New Delhi , the 1st March , 2001 का. आ. 184( अ) -जबकि भारत कोकिंग कोल लिमिटेड की कोयला खदानों, विशेष रूप से, झारखंड राज्य के धनबाद जिले में बागडिघी की कोयला खदानों में 2 फरवरी , 2001 को दुर्घटनाएं हुई हैं, जिनमें कुछ व्यक्ति मारे गये हैं ;
S.O. 184 (E).-Whereas accident has occurred in the colliery of Bharat Coking Coal Limited, more particularly in the Bagdighi colliery in District of Dhanbad ofJharkhand state , on 2nd February, 2001 causing loss of lives;
और जबकि केन्द्रीय सरकार की राय है कि दुर्घटनाएं होने के कारणों और परिस्थितियों की औपचारिक जांच- पड़ताल आयोजित करवायी जानी चाहिए और इसके साथ - साथ दुर्घटना होने के कारणों के लिए जिम्मेदारी निर्धारित करना भी आवश्यक है ।
Andwhereas the Central Government is of opinion that formal inquiry into the causes and the circumstances attending the accidents ought to be held and in addition it is also necessary to fix responsibility for the causes leading to the accident .
अतः , अब, खान अधिनियम, 1952 ( 1952 का 35 ) की धारा 24 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार ऐसी जांच- पड़ताल आयोजित करने और तीन माह की अवधि के भीतर एक रिपोर्ट प्रस्तुत करने के लिए झारखंड उच्च न्यायालय के न्यायाधीश न्यायमूर्ति गुरुशरण शर्मा, को नियुक्त करती है । , केन्द्रीय सरकार जांच- पड़ताल आयोजित करवाने में असेसर के रूप में निम्नलिखित व्यक्तियों को भी नियुक्त करती है, अर्थात्:
Now, therefore, in exercise of the powers conferred by Sub - section ( 1 ) of Section 24 of the Mines Act, 1952 (35 of 1952 ) , the Central Government hereby appoints Justice Gurusharan Sharma , Judge , High Court of Jharkand to hold such inquiry and present a report with a period of three months . The Central Government also appoints the following persons as assessors in holding of the inquiry, namely:
1. प्रो. रवीन्द्र नाथ, प्रोफेसर आफ माइनिंग अभियांत्रिकी, बनारस हिन्दू विश्वविद्यालय, वाराणसी ।
1. Prof. Ravinder Nath , Professor of Mining Engincering, Banaras Hindu University, Varanasi .
2. श्री कमलेश सहाय , अध्यक्ष,
2. Shri Kamlesh Shahay, President , CCL Colliery Karamachari Sangh , Barkakhana..
