सं. एन.- 10/ 12 /2001-पी.वी. सेल. भारतीय प्रसारण निगम, प्रसार भारती ( भारतीय प्रसारण निगम ) अधिनियम, 1990 ( 1990 का 25 ) की धारा 9 की उपधारा ( 2 ) के साथ पठित धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार के पूर्व अनुमोदन से, निम्नलिखित विनियम बनाना है , अर्थात्:-
1. संक्षिप्त नाम और प्रारम्भ:
( 1 ) इन विनियमों का संक्षिप्त नाम प्रसार भारती ( भारतीय प्रसारण निगम ) प्रसारण ( इंजीनियर) सेवा विनियम , 2001 है । (2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएँ:
इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,
(क) " अधिनियम " से प्रसार भारती ( भारतीय प्रसारण निगम ) अधिनियम, 1990 ( 1990 का 25 ) अभिप्रेत है;
गयाहै : (ख) " विभागीय प्रोन्नति समिति " से ऐसी समिति अभिप्रेत है जिसका गठन किसी भी श्रेणी में प्रोन्नति या पुष्टि पर विचार करने के लिए किया (ग ) " कर्त्तव्य पद " से अनुसूची 1 में सम्मिलित कोई पद अभिप्रेत है;
(घ) " परीक्षा " से उन सेवाओं/ पदों पर भर्ती के लिए जो भर्ती बोर्ड द्वारा समय- समय पर, विनिर्दिष्ट किए जाएं, भर्ती बोर्ड द्वारा संचालित प्रतियोगिता परीक्षा अभिप्रेत है ;
(ड) " सरकार " से भारत सरकार अभिप्रेत है;
(च) " श्रेणी" से सेवा श्रेणी अभिप्रेत है;
(छ) किसी श्रेणी के संबंध में निर्यामत सेवा से उस श्रेणी में दीर्घकालीन नियुक्ति के लिए विहित प्रक्रिया के अनुसार चयन के पश्चात् उस श्रेणी मेंकीगई सेवा की अवधि या अधियां अभिप्रेत हैं और उनमें ऐसी अवधि या अवधियां भी सम्मिलित हैं जो: -
1. उन व्यक्तियों के मामले में, जो सेवा के आरंभिक गठन के समय नियुक्त किए गये थे, ज्येष्ठता के प्रयोजन के लिए गणना में ली जाती है/हैं; या 2. जिसके दौरान कोई अधिकारी उस श्रेणी में कर्त्तव्य पद धारण करता , यदि वह छुट्टी पर न होता या अन्यथा ऐसा पद धारण करने के लिए उपलब्ध न होता ;

