का.आ. 15 ( अ ).- केंद्रीय सरकार, राष्ट्रीय राजमार्ग (राजमार्ग/स्थाई पुल/ राजमार्ग पर अस्थाई पुल के खंड के उपयोग के लिए किसी व्यक्ति द्वारा फीस का संग्रहण) नियम, 1997 के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 ( 1956 का 58) की धारा 7 और धारा 8क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के तत्कालीन सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. -432(अ) तारीख 6 जून, 1997 को उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हे ऐसे अधिक्रमण के पूर्व किया गया है या करने से लोप किया गया है, महाराष्ट्र राज्य में राष्ट्रीय राजमार्ग के भाग अर्थात् (-) 0/115 किलोमीटर (थाणे) पर मैजीवडे जंक्शन) से 23/509 किलोमीटर तक (मंबई आगरा रोड़ पर 539/500 किलोमीटर पर जुड़ता है) और जिसके अंतर्गत रेती बंदर पर मुंबई-पूणे मार्ग को जोड़ने वाली लिंक और लूप मार्ग भी है । (जिसे इसके पश्चात् थाणे- भिवंडी बाईपास कहा गया है) , के निर्माण , रखरखाव, प्रबंध और प्रचालन में अंर्तग्रस्त व्यय , विनिधत पूंजी पर ब्याज, विनिधत पूंजी पर युक्तियुक्त वसूली, टैरिफ की मात्रा और मैसर्ज आइडियल रोड़ बिल्डर्स लिमिटेड, जिसका रजिस्ट्रीकृत कार्यालय 501 दत्ता आश्रम, हिंदू कालोनी, लेन नं0 1 , दादर, मुंबई 400014 पर है, के साथ किए गए करार की अवधि को ध्यान में रखते हुए , अधिसूचित करती है कि थाणे-भिवंडी बाईपास के उपयोग के लिए यांत्रिक यानों पर नीचे अनुसूची में विनिर्दिष्ट दरों पर फीस उदगृहीत और संदत्त की जाएगी और उक्त मैसर्ज आइडियल रोड़ बिल्डर्स लिमिटेड को राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से 13 मई, 2017 तक उक्त अनूसुची में विनिर्दिष्ट दरों पर फीस संग्रहीत और प्रतिधारित करने के लिए प्राधिकृत करती है । 44 G1/2002

जब उसी वान को दिन में एक से अधिक बार उक्त थाणे-भिवडी बाईपास को पार करना पडा है तो उपयोक्ता स्त्रे वह विकल्प होगा कि वह पहली पारी में हीं बाईपास के पार कस्ते समय उपयुक्त दरों के डेढ़ गुमा का सदाय करे वा यदि वान को संपूर्ण मास के या उससे भी अधिक अवधि के लिए लगातार और प्रायः बास्कर उपयोग करना पडता है तो यान का स्वामी, ऊपर क्वादिनिर्दिष्ट उसने लामु 30 एकल दर के समतुल्य प्रभार कम संदाय करके मासिक पास प्राप्त कर सकता है ।

2. निम्नलिखित किस्म के यानों को पथकर से छूट दी जाती है और मैसर्ज आइडियल रोड बिल्डर्स लिमिटेड उनको निशुल्क इस प्रसुविधा का लाभ उठाने के लिए अनुज्ञात करेगी:-
(i) रक्षा यान
(ii) वी.आई.पी. प्रतिक वाले यान
(iii) पुलिस यान (विधि प्रवर्तन अभिकरण)
(iv) अग्निशमन यान
(v) एंबुलैंस
(vi) शव यात्रा वैन
(vii) डाक और तार विभाग के यान
(viii) केंद्रीय सरकार और राज्य सरकार के यान
3. शासकीय रूप से निम्नलिखित से संबंधित यान वी.आई.पी. प्रतिक वाले यान माने जाएंगे, अर्थात्:-
भारत के राष्ट्रपति और उपराष्ट्रपति, केंद्रीय मंत्री और राज्यों के मंत्री, लोक सभा/राज्य सभा में विपक्ष के नेता, राज्य विधान मंडल में ऐसे व्यक्ति जिन्हें कैबिनेट मंत्री का दर्जा प्राप्त है, राज्यपाल/उपराज्यपाल/ कार्यकारी पार्षद/ लोक सभा स्पीकर/ राज्य विधान मंडलों के अध्यक्ष, भारत की शासकीय यात्रा पर आए विदेशी उच्च प्राधिकारी, भारत में ठहरे हुए विदेशी राजनयिक जो सी.डी. संकेत वाली कारों का प्रयोग करते हैं ।
4. उपरोक्त उल्लिखित दरें, पथकर पलाजा और पथकर पलाजा से दो सौ मीटर आगे अंग्रेजी, हिंदी और राज्य की भाषाओं में संप्रदर्शित की जानी हैं जो चालक के स्थान से पढ़ने योग्य होनी चाहिए । उक्त मैसर्ज आइडियल रोड बिल्डर्स लिमिटेड इस अधिसूचना के अधीन पथकर फीस की वसूली के प्रत्येक अवसर पर प्राप्ति रसीद देंगे ।

