सा. का. नि. 882( अ ) निम्नलिखित प्रारूप नियम , जिन्हे केन्द्रीय सरकार मोटर यान अधिनियम, 1988 (1988 का 59) की धारा 139 की उपधारा (2 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए बनाना चाहती है उक्त अधिनियम की धारा 212 की उपधारा (1 ) की अपेक्षानुसार उन सभी व्यक्तियो की जानकारी के लिए जिनके उसस प्रभावित होने की संभावना है प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियम पर उस तारीख से जिराको भारत के राजपत्र मे यथा प्रकाशित इस अधिसूचना की प्रतिया जनता को उपलब्ध करा दी जाती है 30 दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा ।
उक्त प्रारूप नियमो की बाबत किसी व्यक्ति से इस प्रकार विनिर्दिष्ट अवधि की समाप्ति से पूर्व प्राप्त किन्ही आक्षेपो या सुझावो पर केन्द्रीय सरकार विचार करेगी ।
इस सबध मे आक्षेप या सुझाव सयुक्त सचिव (परिवहन) राड़क परिवहन और राजमार्ग मत्रालय, परिवहन भवन नई दिल्ली-110001 को भेजे जा सकते है
प्रारूप नियम
1 संक्षिप्त नाम और प्रारंभ इन नियमो का सक्षिप्त नाम केन्द्रीय मोटर यान ( अगरतला और ढाका के बीच बस सेवा का विनियमन) नियम 2001 है ।
2 परिभाषाए -इन नियमो में जब तक कि सदर्भ स अन्यथा अपेक्षित न हो
(क) " करार" से भारत गणराज्य की सरकार और बगलौदेश गणराज्य के बीच दोनो देशों के बीच मोटर यान यात्री यातायात के विनियमन के लिए किया गया करार अभिप्रेत है
(ख) " बस कर्मी दल " से चालक और कडक्टर अभिप्रेत है

IPARI II-SFC 3 ( 1 ) (ग) "सक्षम प्राधिकारी " से : -
(1) परिवहन यान के लिए किसी नियमित अनुज्ञापत्र के संबंध मे, संबद्ध देश की विधि के अधीन ऐसा अनुज्ञापत्र जारी करने वाला कोई सक्षम प्राधिकारी अभिप्रेत है ;
(ii ) चालन अनुज्ञप्ति के सबंध में, सम्बद्ध देश की विधि के अधीन चालन अनुज्ञप्ति जारी करने वाला कोई सक्षम प्राधिकारी अभिप्रेत है ;
(iif) कंडक्टर की अनुज्ञप्ति के सबध मे सम्बद्ध देश की विधि के अधीन कंडक्टर की अनुज्ञप्ति जारी करने वाला कोई सक्षम प्राधिकारी अभिप्रेत है ।
(घ) "कंडक्टर प्रमाणपत्र " से करार के अनुच्छेद 3 के खंड (5) के अधीन जारी प्रमाणपत्र अभिप्रेत है ;
(ङ) " चालक अनुज्ञप्ति" से सक्षम प्राधिकारी द्वारा, यथास्थिति, मोटर यान या किसी विनिर्दिष्ट वर्ग या वर्णन के मोटर यान के चालन के लिए उसमे विनिर्दिष्ट व्यक्ति को प्राधिकृत करने के लिए, जारी दस्तावेज अभिप्रेत है;
(च) "परिचय पत्र/दस्तावेज " से सक्षम प्राधिकारी द्वारा करार के अनुच्छेद 3 के खंड (4)या खंड (5) मे निर्दिष्ट जारी किया गया कार्ड/ दस्तावेज अभिप्रेत है ;
(छ) "यात्री यान " बंगला देश और भारत के बीच भाड़े पर या पुरस्कार के लिए यात्रियों को ले जाने के लिए ऐसा कोई मोटर यान अभिप्रेत है, जो सकल ढुलाई भार पहिया आधार, बैठने की क्षमता और यान की संपूर्ण उंचाई के संबंध में ऐसे निबंधनों के अध्यधीन होगा जो किसी भी देश में समय- समय पर प्रचलित हो ;
(ज) "अनुसूची" से इन नियमो से उपाबद्ध अनुसूची अभिप्रेत है ।
3. अनुज्ञापत्र का प्ररूप , अंतर्वस्तु और अवधि आदि (1 ) यात्री यान के लिए कोई मार्ग अनुज्ञापत्र इन नियमों से उपाबद्ध अनुसूची-1 मे दिए गए प्ररूप में होगा और अहस्तांतरणीय होगा ।
(2) यात्री यान के लिए मार्ग अनुज्ञापत्र एक वर्ष के लिए विधिमान्य होगा ।
4. किसी यान की पात्रता संबंधी शर्तें ( 1 ) कोई यात्री यान इस प्रकार सन्निर्मित और अनुरक्षित होगा कि वह सभी समय उस व्यक्ति के प्रभावी नियंत्रण में रहे जो इसको चला रहा है ।
(2) यात्री यान के चालक के पास ऐसे यान की बाबत निम्नलिखित होंगे -
;
(क) सम्बद्ध देश की विधि के अधीन जारी किया गया कोई विधिमान्य रजिस्ट्रीकरण प्रमाणपत्र (ख) सम्बद्ध देश की विधि के अधीन जारी किया गया कोई विधिमान्य उपयुक्तता प्रमाणपत्र ;
(ग) सम्बद्ध देश की विधि के अधीन जारी की गई कोई विधिमान्य बीमा पालिसी और
(घ) सम्बद्ध देश की विधि के अधीनजारी किया गया कोई विधिमान्य मार्ग अनुज्ञापत्र,
और उक्त दस्तावेज ऐसे यान का निरीक्षण करने के लिए सक्षम प्राधिकारी द्वारा निरीक्षण के लिए उपलब्ध कराए जाएंगे ।
5 चालक/ कंडक्टर के लिए शर्तें (1 ) किसी परिवहन यान को चलाने वाले व्यक्ति के पास सक्षम प्राधिकारी द्वारा ऐसे यान को चलाने के लिए अनुसूची-2 में दिए गए प्ररूप में जारी की गई विधिमान्य चालन अनुज्ञप्ति और चालक का परिचय पत्र/ दस्तावेज होगा ।
(2) किसी यात्री यान के कंडक्टर के पास अपने-अपने सक्षम प्राधिकारी द्वारा जारी किए गए विधिमान्य कंडक्टर का प्रामणपत्र और कंडक्टर का परिचयपत्र/ दस्तावेज होगा । भारत का राजपत्र असाधारण