[PART III-SEC. 4] (ज) " अनुसूची" से इन विनियमों की अनुसूची अभिप्रेत है;
(झ ) " अनुसूचित जातियों और " " अनुसूचित जन जातियों " के क्रमशः वही अर्थ होंगे जो संविधान के अनुच्छेद 366 के खंड ( 24 ) और (25) में उनके हैं;
(अ ) " सेवा " से विनियम 3 के अधीन गठित प्रसारण ( इंजीनियर ) सेवा अभिप्रेत है ; और
(ट ) उन शब्दों और पदों के जो इन विनियमों में प्रयुक्त हैं और परिभाषित नहीं हैं किन्तु अधिनियम में परिभाषित हैं, क्रमशः वही अर्थ होंगे जो उनके अधिनियम में हैं ।
3. प्रसारण ( इंजीनियर ) सेवा का गठन:
( 1 ) प्रसारण ( इंजीनियर ) सेवा के नाम से ज्ञात एक सेवा का गठन किया आएगा जिसमें विनियम 6 और 7 के अधीन सेवा में नियुक्त किए गए व्यक्ति भी होंगे ।
(2 ) यह सेवा आकाशवाणी और दूरदर्शन के लिए एक ही होगी ।
4. श्रेणी, वेतनमान और उसकी प्राधिकृत संख्या:
(1 ) इन विनियमों के प्रारंभ की तारीख को सेवा की विभिन्न श्रेणियों में सम्मिलित किए गए कर्त्तव्य पद, उनकी संख्या और उनके वेतनमान वे होंगे जो अनुसूची 1 में विनिर्दिष्ट हैं ।
( 2 ) इन विनियमों के प्रारंम्भ होने के पश्चात्, विभिन्न श्रेणियों में कर्त्तव्य पदों की प्राधिकृत संख्या वह होगी जो निगम द्वारा , समय - समय पर, अवधारित की जाए ।
5. सेवाके सदस्य:
( 1 ) निम्नलिखित व्यक्ति सेवा के सदस्य होंगे :
(क) विनियम 6 के अधीन कर्त्तव्य पदों पर नियुक्त किए गए व्यक्ति, और
(ख ) विनियम 7 के अधीन कर्त्तव्य पदों पर नियुक्त किए गए व्यक्ति ।
( 2 ) वह व्यक्ति, जो उपविनियम ( 1 ) के खंड ( क) के अधीन नियुक्त किया जाता है , ऐसी नियुक्ति पर, अनुसूची 1 में उसे लागू होने वाली समुचित श्रेणी में सेवा का सदस्य माना जाएगा ।
( 3 ) वह व्यक्ति, जो उपषिनियम ( 1 ) के खंड ( ख ) के अधीन नियुक्त किया जाता है , ऐसी नियुक्ति की तारीख से, अनुसूची 1 में उसे लागू होने वाली समुचित श्रेणी में सेत्रा का सदस्य होगा ।
6. सेवा का आरंभिक गठन:
( 1 ) भारतीय प्रसारण ( इंजीनियर ) सेवा नियम , 1981 के अधीन नियुक्त भारतीय प्रसारण ( इंजीनियर ) सेवा के ऐसे सभी सदस्य, जो नियमित आधार पर पद धारण कर रहे हैं और जिन्होंने अपनी सेवाओं के निगम में अंतरण के लिए विकल्प दिया था, इन नियमों के प्रारम्भ की तारीख से सेवा में तत्स्थानी पदों, श्रेणियों और काडर में नियुक्त किए गए समझे जाएंगे ।
