फा. सं. 3306/आर. एम. डी. बान्बूस. भारतीय लघु उद्योग विकास बैंक अधिनियम, 1989 ( 1989 का 39 ) की धारा 52 की उप - धारा ( 1 ) और 2 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निदेशक मंडल, भारतीय लघु उद्योग विकास बैंक (बॉण्डों का निर्गम और प्रबंध ) विनियमों, 1990, में निम्नलिखित संशोधन करता है, नामतः:-
1 . (1) इन विनियमों को भारतीय लघु उद्योग विकास बैंक (बॉण्डों का निर्गम और प्रबंध) संशोधन विनियम, 2001 कहा जाए .
(2) सरकारी राजपत्र में उनके प्रकाशन की तिथि से वे प्रभावी होंगे .
2. भारतीय लघु उद्योग विकास बैंक (बॉण्डों का निर्गम और प्रबंध) विनियमों, 1990 , (इसमें इसके बाद उन्हें " मुख्य विनियम" कहा जाएगा) के विनियम 3 में, उप- विनियम ( 1 ) के बाद, निम्नलिखित उप विनियम ( 1 ए) के रूप में जोड़ा जाएगा , नामत: -
" ( 1ए) उप - विनियम ( 1 ) में कुछ भी होने के बावजूद तथा डिपॉजिटरीज एक्ट, 1996 के प्रावधानों के अधीन, बॉण्ड खरीदने वाले या बॉण्डधारक प्रत्येक व्यक्ति के पास उसे निक्षेपी में रखने का विकल्प भी होगा. "

[PART III-SEC , 4]41 3. विनियम 3 के उप-विनियम 4(ए) के स्थान पर निम्नलिखित उप- विनियम 4 (ए) रखा जाएगा: -
" (4ए) बॉण्ड भारतीय लघु उद्योग विकास बैंक के अध्यक्ष एवं प्रबंध निदेशक या उनकी अनुपस्थित में उप प्रबंध निदेशक और उन दोनों की अनुपस्थिति में एक कार्यपालक निदेशक और / या न्यूनतम मुख्य महाप्रबंधक स्तर के किसी अधिकारी के हस्ताक्षर से जारी किया जाएगा, जो मुद्रित, उत्कीर्णित, लिथोग्राफित या लघु उद्योग बैंक के निदेशानुसार किसी मशीनी या इलेक्ट्रॉनिक प्रक्रिया से अंकित किया जाएगा. "
4. मुख्य विनियमों के विनियम 4 में, उप-विनियम ( 1 ) के बाद निम्नलिखित परंतुक और स्पष्टीकरण जोड़े जाएंगे, नामत:-
" बशर्ते किसी लाभदायक स्वामी की ओर से पंजीकृत स्वामी के रूप में किसी निक्षेपी द्वारा धारित बॉडों के संबंध में उस निक्षेपी पर इस विनियम में से कुछ भी लागू नहीं होगा " .
स्पष्टीकरण : मुख्य विनियमों के विनियम 3,4,8 और 24 और उनकी तालिका में दिए गए फार्म सं. XIV के उद्देश्य से, "लाभदायक स्वामी ", "निक्षेपी " और " पंजीकृत स्वामी " अभिव्यक्तियों का अभिप्राय क्रमश : वही होगा जोडिपॉजिटरीज एक्ट , 1996, की धारा 2 के उप- खंड 1 के भाग (ए) , (ई) और (जे) में दिया गया है.
5. मुख्य विनियमों के विनियम 8 के लिए, निम्नलिखित विनियम प्रतिस्थापित किया जाएगा, नामत:-
"8. ब्याज का भुगतान: -
बॉण्डपर ब्याज लघु उद्योग बैंक द्वारा ब्याज वारंट रेखित खाता पानेवाला, इलेक्ट्रॉनिक समाशोधन सेवा के माध्यम से बैंक खाते में जमा कराकर या प्रस्ताव कागजात में बताए गए किसी अन्य तरीके से या लघु उद्योग बैंक द्वारा लिए गए निर्णय के अनुसार किसी अन्य तरीके से किया जाएगा" .
6. मुख्य विनियमों के विनियम 10 के लिए, निम्नलिखित विनियम प्रतिस्थापित किया जाएगा, नामत:-
" 10. खोने, चोरी होने , आदि की सूचना का समाचार-पत्र में प्रकाशन: -
1. वचन- पत्र के रूप में किसी बॉण्ड के पूर्णत: या अंशत: खो जाने, चोरी हो जाने, नष्ट (विकृतिया [भाग III- खण्ड 4 ]