(3) यदि किसी कारण से किसी देश के उपनियम (1 ) मे निर्दिष्ट कोई चालक या उपनियम (2) मे निर्दिष्ट कोई कडक्टर, दूसरे देश में अपने कर्तव्यो का निर्वहन करने में असमर्थ रहता है तो किसी सक्षम प्राधिकारी द्वारा जारी किए गए विधिभान्य अनुज्ञप्ति/ प्रमाणपत्र और परिचयपत्र का धारक कोई चालक या कडक्टर यान को चला या नियत्रित कर सकेगा ।
6 यात्री यान पर सम्प्रदर्शित की जाने वाली सुभिन्नकारी विशिष्टियां-अपनी-अपनी सरकार के सक्षम प्राधिकारी द्वारा करार के अधीन चलाए जा रहे किसी यात्री यान को समनुदिष्ट रजिस्ट्रीकरण सख्या के अतिरिक्त, निम्नलिखित विशिष्टिया यात्री यान की दोनो तरफ की सफेद सतह पर लाल रंग से अग्रेजी और अपनी-अपने देश की राजभाषा मे पेट किया जाएगा जो एक ईंच (25 से ० मी ०) से अन्यून उँचाई और एक ईंच (25 से0 मी 0) से अन्यून चौड़ाई के प्रत्येक अक्षरो मे स्पष्ट रूप से यात्री यान से जुड़ी सपाट सतह या प्लेट या प्लेटो पर पेट किया हो, अर्थात्
(1) देश का नाम, और
(11 ) प्रत्येक देश में आरभिक और समाप्ति बिदु ।
7 बस कर्मीदल की निजी चीजबस्त यात्री यान के बस कर्मीदल ऐसी निजी चीजबस्त जिसमे पहनने के कपड़े, बिरतरा और पका हुआ भोजन भी है, ले जा सकता है जो अपने-अपने देश के यात्रियो के यात्री सामान नियमो के अधीन अनुज्ञेय हो ।
8 यान का बीमा- ऐसा कोई यात्री यान जिसकी कोई ऐसी बीमा पालिसी नही है जिसके अतर्गत व्यापक या तीसरे पक्ष का ऐसा जोखिम है, जो यात्री यान के उपयोग से उद्भूत होता हो, और सबद्ध देश की विधि की अपेक्षाओ का अनुपालन करता हो , इन नियमो के अधीन नही चलाया जाएगा ।
9 सवारियो के परिवहन के लिए शर्तें- ऐसा कोई परिवहन यान जो बगलादेश मे रजिस्ट्रीकृत है, भारत में किसी स्थान से भारत में किसी अन्य स्थान तक के लिए यात्रियो के परिवहन के लिए नही लगाया जाएगा और उसी प्रकार ऐसा कोई परिवहन यान जो भारत मे रजिस्ट्रीकृत है उसे बंगलादेश में किसी स्थान से बगलादेश में किसी अन्य स्थान तक सवारियो के परिवहन के लिए नही लगाया जाएगा ।

