सा. का. नि. 865( अ ).-केन्द्रीय सरकार, कपड़ा उपक्रम ( राष्ट्रीयकरण ) अधिनियम, 1995 ( 1995 का 39 ) की धारा 36 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित नियम बनाती है , अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम कपड़ा उपक्रम ( राष्ट्रीयकरण ) दावा नियम, 2001 है ।
(2) ये सरकारी राजपत्र में अपने प्रकाशन की तारीख से लागू होंगे ।
2. परिभाषाएं-इन नियमों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो ,-
(क) " अधिनियम " से कपड़ा उपक्रम ( राष्ट्रीयकरण ) अधिनियम, 1995 ( 1995 का 39 ) अभिप्रेत है;
(ख) " धारा " से उक्त अधिनियम की धारा अभिप्रेत है;
( ग) उन शब्दों और पदों के , जो इन नियमों में प्रयुक्त हैं और परिभाषित नहीं है किन्तु अधिनियम में परिभाषित है, वहीं अर्थ होंगे , जो उनके लिए क्रमशः उक्त अधिनियम में है ।
3. सूचना देने के लिए समय-सीमा-किसी ऐसी संपत्ति का , जो इस अधिनियम के अधीन , यथास्थिति, केन्द्रीय सरकार या किसी विद्यमान सरकारी ( कंपनी ) में निहित थी , प्रत्येक बंधकदार और ऐसी संपत्ति में या उसके संबंध में कोई भार, धारणाधिकार या अन्य हित धारण करने वाला प्रत्येक व्यक्तिऐसी तारीख से, जो अधिनियम की धारा 20 के अधीन केन्द्रीय सरकार द्वारा विनिर्दिष्ट की जाए, तीस दिन की अवधि के भीतर ऐसे बंधक, भार, धारणाधिकार या अन्य हित की सूचना आयुक्त को देगा:
परन्तु यदि आयुक्त का यह समाधान हो आता है कि बंधकदार, या कोई भार , धारणाधिकार या अन्य हित धारण करने वाला व्यक्ति किसी पर्याप्त कारण से तीस दिन की उक्त अवधि के भीतर सूचना देने से निवारित हो गया था तो वह, ऐसे कारणों को लेखबद्ध करके, तीस दिन की और अवधि के भीतर, सूचना प्राप्त कर सकेगा, किन्तु उसके पश्चात् नहीं ।
4. सूचना देने की रीति ( 1 ) नियम 3 के अधीन आयुक्त को दी जाने वाली प्रत्येक सूचना लिखित रूप में होगी , आयुक्त को संबोधित की जाएगी और उसमें निम्नलिखित विशिष्टियां होंगी, अर्थात्: -
(क) बंधकदार या ऐसी संपत्ति में या उसके संबंध में भार, धारणाधिकार या अन्य हित धारण करने वाले व्यक्ति का नाम , वर्णन और पूरा पता;

[PART II SEC. 3 ( i) ] (ख) ऐसे कपड़ा उपक्रम का नाम, वर्णन और पूरा पता जिसकी बाबत दावा किया जाता है;

(घ) लिखित की विशिष्टियां , यदि कोई हों, जिसके द्वारा बंधक, भार, धारणाधिकार या अन्य हित प्रतिभूत किया जाता है , जिसे लिखित की अनुप्रमाणित प्रति द्वारा समर्थित किया जाए;
( ङ) पहले से प्राप्त रकम, यदि कोई हो, विशिष्टयों सहित;
(च) दावे से सुसंगत कोई अन्य विशिष्टियां; और
(छ ) दावाकृत अनुतोग।
(2 ) प्रत्येक सूचना, बंधकदार या भार, धारणाधिकार या अन्य हित धारण करने वाले व्यक्ति या उसके द्वारा सम्यक् रूप से प्राधिकृत व्यक्तिद्वारा सम्यक् रूप से हस्ताक्षरित और सत्यापित की जाए ।
(3 ) उपनियम ( 1 ) के अधीन प्रत्येक सूचना संदाय आयुक्त के कार्यालय, एनटीसी परिसर कोर- IV, स्कोप काम्प्लेक्स, 7, लोधी रोड, नई दिल्ली को सभी कार्य दिवसों को कार्यालय समय के दौरान फाईल की जा सकेगी या रसीदी रजिस्ट्रीकृत डाक द्वारा भेजीजा सकेगी।

New Delhi . the 27th November, 2001
G.S.R. 865 (E ) . In exercise of the powers conferred by Section 36 of the Textile Undertakings (Nationalisation) Act, 1995 (39 of 1995 ) the Central Government hercby makes the following rules, namely :-
1. Short title and commencement.-( 1 ) These rules may be called the Textile Undertakings (Nationalisation) Claims Rules , 2001 .
(2) Tlicy smail comevato force on the date of their publication in the Official Gazette.
2. Definitions .--in those rules , unless the context otherwise requires ,---
(a) "Act" means the Textile Undertakings (Nationalisation ) Act , 1995 (39 of 1995);
(b) " section" means a section of the Act;
(c) words and expressions used in these rules and not defined but defined in the Act shall have the meanings respectively assigned to them in the Act .
3. Time limit for intimation.--Every mortgagee of any property which was vested under the Act in the Central Government or in an existing Government (company ) as the case may be, and every person holding any charge, lien or other interest in , or in relation to , any such property , shall give intimation of such mortgage, charge, lien or other interest, to the भारत का राजपत्र असाधारण

Comnussioner within a period of thirty days from such date as may be specified by the Central Government under section 20 of theAct .
Provided that if the Commissioner is satisfied that the mortgagee or the person holding any charge , lien or other intcrest was prevented by sufficient cause from giving the intimation within the said period of thirty days , he may, after recording reasons in writing , receive the intimation within a further period ofthiry days but not thereafter.
4.Manner of intimation.--( 1 ) Every intimation to be given to the Commissioner under rule 3, shall be in writing , addressed to the Commissioner and shall contain the following particulars , namely:-
(a) name, description and full address of the mortgagce or the person holding charge , lien or other interest in or in relation to such property;
(b) name, description and full address of the textile undertaking in respect of which the claim is made.

(2) Every intimation should be duly signed and verified by the mortgagee or the person holding the charge, lien or other interest , or by a person duly authorised by the mortgagee or the person holding the charge , as the casemaybe.
(3) Every intimation under sub - rule ( 1 ) shall be filed in the offico of the Commissioner of Payments at NTC Promises Corc- IV, Scope Complex, 7, Lodhi Road, New Delhi, on all working days during office hours or may be sent by registered post with acknowledgement due.
