भारतीय प्रतिभूति और विनिमय बोर्ड ( स्टाक दलाल और उप- दलाल ) ( संशोधन ) विनियम, 2001
का. आ. 1128 ( अ).- बोर्ड, भारतीय प्रतिभूति और विनिमय बोर्ड अधिनियम, 1992 ( 1992 का 15 ) की धारा 30 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए एतद्वारा भारतीय प्रतिभूति और विनिमय बोर्ड ( स्टाक दलाल और उप - दलाल ) विनियम, 1992 का और संशोधन करने के लिये निम्नलिखित विनियम बनाता है ।
I. (i ) इन विनियमों को भारतीय प्रतिभूति और विनिमय बोर्ड ( स्टाक दलाल और उप- दलाल) ( संशोधन ) विनियम, 2001 कहा जा सकेगा ।
(ii ) वे राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
II. भारतीय प्रतिभूति और विनिमय बोर्ड ( स्टाक दलाल और उप - दलाल ) विनियम , 1992 में: -
1. विनियम 2 में, खंड (च ) के पश्चात्, निम्नलिखित खंड अंतःस्थापित किया जायेगा , अर्थात्: -
" (चक) ' स्व- समाशोधन सदस्य ' से व्युत्पन्नी एक्सचेंज या स्टाक एक्सचेंज के व्युत्पन्नी खंड के समाशोधन निगम या समाशोधन गृह का सदस्य अभिप्रेत है जो संव्यवहारों का समाशोधन

[PART II-SEC. 3 (ii)] तथा निपटान केवल इसके स्वयं के लेखे में या इसके ग्राहकों के लेखे में कर सकेगा, और किसी अन्य व्यापारिक सदस्य(यों ) के लिये प्रतिभूतियों में संव्यवहारों का समाशोधन तथा निपटान नहीं करेगा । "
2. विनियम 16क में , उप-विनियम (2) में: -
क) शब्दों "या स्व - समाशोधन सदस्य" को शब्दों " समाशोधन सदस्य" के पश्चात् अंतःस्थापित किया जायेगा ;
ख) परंतुक में, शब्दों "या स्व - समाशोधन सदस्य" को शब्दों "समाशोधन सदस्य" के पश्चात् अंतःस्थापित किया जायेगा ।
3. विनियम 16ग में ,
क) उप-विनियम (3 ) के पश्चात्, निम्नलिखित उप- विनियम परिवर्धित किया जायेगा, अर्थात्: -
" (4) आवेदक जो स्व समाशोधन सदस्य के रूप में कार्य करने की वाँछा करता है, उप- विनियम ( 1 ) की अपेक्षाओं की अनुपालना करने के अतिरिक्त , के पास रु.100 लाख की न्यूनतम शुद्ध मालियत होगी और कम से कम रु.50 लाख की राशि या उच्चतर रकम व्युत्पन्नी एक्सचेंज या व्युत्पन्नी खंड के समाशोधन निगम या समाशोधन गृह के पास समय - समय पर विनिर्दिष्ट रूप में जमा करेगा । "
ख) स्पष्टीकरण में, शब्दों " उप - विनियम (2 ) और (3 ) " के लिये, शब्द "उप- विनियम (2 ) , (3 ) और (4 ) " प्रतिस्थापित किये जायेंगे ।
4. विनियम 16छ में: -
क) उप-विनियम ( 1 ) में, शब्दों "या स्व- समाशोधन सदस्य " को शब्दों " समाशोधन सदस्य" के पश्चात् अंतःस्थापित किया जायेगा ;
ख) उप-विनियम (2) में, शब्दों "या स्व-समाशोधन सदस्य" को शब्दों "जहाँ व्यापारिक या समाशोधन सदस्य" के पश्चात् तथा शब्दों " जिस पर व्यापारिक या समाशोधन सदस्य" के पश्चात् भी अंतःस्थापित किया जायेगा । 3