विरूपण) हो जाने की सूचना आवेदक की ओर से क्षेत्र के अग्रणी समाचार- पत्र में प्रकाशित की जाएगी.। स्पष्टीकरण - लघु उद्योग बैंक समय समय पर यह निर्णय करेगा कि निर्गम के कार्यालय के क्षेत्राधिकार के अंतर्गत कौन सा समाचार- पत्र क्षेत्र का अग्रणी समाचार- पत्र माना जाए.
2. उप-विनियम ( 1 ) में बताया गया प्रकाशन निम्नलिखित रूप में या परिस्थिति के अनुरूप लगभग ऐसा होगा, नामत: -
" भारतीय लघु उद्योग विकास बैंक का रु. का प्रतिशत बॉण्डसं. जो मूलतः स्वामी को पृष्ठांकित किया गया था, जिसने केनाम पर था तथा आखिरी बार उसे किसी भी अन्य व्यक्ति को पृष्ठांकित नहीं किया, खो गया, चोरी हो गया / नष्ट । (विकृत / विरूपित) हो गया है. एदद्वारा सूचना दी जाती है कि निर्गम के कार्यालय में उपर्युक्त बॉण्ड का भुगतान तथा उस पर ब्याज का भुगतान रोक दिया गया है, तथा स्वामी के पक्ष में डुप्लीकेट बॉण्ड जारी करने के लिए आवेदन लगभग किया ही जा रहा है या कर दिया गया है. जनता को सावधान किया जाता है कि वे उपर्युक्त बॉण्ड न खरीदें या उसका अन्य किसी रूप में लेनदेन न करें ";
7. मुख्य विनियमों के विनियम 11 के लिए, निम्नलिखित विनियम प्रतिस्थापित किया जाएगा, नामत: -
" 11. डुप्लीकेट बॉण्ड जारी करना और क्षतिपूर्तिलेना:-
(1 ) यदि निर्धारित अधिकारी वचन- पत्र के रूप में बॉण्ड के खो जाने, चोरी हो जाने, नष्ट हो जाने या उसके विरूपित हो जाने से संतुष्ट है तो वह आवेदक द्वारा एक या अधिक जमानत देते हुए, क्षतिपूर्ति बॉण्ड देने पर डुप्लीकेट बॉण्ड जारी करने का आदेश दे सकता है.
बशर्ते, वचन- पत्र के रूप में डुप्लीकेट बॉण्ड जारी करने से पहले किसी भी समय , मूल बॉण्ड मिल जाता है या निर्गम कार्यालय को अन्य कारणों से यह लगता है कि आदेश रद्द किया जाना चाहिए, तो वह मामला THE GAZETTE OF INDIA: EXTRAORDINARY
[PART III-SEC .4] आगे विचार के लिए निर्धारित अधिकारी को भेज दिया जाएगा, और इस बीच आदेश पर की जाने वाली समस्तकार्रवाई रोक दी जाएगी. इस उप-विनियम के अंतर्गत पारित आदेश, उसमे उल्लिखित तीन माह की अवधि समाप्त होने पर अंतिम समझा जाएगा बशर्ते कि इस बीच वह रद्द न कर दिया गया हो या अन्यथा संशोधित न कर दिया गया हो; और
बशर्ते जब वचन -पत्र के रूप में खो चुका, चोरी हो चुका, नष्ट हो चुका, विकृत हो चुका या विरूपित हो चुका बॉण्ड पचास हजार रुपये से अधिक मूल्य का न हो, तो आवेदक द्वारा बिना ऐसी कोई जमानत दिए, क्षतिपूर्ति बॉण्ड प्रस्तुत करने पर वचन- पत्र के रूप में डुप्लीकेट बॉण्ड जारी किया जा सकता है; इसके अतिरिक्त, बशर्ते जब वचन- पत्र के रूप में किसी भी मूल्य के बॉण्ड के विकृत होने या विरूपित होने के संबंध में इस प्रकार का आवेदन किया जाता है और यदि वचन- पत्र के रूप में बॉण्ड मूल रूप से जारी किए गए बॉण्ड के रूप में पहचाने जा सकने के योग्य हो, तो इस प्रकार की किसी क्षतिपूर्ति के बगैर, जमानत लेकर या न लेकर डुप्लीकेट बॉण्ड जारी किया जा सकता है;
(2) इस विनियम के अंतर्गत लघु उद्योग बैंक सद्भाव में इस प्रकार का बॉण्ड जारी करने के लिए किसी रूप में उत्तरदायी नहीं होगा.
(3) उप-विनियम ( 1 ) के अंतर्गत जारी डुप्लीकेट प्रमाणपत्र इन विनियमों के सभी उद्देश्यों के लिए मूल प्रमाणपत्र के समकक्ष माना जाएगा, केवल यह शर्त होगी कि यह बॉण्ड जिस निर्गम कार्यालय में पंजीकृत है, उसे छोड़कर अन्य निर्गम कार्यालय में वह पूर्व सत्यापन के बिना भुनाया नहीं जा सकेगा.

