सा.का.नि. 22 (अ) .-केन्द्रीय सरकार खान और खनिज ( विकास और विनियमन ) अधिनियम , 1957 ( 1957 का 67 ) की धारा 18 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, खनिज संरक्षण और विकास नियम, 1988 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम खनिज संरक्षण और विकास ( संशोधन ) नियम, 2002 है ।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. खनिज संरक्षण और विकास नियम , 1988 ( जिन्हें इसमें इसके पश्चात् मूल मियम कहा गया है ) के नियम 8 के उपनियम ( 1 ) के खंड (ख ) में " एक वर्ष" शब्दों के स्थान पर " बारह मास " शब्द रखे जाएंगे ।
3. मूल नियमों के नियम 10 के उपनियम ( 2 ) में, " या ऐसे उपांतरणों के साथ अनुमोदन कर सकेगा जो वह समीचीन समझे " शब्दोंके स्थान पर निम्नलिखित शब्द रखे जाएंगे , अर्थात्:-
" या ऐसे उपांतरणों के साथ जिन्हें वह समीचीन समझे, नब्बे दिन की अवधि के भीतर अनुमोदन कर सकेगा । "
4. मूल नियमों के नियम 27 के उपनियम ( 4 ) के स्थान पर निम्नलिखित उपनियम रखा जाएगा, अर्थात्:-
" (4 ) इन नियमों के अधीन अपेक्षित रेखांक और खंड नियम 42 के उपनियम ( 1 ) के खंड ( ख ) में यथानिर्दिष्ट प्रवर्ग ' क' की खानों की दशा में तीन मास के भीतर और किसी अन्य खान की दशा में बारह मास के भीतर अध्यतन रखे जाएंगे" ।
5. मूल नियमों के नियम 28 के उपनियम ( 5 ) के खंड ( ii ) में " 15 " अंक के स्थान पर " बीस " शब्द रखा जाएगा ।
6. मूल नियमों के नियम 29 में, " 31 मार्च को या उससे पूर्व " शब्दों और अंकों के स्थान पर, " 30 जून को या उससे पूर्व " शब्द और अंक रखे जाएंगे ।
7. मूल नियमों के नियम 50 के पश्चात् निम्नलिखित नियम अंतःस्थापित किया जाएगा, अर्थात्:- " 50क. खनन पट्टों के समामेलन की सूचना अधिनियम या उसके अधीन बनाए गए नियमों के उपाबंधों या खनन पट्टे के निबंधनों और शर्तों 108 GI/2002

[PART II-SEC . 3 ( i ) ] पर प्रतिकूल प्रभाव डाले बिना, प्रत्येक खनन पट्टा धारक खनिज रियायत नियम , 1960 के नियम 38 के अधीन किए गए खनन पट्टोंके ममामेलन की तारीख से तीस दिन के भीतर उसकी सूचना महानियंत्रक और राज्य सरकार को भेजेगा । "
8. मूल नियमों के नियम 58 के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्:-
" 58. शास्तिः जो कोई इन नियमों के उपबंधों में से किसी का उल्लंघन करेगा तो वह ऐसे कारावास से, जिसकी अवधि दो वर्ष तक की हो सकेगी या जुर्माने से जो पचास हजार रुपए तक हो सकेगा अथवा दोनों से और निरंतर उल्लंघन की दशा में ऐसे अतिरिक्त जुर्माने से, जो पहले ऐसे उल्लंघन के लिए दोषसिद्धि के पश्चात् ऐसे प्रत्येक दिन के लिए जिसके दौरान ऐसा उल्लंघन जारी रहता है , पांच हजार रुपए तक का हो सकेगा , दंडनीय होगा :
परंतु बार- बार उल्लंघन के लिए दंड केवल कारावास के रूप में ही होना चाहिए :
परंतु यह और कि इन नियमों के अधीन दंडनीय कोई अपराध, अभियोजन संस्थित किए जाने से पूर्व या उसके पश्चात्, उस अपराध की बाबत न्यायालय में परिवाद करने के लिए प्राधिकृत अधिकारी द्वारा उस अधिकारी को ऐसी धनराशि के संदाय पर जिसे वह अधिकारी विनिर्दिष्ट करें शमन किया जा सकेगा और वह धनराशि सरकार के खाते में जमा की जाएगी :
परंतु यह भी कि केवल जुर्माने से दंडनीय किसी अपराध की दशा में, ऐसी धनराशि उस जुर्माने की अधिकतम रकम से अधिक नहीं होगी जो उस अपराध के लिए अधिरोपित की जा सकेगी:
परंतु यह और कि जहां कोई अपराध इन नियमों के अधीन शमन कर दिया जाता है वहां, यथास्थिति कोई कार्यवाही या आगे कार्यवाही इस प्रकार किए गए अपराध की बाबत अपराध शमन के विरुद्ध नहीं की जाएगी और यदि अपराधी अभिरक्षा में है तो उसे तत्काल छोड़ दिया जाएगा । " ।
9. मूल नियमों के नियम 63 के स्थान पर निम्नलिखित नियम रखा जाएगा , अर्थात्:-
" 63. अन्य सूचना प्रदाय करने की बाध्यता:- आवीक्षी अनुज्ञा पत्र , पूर्वेक्षण अनुज्ञप्ति या खनन पट्टे का धारक अथवा उसका अभिकर्ता अपने आषीक्षण या पूर्वेक्षण संक्रियाओं या खान या उनसे संबंधित किसी विषय के संबंध में ऐसी सूचना देगा जिसकी महानियंत्रक या प्राधिकृत अधिकारी किसी लिखित आदेश द्वारा अपेक्षा करें और ऐसी सूचना ऐसे समय के भीतर दी जाएगी ओ पूर्वोक्त आदेश में विनिर्दिष्ट किया जाए। "