NOTIFICATION
New Delhi , the 6th December, 2001
G.S.R. 882(E) . The following draft rules which the Central Government proposes to make in exercise of the powers conferred by sub - section( 2 ) of section 139 of the Motor Vehicles Act , 1988 (59 of 1988 ) are hereby published as required by sub- section ( 1 ) of section 212 of the said Act for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules will be taken into consideration after the expiry of a period of 30 days from the date on which the copies of this notification as published in the Gazette of India are made available to the public .
Any objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period so specified will be considered by the Central Government .
The objections or suggestions may be sent to the Joint Secretary ( Transport ) . Ministry of Road Transport and Highways , Transport Bhavan , New Delhi - 110001 .
DRAFT RULES
1. Short title and commencement : These rules may be called the Central Motor Vehicles (Regulation of Bus Service Between Agartala and Dhaka ) Rules , 2001 .
2. Definitions : - In these rules , unless the context otherwise requires , --
(a) "Agreement" means the Agreement between the Government of the Republic of India and the Peoples ' Republic of Bangladesh for the Regulation of motor vehicles passenger traffic between the two countries ;
(b) *"bus crew" means driver and conductor;
(c) "competent authority" means ,
( i)
in relation to a regular permit for transport vehicle , an authority competent to issue such permit under the law of the country concerned;
(ii)
in relation to driving licence , an authority competent to issue driving licence under the law of the country concerned;
(iii) in relation to a conductor's licence , an authority competent to issue conductor's licence under the law of the country concerned;

(d) "Conductor's Certificate " means a certificate issued under clause ( 5 ) of Article III of the Agreement;
(e) "Driving Licence " means the document issued by a competent authority as the case may be, authorizing the person specified therein to drive a motor vehicle or a motor vehicle of any specified class or description;
(f) "Identity Card/Documents " means the identity card/ documents issued by the competent authority as referred to in clause (4) or ( 5 ) of Article III of the Agreement ;
( g) "passenger vehicle " means motor vehicle for the carriage of passengers for hire or reward between Bangladesh and India subject to such restrictions on the gross laden weight , wheel base , seating capacity and overall height of vehicle as may be operating in either country from time to time ;
(h) " Schedule " means a Schedule annexed to these rules .
3. Forms , contents and duration , etc. of the permit : - ( 1 ) A route permit for passenger vehicle shall be in the form set out in the Schedule I annexed to these rules and shall be non- transferable .
(2) A route permit for passenger vehicle shall be valid for one year at a time .
4. Eligibility conditions of a vehicle : ( 1 ) A passenger vehicle shall be so constructed and maintained as to be at all times under the effective control of the person driving it .
( 2) Driver of a passenger vehicle shall have-
( a ) a valid registration certificate ;
(b ) a valid certificate of fitness ;
( c ) a valid insurance policy ; and
(d) a valid route permit ;
issued under the law of the country concerned in respect of such vehicle and shall make the said documents available for inspection by any authority competent to inspect such vehicle .
5. Conditions for the driver/ conductor: - ( 1 ) The person driving a passenger vehicle shall be in possession of a valid driving licence to drive such a vehicle and driver's identity card /document issued by a competent authority in the form set out in Schedule 11 .

(2) The conductor of a passenger vehicle shall be in possession of a valid conductor's certificate and a conductor's identity card/document issued by the respective competent authority.
(3) If, for any reason , a driver referred to in sub - rule ( 1 ) or a conductor referred to in sub- rule (2) of a country is unable to perform his duties in the other country , a driver or a conductor in possession of a valid driving licence/certificate and identity card issued by a competent authority , may drive or control the vehicle.
6. Distinguishing particulars to be exhibited on the passenger vehicle : - In addition to the registration number assigned to a passenger vehicle , operating under the Agreement, by the competent authority of the respective Government , the following particulars shall be painted in English and in the official language of the respective country in red colour on white surface on both the sides of the passenger vehicle each letter being not less than one inch (2.5 cm) high and one inçli (2.5 cm) wide legibly painted on a plain surface or a plate or plates affixed to the passenger vehicle, namely : -
(i) Name of the country, and
( ii) Starting and terminal points in each country .
7. Personal effects of bus crew: The bus crew of a passenger vehicle may carry such personal effects , including wearing apparel, bedding and cooked food, as permissible under the passenger baggage rules of the respective country.
8. Insurance of the vehicle :- No passenger vehicle which does not have a policy of insurance, which covers comprehensive or third party risks , arising out of the use of the passenger vehicle and which complies with the requirements of the law of the country concerned shall operate under these rules .
9. Conditions for transport of passengers :- No transport vehicle registered in Bangladesh shall be engaged in the transport of passengers from any point in India to any other point in India, and similarly no transport vehicle registered in India shall be engaged in the transport of passengers from any point in Bangladesh to any other point in Bangladesh .