5 8. मुख्यविनिमयों के विनियम 13 के लिए, निम्नलिखित विनियम प्रतिस्थापित किया जाएगा, नामत: - " 13. डुप्लीकेट बॉण्डों की सूची का प्रकाशन : -
1) लघु उद्योग बैंक जो डुप्लीकेट बॉण्ड जारी करेगा, उनकी सूची वह छमाही रूप से जनवरी और जुलाई में दो अग्रणी समाचार पत्रों में या एक अग्रणी समाचार पत्र में और भारत के राजपत्र में प्रकाशित करेगा.
2) उस सूची में लघु उद्योग बैंक द्वारा जारी डुप्लीकेट बॉण्डों के संबंध में निम्नलिखित विवरण होगा: - (क) निर्गम का नाम, (ख) बॉण्ड की संख्या, उसका मूल्य, (ग) जिस व्यक्ति को यह जारी किया गया था, उसका नाम (घ) ब्याज आरंभ होने की तिथि (ड. ) डुप्लीकेट के लिए आवेदक का नाम, (च) निर्धारित अधिकारी द्वारा ब्याज के भुगतान या डुप्लीकेट जारी करने के लिए पारित आदेश की संख्या ओर तिथि.
9. मुख्य विनियमों के विनियम 17 के उप विनियम (3 ) के लिए, निम्नलिखित उप विनियम (3) प्रतिस्थापित किया जाएगा, नामत:-
" (3) निर्गम कार्यालय तब तक ऐसे निष्पादकों या प्रशासकों को मान्यता देने के लिए बाध्य नहीं होगा जब तक वे भारत में स्थित निर्गम कार्यालय स्थल के क्षेत्राधिकार वाले सक्षम न्यायालय या कार्यालय से मामले के अनुसार वसीयत प्रमाणपत्र (प्रोबेट) या प्रशासन- पत्र प्राप्त न कर लें, बशर्ते यदि किसी भी मामले में निर्धारित अधिकारी अपने पूर्ण विवेकानुसार उचित समन्नता है तो उसके लिए यह वैध होगा कि वह क्षतिपूर्ति जैसी या अन्यथा शर्तों पर, जैसा वह ठीक समझे, वसीयत प्रमाणपत्र या प्रशासन- पत्र या अन्य विधिक अभ्यावेदन प्रस्तुत करने से छूट दे दे " .

[PART III-SEC. 4] 10. मुख्य विनियमों के विनियम 24 में, उप- विनियम (बी) के लिए, निम्नलिखित उप- विनियम प्रतिस्थापित किया जाएगा, नामत: -
" (बी) जब कोई बॉण्ड किसी खाते में प्रविष्टि के रूप में या किसी निक्षेपी में होगा तथा उस पर मूल का भुगतान देय हो जाएगा तो मामले के अनुसार धारक या लाभदायक स्वामी, निर्गम कार्यालय को फार्म XIV में विधिवत हस्ताक्षरित रसीद भेजेगा. "
स्पष्टीकरण: श्न विनियम के उद्देश्य से, "लाभदायक स्वामी ", "निक्षेपी " और " पंजीकृत स्वामी " अभिव्यक्तियों का अभिप्राय क्रमश : वही होगा जो डिपॉजिटरीज एक्ट , 1996, की धारा 2 के उप-खंड 1 के भाग (ए), (३) ओर (जे) में दिया गया है.
11. मुख्य विनियमों केविनियम 25 के लिए, निम्नलिखित विनियम प्रतिस्थापित किया जाएगा. "25. लघु उद्योग बैंक की ओर से शक्तियों का प्रयोग
विनियमों 4 ( 2 ) , 5 ( 2 ) , 5(7 ), 6(6) और 8 ( 1 ) के अंतर्गत लघु उद्योग बैंक द्वारा प्रयोज्य शक्तियों का प्रयोग, लघु उद्योग बैंक की ओर से लघु उद्योग बैंक के अध्यक्ष एवं प्रबंध निदेशकऔर उनकी अनुपस्थिति में एक उप प्रबंध निदेशक और / या एक कार्यपालक निदेशक और / या एक मुख्य महाप्रबंधक कर सकते हैं ".
12. मुख्य विनियमों की तालिका में , फार्म सं. XIV निम्नलिखित फार्म से प्रतिस्थापित किया जाएगा, नामत: - 7 [ भाग III-खण्ड 4 ]