(2) उप विनियम ( 1 ) में विनिर्दिष्ट किसी व्यक्ति की नियमित निरन्तर सेवा को, सेवा में प्रोन्नति, पुष्टि और पेंशन के प्रयोजन के लिए गणना में लिया जाएगा।
7. सेवा का भाषी अनुरक्षण:
( 1 ) विनियम 6 में यथा उपबंधित सेवा के आरंभिक गठन के पश्चात् अनुसूची 1 में निर्दिष्ट किसी श्रेणी में कोई रिक्ति होने पर, उसे इसमें इसके पश्चात् इस विनियम के अधीन उपबंधित रीति में भरा जाएगा ।
( 2 ) श्रेणी 5 में नियुक्तियां निम्नलिखित रूप में की जाएंगी :
(क) श्रेणी 5 में रिक्तियों की 50 प्रतिशत रिक्तियों को अनुसूची 2 में विनिर्दिष्ट शैक्षिक अर्हताओं और आयु- सीमा के आधार पर भर्ती बोर्ड द्वारा संचालित किसी प्रतियोगिता परीक्षा और भर्ती बोर्ड के परामर्श से समय - समय पर निगम द्वारा अधिसूचित किसी परीक्षा स्कीम के परिणामस्वरूप सीधी भर्ती द्वारा भरा जाएगा ।
(ख) श्रेणी 5 में शेष 50 प्रतिशत रिक्तियों को प्रोन्नति के सुसंगत क्षेत्र से इन विनियमों की सूची 2 में श्रेणी 5 में सीधी भर्ती के लिए विहित अर्हताएं रखने वाले और अनुसूची 3 की क्रम सं . 6 के सामने स्तंभ 4 में यथा विनिर्दिष्ट न्यूनतम अर्हक सेवा रखने वाले अधिकारियों की अनुसूची 4 में उपबंधित रूप में सम्यक रूप से गठित विभागीय प्रोन्नति समिति द्वारा गुणागुण के अनुसार चयन के आधार पर प्रोन्नति द्वारा भरी जाएंगी । (3 ) श्रेणी 4 में और उससे उपर के पदों पर सेवा में नियुक्तियां अनुसूची 3 में यथा विनिर्दिष्ट न्यूनतम अर्हक सेवा के साथ अगले निम्न श्रेणी में अधिकारियों में से प्रोन्नति द्वारा की जाएंगी ।
(4) प्रोन्नति के लिए अधिकारियों का चयन, श्रेणी 4 में और अकृत्यिक श्रेणी 3 में पदों पर प्रोन्नति के मामले को छोड़कर गुणागुण के आधार पर चयन द्वारा किया जाएगा । श्रेणी 4 में और अकृत्यक श्रेणी 3 में प्रोन्नतियां अनुसूची 4 के अधीन सम्यक रूप से गठित विभागीय प्रोन्नति समिति की सिफारिशों पर, अयोग्य को अस्वीकार करते हुए, ज्येष्ठता के क्रम में की जाएंगी । 3 [ भाग III- खण्ड 4 ]

