सा.का.नि. 67( अ ) खाद्य अपमिश्रण निवारण नियम , 1955 का और संशोधन करने के लिए कतिपय प्रारूप नियम खाद्य अपमिश्रण निवारण अधिनियम , 1954 ( 1954 का 37 ) की धारा 23 की उपधारा ( 1 ) की अपेक्षानुसार भारत के राजपत्र, असाधारण, भाग II , खंड 3 , उपखंड ( 1 ) तारीख 11 फरवरी, 2000 में, भारत सरकार, स्वास्थ्य और परिवार कल्याण मंत्रालय ( स्वास्थ्य विभाग ) की उस अधिसूचना सा.का नि 107(अ ) तारीख 11 फरवरी , 2000 में, प्रकाशित किए गए थे जिसके द्वारा उन सभी व्यक्तियों से जिनका उससे प्रभावित होने की संभावना है, जिमको भारत के उस राजपत्र की प्रतियां जिसमें उक्त अधिसूचना प्रकाशित की गई थी , जनता को उपलब्ध करा दी गई थी, माठ दिन की अवधि की समाप्ति से पूर्व आक्षेप और सुझाव आमंत्रित किए गए थे;

और उक्त भारत के राजपत्र की प्रतियां तारीख 14 फरवरी , 2000 को जनता को उपलब्ध करा दी गई थीं;

और उक्त प्रारूप नियमों के संबंध में जनता से प्राप्त आक्षेपों और सुझावों पर केन्द्रीय सरकार, ने विचार किया है ;

अतः अब, केन्द्रीय सरकार, केन्द्रीय खाद्य मानक समिति से परामर्श करने के पश्चात्, उक्त अधिनियम की धारा 23 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों को प्रयोग करते हुए खाद्य अपमिश्रण नियम , 1955 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है:-

नियम

1 ( 1 ) इन नियमों का संक्षिप्त नाम खाद्य अपमिश्रण निवारण ( दूसरा संशोधन ) नियम, 2001 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2 खाद्य अपमिश्रण निवारण नियम , 1955 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है ) में,

(क) नियम 42 में, उपनियम, ( ट ) का लोप किया जाएगा ।

[PART II-SEC. 3 ( i) ] (ख) नियम 55 की सारणी के स्तंभ 1 में आने वाली " 28 चीज या संसाधित चीज " प्रविष्टि के सामने स्तंभ ( 2 ) और स्तंभ ( 3 ) में, प्रविष्टियों के स्थान पर क्रमशः निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्:-

3,000 " मोविक अम्ल जिसके अन्तर्गत इसका ( सोर्षिक अम्ल के रूप में संगणित ) सोडियम , पोटेशियम और कैल्शियम लवण भी हैं ।

3. उक्त नियम के परिशिष्ट " ख " में;

( क) मद क. 11.01.11 में, " विभिन्न प्रकार और नाम के दूध के लिए मानक निम्न प्रकार होंगे " शब्दों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: - " विभिन्न प्रकार और नाम के दूध के मानक वह होंगे जो नीचे सारणी में दिए गए हैं, दूध , दूध वसा और गैर वसा दूध ठोस दोनों के यथाविहित प्राचलों को स्वतंत्र रूप से पूरा करेगा जैसा उक्त सारणी के स्तंभ ( 4 ) और ( 5 ) में विहित है";

(ख) मद क. 11.02.07 में " कठोर चीज में सार्विक अम्ल या सार्षिक अम्ल के रूप में संगणित इसका सोडियम, पोटाशियम , या कैल्शियम लवण 0.1 प्रतिशत या नाइसीन अकेले या संयोजन सहित 0.1 प्रतिशत होगा " शब्दों और अंकों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्:- " कठोर चीज में सार्षिक अम्ल या सार्विक अम्ल के रूप में संगणित इसका मोडियम, पोटाशियम अथवा कैल्शियम लवण 3000 भाग प्रति दस लाख तक और/ या नाइसीन अकेले अथवा संयोजन में 12.5 भाग प्रति दस लाख तक हो सकेगी । " ;

( ग ) मद क. 11.02.07.01 और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित मद और प्रविष्टियां रखी जाएंगी, अर्थात्:-

