee at the rate of rupees fifty " shall be substituted;
(ii) in sub - rule (3 ) , for the words " a fee of one rupee and twenty five paise ", the words " a fee of rupees fifty " shall be substituted.
7. In rule 67- E of the said rules , for the words , figures and letters " valid up to the 31st December of the year following the year in which " , the words " valid for a period of five years from the date on which " shall be substituted
8. In rule 69 of the said rules , -
(i) in sub - rule ( 2) , for clauses ( a ) , ( b) and ( c) , the following clauses shall respectively be substituted , namely:-
"( a ) Every application in Form 24 - B shall be made upto ten items for each name of drugs categorised in Schedule M and shall be 12

[PART II-SEC . 3 (i) ] accompanied by a licence fee of rupees five hundred plus and an inspection fee of rupees two hundred for the first inspection and every subsequent inspection or for the purposes of renewal of the licence.
(b ) Every application in Form 24 - F shallbe made upto ten items for éach name of drugs categorised in Schedule M and shall be accompanied by a licence fee of rupees six thousand and an inspection fee of rupees one thousand and five hundred for the first inspection and for every subsequent inspection or for the purposes ofrenewal of licence .
(c) Every application in Form 24 shall be made upto ten items for each name of drugs categorised in Schedule M and Schedule M - III and shall be accompanied by a licence fee of rupees six thousand and an inspection fee of rupees one thousand and five hundred for the first inspection and for every subsequent inspection or for the purposes of renewal of the licence.
(ii) in sub - rule ( 3 ) , for clauses ( i ) , ( ii ) and ( iii ) , the following clauses shall be substituted , namely: -
" ( i) in the case of Form 24- B a licence fee of rupees five hundred plus an additional fee at the rate of rupees two hundred and fifty per month or part thereof in addition to an inspection fee of rupees two hundred ;
( ii) in the case of Form 24 - F a licence fee of rupees six thousand plus an additional fee at the rate of rupees one thousand per month or part thereof in addition to an inspection fee of rupees one thousand;
(iii) in the case of Form 24 a licence fee of rupees six thousand plus an additional fee at the rate of rupees one thousand per month or part thereof in addition to an inspection fee of rupees one thousand and five hundred . " .
(iii) in sub - rule (4), for the words " rupees fifteen , rupees two hundred or rupees sixty five shall be paid respectively " , the words " rupees one thousand shall be paid " shall be substituted;

(iv) for sub - rule (5) , the following shall be substituted , namely: - "(5) Applications by licensees to manufacture additional items of drugs shall , in the case of a licence to manufacture for sale and distribution for repacking and other than those specified in Schedules C and C ( 1 ) , be made to the Licensing Authority . Such applications shall , if the additional items of drugs applied for belong to categories which are not already included in the licence , be accompanied by an additional fee at the rate of rupees one hundred for each additional item of drug for repacking and rupees three hundred for each additional item for each name of drugs categorized in Schedule M and Schedule M - III . " shall be substituted.
9. In rule 69 -A of the said rules, _
(i ) for sub - rule ( 1 ) , the following sub - rule shall be substituted , namely: - "(1) Application for the grant or renewal of loan licences to manufacture for sale or for distribution of drugs other than those specified in Schedules C , C ( 1 ) and X shall be made upto ten items for each name of drugs categorised in Schedute M and Schedule M- III and shall be made in form 24 accompanied by a licence fee of rupees six thousand and an inspection fee of rupees one thousand and five hundred to the licensing authority:
Provided that if the applicant applies for the renewal of a licence after its expiry but within six months of such expiry the fee payable for renewal of such licence shall be accompanied by a licence fee of rupees six thousand and an inspection fee of rupees one thousand and five hundred plus an additional fee at rate of rupees one thousand per month or part thereof. " .
(ii ) for sub - rule( 3 ) , the following sub - rule shall be substituted , namely: - " (3 ) Subject to the provisions of sub - rule (2) , application for manufacture of more than ten items for each category of drug on a loan licence shall be accompanied by an additional fee of rupees three hundred per additional item specified in Schedule M and Schedule M - III " ;