NOTIFICATION
New Delhi , the 11th January, 2002
G.S.R. 22 (E) . In exercise of the powers conferred by Section 18 of the Mines and Minerals (Development and Regulation) Act , 1957 (67 of 1957) , the Central Government hereby makes the following rules further to amend the Mineral Conservation and Devclopment Rules , 1988 , namely:-
1 ( 1) These rules may be called Mineral Conservation and Development ( Amendment ) Rules , 2002.
(2) They shall come into force on the date of their publication in the Official Gazette .
2 In rule 8 of the Mineral Conservation and Development Rules , 1988 (hereinafter referred to as the principal , in sub - rule ( 1 ) , in clause (b) , for the words " one year " , the words " twelve months " shall be substituted.
rules) 3. In rule 10 of the principal rules , in sub - rule (2) , for the words, " or approve with such alterations as he may consider expedient " , the following words shall be substituted, namely :-
"or approve with such alterations as he may consider expedient within a period of ninety days" .
4 In rule 27 of the principal rules, for sub- rule (4) , the following sub - rule shall be substituted, namely:---
"(4) The plans and sections required under these rules shall be maintained up to date within three months in case of category' A' mines as refcrred to in clause (b ) of sub- rule ( 1 ) of rulc 42, and within twelve months in the case of any othermine. " .

5 In rule 28 of the principal rules , in sub- rulc (5 ) , in clause ( ii ) , for the word " fifteen " , the word " twenty " shall be substituted .
6. In rule 29 of the principal rules , for the words , fugures and letters " on or before the 31st day of March , " the words , figures and letters " on or before the 30th day of June " shall be substituted .
7. After rule 50 of the principal rules, the following rule shall be inserted, namely:-
"50A. Notice of amalgamation of mining lease :-Without prejudice to the provisions of the Act or any rules made thereunder or the terms and conditions of a mining lease , cvery holder of a mining lease shall within thirty days of the date of amalgamation of mining leascs carried out under rule 38 of Mineral Concession Rules , 1960 , send an intimation thereof to the Controller General and the State Government . " .
8. For rule 58 of the principal rules, the following rule shall be substituted , namely :
"58. Penalty : Whoever contravenes any of the provisions of these rules shall be punishable with imprison- ment for a term which may extend up to two years , or with fine extending to fifty thousand rupees or with both . and in the case of continuing contravention with an additional fine which may extend up to five thousand rupees for every day during which such contravention continues , after conviction for the first such contra- vention .
Provided that for repeated contravention the punishment should be in the form of imprisonment only :
Provided further that any offence punishable under these rulcs may either before or after the institution of the prosecution , be compounded by the authorized officer to make a complaint to the court with respect to that offence, on payment to that officer for credit to the Government , of such sum that officer may specify :
Provided also that in case of an offence punishable with fine only, such sum shall not exceed the maximum amount of fine which may be imposed for that offence:
Provided further that where an offence is compunded under these rules , no proceeding or further proceeding , as the case may be, shall be taken against the offender in respect of the offence so compounded, and the offender, if in custody shall be released forthwith. "
9. For rule 63 of the principal rules , the following rule shall be substituted, namely :-
"63 Obligation to supply other information : --The holder of reconnaissance permit , prospecting license or mining leasc , or his agent shall furnish such information regarding his reconnaissance or prospecting opera- tions or minc or any matter connected therewith as the Controller General or the authorised officer may require by an order in writing and the information shall be furnished within such time as may be specified in the aforesaid order ." .