" क. 11.02.07.01- संमाधित चीज से अनुज्ञात पादसीकारकों और/या स्थायीकारकों अर्थात् साइट्रिक अम्ल, सोडियम सीट्रेट, ओर्थोफास्फोरिक अम्ल और पोलिफास्फोरिक अम्ल के ( रेखिक फास्फेट के रूप में ) सोडियम लवण और मिलाए गए कोडिमेन्टस सहित या बगैर और अम्लीकरण कारकों, अर्थात् सिरका, लेक्टिक अम्ल, एसीटिक अम्ल, साइट्रिक अम्ल और फास्फोरिक अम्ल के साथ एक या अधिक प्रकार के कठोर चीजों को गर्म करके अभिप्राप्त किया गया उत्पाद अभिप्रेत है । संसाधित चीज में निर्जल अनुज्ञात पायसीकारक और /या स्थायीकारक 4.0 प्रतिशत से अधिक नहीं हो सकेंगे , परन्तु निर्जल अकार्बनिक कारकों की अन्तर्वस्तु किसी भी दशा में तैयार उत्पाद के 3.0 प्रतिशत से अधिक नहीं होगी । इसमें 47.0 प्रतिशत से अधिक आर्द्रता नहीं होगी । संसाधित चीज चिपलेटस ( म्लाइस किया हुआ चीज जिसे पैक किया गया है ) में, जब उन्हें टिन से अन्य पैकेज में विक्रय किया जाए, 50.0 प्रतिशत से अधिक आर्द्रता नहीं होगी । दुग्ध वसा अन्तर्वस्तु शुष्क पदार्थ के 40.0 प्रतिशत से कम नहीं होगी । संसाधित चीज में सार्षिक अम्ल या इसका ( सार्षिक अम्ल के रूप में संगणित ) सोडियम, पोटाशियम अथवा कैल्शियम लवण 3000 भाग प्रति दस लाख तक और/या नाइसिन अकेले अथवा संयोजन में 12.5 भाग प्रति दस लाख तक हो सकेगी । इसमें कैल्शियम क्लोराइड ( निर्जल ) भार के 0.02 प्रतिशत से अधिक नहीं होगा । ";

(घ) मद क. 11 02.07.02 के दूसरे पैरा में " संमाधित चीज स्प्रेड में मार्षिक अम्ल या नाइसिन या दोनों हो सकते हैं , जो भार के आधार पर अधिकतम 0.01 प्रतिशत होंगे " शब्दों और अंकों के स्थान पर निम्नलिखित शब्द, अंक और कोष्ठक रखे जाएंगे, अर्थात्: - " संसाधित चीज स्प्रेड में सार्षिक अम्ल या इसका ( सार्षिक अम्ल के रूप में संगणित ) सोडियम, पोटाशियम अथवा कैल्शियम लवण 3000 भाग प्रति दस लाख और/या नाइसीन 12.5 भाग प्रति दस लाख तक हो सकेगी । ";

( ङ) मद क. 11.02.16 के अंतिम पैरा में " बेकरी जैसे उद्योग द्वारा प्रयुक्त भागतः मखनिया दूध पाउडर " शब्दों से प्रारम्भ होकर " सिवाय इसके कि विलेयमा प्रतिशतता भार में न्यूनतम 75 प्रतिशत होगी " शब्द और अंकों के साथ समाप्त होने वाले भाग का लोप किया जाएगा;

( च ) मदक 18.01 में " आटा या पारिणामिक आटा से गेहूँ को दल कर या पीसकर निकाला गया मोटा उत्पाद अभिप्रेत है " शब्दों के स्थान पर निम्नलिखित शब्द रखे जाएंगे , अर्थात् -

'आटा या पारिणामिक आटा से कृंतकतन्तु और सत्सर्ग से मुक्त गेहूँ को दल कर या पीसकर निकाला गया मोटा आटा अभिप्रेत है। " ;

( छ ) मद क. 18.02 " मैदा से गेहूँ को दल कर या पीसकर उससे निकले चूरे को चाल कर या संसाधित करके बनाया गया महीन उत्पाद . अभिप्रेत है " शब्दों के स्थान पर निम्नलिखित शब्द रखे जाएंगे, अर्थात्: - भारत का