5. विनियम 16ज में, -
क) शीर्षक में , शब्दों " या स्व- समाशोधन सदस्य " को शब्दों "समाशोधन सदस्य" के पश्चात् अंतःस्थापित किया जायेगा ;
ख) उप -विनियम ( 5) के पश्चात्, निम्नलिखित उप- विनियम परिवर्धित किया जायेगा, अर्थात्: -
" (6) उप- विनियम (1) से (5) के उपबंध स्व- समाशोधन सदस्य को यथावश्यक परिवर्तन सहित लागू होंगे । "
विनियम 16झ में ; - 6.
(i) उप-विनियम ( 1 ) में, शब्दों " , स्व- समाशोधन सदस्य " को शब्दों " व्यापारिक सदस्य " के पश्चात् अंतःस्थापित किया जायेगा ;
(ii) उप-विनियम ( 2 ) में, शब्दों " या स्व- समाशोधन सदस्य" को शब्दों " समाशोधन सदस्य " के पश्चात् अंतःस्थापित किया जायेगा ;
(iii) उप-विनियम (3 ) में , शब्दों " या स्व- समाशोधन सदस्य" को शब्दों " समाशोधन सदस्य" के पश्चात् अंतःस्थापित किया जायेगा ;
( iv) उप-विनियम (4) में, शब्दों "या स्व- समाशोधन सदस्य" की शब्दो "समाशोधन सदस्य" के पश्चात् अंतःस्थापित किया जायेगा । "
7. अनुसूची । में ; -
क) प्ररूप कक में ; -
i) प्ररूप कक के शीर्षक में, शब्दों "और / या स्व- समाशोधन सदस्य" को शब्दों "समाशोधन सदरय " के पश्चात् अंतः थापित किया जायेगा ;
ii ) मद 3 में , शब्दों " और / या स्व- समाशोधन सदस्य" को शब्दों "समाशोधन सदस्य" के पश्चात्अंतःस्थापित किया जायेगा ; तथा
iii) मद 4 में , शब्दों "या स्व- समाशोधन सदस्य" को शब्दों "आवेदक से समाशोधन सदस्य" के पश्चात् अंतःस्थापित किया जायेगा ।
ख) प्ररूप घक में , शब्दों "या स्व - समाशोधन सदस्य" को शब्दों "के अध्यधीन व्यापारित । समाशोधन सदस्य" के पश्चात् अंतःस्थापित किया जायेगा । THE GAZETTE OF INDIA : EXTRAORDINARY

क) शीर्षक में , शब्दों "या स्व- समाशोधन सदस्य" को शब्दों " समाशोधन सदस्य" के पश्चात् अंतःस्थापित किया जायेगा ;
ख) खंड 2 में , स्पष्टीकरण में , शब्दों "व्यापारों का मूल्य भी होगा । " के पश्चात्, निम्नलिखित वाक्य अंतःस्थापित किया जायेगा, अर्थात्: -
" तथापि, विकल्प संविदाओं के लिये, 'वार्षिक व्यापारावर्त' की संगणना विकल्प संविदाओं के लिये व्यापारित प्रीमियम के आधार पर की जायेगी और यदि जहाँ विकल्प प्रयुक्त / नियत होता है , 'वार्षिक व्यापारावर्त' की संगणना प्रयुक्त / नियत विकल्प संविदाओं के आनुमानिक मूल्य के आधार पर की जायेगी , व्यापारित प्रीमियम के आधार पर संगणित 'वार्षिक व्यापारावर्त' के अतिरिक्त । "
खंड 2 के पश्चात्, निम्नलिखित खंड अंतःस्थापित किया जायेगा : -
ग)
" 2क "स्व - समाशोधन सदस्य" प्रत्येक वर्ष खंड 1 एवं 2 में यथा विनिर्दिष्ट फीस का भुगतान करेगा । खंड 3 से 6 के उपबंध स्व- समाशोधन सदस्य को यथावश्यक परिवर्तन सहित लागू होंगे । "

SECURITIES AND EXCHANGE BOARD OF INDIA (STOCK BROKERS AND SUB- BROKERS) (AMENDMENT) REGULATIONS, 2001
S.O. 1128 (E). In exercise of the powers conferred by sub - section ( 1 ) of Section 30 of the Securities and Exchange Board of India Act, 1992 ( 15 of 1992 ) , the Board hereby makes the following regulations to further amend the Securities and Exchange Board of India ( Stock Brokers and Sub-Brokers ) Regulations , 1992 .
I. ( i ) These Regulations may be called the Securities and Exchange Board of India Stock Brokers and Sub - Brokers ) ( Amendment ) Regulations , 2001 .
(ii ) They shall come into force on the date of their publication in the Official Gazette .

