आ. अ. 3( अ ). यत राज्य सभा में पंजाब राज्य की विधान सभा के निर्वाचित एदस्यों द्वारा निर्वाचित श्री बरजिन्दर सिंह का स्थान , संविधान के अनुच्छेद 101 के खण्ड( 4 ) के उपबन्धों के अनुसार रिक्त घोषित किए जाने के परिणामस्वरूप उनकी पदावधि जो 9 अप्रैल 2004 को सम्मिलित करते हुए उस तारीख तक थी , के अवसान से पूर्व 21 दिसम्बर , 2000 को रिक्त हो गया है और
है, यतः इस प्रकार उत्पन्न हुई रिक्ति को भरने के प्रयोजन से उप-निर्वाचन कराया जाना अतः अब लोक प्रतिनिधित्व अधिनियम , 1951( 1951 का 43 ) की धारा 147 धारा 39 की उप - धारा ( 1 ) और धारा 56 के अनुसरण में, भारत निर्वाचन आयोग एतद्वद्वारा-
(अ) पंजाब राज्य की विधान सभा के निर्वाचित सदस्यों से यह अपेक्षा करता है कि वे 24 फरवरी , 2001 ( शनिवार ) से पूर्व ओर उवत अधिनियम और तब्द्धीन बनाए गए नियमों और

[PART II-SEC. 3 ( iii)) किए गए आदेशों के अपबन्धों के अनुसार राज्य सभा में उक्त रिक्ति को भरने के प्रयोजन से एक सदस्य निर्वाचित कर दें ;
(आ) उक्त निर्वाचन के संबंध में -
12 फरवरी , 2001(सोमवार ) (क) नाम निर्देशन करने की अंतिम तारीख-
13 फरवरी , 2001 ( मंगलवार) (ख) नाम निर्दशनों की संवीक्षा की तारीख-
15 फरवरी , 2001 ( बृहस्पतिवार ) (বা) अभ्यर्थिताएं वापस लेने की अंतिम तारीख-
22 फरवरी , 2001 ( बृहस्पतिवार) और
(घ) वह तारीख जिसको यदि आवश्यक हुआ तो मतदान होगा
24फरवरी , 2001 ( शनिवार ) (ड) वह तारीख जिसके पूर्व निर्वाचन संपन्न कर लिया जाएगा-
नियत करता है और
(इ ) 9:00 बजे पूर्वाहन से 4:00 बजे अपराह्न तक का समय ऐसे समय के रूप में नियत करता है जिसके दौरान यदि आवश्यक हुआ तो निर्वाचन के लिए उक्त विनिर्दिष्ट तारीख को मतदान होगा ।

O. N. 3( E). WHEREAS , the seat of Shri Barjinder Singh in the Council of States, elected by the elected members of the Legislative Assembly of the State of Punjab , has become vacant on 21 " December , 2000, by the reason of his seat having been declared vacant in accordance with the provisions of clause (4) of Article 101 of the Constitution, before the expiration of his term ofoffice which was upto and including the 9th April, 2004; and
WHEREAS, abye-election is to be held for the purpose of filling the vacancy so caused;
NOW , THEREFORE, in pursuance of section 147, sub-section ( 1 ) of section 39 and section 56 ofthe Representation of the People Act, 1951 (43 of 1951 ), the Election Commission of India hereby- (A) calls upon the elected members ofthe Legislative Assembly of the State of Punjab to elect, before 24th February , 2001 ( Saturday) and in accordance with the provisions of the said Act and of the 3

rules and orders made thereunder , a person for the purpose of filling the said vacancy in the Council of States;
(B) appoints , with respect to the said election,
(a) the 12th February , 2001 ( Monday ), as the last date for making nominations;
(b) the 13th February, 2001 (Tuesday), as the date for the scrutiny of nominations ;
(c) the 15th February, 2001 (Thursday) , as the last date for the withdrawal of candidatures ;
(d) the 22nd February, 2001 ( Thursday), as the date on which a poll shall, if necessary, be taken; and
(e) the 24th February, 2001 ( Saturday) , as the date before which the election shall be completed: and (C) fixes the hours from 9:00 Α.Μ. to 4:00 P.M. , as the hours during which the poll shall, if necessary, be taken on the date specified above for the election.

आ. अ. 4( अ ).--लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43) की धारा 21 के अनुसरण में ओर धारा 22 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए पंजाब राज्य की सरकार के परामर्श से एतद्वारा भारत निर्वाचन आयोग 5 फरवरी , 2001 को भारत के राजपत्र में प्रकाशित आयोग की अधिसूचना के अनुसरण में उक्त राज्य में उस राज्य में राज्य सभा के लिए होने वाले उप-निर्वाचन के संबंध में
(1) नीचे की सारणी के स्तम्भ ( 1 ) में विनिर्दिष्ट अधिकारी को रिटनिगि आफिसर के रूप में पदामिहित करता है ; और
(ii) उक्त सारणी के स्तम्भ ( 2 ) में विनिर्दिष्ट अधिकारी को रिटर्निंगि आफिसर की , उसके कृत्यों के पालन में सहायता के लिए सहायक रिटर्निंग आफिसर नियुक्त करता है ।

O. N. 4(E) . In pursuance of section 21. and in exercise of the powers conferred by sub - section ( 1 ) of section 22. of the Representation of the People Aυτ. 1951 (43 of 1951 ) , the Election Commission of India , in consultation with the Government of the State of Punjab , hereby
(i) designates the officer. specified in column ( 1 ) of the TABLE below, tobe the Returning Officer; and
(ii) appoints the officer, specified in column ( 2) of the said Table . to be the Assistant Returning Officer to assist the Returning officer in the performance ofhis functions;
in respect of the bye- election to the Council of States , tobe held in that State in pursuance of the Commission's notification, published in the Gazette of India on 5th February, 2001 :

आ. अ. 5( अ ).- यतः राज्य सभा में उत्तर प्रदेश राज्य की विधान सभा के निर्वाचित सदस्यों द्वारा निर्वाचित चौधरी चुन्नी लाल का स्थान उनकी मृत्यु हो जाने के परिणामस्वरूप उनकी पदावधि जो 25 नवम्बर , 2002 को सम्मिलित करते हुए उस तारीख तक थी , के अववसान से पूर्व 3 दिसम्बर , 2000 को रिक्त हो गया है ; और
यतः इस प्रकार हुई रिक्ति को भरने के प्रयोजन से उप - निर्वाचन कराया जाना है ;
अतः अब लोक प्रतिनिधित्व अधिनियम , 1951 (1951 का 43) की धारा 147 , धारा 39 की उप- धारा (1 ) और धारा 56 के अनुसरण में भारत निर्वाचन आयोग एतद्वारा- भारत का राजपत्र असाधारण

WHEREAS , a bye-election is to be held for the purpose of filling the vacancy so caused;
NOW, THEREFORE, in pursuance of section 147, sub- section ( 1 ) of section 39 and section 56 of the Representation of the People Act, 1951 (43 of 1951 ), the Election Commission of India hereby - (A) calls upon the elected members of the Legislative Assembly of the State of Uttar Pradesh to elect, 399-11/ 2001-2 6