" मैदा से कृंतकतन्तु और उत्सर्ग से मुक्त साफ गेहूँ को दलकर या पीसकर उससे निकले चूरे को चाल कर या संमाधित करके बनाया गया महीन उत्पाद अभिप्रेत है " ;

ज) मद क. 18.03 में " सेमोइला ( सूजी या रवा ) से पेसण और चालन प्रक्रिया द्वारा गेहूँ से निर्मित उत्पाद अभिप्रेत है " शब्दों कोष्ठकों के स्थान पर निम्नलिखित शब्द और कोष्ठक रखे जाएंगे , अर्थात्: -

" सेमोइला ( सूजी या रवा ) से पेसण और चालन प्रक्रिया द्वारा कृंतकतन्तु और सत्सर्ग से मुक्त साफ गेहूँ से निर्मित उत्पाद अभिप्रेत है।";

(झ) मद क. 18.05.01

( क) " चोकर युक्त ओ चूर्ण या जौ का आटा या चोकर युक्त जौ का चूर्ण से साफ और अच्छे छिलका निकाले गए जौ ( हार्डियम बलगैर या हार्डियम डिस्टिकोन ) के दानों को पीस कर प्राप्त किया गया उत्पाद अभिप्रेत है " शब्दों के स्थान पर निम्नलिखित शब्द और कोष्ठक रखे जाएंगे , अर्थात्:-

" चोकर युक्त जौ चूर्ण या जौ का आटा या चौकर युक्त जौ का चूर्ण से साफ और अच्छे छिलका निकाले गए जौ ( होर्डियम वलगैर या होर्डियम डिस्कोन) के ऐसे दानों को, जो कृंतकतन्तु और उत्सर्ग से मुक्त है पीसकर प्राप्त किया गया उत्पाद अभिप्रेत है ।";

( ख ) " कृंतकतन्तु और उत्सर्ग प्रति किलोग्राम 5 से अधिक नहीं होंगे " शब्दों, अंक और अक्षर का लोप किया जाएगा ।

G.S.R. 67 ( E) . Whereas certain draft rules further to amend the Prevention of Food Adulteration Rules , 1955 were published as required by sub - section ( 1 ) of section 23 of the Prevention of Food Adulteration Act , 1954 (37 of 1954 ) in the notification of Government of India in the Ministry of Health and Family Welfare ( Department of Health ) number. G.S.R. 107 ( E), dated the 11th February , 2000 in the Gazette of India , Extra- Ordinary , Part II, Section 3 , Sub- Section ( i ) , dated the 11th February , 2000 inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of sixty days from the date on which copies of the Gazette of India in which the said notification was published , were made available to the public;

And whereas the copies of the said Gazette of India were made available to the public on the 14th February , 2000 ;

And whereas the objections and suggestions received from the public on the said draft rules have been considered by the Central Government ;

Now, therefore, in exercise of the powers conferred by sub - section ( 1 ) of section 23 of the said Act , the Central Government , after consultation with the Central Committee for Food Standards , hereby makes the following rules further to amend the Prevention of Food Adulteration Rules , 1955 , namely: -

These rules may be called the Prevention of Food Adulteration

PART II- SEC . 3 ( i ) ] (2) They shall come into force on the date of their publication in the Official Gazette .

2. In the Prevention of Food Adulteration Rules , 1955 ( hereinafter referred to as the said rulcs)-

(a) in rule 42 , sub - rule ( K) shall be omitted .

(b) in rule 55 , in the table , against entry " 28. Cheese or processed checse" occurring in column ( 1 ) , in columns ( 2 ) and (3 ) , for the entries , the following entries shall respectively be substituted , namely, -

3. In Appendix " B " to the said rules, -

(a) in item A.11.01.11 , for the words , "Standards for different classes and designations of milk shall be as follow : " , the following shall be substituted , namely , -

" The standards of different classes and designations of milk shall be as given in the table below. Milk shall conforin to both the parameters for milk fat and milk solids not fat , independently, as prescribed in columns (4) and (5 ) of the said table.";

