सा.का.नि. 930( अ ) .- अभिहित प्राधिकारी,, यू०के ० , जर्मनी,, बलगारिया और ब्राजील । जिसे इसक बाद 'विषयगत देश' कहा गया है । में मूलतः उत्पादित या वहा से निर्यातित , सीमाशुल्क र्टारफ अधिनियम , 1975 11975 का 51। की पहली अनुसूची के उपशीर्ष स0 550130 और 5503 30 क अतर्गत आन वाली एर्कीलिक फाइबर ।जिसे इसके बाद ' विषयगत माल ' कहा गया है । क आयात क मामले में, भारत क राजपत्र, असाधारण, भाग I , खंड 1 तारीख 23 नवम्बर , 2001 म प्रकाशित अपन प्रारंभिक निष्कर्षों में इस निष्कर्ष पर पहुंचे है कि, -
।क । यू० कं ० , जर्मनी,, बलगारिया और ब्राजील के निर्यातक विषयगत माल को उनके सामान्य मूल्य स कम मृल्य पर निर्यात कर रहे हैं जिसक फलस्वरूप पाटन हुआ हे , । ख । भारतीय उद्याग का तात्विक क्षति पहुंची है ,
। ग । विषयगत दशा स आयातों से सचयी रूप से क्षति कारित हुई है;
आर विषयगत दशो में मूलत उत्पादित या वहां से निर्यातित और भारत में आयातित विषयगत माल क सभी आयाता पर, अभिहित प्राधिकारी ने , अंतिम अवधारण के लंबित रहने तक , पाटनराधी शुल्क को अनतिम रूप से अधिरापित करना आवश्यक समझा है,
अतः, अब, कन्द्रीय सरकार, सीमाशुल्क टैरिफ पाटित वस्तुओं की पहचान, उस पर प्रतिपाटन शुल्क का निर्धारण और संग्रहण तथा क्षति का अवधारण । नियम 1995 के नियम 13 और 20 क साथ पठित उक्त सीमाशुल्क टैरिफ अधिनियम की धारा 9 क की उपधारा ।2 । द्वारा

[PART II-SEC. 3 (i) ] प्रदत्त शक्तियों का प्रयोग करते हुए , अभिहित प्राधिकारी के निष्कर्षों के आधार पर, विषयगत देशो में मूलतः उत्पादित या वहां से निर्यातित उक्त सीमाशुल्क टैरिफ अधिनियम की पहली अनुसूची के उपशीर्ष सं 0 550130 और 5503.30 के अंतर्गत आने एकीलिक फाइबर पर, जब उसका इससे उपाबद्ध सारणी के स्तंभ ।2 । में वर्णित निर्यातक द्वारा निर्यात और भारत में आयात किया जाए, उक्त सारणी के स्तंभ ।3 । में उल्लिखित रकम प्रति किलोग्राम के बराबर दर से प्रतिपाटन शुल्क अधिरापित करती है ।

2 इस अधिसूचना के अधीन अधिरोपित प्रतिपाटित शुल्क 30 जून, 2002 तक, जिसमें यह तारीख भी सम्मिलित है, प्रभावी होगा और भारतीय मुद्रा में देय होगा ।
स्पष्टीकरण. इस अधिसूचना के प्रयोजनों के लिए, ऐसे प्रतिपाटित शुल्क की संगणना के प्रयोजनों के लिए लागू "विनिमय दर " वह दर होगी जो सीमाशुल्क अधिनियम , 1962 1962 का 52। की धारा 14 की उपधारा ।3 । के खड । क । के उपखंड ।। के अधीन शक्तियों का प्रयोग करते हुए , समय - समय पर जारी की गई भारत सरकार के वित्त मंत्रालय ।राजस्व विभाग । की अधिसूचना में विनिर्दिष्ट की गई है और "विनिमय दर" के अवधारण के लिए सुसंगत तारीख उक्त सीमाशुल्क अधिनियम की धारा 46 के अधीन "प्रवेश पत्र" के प्रस्तुत करने की तारीख होगी ।

G.S.R. 930 (E).-- WHEREAS in the matter of import of Acrylic Fibre (hereinafter referred to as ' the subject goods' ) , falling under sub -heading No. 5501.30 or 5503.30 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975 ) , originating in, or exported from UK, Germany , Bulgaria and Brazil (hereinafter referred to as ' subject countries ' ) , the designated authority vide its preliminary findings, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 7th December, 2001 , has come to the conclusion that-
(a) Acrylic Fibre has been exported to India from subject countries below its normal value;
(b) the domestic industry has suffered material injury;
(c) the material injury has been caused by the dumped imports from subject countries;
and the designated authority has considered it necessary to impose anti -dumping duty, provisionally, pending final determination , on all imports of the subject goods , originating in , or exported from, the subject countries;

NOW, therefore , in exercise of the powers conferred by sub-section (2) of section 9A of the said Customs Tariff Act, read with rules 13 and 20 of the Customs Tariff (Identification , Assessment and Collection of Anti -dumping Duty on Dumped Articles and for Determination of Injury) Rules , 1995, the Central Government, on the basis of the above findings of the designated authority, hereby imposes on Acrylic Fibre, falling under sub-heading No. 5501.30 or 5503.30 of the First Schedule to the said Customs Tariff Act, originating in, or exported from subject countries , and exported by exporters specified in column (2) of the Table annexed hereto, and imported into India , an anti -dumping dutyat the rates specified in column (3) ofthe said Table.

2. The anti -dumping duty imposed under this notification shall be effective upto and inclusive of the 30th day of June, 2002, and shall be payable in Indian currency.
Explanation. For the purposes of this notification, " rate of exchange" applicable for the purposes of calculation of anti -dumping duty shall be the rate which is specified in the notification of the Government of India in the Ministry of Finance (Department of Revenue) , issued from time to time , in exercise of the powers under sub-clause (i) of clause (a) of sub - section (3) of section 14 of the Customs Act, 1962 (52 of 1962) and the relevant date for the determination of the " rate of exchange" shall be the dateofpresentation of the "bill of entry " under section 46 of the said Customs Act .

सा.का.नि. 931 ( अ ) केन्द्रीय सरकार वित्त अधिनियम 2001 2001 का 14। की धारा 119 की उपधारा (ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , 1 जनवरी 2002 को ऐसी तारीख के रूप में नियुक्त करती है, जिसका सीमाशुल्क टैरिफ अधिनियम 1975 11975 का 51। की पहली अनुसूची का, उक्त वित्त अधिनियम की तीसरी अनुसूची में यथाउपबंधित रूप में संशोधन किया जायेगा ।

In exercise of the powers conferred by section 25 of the Customs Act , 1962 ( 52 of 1962), or, as the case may be, sub- section( 1 ) of section 9A of the Customs Tariff Act, 1975( 51 of 1975 ) , read with clause (b) of section 119 of the Finance Act, 2001 ( 14 of 2001 ) , the Central Government , being satisfied that it is necessary in the public interest so to do , hereby directs that each of the notifications of the Government of India, in the Ministry of Finance ( Department of Revenue) , specified in column(2 ) of the Table hereto annexed , shall be amended or further amended , as the case may be , except as respects things done or omitted to be done before such amendments , in the manner specified in the corresponding entry in column( 3) of the said Table .