[PART II-SEC . 3(ii) ] II . In the Securities and Exchange Board of India ( Stock Brokers and Sub- brokers ) Regulations , 1992: -
1. In regulation 2, after clause ( f) , the following clause shall be inserted ; namely: -
(fa) self- clearing member' means a member of a clearing corporation or clearing house of the derivatives exchange or derivatives segment of a stock exchange who may clear and settle transactions on its own account or on account of its clients only , and shall not clear or settle transactions in securities for any other trading member (s ) . "
2. In regulation 16A, in sub- regulation (2) ; -
a) the words " or self-clearing member" shall be inserted after the words "clearing member" ;
b) in the proviso, the words " or self-clearing member " shall be inserted after the words "clearing member" .
3. In regulation 16C ,
a) after sub - regulation ( 3) , the following sub- regulation shall be added , namely: - (4) An applicant who desiresto act as a self clearing member, in addition to complying with the requirements of sub - regulation ( 1 ) , shall have a minimum net worth of Rs.100 lacs and shall deposit at least a sum of Rs.50 lacs or higher amount with the clearing corporation or clearing house of the derivatives exchange or derivatives segment in the form specified from time to time. " b) In the Explanation , for the words , " sub - regulation (2) and (3) " , the words , "sub- regulations (2), (3) and (4)" shall be substituted.

4. In regulation 16G; -
a) in sub- regulation ( 1 ) , the words " or self-clearing member" shall be inserted after the words " clearing member" ;
b) in sub- regulation (2) , the words " or self clearing member" shall be inserted after the words "Where a trading or clearing member" and also after the words " whereupon the trading and clearing member " .
5. In regulation 16H , -
a) in the heading , the words "or self- clearing member" shall be inserted after the words " clearing member" .
b) after sub - regulation ( 5) , the following sub- regulation shall be added , namely: -
(6) The provisions of sub- regulation ( 1 ) to ( 5) shallbe applicable mutatis mutandis to a self- clearing member . "
6. In regulation 161 ; -
(1) in sub - regulation ( 1 ) , the words "self -clearing member" shall be inserted after the words " a trading member, " ;
(ii) in sub - regulation ( 2) , the words "or self- clearing member " shall be inserted after the words " clearing member" ;
(iii) in sub - regulation (3) , the words " or self- clearing member " shall be inserted after the words "clearing member" .
(iv) In sub - regulation (4) , the words " or self- clearing member" shall be inserted after the words " clearing member" .

a) In Form AA; -
i) In the Heading of Form AA , the words " and / or a self- clearing member" shall be inserted after the words " clearing member" ;
ii ) in item 3, the words " and / or a self- clearing member " shall be inserted after the words " clearing member" ; and
iii) In item 4, the words " or self- clearing member" shall be inserted after the words "details of the clearing member " .
b) In Form DA, the words " or self-clearing member" shall be inserted after the words " as trading / clearing member ".
8. In Schedule IV; -
a) In the heading , the words "OR SELF - CLEARING MEMBER " shall be inserted after the words "CLEARING MEMBER " .
b) In clause 2, in the Explanation , after the words , " expiration of derivative contracts" , the following sentence shall be inserted , namely : -
However , for option contracts , the `annual turnover' shall be computed on the basis of the premium traded for the option contracts and in case where the option is exercised / assigned , the ` annual turnover ' shall be computed on the basis of the notional value of the option contracts exercised / assigned , in addition to the annual turnover ' computed on the basis of premium traded " .
c) After clause 2, the following clause shall be inserted : -
2A The " self-clearing member " shall pay every year a fee as specified in clause 1 & 2. The provisions of clauses 3 to 6 shall be applicable mutatis mutandis to a self- clearing member . "