[PART II-SEC 3 (i ) ] ( iii ) in sub - rule(4) , for the words " a fee of rupees thirty " , the words " a fee of rupees one thousand " shall be substituted .
10. In rule 72 of the said rules , for the words , figure and letters , " valid upto the 31st December of the year following the year in which " , the words " valid for a period offive years from the date on which " shall be substituted .
11. In rule 73 -AA of the said rules , for the words , figure and letters , " valid up to the 31st December of the year following the year in which " , the words " valid for a period of five years from the date on which " shall be substituted.
12. In rule 75 of the said rules ,
(i) in sub - rule ( 1 ) , _
(a) for the words " shall be accompanied by a fee of rupees six hundred and an inspection fee of rupees four hundred for the first inspection or rupees two hundred in the case of second or every subsequent inspection or for the purposes of renewal of licence . " , the words " shall be made upto ten items for each name of drugs categorised in Schedule M and Schedule M - III and shall be accompanied by a licence fee of rupees six thousand and an inspection fee of rupees one thousand and five hundred for the first inspection or for every subsequent inspection or for the purposes of renewal of licences . " shall be substituted;
(b) in the proviso, for the words " rupees six hundred plus an additional fee of rupees three hundred per month or a part thereof in addition to the inspection fee " , the words " rupees six thousand plus an additional fee of rupees one thousand per month or a part thereof in addition to an inspection fee of rupees one thousand and five hundred " shall be substituted (ii) in sub- rule ( 2 ) , -
(a) for the words " shall be accompanied by a fee of rupees twelve hundred and an inspection fee of rupees four hundred for the first inspection or rupees two hundred in the case of second or every subsequent inspection or for the purposes of renewal of licence . " , the words , letters and figures " shall be made upto ten 15

(b) in the second proviso , for the words " rupees twelve hundred plus an additional fee of rupees six hundred per month or a part thereof in addition to an inspection fee " , the words " rupees six thousand plus an additional fee of rupees one thousand per month or a part thereof in addition to an inspection fee of rupees one thousand and five hundred " shall be substituted;
(iii) insub- rule ( 3) , -
(a) for the words " shall be accompanied by a licence fee of rupees six hundred and an inspection fee of rupees four hundred for the first inspection or rupees two hundred in the case of second or every subsequent inspection or for the purposes of renewal of licence. " , the words and letters " shall be made upto ten items for each name of drugs categorised in Schedule M and shall be accompanied by a licence fee of rupees six thousand and an inspection fee of rupees one thousand and five hundred for the first inspection and for every subsequent inspection or for the purposes of renewal of licences: " shall be substituted ;
(b) in the proviso , for the words " shall be rupees six hundred plus anadditional fee of rupees three hundred per month or a part thereof in addition to an inspection fee . " the following words shall be substituted , namely , -
"shall be rupees six thousand plus an additional fee of rupees one thousand per month or a part thereof in addition to the inspection fee of rupees one thousand and five hundred . " ;
(iv) for sub - rules (4) and (5), the following sub- rules shall respectively be substituted, namely: -
" (4) A fee of rupees one thousand shall be paid for duplicate copy of the licence issued under sub- rule (1 ), sub- rule ( 2) or 16

[PART II- SEC . 3 (i ) ] sub- rule ( 3 ) , as the case may be , if the original licence is defaced, damaged or lost.
(5) If the licensee applies for manufacture of more than ten items of each category of drugs , the application shall be accompanied by an additional fee at the rate of rupees three hundred for each additional item of drugs categorised in Schedule M and Schedule M - III . "
13. In rule 75 -A of the said rules , -
in sub - rule ( 1 ) , (i)
(a) for the words " shall be accompanied by a fee of rupees six hundred: " , the words , letters and figures " shall be made upto ten items for each name of drugs categorised in Schedule M and Schedule M - III and shall be accompanied by a licence fee of rupees six thousand and an inspection fee of rupees one thousand and five hundred for the first inspection or for every subsequent inspection or for the purposes of renewal of licences : " shall be substituted;
(c) in the proviso , for the words " rupees six hundred plus an additional fee at the rate of rupees three hundred " the following words shall be substituted , namely, -
" rupees six thousand and an inspection fee of rupees one thousand and five hundred plus an additional fee at the rate of rupees one thousand" ;
(ii) for sub - rules (3) and (4) , the following sub- rules shall respectively be substituted , namely: -
"( 3) Subject to the provision of sub- rule (2 ) , the application for manufacture of more than ten items of each category of drugs on a loan licence , shall be accompanied by an additional fee at the rate of rupees three hundred for each additional item of drugs.
(4) If the licensing authority is satisfied that a loan licence is defaced , damaged or lost, he may , on payment of a fee of rupees one thousand , issue a duplicate copy of loan licence . " .