8. ज्येष्ठता:
( 1 ) सेवा के आरंभिक गठन के समय विनियम 6 के अनुसार किसी श्रेणी में नियुक्त किए गए सेवा के सदस्यों की सापेक्ष ज्येष्ठता इन विनियमों के प्रारंभ की तारीख से ठीक पूर्व अभिप्राप्य उनकी सापेक्ष ज्येष्ठता के द्वारा शासित होगी : .
परंतु यदि उस तारीख पर किसी ऐसे सदस्य की ज्येष्ठता विनिर्दिष्ट रूप से अवधारित नहीं की गई तो ज्येष्ठता सरकार के अधीन समरूप सेवाओं के सदस्यों को लागू नियमों के अनुसार निगम द्वारा अवधारित की जाएगी ।
(2 ) ऐसे अधिकारी जो सेवा के आरंभिक गठन के पश्चात् किसी श्रेणी में सेवा में सुम्मिलित होते हैं, विनियम 6 के अधीन गठन के समय उस श्रेणी में सेवा में नियुक्त किए गए अधिकरियों से रैंक में नीचे होंगे ।
(3) आरंभिक गठन के पश्चात् सेवा में भर्ती किए गए व्यक्तियों की ज्येष्ठता, उस संबंध में सरकार द्वारा , समय समय पर जारी किए गए साधारण अनुदेशों के अनुसार अवधारित की जाएगी ।
(4 ) उन मामलों में जो उपर्युक्त उपबंधों के अंतर्गत नहीं आते हैं , ज्येष्ठता का अवधारण निगम द्वारा भर्ती बोर्ड के परामर्श से किया जाएगा । 9. परिवीक्षा:
रहेगा: ( 1 ) श्रेणी 5 में, चाहे सीधी भर्ती द्वारा या प्रोन्नति द्वारा सेवा में नियुक्त किया गया प्रत्येक अधिकारी दो वर्ष की अवधि के लिए परिवीक्षा पर परंतु निगम, उन कारणों से जो लेखबद्ध किए जाएंगे, परिवीक्षा की अवधि को बढ़ा या घटा सकेगा:
परंतु यह और कि परिवीक्षा की अवधि को बढ़ाए जाने के लिए कोई भी विनिश्वय, परिवीक्षा की पूर्व अवधि के समाप्ति के पश्चात् आठ सप्ताह के भीतर किया जाएगा और उक्त अवधि के भीतर ऐसा करने के कारणों के महित संबद्ध अधिकारी को लिखित रूप में संसूचित किया जाएगा । (2 ) परिवीक्षा अवधि या उसके किसी विस्तार के संतोषजनक रूप से पूरा होने पर अधिकारियों को उनकी नियुक्यिो में निर्यामत आधार पर प्रतिधारित किया जाएगा और सम्यक अनुक्रम में उनकी पुष्टि की जाएगी ।
(3 ) यदि, यथास्थिति, परिवीक्षा की अधि या उसके किसी विस्तार के दौरान , निगम की यह राय है कि कोई अधिकारी नियमित नियुक्ति के लिए उपयुक्त नहीं है तो निगम , यथास्थिति अभ्यर्थी को सेवा से निर्मुक्त कर सकेगा या उसे सेवा में नियुक्ति के पूर्व उसके द्वारा धारित पद पर पदावनत कर सकेगा या ऐसा आदेश दे सकेगा जिसे वह ठीक समझे ।
( 4 ) परिवीक्षा अवधि या उसके किसी विस्तार के दौरान निगम अधिकारियों से यह अपेक्षा कर सकेगा कि वे परिवीक्षा को संतोषजनक रूप से पूरा करने की एक शर्त के रूप में ऐसा प्रशिक्षण और अनुदेश पाठ्यक्रम पूरा करें और ऐसी परीक्षाएं या परीक्षण ( जिनके अंतर्गत हिन्दी की परीक्षा भी है ) उत्तीर्ण करें जिसे निगम ठीक समझे ।
10. सेवा में नियुक्ति:
' आकाशवाणी ' और ' दूरदर्शन ' में सेवा की सभी श्रेणीयों में सभी पदों के लिए सभी नियुक्तियां निगम द्वारा की जाएंगी । 11. भारत के किसी भाग में सेवा के लिए दायित्व और सेवा की अन्य शर्ते:
( 1 ) सेवा में नियुक्ति किए गए अधिकारी, भारत में कहीं पर भी या भारत से बाहर सेवा करने के लिए दायी होंगे । (2 ) ऐसे मामलों के संबंध में जिनके लिए इन विनियमों में कोई उपबंध नहीं किया जाता है, सेवा के सदस्यों की सेवा की शर्तें वही होंगी जो साधारण रूप में निगम के अधिकारियों को, समय- समय पर लागू होती हैं ।
12. निरर्हताएं:
ऐसाकोई व्यक्ति, -
( क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है ; या
( ख ) जिसने, अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, सेवा में नियुक्ति का पात्र नहीं होगा :
परंतु यदि मरकार का यह समाधान हो जाता है कि ऐसा विवाह, विवाह के पक्षकारों की स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार भी हैं, तो यह किसी व्यक्ति को इस विनियम के प्रवर्तन से छूट दे सकेगी ।
13. शिथिल करने की शक्ति:
जहां निगम की यह राय है कि ऐसा करना आवश्यक या समीचीन है वहां वह उसके लिए जो कारण हैं , उन्हें लेखबद्ध करके और भर्ती बोर्ड से परामर्श करके इन विनियमों के उपबंधों को उच्च अर्हता प्राप्त व्यक्ति के लिए न्यूनतम अर्हक सेवा की बाबत एक वर्ष से अनधिक की अर्वाध के लिए शिथिल कर सकेगाः
परंतु सरकार, किसी समय, निगम द्वारा किए गए आदेशों को उपांतरित या रद्द कर सकेगी ।
14. व्यावृत्ति:
इन विनियमों की कोई भी बात ऐसे आरक्षणों, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी जिनके लिए सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों और अनुसूचित जनजातियों तथा अन्य विशेष व्यक्तियों के लिए उपबंध करना अपेक्षित है । 4

