का.आ. 151 ( अ) .- केन्द्रीय सरकार ने , पैट्रोलियम और खनिज पाइपलाइन ( भूमि के उपयोग के अधिकार का अर्जन ) अधिनियम , 1962 ( 1962 का 50 ) (जिसे इसमें इसके पश्चान उक्त अधिनियम कहा गया है ) की धारा 3 की उपधारा ( 1 ) के अधीन जारी की गई भारत सरकार के पैट्रोलियम और प्राकृतिक गैस मंत्रालय की अधिसूचना सं ० का० आ० 2150 , तारीख 27 सितम्बर , 200० द्वारा गैस अथॉरिटी ऑफ इंडिया लिमिटेड द्वारा गुजरात राज्य में रणामण टी पॉइंट से श्याम इंडस्ट्रीज तक प्राकृतिक गैस के परिवहन के लिए ' पाइपलाइन बिछाए जाने के प्रयोजन हेतु उक्त अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि उपयोग के अधिकार का अर्जन करने के अपने आशय की घोषणा की थी,
और उक्त राजपत्र में अधिसूचना की प्रतिया 20 अक्तूबर , 2000 को जनता को उपलब्ध करा दी गई थीं ।
और सक्षम प्राधिकारी ने उक्त अधिनियम की धारा 6 की उपधारा ( 1 ) के अधीन रिपोर्ट केन्द्रीय सरकार को प्रस्तुत कर दी है,
और केन्द्रीय सरकार ने , उक्त रिपोर्ट पर विचार करने के पश्चात , अनुसूची मे विनिर्दिष्ट भूमि के उपयोग के अधिकार का अर्जन करने का विनिश्चय किया है,
अतः , अब , केन्द्रीय सरकार उक्त अधिनियम की धारा 6 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए घोषणा करती है कि अनुसूची में विनिर्दिष्ट उक्त भूमि मे पाइपलाइन बिछाने के प्रयोजन के लिए उसके उपयोग का अधिकार अर्जित किया जाता है ।

[PART II SFC. 3(ii) ] और आगे केन्द्रीय सरकार , उक्त अधिनियम की धारा 6 की उपधारा ( 4) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निर्देश दे देती है कि उक्त भूमि में उपयोग का अधिकार इस घोषणा के प्रकाशन की तारीख को केन्द्रीय सरकार में निहित होनें के बजाए सभी विल्लगमों से मुक्त गैस अथॉरिटी ऑफ इंडिया लिमिटेड में निहित होगा ।

NOTIFICATION
New Delhi , the 20th February, 2001
1 S.O. 151 (E ) .- whereas , by a notification of the Government of India in the Ministry of Petroleum and Natural Gas , number S.O. 2150 dated the 27th September, 2000 issued under sub- section ( 1 ) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of Users in Land ) Act, 1962 ( 50 of 1962 ) , ( hereinafter referred to as the said act), the Central Government declared its intention to acquire the right of user in the land , specified in the Schedule appended to that notification for the purpose of laying pipeline for transport of natural gas from Ranasan T- point to Shyam Industries in the State of Gujarat by the Gas Authority of India Limited;
And whereas , the copies of the said Gazette notification were made available to the public on 20th day of October , 2000 ;
And whereas , the competent authority has under sub - section (1 ) of section 6 of the said Act , has submitted report to the Central Government ;

And whereas , the Central Government has , after considering the said report, decided to acquire the right of user in the lands specified in the Schedule;
Now, therefore , in exercise of the powers conferred by sub- section ( 1 ) of section 6 of the said Act , the Central Government hereby declares that the right of user in the said land specified in the Schedule is hereby acquired for laying the pipeline;
And , further, in exercise of the powers conferred by sub - section (4) of section 6 of the said Act, the Central Government directs that the right of user in the said lands shall instead of vesting in the Central Government , vest , on this date of the publication of this declaration in the Gas Authority of India Limited , free from all encumbrances.