SMALL INDUSTRIES DEVELOPMENT BANK OF INDIA (ISSUE AND MANAGEMENT OF BONDS) AMENDMENT REGULATIONS,2001 NOTIFICATION
New Delhi , the 20th February, 2002
F. No. 3306/RMD Bonds.-- In exercise of the powers conferred by Sub - section ( 1 ) and 2 of Section 52 of the Small Industries Development Bank of India Act, 1989 (39 of 1989) , the Board, makes the following amendments to the Small Industries Development Bank of India (Issue and Management of Bonds) Regulations , 1990, namely:---
1. (1) These Regulations may be called Small Industries Development Bank of India ( Issue and Management of Bonds ) Amendment Regulations , 2001 .
(2) They shall come into force on the date of their publication in the official gazette .
2. InRegulation 3 of the Small Industries Development Bank of India (Issue and Management of Bonds ) Regulations , 1990 , ( hereinafter referred to as "the Principal Regulations " ) after sub-regulation ( 1 ) , the following shall be inserted as sub- regulation (1A) namely:-
" (1A) Notwithstanding anything contained in sub- regulation ( 1 ) and subject to the provisions of Depositories Act , 1996 , every person subscribing to or holding the Bond shall have the option to hold the same with a depository" ;

3. Sub- regulation 4 (a) of regulation 3 shall be substituted with the following sub- regulation 4 (a) : -
"4 (a) A Bond shall be issued over the signature of the chairman and managing director or in his absence by deputy managing director and in absence of both by an executive director and/or an officer not below the rank of chief general manager of the Small Industries Development Bank of India which may be printed, engraved , lithographed or impressed by such mechanical or electronic process as the Small Industries Bank may direct . "
4. InRegulation 4 of the Principal Regulations , after sub- regulation ( 1 ) , the following proviso and explanation shall be inserted namely : -
" Provided that nothing in this Regulation shall apply to a depository in respect of Bonds held by it as a registered owner on behalf of the beneficial owner .
Explanation : For the purpose of Regulation 3,4,8 and 24 of the Principal Regulations and Form No. XIV set out in the Schedule thereto , the expression "beneficial owner" , " depository" and " registered owner" shall have the same meaning respectively assigned to them in Clauses ( a) , ( e) and (j ) of sub-clause (1) ofSection 2 of the Depositories Act, 1996. "
5. For Regulation 8 of the Principal Regulations , the following Regulation shall be substituted namely:-
"8 . Payment of Interest: -
Interest on a Bond shall be paid by the Small Industries Bank by means of interest warrant crossed account payee , credit to the bank account by electronic 10

[PART III-SEC . 4] clearing service or such other manner as may be specified in the offer document or such other manner as may be decided by the Small Industries Bank . "
6. ForRegulation 10 of the Principal Regulations , the following Regulation shall be substituted namely :-
"10. Publication of notice of loss , theft ,etc. in newspaper: -
(1) The loss, theft, destruction , ( mutilation or defacement ) of a Bond, either wholly or in part, in the form of a promissory note shall be published on behalf of the applicant in a leading newspaper of the area.
Explanation - The Small Industries Bank shall decide from time to time as to which of the newspaper shall be deemed to be ' leading ' newspaper for the area, under jurisdiction of the Office of Issue.
(2) The publication referred to in sub-regulation ( 1 ) shall be in the following form or nearly in such form as circumstances permit , namely :-
"The Small Industries Development Bank of India Bond No ....... of the percent Bond . .for Rs ......... originally standing in the name of last endorsed to .... the proprietor, by whom it was never endorsed to any other person having been Lost/ Stolen/ Destroyed/( Mutilated/ Defaced) , notice is hereby given that payment of the above Bond and the interest thereupon has been stopped at the Office of Issue, and that application is about to be made or has been made for the issue of a duplicate in favour of the proprietor. The public are cautioned against purchasing or otherwise dealing with the above - mentioned Bond";