यदि इन विनियमों के निर्वाचन के संबंध में कोई प्रश्न उद्भूत होता है तो उसे निगम द्वारा, यदि आवश्यक हो तो, केन्द्रीय सरकार के परामर्श से, विनिश्चित किया जाएगा ।

टिप्पण:
अकृत्यिक श्रेणी 3 में पदों की अधिकतम संख्या, निम्नलिखित शर्तों के अधीन रहते हुए, ज्येष्ठ कर्त्तव्य पदों ( अर्थात् काडर में श्रेणी 4 और उसके ऊपर के स्तर पर सभी ज्येष्ठ कर्त्तव्य पद ) के 30 प्रतिशत तक निर्बधित रहेगी , कि-
(i ) काडर में कुल संख्या में कोई बढ़ोतरी नहीं होगी, और
( ii ) अकृत्यिक श्रेणी 3 ( रु.12000-375-16500 ) में संचालित पदों की संख्या रु. 10000-325-15200 के वेतनमान में उपलब्ध पदों की संख्या से अधिक नहीं होगी ।
अनुसूची 2
[विनियम 7 का उपविनियम (2 ) देखें ]
भर्ती बोर्ड द्वारा या सरकार के अनुमोदन से विनिश्चित किसी अन्य अभिकरण द्वारा संचालित की जाने वाली प्रतियोगिता परीक्षा के परिणाम पर प्रसारण ( इंजीनियर ) सेवा में सम्मिलित किए गए श्रेणी 5 के पदों पर सीधी भर्ती के लिए न्यूनतम शैक्षिक अर्हताएं और आयु सीमा । अभ्यर्थी के पास: -
( 1) ( i ) भारत में केन्द्रीय या राज्य विधान मंडल के किसी अधिनियम द्वारा निगमित किसी विश्वविद्यालय से; या
( ii ) संसद के किसी अधिनियम द्वारा स्थापित या विश्वविद्यालय अनुदान आयोग अधिनियम , 1956 की धारा 3 के अधीन समझे गए विश्वविद्यालय के रूप में घोषित किसी शैक्षिक संस्था से इलैक्ट्रानिक/दूरसंचार/ इंजीनियरी में डिग्री होगी; या
(iii ) ऐसी अन्य अर्हताएं होंगी जिन्हें भारतीय इंजीनियरी सेवा में प्रवेश के प्रयोजन के लिए संघ लोक सेवा आयोग द्वारा मान्यता दी गई है; या ( iv ) ऐसे विदेशी विश्वविद्यालयों , महाविद्यालयों या संस्थाओं से और ऐसी शर्तों के अधीन जिन्हें इस प्रयोजन के लिए समय- समय पर ऐसी ही परीक्षा के लिए सरकार द्वारा मान्यता दी जाए, इंजीनियरी में कोई डिग्री/डिप्लोमा होगा ।
( 2 ) उस वर्ष की जिसमें परीक्षा ली जाती है, 1 अगस्त को 20 वर्ष की आयु प्राप्त कर ली है किन्तु 30 वर्ष की आयु पूरी नहीं की है ।

प्रसारण ( इंजीनियर ) सेवा की विभिन्न श्रेणियों में सम्मिलित किए गए कर्तव्य पदों पर प्रोन्नति पर अधिकारियों की नियुक्ति के लिए भर्ती की पद्धति प्रोन्नति का क्षेत्र और निकटतम निश्चली श्रेणी में न्यूनतम अर्हक सेवा ।

गुणागुण के आधार पर चयन द्वारा /प्रोन्नति द्वारा
श्रेणी 2 के ऐसे अधिकारी जिन्होंने उस श्रेणी में 8 वर्ष की नियमित सेवा की है या श्रेणी 5 में नियमित आधार पर नियुक्ति के पश्चात् 17 वर्ष की सेवा की है जिसमें से श्रेणी 2 में कम से कम 4 वर्ष की नियमित सेवा होनी चाहिए । 3.
श्रेणी 2
गुणागुण के आधार पर चयन द्वारा /प्रोन्नति द्वारा
ऐसे अधिकारी जिन्होंने श्रेणी 5 में नियमित आधार पर नियुक्तिके पश्चात् कम से कम 13 वर्ष की नियमित मेषा पूरी कर ली है जिसमें से कम से कम 4 वर्ष की नियमित सेवा अकृत्यिक ** में होनी चाहिए या कम से कम 9 वर्ष की नियमित सेवा श्रेणी 3 और श्रेणी 4 में होनी चाहिए ।
4. श्रेणी 3 (अकृत्यिक ) आयोग्य को अस्वीकार करते हए ज्येष्ठता के आधार पर प्रोन्नति द्वारा ।
ऐसे अधिकारी जिन्होंने सेवा की श्रेणी 5 में नियुक्ति के पश्चात् कम से कम 9 वर्ष की नियमित सेवा पूरी कर ली है जिसमें से कम से कम 5 वर्ष की नियमित सेवा श्रेणी 4 में होगी ।