NOTIFICATION
New Delhi , the 4th January , 2002
S. O. 15 (E ) -In exercise of the powers conferred by sections 7 and 8A of the National Highways Act, 1956 ( 58 of 1956) , read with rule 3 of the National Highways (Collection of Fees by any Person for the Use of Section of National Highways/Permanent Bridge/Temporary Bridge on National Highway) Rules , 1997 and , in supersession of the notification of the Government of India in the erstwhile Ministry of Road Transport And Highways. No.S.O.432 (E) , dated the 6th June, 1997, except as respects things done or omitted to be done before such supersession, the Central Government , having regard to the expenditure involved in building , maintenance , management and operation ofpart of the National Highway, i.e. , starting from Km. (-) 0/115 ( Maziwadi Junction at Thane) to Km.23/509 ( joining Mumbai- Agra Road at Km.539/500) and includes link and loops to connect to Mumbai -Pune Road at Reti Bunder (hereinafter referred to as the Thane- Bhiwandi Bypass ) in the State of Maharashtra, interest on the capital invested, reasonable return on the capital invested, the volume of traffic and the period of agreement entered into with M/s . Ideal Road Builders Limited, having its registered office at 501 , Dattashram Hindu Colony, Lane No. 1 , Dadar, Mumbai -400014, hereby notifies that there shall be levied and paid fees on mechanical vehicles for the use Thane - Bhiwandi Bypass at the rates specifies in the Schedule below and authorizes the said M/s . Ideal Road Builders Limited to collect and retain the fees at the rates specified in the said Schedule from the date of publication of this notification in the Official Gazette to the 13thmay, 2017.

[PARTII-SEC.3(ii)] ote: When the same vehicle has to cross the said Thane - Bhiwandi Bypass more than once in a day, the users shall have the option to pay one and half times the above rates while crossing the bypass in the first trip itself or if the vehicle has to use the bypass continuously and quite frequently for entire month or even beyond that for much longer period, the vehicle owner can have a monthly pass on the payment of charges equal to 30 single rates /rate applicable to it as specified above .

3. In the said rules , in rule 3 , in sub - rule ( 1) , the following proviso shall be added , namely: -
"Provided that the race horses which have been registered by the owners with the Turf Authorities shall not, on intimation of such registration to the prescribed authority, require registration under this rule and the general conditions as specified in rule 8 shall apply to such registration subject to such other conditions as may be imposed by the prescribed authority" .
4. In the said rules, in rule 8, in sub rule (1 ) , -
(a) for the word " shall " , the word " may " shall be substituted;
(b) in clause (xvii ) , -
(i) the words ' an air cushioned ' shall be omitted;.
(ii) for the figure and word " 3 times " , the words " eight times " shall be substituted, -
(iii) aftersub - clause ( d) , the following sub - clauses shall be inserted , namely:-
"(e) each horse immediately after the race and again after a period of six hours but within eight hours of the race shall be subject to the veterinary inspection to check for injuries .
(f) the horses shall be housed in stables admeasuring 12ft X 12ft with adequate facility for the horses to see each other with adequate provision for proper ventilation and protection against heat, and an environmentally friendly atmosphere as far as possible.";
(iv) the following proviso shall be added at the end , namely: -
"Provided that if the whip is used more than eight times in a race, the prescribed authority in consultation with the Turf Authorities shall decide, if the use of such whip in excess of the number specified , was for any reason to save the horse or the jockey from any accident, for the purpose of initiating any action under the Act.";
(c) in clause xx, at the end , 6

[PART II SEC. 3(ii) ] the following shall be added namely: -
"and the use of steroids shall be avoided as far as possible provided the steroids may be used if no other option is availak'e to be supported by a veterinary prescription and the purchase of such steroids shall be from a duly authorized source ." ;
(d) after clause xxiv , the following new clause shall be inserted, namely: -
"xxv. ' persons desirous of transporting horses from one place to another shall adhere to the following minimum norms to enhance conditions of travel as also safety of the horses , namely: -
(a) no horse shall be tied up in such a way that his head and neck movements are unnaturally restricted while travelling.
(b) all horses must be watered at least every four hours and provided adequate ration of hay during the journey lasting more than eight hours .
(c) adequate ventilation and free flow of fresh air in the vehicle shall be ensured during transport .
(d) rubber mats shall preferably be used for flooring instead of straw bedding.
(e) horses shall not be transported within twenty four hours of having raced.
(f) no horse shall be raced, where the period of journey exceeds six hours , unless twenty four hours have elapsed since completion of the travel . "