7. For Regulation 11 of the Principal Regulations , the following Regulation shall be substituted namely:-
"11. Issue of duplicate Bond and taking of indemnity:-
(1 ) If the Prescribed Officer is satisfied of the loss, theft, destruction or defacement of the Bond in the form of a promissory note , he may order issue of a duplicate Bond in the form of a promissory note on applicant's furnishing an indemnity bond with one or more sureties:
Provided that if at any time before the issue of the duplicate Bond in the form of a promissory note , the original Bond is discovered or it appears to the Office of the Issue for other reasons that the order should be rescinded , the matter shall be referred to the Prescribed Officer for further consideration , and in the meantime , all action on the order shall be suspended .An order passed under this sub- regulation shall , on expiry of the three months referred to therein , become final unless it is in the meantime rescinded or otherwise modified ; and
Provided that where a Bond in the form of a promissory note lost , stolen , destroyed , mutilated or defaced is of denomination not exceeding rupees fifty thousand , a duplicate Bond in the form of promissory note may be issued on applicant furnishing an indemnity Bond without any such surety;
Provided further that where such application is made with respect to a Bond in the form of a promissory note mutilated or defaced, of whatever face value , a duplicate Bond in the form of promissory note may be issued without any such indemnity with or without surety, if the Bond in the form of promissory note is capable of being identified as the one originally issued;

[PART III-SEC. 4] (2) the Small Industries Bank shall not incur any liability for issuing such Bond in good faith under this regulation .
(3) A duplicate certificate issued under sub- regulation ( 1 ) shall be treated as equivalent to the original certificate for all the purposes of these regulations except that it shall not be encashable at an office of issue other than the office of issue at which such certificate is registered without previous verification .
8. For Regulation 13 of the Principal Regulations , the following Regulation shall be substituted namely: -
"13. Publication of list of duplicate Bonds : -
(1) The Small Industries Bank shall publish half- yearly in the two leading newspapers or in one leading newspaper and in the Gazette of India in the months of January and July a list of duplicate Bonds issued by the Small Industries Bank .
(2) The list shall contain the following particulars regarding the duplicate Bonds by the Small Industries Bank :- (a) the name of the issue , (b) the number of the Bond , its value, ( c) the name of the person to whom it was issued , (d) the date from which it bears interest , (e) the name of the applicant for a duplicate, (f) the number and date of order passed by the Prescribed Officer for payment of interest or issue of a duplicate.
9. For Sub- Regulation (3) of Regulation 17 of the Principal Regulations , the following Sub- Regulation ( 3) shall be substituted namely:-
"(3) The Office of Issue shall not be bound to recognise such executors or administrators unless they shall have obtained probate or letters of 13

administration , as the case may be , from a competent court or office in India , having effect at the place of situation of the Office of Issue , provided that in any case where the Prescribed Officer in his absolute discretion thinks fit, it shall be lawful for him to dispense with the production of probate or letters of administration or other legal representation upon such terms as to indemnity or otherwise , as he may think fit .
(b ) , the 10. In Regulation 24 of the Principal Regulations , for sub- regulation
following sub - regulation shall be substituted namely:-
"( b) When a Bond in the form of an entry in the account or held with a depository becomes due for payment of principal , a duly signed receipt in Form XIV shall be furnished by the holder or beneficial owner , as the case may be , to the Office of Issue ."
Explanation : For the purpose of this Regulation , the expression " beneficial owner " , " depository" and " registered owner " shall have the same meaning respectively assigned to them in clauses (a) , ( e) and (j ) of sub- clause ( 1 ) section 2 ofthe Depositories Act , 1996.
11. For Regulation 25 of the Principal Regulations , the following Regulation shall be substituted namely: -
"25. Exercise of Powers on behalf of the Small Industries Bank: -
The Powers exercisable by the Small Industries Bank under Regulations 4(2), 5(2), 5( 7) , 6 (6) and 8( 1 ) may be exercised on behalf of the Small Industries Bank by the Chairman and Managing Director and in his absence a Deputy Managing Director and /or an Executive Director and /or a Chief General Manager of the Small Industries Bank .
12. In the Schedule to the Principal Regulations , Form No. XIV shall be substituted by the following Form , namely: - 14