ज्येष्ठता एवं योग्यता के आधार पर प्रोन्नति द्वारा
श्रेणी 4 के ऐसे अधिकारी जिन्होंने उस श्रेणी में 4 वर्ष की नियमित सेवा की है । 6
श्रेणी 5
(1 ) 50% प्रतिशत, गुणागुण के आधार पर चयन द्वारा/प्रोन्नति द्वारा ।
(11) 50 प्रतिशत , विनियम 7 के उपविनियम ( 2 ) के खंड ( क ) के अनुसार सीधी भर्ती द्वारा ।
सिविल निर्माण खंड के अधिकारियों को छोड़- कर आकाशवाणी/दूरदर्शन के ऐमे सहायक इंजीनियर जिन्होंने उस श्रेणी में 3 वर्ष की निय- मित सेवा की है और जिनके पास अनुसूची 2 में श्रेणी 5 में सीधी भर्ती के लिए विहित अर्हताएं हैं । **जहां किसी अधिकारी को सेवा में 13 साल की नियमित सेवा पूरी करने से पूर्व श्रेणी 2 में प्रोन्नत किया जाता वहां वह अकृत्यिक श्रेणी 3 में तब तक बना रहेगा जब तक कि वह श्रेणी 2 के लिए पात्र नहीं हो जाता । तथापि वह प्रोन्नति पर एफ आर 22 ( 1 ) ( क) ( 1 ) के अधीन वेतन नियत किए जाने के फायदे का हकदार हो जाएगा । यह फायदा उसे श्रेणी 2 में उसके स्थानापन्न पर दुबारा प्राप्त नहीं होगा ।

NOTIFICATION
New Delhi , the 22nd November , 2001
No. N - 10/ 12/2000 - PB Cell .- In exercise of the powers conferred by section 33 read with sub - section (2 ) of section 9 of the Prasar Bharati ( Broadcasting Corporation of India ) Act, 1990 ( 25 of 1990 ) , the Corporation , with the prior approval of the Central Government , hereby makes the following regulations , namely
1. Short title and commencement : -
(1) These regulations may be called the Prasar Bharati (Broadcasting Corporation of India ) Broadcasting (Engineers) Service Regulations, 2001 7

(2) They shall come into force on the date of their publication in the Official Gazette .

Definitions:-
In these regulations , unless the context otherwise requires:-
"Act " means the Prasar Bharati ( Broadcasting Corporation of India) Act , 1990 (25 of 1990 ) ; (a)
"Departmental Promotion Committee " means a committee constituted to consider promotion and or confir- (b) mation in any grade ;
(c) "Duty Post " means any post , included in Schedulc- I;
(d) "Examination" means a competitive examination conducted by the Recruitment Board for recruitment to the Service posts as may be specified by the recruitment Board, from time to time;
(e) "Government " means the Government of India ,
(f) "Grade " means a grade of the Service;
(g) "Regular Service " in relation to any grade means the period or periods of service in that grade rendered after selection according to the prescribed procedure for long term appointment to that grade and includes any period or periods:-
(1) taken into account for purpose of seniority in case of those appointed at the initial constitution of the Service.

duringwhich an officer would have held a duty post in that grade but for being on leave or otherwisc not being available for holding such a post , (2)
"Schedule " means a Schedule to these regulations ; (h)
(1) "Scheduled Castes " and " Scheduled Tribes " shall respectively have the same meanings as assigned to them respectively in clauses (24 ) and (25 ) of Article 366 of the Constitution;
(j ) " Service " means the Broadcasting (Engineers ) Service constituted under regulation 3 ; and (k) Words and expressions used therein and not defined in these regulations but defined in the Act shall have the meanings respectively assigned to them in the Act .

