सा.का.नि. 76( अ) खाद्य अपमिश्रण निवारण नियम, 1955 का और संशोधन करने के लिए कतिपय नियमों का प्रारूप जिसे केन्द्रीय सरकार खाद्य अपमिश्रण निवारण अधिनियम, 1954 ( 1954 का 37 ) की धारा 23 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय खाद्य मानक समिति से परामर्श करने के पश्चात् बनाना चाहती है , उक्त उपधारा की अपेक्षानुसार ऐसे सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है, प्रकाशित किया जाता है , और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से , जिसको भारत के उस राजपत्र की प्रतियाँ जिसमें यह अधिसूचना प्रकाशित की जाती है । जनता को उपलब्ध करा दी जाती है , साठ दिनों की अवधि की समाप्ति के पश्चात् विचार किया जाएगा;

सकते हैं । आक्षेप या सुझाष , यदि कोई हो, सचिव, स्वास्थ्य और परिवार कल्याण मंत्रालय, भारत सरकार, निर्माण भवन , नई दिल्ली को भेजे आ ऐसे आक्षेपों या सुझावों पर जो उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से इस प्रकार पूर्वोक्त विनिर्दिष्ट अवधि के भीतर प्राप्त होंगे, केन्द्रीय सरकार विचार करेगी ।

प्रारूप नियम

1. ( 1 ) इन नियमों का संक्षिप्त नाम खाद्य अपमिश्रण निवारण ( संशोधन) नियम, 2001 है ।

(2) ये नियम से प्रवृत्त होंगे ।

2. खाद्य अपमिश्रण निवारण नियम, 1955 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है ) में नियम 37 ष के पश्चात् निम्नलिखित नियम अन्तःस्थापित किया जाएगा , अर्थात्:-

" 37ङ. पान मसाला/खाने की तम्बाकू पर लेबल लगाना - इन नियमों में अन्तर्विष्ट लेबल लगाने की अपेक्षाओं से संबंधित किन्हीं अन्य उपबन्धों पर प्रतिकूल प्रभाष डाले बिना, पान मसाला, खाने की तम्बाकू के प्रत्येक आधान या उस पर लगे हुए किसी लेबल और उससे संबंधित विज्ञापन नियम 42 के उपनियम ( ययय ) और ( ययय ) ( 3 ) के अधीन यथा उपबन्धित घोषणा और विज्ञापन स्पष्ट, सहजदृश्य और आसानी से पठनीय रीति में इंगित होंगे ।

[PART II- SEC. 3 (i) ] घोषणा/चेतावनी निम्नलिखित अपेक्षाओं को पूरा करेगी , अर्थात्:-

( 1 ) घोषणा की विशिष्टियां दो भाषाओं में होंगी; जिनमें से अंग्रेजी या हिन्दी अनिवार्य है और दूसरी भाषा प्रादेशिक भाषा हो सकेगी । जहां प्रादेशिक भाषा हिन्दी है वहां ऐसे प्रदेश में हिन्दी और अंग्रेजी दोनों भाषाओं में घोषणा अनिवार्य होगी जिससे उपभोक्ता उसे समझ सके;

(2 ) मुद्रित चेतावनी के पाठ या विज्ञापन के लिए प्रयुक्त रंग , यथास्थिति, लेबल , आधान या विज्ञापनों की पृष्ठभूमि के रंग से भिन्न होगा;

(3 ) कुल मात्रा की दशा में उत्पाद का वजन 200 ग्राम तक है तो घोषणा के लिए प्रयुक्त अक्षरों का रूप किसी भी दशा में दो मिलीमीटर की ऊंचाई से कम का नहीं होगा । अन्य पैकेटों के लिए अक्षरों का रूप नियम 36 के उपबन्धों के अनुसार होगा;

(4) चेतावनी:

(क) बेलनाकार/आयताकार आधान पर- मध्य फलक के ऊपर ।

(ख) थैलियों/पाउचों पर थैलियों/पाउचों/पैकों के दोनों तरफ ऊपर की ओर; दर्शायी जाएगी ।

(5 ) लेबल और घोषणा का मुद्रण मैट फिनिश में होगा ।

3. उक्त नियमों के नियम 42 में-

(क) उपनियम ( ययय ) के स्थान पर निम्नलिखित उपनियम रखा जाएगा, अर्थात्:-

" (ययय ) खाने के तम्बाकू के प्रत्येक पैकेज और उससे संबंधित विज्ञापन पर निम्नलिखित घेतावनी लगी होगी, अर्थात् तम्बाकूखाना स्वास्थ्यके लिए हानिकारक है । "

