सा.का.नि. 912 (अ ) .- केन्द्रीय सरकार, राजनयिक और कोंसलीय आफिसर(शपथ और फीस ) अधिनियम, 1948 (1948 का 41 ) की धारा 8 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राजनयिक और कोंसलीय आफिसर ( शुल्क) नियम, 1949 का और संशोधन करने के लिए , निम्नलिखित नियम बनाती है, अर्थात्: -
1. (1) इन नियमों का नाम राजनयिक और कोंसलीय आफिसर (फीस ) संशोधन नियम 2001 है ।
(2) ये 1 जनवरी, 2002 से प्रवृत्त होंगे ।
2. राजनयिक और कोंसलीय आफिसर(फीस ) नियम 1949 की अनुसूची 1 के स्थान पर,

मामले जिनकी बाबत फीस उद्ग्रहणीय है

1 (क) पूर्णस्वामिक स्थावर संपदा या जंगम संपत्ति के विक्रय, क्रय, मुख्तारनामा बंधक, अंतरण, दान आदि से संबंधित शपथपत्रों/ दस्तावेजों का अनुप्रमाणन या किसी कौंसलीय आफिसर द्वारा ऐसे मामलों से संबंधित किसी दस्तावेज का जारी किया जाना ।

1 (ख) जहां कोई कोंसलीय आफिसर उपरोक्त मद 1 (क) में वर्णित कोई दस्तावेज तैयार करता है या तैयार करने में सहायता करता है ।

2 (क) सिविल दस्तावेजों का अनुप्रमाणन (शपथपत्र, शैक्षिक डिग्रियां, प्रयोजन प्रमाणन, विवाह प्रमाणपत्र बिल, मुख्तारनामा आदि)

(ख) जहां कोई कोंसलीय आफिसर, कोसलीय निर्देशिका के अनुसार मद 2(क) में वर्णित कोई दस्तावेज तैयार करता है या तैयार करने में सहायता करता है ।

3. (क) विदेश से भारत को निर्यात से संबंधित व्यापार/ वाणिज्यिक दस्तावेजों का अनुप्रमाणन या किसी प्रमाणपत्र को (उद्भव का देश आदि) जारी किया जाना ।

3 (ख) भारत से विदेश को निर्यात से संबंधित व्यापार/ वाणिज्यिक दस्तावेजों का अनुप्रमाणन या किसी प्रमाणपत्र का जारी किया जाना ।

4 किसी विवाह का अनुष्ठापन करने वाला कोई कोंसलीय आफिसर किसी विवाह प्रमाणपत्र का रजिस्ट्रकरण और प्रविष्टि की एक प्रमाणित प्रति ( सभी ) । 3

5. (क) जलयान के विक्रय , क्रय , बंधक, अंतरण से संबंधित दस्तावेजों या वाणिज्यिक जलयान में अपचे हित के अन्तरण काअनुप्रमाणन ।

5 (ख) पोत/जलयान से संबंधित अन्य दस्तावेजों का अनुप्रमाणन या किसी दस्तावेज का प्रमाणपत्र या सत्यापन या प्रतिग्रहण जारी किया जाना या " वाणिज्यिक पोत " पर कोंसलीय निर्देशिका के अध्याय IX के अनुसार कोई कार्रवाई करना । पोत परिवहन कंपनी (या कंपनी की ओर से जलयान का कप्तान) आवेदक/ कोंसलीय फीस को देने वाला है ।

5 ( ग) " वाणिज्यिक नौवहन " पर कोंसलीय निर्देशिका के अध्याय IX के अनुसार दस्तावेजों का अनुप्रमाणन, या किसी नाविक को प्रमाणपत्र जारी किया जाना (व्यक्तिक नाविक अपने व्यष्टिक उपयोग के लिए 'आवेदक है) ।
अन्य सेवाओं के संबंध में फीस
260 320 या सम्पत्ति के प्राक्कलित मूल्य का 2.5% , इनमें से जो भी अधिक हो ।
6 (क) किसी भारतीय नागरिक या किसी अन्य व्यक्ति की जो नाविक नहीं है, जिसकी निर्वसीयत मृत्यु हो जाती है, कोंसलीय आफिसर के निवास स्थान के देश में अवस्थित संपत्ति के प्रशासन या वितरण या दोनों के लिए या जब निर्वसीयत मृत्यु नहीं होती है, तब उसकी मृत्यु के देश में मृतक व्यक्ति के वैध रूप से सक्षम प्रतिनिधि की अनुपस्थिति में या, यथास्थिति, भारत में रह रहे मृतक व्यक्ति के विधिक वारिसों के अनुरोध पर ले जाती है ।