Constitution of Broadcasting (Engineers ) Service:-
(1) There shall be constituted a Service known as Broadcasting ( Engineers ) Service consisting of persons appointed to the Service under regulations 6 and 7 .
(2) The Service shall be common for Akashwani and Doordarshan
4.
Grades , scales of pay and its authorized strength :-
(1) The duty posts included in the various grades of the Service , their numbers and scales of pay on the date ofcommencement of these regulations shall be as specified in Schedule I
(2) After the commencement of these regulations , the authorized strength of the duty, posts in various grades shall be such as may, from time to time , be determined , by order, by the Corporation

Members of the Service :-
(1) The following persons shall be the members of the Service:-
(a) persons appointed to duty posts under regulation 6 ; and
(b) persons appointed to duty posts under regulation 7
(1) Aperson appointed under clause ( a ) of sub - regulation ( 1 ) shall , on such appointment , be deemed to be a member of the Service in the appropriate grade applicable to him in Schedule I , from the date of initial constitution of the Service
(3) Aperson appointed under clause (b ) of sub - regulation ( 1 ) shall be a member of the Service in the appropri- ate grade applicable to him in Schedule I from the date of such appointment
Initial Constitution of the Service :-

(3) All the members of the Indian Broadcasting ( Engineers ) Service appointed under the Indian Broadcasting (Engineers) Service Rules , 1981 , holding posts on regular basis and who had opted for transfer of their services to the Corporation , shall be deemed to have been appointed from the date of commencement of thcsc regulations to the corresponding posts , grades and the cadres in the service .
(2) The regular continuous service of a person referred to in sub- regulation ( 1 ) , shall be counted for the purpose 8

7. Future maintenance of the Service :-
(1) Any vacancy arising in any ofthe grades referred to in Schedule I, after the initial constitution of the Service as provided in regulation 6 , shall be filled in the manner hereinafter provided under this regulation .
(2) Appointments to Grade V shall be made as under:
(a) 50% of the vacancies in Grade V shall be filled by direct recruitment on the results of a competitive examination conducted by the Recruitment Board on the basis of the educational qualifications and age limit specified in Schedule I and any scheme of examination that may be notified by the Corpora- tion, in consultation with the Recruitment Board, from time to time
(b) The remaining 50% vacancies in Grade V shall be filled by the Corporation by promotion of officers possessing qualifications prescribed for direct recruitment to Grade V in Schedule II of these regula- tions from the relevant field of promotion and possessing the minimum qualifying service as specified against Serial No. 6 , in Column 4 of Schedule III on the basis of selection by merit by a duly consti- tutedDepartmental Promotion Committec as provided in Schedule IV.
(3) Appointments in the Service to posts in Grade IV and above shall be made by promotion from amongst the officers in the next lower grade with minimum qualifying service as specified in Schedule III .
(4) The selection of officers for promotion shall be made by selection by merit except in the case of promotion to the posts in Grade IV and Non - functional Grade III . Promotion to Grade IV and non - functional grade III shall be made in the order of seniority subject to rejection of the unfit on the recommemdations of the Departmental Promotion Committee duly constituted under Schedule IV.
8. Seniority :-
(1) The relative seniority of members of the Service appointed to any grade in accordance with regulation 6 at the time of initial constitution of the Service , shall be governed by their relative seniority obtaining immediately before the date of commencement of these regulations
Provided that if the seniority of any such member had not been specifically determined on the said date , the same shall be as determined by the Corporation in accordance with the rules applicable to members of similar Services under Government
(2) Officers who join the Service in any grade after its initial constitution shall rank below those appointed to the Service in that grade at the time of the constitution under regulation 6 .
(3) The seniority of persons recruited to the Service after the initial constitution shall be determined in accor- dance with the general instructions issued by Government in the matter, from time to time.
(4) In cases not covered by the above provisions , seniority shall be determined by the Corporation in consul- tation with the Recruitment Board.
9 Probation :
(1) Every officer on appointment to the Service either by direct recruitment or by promotion in Grade V shall be on probation for a period of two years
Provided that the Corporation may extend or curtail the period of probation , for reasons to be recorded inwriting
Provided further that any decision for extension of a probation period shall be taken within cight wecks after the expiry of the previous probationary period and communicated in writing to the concerned officer together with the reasons for so doing within the said period.
(2) Onsatisfactory completion of the period of probation or any extension thercof, officers shall be retained in their appointments on regular basis and be confirmed in due course .
(3) If, during the period of probation or any extension thereof, as the case may be , the Corporation is of the opinion that an officer is not fit for regular appointment , the Corporation may discharge or revert the candidate to the post held by him prior to his appointment in the Scrvice , as the case may be, or pass such orders as it deems fit .
(4) During the period of probation or any extension thercof, officers may be required by the Corporation to undergo such course of training and instructions and to pass such examinations and tests ( including examination in Hindi ) as it may deem fit , as a condition to satisfactory completion of the probation 10 Appointment to the Service :
All appointments to the Service shall be made by the Corporation for all the posts in various grades of the Service in ' Akashvani ' and 'Doordarshan' .