(ख) उपनियम ( ययय ) (3 ) के स्थान पर निम्नलिखित उपनियम रखा जाएगा, अर्थात्: -

" (ययय) ( 3 ) पान मसाले के प्रत्येक पैकेज और उससे संबंधित विज्ञापन पर निम्नलिखित चेतावनी लिखी होगी, अर्थात्: - पान मसाला खाना स्वास्थ्य के लिए हानिकारक हो सकता है । "

4. उक्त नियमों के नियम 62 में, दूसरे परन्तुक के पश्चात् निम्नलिखित अन्तःस्थापित किया जाएगा, अर्थात्: ---

" परन्तु यह भी कि पाउडरीकृत मृदु पेय सम्मिश्रण, गैर डेरी क्रीमों में सोडियम एल्युमिनियम सिलीकेट की मात्रा में 0.5 प्रतिशत से अधिक उपयोग नहीं किया जा सकेगा । "

5. उक्त नियमों के नियम 64 ख के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्:-

" 64ख. मोनो सोडियम ग्लूटामेट का उपयोग-नियम 42 के उपनियम ( ध) में यथा उपबन्धित समुचित लेबल घोषणा के अधीन मोनोसोडियम ग्लूटामेट को किसी खाद्य पदार्थ में मिलाया जा सकता है । इसे किसी ऐसे खाद्य में नहीं मिलाया जाएगा जो बारह मास से कम के शिशुओं के उपयोग के लिए है । "

6. उक्त नियमों के नियम 72 क में सारणी में और उससे संबंधित स्तम्भ ( 1 ) , ( 2 ) और ( 3 ) में मद 17 की प्रविष्टियों के पश्चात् निम्नलिखित मद और प्रविष्टियां क्रमशः अन्तःस्थापित की जाएंगी , अर्थात्: -

7.. उक्त नियमों के नियम 69 के पश्चात् " भाग 16-प्रच्छादक और उभय प्रतिरोधक ( अम्ल, क्षारक और लवण ) " शीर्ष के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: -

" [ भाग 16- प्रच्छादक और उभय प्रतिरोधक ( अम्ल, क्षारक और लवण ) और अन्य पदार्थ ] । "

8. उक्त नियमों के नियम 72 - ग के पश्चात् निम्नलिखित नियम अन्तःस्थापित किया जाएगा, अर्थात्: -

" 72 - घ. खाद्य में लैक्टुलोज़ सिरप का उपयोग-

(1 ) विशेष दुग्ध आधारित शिशु खाद्य निर्मितियों में जो कि चिकित्सिय सलाह से लिए जाने हैं , लैक्टुलोज़ सिरप का उपयोग किया जा 3

सकेगा और वह लेबल घोषणा के अधीन रहते हुए अन्तिम खाद्य के 0.5 प्रतिशत के अधिकतम स्तर तक प्रयोग किया जा सकेगा । ( 2 ) लैक्टुलोज़ सिरप का उपयोग बेकरी उत्पादों में भार के हिसाब से अधिकतम 0.5 प्रतिशत तक किया जा सकेगा । 9.

उक्तनियमों के परिशिष्ट " ख " में, मद क. 15.01 में दूसरे परन्तुक के पश्चात् निम्नलिखित परन्तुक अन्तःस्थापित किया जाएगा, अर्थात्:-

" परन्तु यह भी कि आयोडाइज़ड नमक में पोटाशियम क्लोराइड का अनुपात लेबल घोषणा में पोटाशियम क्लोराइड और सोडियम क्लोराइड का अनुपात देने की शर्त के अधीन रहते हुए पचास प्रतिशत से अधिक नहीं होगा । उत्पाद को आयोडाइज़ड नमक के रूप में नहीं बेचा जाएगा । तथापि, यह आयोडीन तत्वों के अनुरूप होगा जो मद सं. क. 15.01 के अधीन विनिर्माण/वितरण चैनल में आयोडाइज़ड नमक के लिए विहित है । "

G.S.R. 76 (E) . The following draft of certain rules further to amend the Prevention of Food Adulteration Rules , 1955 , which the Central Government after -consultation with the Central Committee for Food Standards proposes to make, in exercise of the powers conferred by sub - section ( 1 ) of section 23 of the Prevention of Food Adulteration Act, 1954 (37 of 1954) , is hereby published as required by the said sub- section of the said Act, for the information of all persons likely to be affected thereby, and notice is hereby given that the said draft rules will be taken into consideration after the expiry of a period of sixty days from the date on which the copies of this Official Gazette in which this notification is published, are made available to the public;

Objections or suggestions, if any , may be addressed to the Secretary, Ministry of Health and Family Welfare , Government of India, Nirman Bhavan, New Delhi - 110011.