(b) in item A.11.02.07 , for the words and figures , " Hard cheese may contain 0.1 percent of sorbic acid , or its sodium , potassium or calcium salts calculated as sorbic acid, or 0.1 percent of nisin either singly or in combination ." , the following words and figures shall be substituted, namely , -

"Hard cheese may contain up to 3000 parts per million sorbic acid , or its sodium, potassium or calcium salts calculated as sorbic acid , and /or 12.5 parts per million nisin either singly or in combination . " ;

(c) for item A. 11.02.07.01 and the entries relating thereto , the following item and entries shall be substituted , namely, -

" A.11.02.07.01 - PROCESSED CHEESE means the product obtained by heating one or more types of hard cheeses with permitted emulsifiers and/or stabilizers namely citric acid, sodium citrate , sodium salts of orthophosphoric acid and polyphosphoric acid ( as linear phosphate ) with or without added condiments , and acidifying agents , namely vinegar , lactic acid, acetic acid, citric acid and phosphoric acid. Processed cheese may contain not more than 4.0 per cent of anhydrous permitted emulsifiers and/ or stabilizers , provided that the content of anhydrous inorganic agents shall in no case exceed 3.0 per cent of the finished product. It shall not contain more than 47.0 per cent moisture . Processed cheese chiplets (packed sliced cheese ) when sold in a package other than tin , shall not contain more than 50.0 per cent moisture. The milk fat content shall not be less than 40.0 per cent of the dry matter . Processed cheese may contain upto 3000 parts per million sorbic acid or its sodium , potassium or calcium salts ( calculated as sorbic acid ) and/or 12.5 parts per million nisin cither singly or in combination. Itmay contain calcium chloride ( anhydrous) not exceeding 0.02 per cent by weight ." ;

(d) in item A. 11.02.07.02 , in the second paragraph , for the words and figures , " Processed cheese spread may contain sorbic acid or nisin or both to the maximum extent of 0.1 percent by weight ." the following words , figures and brackets shall be substituted , namely , -

" Processed cheese spread may contain up to 3000 parts per million sorbic acid or its sodium , potassium or calcium salts ( calculated as sorbic acid ) and/ or 12.5 parts per million nisin . " ;

[PART II - SEC . 3 (i) ] (c) in item A. 11.02.16 , in the last paragraph, the portion beginning with the words , " Partly skimmed milk powder ( sour ) "and ending with the words and figures, "except that solubility percentage will be 75 percent minimum by weight . " shall be omitted.;

(f) in item A. 18.01 , for the words , " ATTA or resultant atta means the course product obtained by milling or grinding wheat. " the following words shall be substituted , namely-

" ATTA OR RESULTANT ATTA means the course product obtained by milling or grinding clean wheat free from rodent hair and excreta. " ;

(g) in item A.18.02 , for the words , " MAIDA means the fine product made by milling or grinding wheat and bolting or dressing the resulting wheat meal , " the following words shall be substituted, namely-

" MAIDA means the fine product made by milling or grinding clean wheat free from rodent hair and excreta and bolting or dressing the resulting wheat meal ." ;

(h) in item A. 18.03 , for the words and brackets , " SEMOLINA ( SUJI OR RAWA) means the product prepared from wheat by process ofgrinding or bolting, ' the following words and brackets shall be substituted, namely-

" SEMOLINA ( Suji or Rawa ) means the product prepared from clean wheat free from rodent hair and excreta by process of grinding and bolting." ;

in item A. 18.05.01- (i)

(a) for the words and brackets , " WHOLE MEAL BARLEY POWDER OR BARLEY FLOUR OR CHOKER Yukt Jau ka Churan means the product obtained by grinding clean and sound dehusked barley ( Hordeum भारत का राजपत्र असाधारण

vulgare or Hordeum distichun ) grains .", the following words and brackets shall be substituted , namely, -

"WHOLEMEAL BARLEY POWDER OR BARLEY FLOUR OR CHOKER Yukt Jau ka Churan means the product obtained by grinding clean and sound chusked barley ( Hordeum vulgare or Hordeum distichun ) grains free from rodent hair and excreta. " ;

(b) the words , figure and letters , " Rodent hair and excreta shall not exceed 5 pieces per kg. " , shall be omitted .