11. Liability for service in any part of India and other conditions of service:
(1) Officersappointed to the Service shall be liable to serve anywhere in India or outside .
(2) Theconditions of service of the members of the Service in respect of matters for which no provision is made in these regulations shall be the same as are applicable , from time to time , to officers of the Corporation in general .
12. Disqualifications : No person-
(a) who, has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living , has entered into or contracted a marriage with any person ,
shall be eligible for appointment to the service:
Provided that the Government may, if satisfied that such marriage is permissible under the personal law ofparties to the marriage and that there are other grounds for so doing , exempt any person from the operation of this regulation .
13. Powerto relax:
Where the Corporation is of the opinion that it is necessary or expedient so to do, it may, by order , for reasonsto berecorded inwriting and in consultation with the Recruitment Board , relax provisions of these regulations with respect to minimum qualifying service for a highly qualified person by a period not exceeding one year :
Provided that the Government may, at any time , modify or cancel the order made by the Corporation.
14. Saving:
Nothing in these regulations shall affect reservations , relaxation of age limit and other concessions required to be provided for persons belonging to the Scheduled Castes and the Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Government, from time to time .
15. Interpretation:
If any question relating to interpretation of these regulations arises , it shall be decided by the Corporation, if necessary, in consultation with the Central Government.

Notes:
The maximum number of posts in the Non - functional Grade III shall be restricted to 30% of the senior duty posts (i.e. all senior duty posts at the level of Grade IV and above in the Cadre ) , subject to the conditions that:-
(i) there is no increase in the overall strength of the Cadre; and
(ii) the number of posts to be operated in the non -functional Grade III (Rs . 12000-375-16500 ) does not exceed the number ofposts available in the pay scale of Rs. 10000-325-15200.

Minimum educational qualifications and age limits for direct recruitment to posts in the Grade V included in Broadcasting (Engineers) Service on the results of the competitive examination to be conducted by the Recruitment Board or by any other agency decided with the approval of the Government .
A candidate shall possess :-
(1) ADegree in Electronic/Telecommunication/Engineering from:--
(i) A University incorporated by an Act of the Central or State Legislature in India ; or
(ii) An educational institution established by an Act of Parliament or declared as deemed to be University under Section 3 of the University Grants Commission Act, 1956; or

[PART III-SEC . 4] ( ii) Possessing such other equivalent qualifications as have been recognized by the UPSC for the purpose of admissionto Indian Engineering Services ; or
( iv) A Degree/Diploma in Engineering from such foreign Universities , Colleges or Institutions and under such conditions as may be recognized by Government for similar examination for the purpose, from time to time.
(2) Attained the age of 20 years and must not have attained the age of30 years as on first day of August of the year inwhich the examination is held.

Officers who have completed not less than 13 years of regu- larservice after appointment on regular basis to Grade V out ofwhich atleast 4 years regular service should be in the non- functional Grade III * or at least 9 years regular service in Grade III and Grade IV.
Officers who have completed atleast 9 years of regular ser- vice after appointment to Grade V ofthe Service out of which atleast 5 years of regular service shall be in Grade IV.
Officers in Grade V with 4 years regular service in the grade.
Assistant Engineers of Akashvani/Doordarshan excluding those in Civil Construction Wing with 3 years regular service in the grade possessing qualifications prescribed for direct recruitment to Grade V in Schedule II .
* Where an officer is Promoted to Grade II before completion of 13 years of regular service in the Service , he will continue to remain in the non - functional Grade III till he becomes eligible for the Grade II . He will, however, be entitled to the benefit ofpay fixation under F. R. 22 ( 1 ) ( a ) ( i ) on promotion. This benefit will not be available again on his placement in Grade II .