Ojections and suggestions, which may be received from any person with respect to the said draft rules within the period specified above, will be considered by the Central Government .

DRAFT RULES

1. (1) These rules may be called the Prevention of Food Adulteration ( Amendment) Rules, 2001 .

(2) These rules shall come into force with effect from ...

2. In the Prevention of Food Adulteration Rules, 1955. ( hereinafter referred as the said rules), after rule 37 - D, the following rule shall be inserted namely "37 -E - Labelling of Pan Masala, Chewing Tobacco : -Without prejudice to any other provisions relating to Labelling requirements conteired ir tar THE GAZETTE OF INDIA : EXTRAORDINARY

or any label rules , every container of Pan Masala , Chewing Tobacco affixed thereto and advertisements relating thereto shall indicate in a clear , conspicuous and in an easily readable manner , the declaration and advertisement as provided under sub rules (zzz) and (zzz) (3 ) of rule 42 The declaration/ warning shall meet the following requirements namely : -

(i) The particulars of declaration shall be in two languages ; wherein English orHindi is compulsory and second language may be regional language . Where regional language is Hindi in such region declaration in both Hindi and English shall be compulsory so that consumer may understand it.;

(ii) The colour of the warning text printed or used for advertisement shall be different from that of colour of background of the label , container, or the advertisements , as the case may be. ,

(iii) The type of letters used for declaration shall not be in any case less than two millimeter height, in case of net quantity, weight of the products are upto 200 gm . For other packets , the types of letter shall be as per the provisions of rule 36.;

Warning shall be displayed :-

(iv)

(a) OnCylindrical/Rectangular Container - On Top of Central Panel .

(b) On Sachets/Pouches Top of the both sides of Sachets/Pouches , Packs .; On

(v) The printing of label and declaration shall be in Matt finish.

3 . In rule 42 of the said rules-

sub- rule

(a) for sub - rule (zzz) , following/ shall be substituted , namely: -

"(zzz) Every package of chewing tobacco and advertisement relating thereto shall carry the following warning, namely: -

CHEWING OF TOBACCO IS INJURIOUS TO HEALTH

(b) for sub - rule zzz ( 3 ) the following sub - rule shall be substituted , namely--

"(zzz) (3 ) Every package of Pan Masala and advertisement relating thereto shall carry the following warning, namely: -

CHEWING OF PAN MASALA MAY BE INJURIOUS TO HEALTH 4. In rule 62 of the said rules , after the second provise the following shall be inserted, namely -

"Provided also that Sodium Aluminüm Silicate may be used in powered soft drink mixes , non- dairy creams in quantities not exceeding 0.5 percent . " 5

5. Forrule 64 - B of the said rules , the following rule shall be substituted, namely, - " 64 -B . Use of monosodium glutamate may be added to an article of food under proper label declaration as provided in sub- rule (S) of rule 42. It shall not be added to any food for use by the infant below twelve months . "

6 In rule 72A of the said rules , in the Table after item 17 and the entries relating thereto in columns 1,2 and 3 , the following items and entries shall respectively be inserted, namely

7 After rule 69 , in Part XVI- of the said rules in the heading , for the words and brackets " SEQUESTERING AND BUFFERING AGENTS ( ACIDS, BASES AND SALTS ) " the following shall be substituted, namely-

" SEQUESTERING AND BUFFERING AGENTS ( ACIDS , BASES AND SALTS ) AND OTHER SUBSTANCES " ;

8. After rule 72 - C of the said rules , the following rule shall be inserted namely - " 72- D- Use of Lactulose Syrup in foods

(i) Lactulose Syrup may be used in special Milk based infant food formulations to be taken under medical advice upto a maximum level of 0.5 percent of final food subject to label declaration

(ii) Lactulose Syrup may be used in bakery products upto 0.5 percent maximum by weight

9. In appendix ' B ' to the said rules , in item A 15.01 after the second proviso, the following shall be inserted namely:

"Provided also that the potassium chloride may be added to iodised salt in ratio not exceeding fifty percent of potassium chloride subject to label declaration giving ratio of potassium chloride and sodium chloride. The product shall not be sold as iodised salt . However this shall conform to the Iodine content prescribed for iodised salt at manufacturer / distribution channel under item No. A15.01.7