14. In rule 77 of the said rules , for the words figures and letters "be valid up to the 31st December of the year following the year in which " , the words , " valid for period of five years from the date on which " shall be substituted .
15. In rule 82 of the said rules , for the words " fee of rupees fifty " , the words " fee of rupees two hundred and fifty " shall be substituted.
16. In rule 83 -AA of the said rules , for the words , figures and letters " be valid up to the 31st December of the year following the year in which " , the words , "valid for a period of five years from the date on which " shall be substituted
17. In rule 85 - B of the said rules, -
(a) in sub- rule ( 1 ) , for the portion beginning with the words " Homoeopathic medicines " and ending with the word , figure and letter " Form 24 -C " , the following words , letters and figures shall be substituted , namely: -
"Homoeopathic medicines categorised in Schedule M - 1 shall be made upto ten items for each category of Homeopathic medicines specified in Schedule M-1 to the Licensing Authority appointed by the State Government for the purpose of this Part ( hereinafter in this Part referred to as the Licensing Authority) and shall be made in Form 24 -C ".
(b) in sub- rule ( 2) , -
(i ) in clause (a) , for the words " rupees eighty " , " rupees twenty " and " rupees ten " , the words " rupees two hundred , " rupees one hundred " and " rupees fifty " shall respectively be substituted ;
(ii) in clause (b ) , for the words " rupees forty " , " rupees ten " and " rupees five " , the words " rupees two hundred , " " rupees one hundred " and " rupees fifty " shall respectively be substituted;
(iii) in clause (c) , for the words " rupees forty " , " rupees ten " and " rupees five ", the words " rupees two hundred " , " rupees one hundred " and "rupees fifty " shall respectively be substituted
(c) insub- rule (3 ) , -
(i) in clause ( a) , for the words " rupees eighty " , " rupees thirty " and " rupees ten " the words " rupees two hundred " , " rupees one hundred " and " rupees fifty" shall respectively be substituted;
( ii ) in clause (b ) , for the words " rupees forty " , " rupees thirty " and " rupees five " , the words " rupees two hundred " , " rupees one hundred" and " rupees one fifty" shall respectivelybe substituted;
(iii) in clause (c) , for the words " rupees forty " , " rupees fifteen " and " rupees five " , the words " rupees two hundred " , " rupees one hundred " and " rupees fifty" shall respectively be substituted;

[PARI II- SEC . 3 (i)] (d) in sub - rule (4) , for the words " rupees fifteen " , and " rupees ten " , the words" rupees fifty " shall be substituted;
(e) in sub-rule (5) , for the words " rupees five " , the words " rupees fifty " shall be substituted.
18. In rule 85 - ED of the said rules , for the words " rupees fifty " , the words " rupees two hundred andfifty" shall be substituted.
19. In rule 85 -F of the said rules , for the words, figures and letters " valid up to the 31st December of the year following the year in which " , the words " valid for a period of five years from the date on which " shall be substituted.
20. In rule 90 of the said rules , in sub - rule ( 2) , for the words " a fee of rupees fifteen " , the words " a fee of rupees two hundred and fifty " shall be substituted.
21. In rule 122- F of the said rules , -
(i) insub - rule( 1 ), -
(a) for the words " licence fee of rupees six hundred and an inspection fee of four hundred for the first inspection or rupees two hundred in ) the case of second or every subsequent inspection or for the purposes of renewal of licence " , the words " licence fee of rupees six thousand and an inspection fee of rupees one thousand and five hundred for first inspection or every subsequent inspection thereof or for the purposes of renewal of licence " shall be substituted;
(b) in the proviso, for the words " shall be rupees six hundred plus anadditional fee at the rate of rupees three hundred per month or a partthereof in addition to the inspection fee : " , the words "shall be rupees six thousand and inspection fee of rupees one thousand and five hundred plus an additional fee at rate of rupees one thousand per month or a part thereof in addition to the inspection fee: " shall be substituted;
(ii) in sub - rule (2) , for the words " rupees one hundred " , the words " rupees five hundred " shall be substituted ;
(iii) in sub - rule (3) , for the words " rupees fifty " , the words " rupees one hundred " shall be substituted .