6 (ख ) यदि ऐसी संपत्ति किसी कोंसलीय आफिसर के समवर्ती प्रत्यायन के देश में है ।
1,270 या संपत्ति के प्राक्कलित मृत्यु का 2.5 प्रतिशत , इन में से जो भी अधिक हो । 6 (ग) कोंसलीय निर्देशिका में यथा अधिकथित उत्तराधिकार प्रमाणपत्र का जारी किया जाना ।
सम्पदा या संपत्ति के प्राक्कलित मूल्य का 2.5%
7. ऐसी संदाय जिनसे चांसरी से दूर आवेदक के अनुरोध पर किसी कोंसलीय आफिसर की यात्रा या उपस्थिति अपेक्षित है ।
प्रत्येक यात्रा तथा मांगी गई सेवा की बाबत कोंसली फीस के लिए आफिसर यात्रा भत्ता और दैनिक भत्ता तथा 103 अमरीकी डालर अथवा 127 यूरो प्रति अनुप्रमाणन । 4

8 (क) पेंशन भोगियों से संबंधित पेंशन कागजपत्रों, जीवन प्रमाणपत्र आदि का अनुप्रमाणन

8 (ख) वेतन या पेंशन की घोषणा के लिए अपेक्षानुसार कोंसलीय आफिसरों के हस्ताक्षर और मुद्रा लगाने के लिए ।

9 ( क) ऐसे अन्य प्रकीर्ण अनुप्रमाणन सिविल प्रमाणपत्रों का जारी किया जाना, कोंसलीय निर्देशिका के अनुसार नोटेरी सेवाएं जो पूर्वोवत श्रेणियों में से किसी के अंतर्गत न्यहीं आती है; जन्म का पंजीकरण और प्रविष्टि की एक प्रमाणित प्रति ।

9 (ख) जहां कोंसलीय आफिसर मद 29 (क) में वर्णित सेवाओं से संबंधित किसी दस्तावेज को तैयार करता है या तैयार करने में सहायता करता है ।

25 9 (ग) मृत्यु का पंजीकरण और प्रविष्टि की एक प्रमाणित प्रति इस प्रावधान के साथ कि मिशन प्रमुख/ केन्द्र प्रमुख अपने विवेकानुसार इन शुल्कों को माफ कर सकते हैं ।

10. ऐसे किसी भारतीय राष्ट्रिक के भारतीय पासपोर्ट का रद्द किया जाना जिसकी विदेश में मृत्यु हो जाती है ।
टिप्पणी :-दरें प्रति सत्यापन के हिसाब से हैं और उन पृष्ठों पर जिन पर मिशन की गोल मोहर लगी हुई है , उसके लिये अतिरिक्त प्रभार नहीं लिया जायेगा ।

NOTIFICATION
New Delhi, the 20th December , 2001
G.S.R. 912 (E) . In exercise of the powers conferredby section 8 of the Diplomatic Officers (Oaths and Fees ) Act, 1948 , (41 of 1948) , the Central Government hereby makes the following rules further to amend the Diplomatic and Consular Officers (Fees) Rules , 1949 , namely: -
1. (1) These rules may be called the Diplomatic and Consular Officers (Fees) Amendment Rules , 2001 .
(2) They shall come into force on 1 January 2002 .
2 . Inthe Diplomatic and Consular Officers (Fees) Rules , 1949 , for Schedule - I , the following shall be substituted: -

62 5(B) Attestation of other documents pertaining to ship /vessel for issue of a certificate or verification or acceptance of a document or taking any action as per Chapter IX of the Consular Manual on ' Merchant Shipping ' . The Shipping Company (or Captain of vessel on behalf of Company) being applicant/payee of consular fee .

5(C) Attestation of documents of issue of certificates to a sailor as per Chapter IX of the Consular Manual on 'Merchant Shipping ' ( individual sailor being applicant for his individual use) .
Fee in respect of other services
260 320 or 2.5 per cent of estimated value ofthe property/ estate , whichever ismore.
6(A) For administration or distribution, or both of the property situated in country , of the Consular Officer's residence , of an Indian citizen or any other person , not being a seaman, dying intestate , or if not intestate , whenundertaking in the absence of legally competent representative of the deceased in country of his death or a request of legal heirs of deceased living in India as the casemay be.
6(B) If such property is in country of concurrent accreditation ofa Consular Officer .
