सा.का.नि. 106 ( अ ) केन्द्रीय मोटर यान नियम, 1989 का और संशोधन करने के लिए निम्नलिखित प्रारूप नियम, जिन्हें केन्द्रीय सरकार, मोटर यान अधिनियम, 1988 ( 1988 का 59 ) की धारा 110 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाना चाहती है उक्त अधिनियम की धारा 212 की उपधारा ( 1 ) की अपेक्षानुसार, ऐसे सभी व्यक्तियों की जानकारी के लिए, जिनके उनसे प्रभावित होने की संभावना है , प्रकाशित किए जाते हैं, और यह सूचना दी जाती है कि उक्त प्रारूप नियमो पर, उस तारीख से, जिसको भारत के राजपत्र में यथा प्रकाशित इस अधिसूचना की प्रतियां जनता को उपलब्ध करा दी जाती हैं, तीस दिन की अवधि की समाप्ति के पश्चात विचार किया जाएगा ।
ऐसे किन्हीं आक्षेपों या सुझावों पर, जो उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से ऊपर विनिर्दिष्ट अवधि के भीतर प्राप्त हों, केन्द्रीय सरकार विचार करेगी ।
इन नियमों के प्रति आक्षेप या सुझाव, संयुक्त सचिव ( परिवहन ) , सड़क परिवहन और राजमार्ग मंत्रालय, परिवहन भवन, नई दिल्ली को, ऊपर विनिर्दिष्ट अवधि के भीतर भेजे जा सकते हैं ।
प्रारूप नियम
1. (i ) इन नियमों का संक्षिप्त नाम केंद्रीय मोटर यान ( संशोधन ) नियम, 2001 है ।
(ii)ये
(क) राष्ट्रीय राजधानी राज्य क्षेत्र दिल्ली में, इनके राजपत्र में अंतिम प्रकाशन की तारीख से छह मास के पश्चात् प्रवृत्त होंगे; और (ख) ऐसे वाणिज्यिक याानों की बाबत जो अन्तरराज्यीय रूटों पर या राष्ट्रीय राजधानी राज्यक्षेत्र दिल्ली की अधिकारिता के भीतर राष्ट्रीय परमिटों पर चल रहे हैं और देश के अन्य क्षेत्रों में किन्हीं यानों की बाबत, उस तारीख से प्रवृत्त होंगे, जिसे केंन्द्रीय सरकार, राजपत्र में अधिसूचना द्वारा , नियत करे और विभिन्न क्षेत्रोंके लिए विभिन्न तारीखें नियत की सकेंगी ।

[PART II-SEC . 3 ( i) ] 2. केंद्रीय मोटर यान नियम, 1989 के नियम 115 के उपनियम ( 11 ) में खंड ( ख ) के पश्चात् निम्नलिखित खंड अन्तः स्थापित किए जाएंगे , अर्थात्: -
" (
ख) 3500 कि.ग्रा. के समतुल्य या उससे कम जी वी डब्ल्यू वाले परिवहन यान निम्नलिखित यानों के अनुरूप होंगे । टाइप अनुमोदन (टी ए ) तथा ( सी ओ पी ) के लिए सीमा मान

टिप्पण :
1 .
(क) सीओपी प्रयोजकों के लिए कोई शिथिलीकरण नहीं होगा ।
(ख) परीक्षण, मूल नियमों के उपाबंध 4क में विनिर्दिष्ट रूप में इंजन डायनामोमीटर पर किए जाएंगे । (ग) निदिष्टि ईंधन में अधिकतम 0.05 प्रतिशत सल्फर तत्व होंगे ।

उर्पयुक्त मानों का पालन करने के लिए वाणिज्यिक ईंधन में अधिकतम सल्फर तत्व 0.05 प्रतिशत तक होंगे । 3. जब पूरे भार सहित अपरिवर्ती गति पर परीक्षण किया जाए और जब उसे नियम 115 ( 9 ) के उपाबंध I के अनुसार विभिन्न अंकित स्रावों के लिए प्रकाश अवशोषण गुर्णाक के रूप में व्यक्त किया जाए तो दृश्यमान प्रदूषकों ( धूम्र ) का उतसर्जन धूम्र के घनत्व के सीमामान से अधिक नहीं होगा ।
4. प्राकृतिक रूप से एस्पीरेटिड और टर्बो से चार्ज किए गए इंजनों के लिए मुक्त त्वरक धूम्र, नियम 115 ( 2 ) (ग ) में यथाविहित धूम्र घनत्व सीमामान से अधिक नहीं होगा ।
(घ) 3500 कि.ग्रा. से अधिक जी वी डब्ल्यू वाले यान निम्नलिखित मानों के अनुरूप होंगे-

टिप्पण:
1.

आलोक रावत, संयुक्त सचिव टिप्पण: - मूल नियम सां.का.नि. 590 ( अ ) तारीख 2 जून , 1989 को अधिसूचित किए गए थे और अंतिम बार सा.का.नि. 642 ( अ ) तारीख 28 जुलाई , 2000 द्वारा उनमें संशोधन किए गए थे ।

G.S.R. 106(E ) . The following draft rules further to amend the Central Motor Vehicles Rules 1989 , which the Central Government proposes to make in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988 ) is hereby published as required by sub -section ( 1 ) of section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration after expiry of the period of thirty days from the date on which the copies of this notification , as published in the Gazette of India , are made available to the public;
Any objections or suggestions which may be received from any person with respect to the said draft rules within the expiry of the period specified above will be considered by the Central Government;
The objections or suggestions to these rules be sent to the Joint Secretary (Transport ), Ministry of Road Transport and Highways , Transport Bhawan , New Delhi , within the period , specified above .
DRAFT RULES
1. (i ) These rules may be called the Central Motor Vehicles( Amendment) Rules, 2001 .
( ii ) They shall come into force--
(a) in the National Capital Territory of Delhi ,after six months from the date of their final publication in the Official Gazette; and THE GAZETTE OF INDIA : EXTRAORDINARY
[PART II-SEC. 3 (i) ] (b) in respect of the commercial vehicles which are plying on inter- State routes or on national permits within the jurisdiction of National Capital Territory of Delhi and in respect of any vehicles in other areas of the country , from such date as the Central Government may, by notification appoint in the Official Gazette; and different dates may be appointed for different areas .
2. In the Central Motor Vehicles Rules, 1989 , in rule 115, in sub - rule ( 11 ), after clause( B) , the following clauses shall be inserted , namely: -
" (C) Transport Vehicles with GVW equal to or less than 3500 kg shall conform the following norms .--

NOTES:
1. ( a) There shall be no relaxation for COP purposes .
(b) The tests shall be on the engine dynamometer as specified in Annexure IV A of the principal rules .
(c) The reference fuel shall be of a maximum of 0.05% sulphur contents.
2. Commercial fuel for meeting above norms shall be up to 0.05% mass maximum sulphur content .
3. The emission of visible pollutants ( smoke) shall not exceed the limit value to smoke density , when expressed as light absorption coefficient for various nominal flows as in Annexure - I to rule 115 (9) when tested at constant speeds over full load.
4. The free acceleration smoke for naturally aspirated and turbo-charged engines shall not exceed the smoke density limit value as in rule 115 (2) (c) .