22. In rule 122 - H of the said rules , for the words , figures and letters " be valid up to the 31st December of the year following the year in which " , the words " valid for a period of five years from the date on which " shall be substituted .
23. In rule 122 - K of the said rules , for the words " fee of rupees fifty " , the words " fee of rupees two hundred and fifty " shall be substituted.
24. In rule 138 of the said rules , -
(i) in sub - rule( 1 ) , for the portion beginning with the words " shall be made to Licensing Authority " and ending with the words " renewal of licence " , the following words , letters and figures shall be substituted , namely , : - "shall be made upto ten items of each name of cosmetics categorised in Schedule M - II to the Licensing Authority appointed by the State Government for the purpose of this part ( hereinafter in this Part referred to as Licensing Authority) in Form 31 and shall be accompanied by a licence fee of rupees two thousand and five hundred and an inspection fee of rupees one thousand for the first inspection or every subsequent inspection thereof or for the purposes of renewal of licence." .
(ii ) in sub - rule (2 ) , for the words " rupees four hundred plus an additional fee at the rate of rupees two hundred per month or a part thereof and an inspection fee of rupee fifty " , the words " rupees two thousand and five hundred plus an additional fee at the rate of rupees four hundred per month or part thereof in addition to an inspection fee of rupees one thousand " , shall be substituted ;
(iii) in sub - rule ( 3 ) , for the words " rupees five for each item . " the words "rupees one hundred for each product subject to a maximum of rupees three thousand for each application . " shall be substituted;
(iv) in sub -rule ( 4), for the words " rupees fifty " the words " rupees two hundred and fifty " shall be substituted.
25. In rule 138 -A of the said rules, -
(i) in sub - rule ( 1 ) for the portion beginning with the words " shall be made in " and ending with the words " a fee of rupees two hundred " , the following words , letters and figure shall be substituted , namely: - shall be made upto ten items of each name of cosmetics categorised in Schedule M -II in Form 31 -A to the Licensing Authority 266 / 01 /2001-4 20

[PART II-SEC 3 ( 1) ] and shall be accompanied by a licence fee of rupees two thousand and five hundred and an inspection fee of rupees one thousand for first inspection or every subsequent inspection thereof. " .
(ii) in sub - rule ( 2 ) , for the words " rupees two hundred plus an additional fee at the rate of rupees seventy five per month or part thereof. " , the words " rupees two thousand and five hundred plus an additional fee at the rate of rupees four hundred for each month or part thereof " shall be substituted;
(iii) in sub - rule ( 5) , for the words " rupees five for each item " , the words " rupees one hundred for each product subject to a maximum of rupees three thousand for each application " shall be substituted ;
(iv) in sub- rule (6 ) , for the words " fee of rupees thirty " , the words " fee of rupees two hundred and fifty " shall be substituted .
26 . In rule 139 -AD of the said rules , for the words " fee of rupees fifty " , the words " fee of rupees two hundred and fifty " shall be substituted
27 . In rule 140 of the said rules , for the words , figures and letters " valid up to the 31st December of the year following the year in which " , the words " valid for a period of five years from the date on which " shall be substituted .
28. In rule 141 -AA of the said rules , for the words , figures and letters "valid up to the 31st December of the year following the year in which " , the words " valid for a period of five years from the date on which " shall be substituted .
29. In rule 150 - B of the said rules , -
(i ) in sub - rule ( 1 ) , -
(a) for the words " rupees five hundred " and " rupees three hundred " , the words " rupees six thousand " and " rupees one thousand and five hundred " shall respectively be substituted ;
(b) for the second proviso , the following proviso shall be substituted , namely:-
"Provided further that if the applicant applies for renewal of approval after its expiry but within six months of such expiry , the inspection fee payable shall be rupees six thousand in case of testing of drugs specified in Schedules C and C ( 1 ) and rupees one thousand and five hundred in the case of testing of drugs other than those specified in Schedules C and भारत का राजपत्र असाधारण

C(1 ) , Homeopathic medicines and cosmetics , plus an additional fee at the rate of rupees one thousand per month . "
( ii ) for sub -rule ( 2) , the following shall be substituted , namely: -
" (2) A separate application shall be made for grant of approval for carrying out tests on additional categories of drugs or items of cosmetics and shall be accompanied by an inspection fee of rupees one thousand and five hundred in the case of drugs specified in Schedules C and C( 1 ) and rupees nine hundred each in case of drugs other than those specified in Schedules C and C( 1 ) , Homeopathic medicines and cosmetics .
Explanation: - For the purpose of this Part, the words ' drugs ' and ' cosmetics ' shall also mean and include raw materials used in the manufacture of drugs including Homeopathic drugs or cosmetics , as the casemay be . "
30. In rule 150 - D of the said rules , for the words , figures and letters " valid up to the 31st December of the year following the year in which " , the words " valid for a period of five years from the date on which " shall be substituted
31. In rule 150-1 of the said rules , for the words " rupees fifty " , the words " rupees two hundred and fifty" shall be substituted.
