का.आ. 241( अ ). -जबकि भारत सरकार के श्रम मंत्रालय ने दिनांक 1-3-2001 की अपनी अधिसूचना संख्या का. आ. 184 ( अ) के तहत झारखण्ड उच्च न्यायालय के न्यायाधीश माननीय न्यायमूर्ति श्री गुरूशरण शर्मा को भारत कोकिंग कोल लिमिटेड की कोयला खदानों, विशेष रूप से बागडिही कोयला खदान में 2 फरवरी , 2001 को हुई दुर्घटना, जिसमें कई श्रमिकों की जान गयी थी, के कारणों और परिस्थितियों की जांच- पड़ताल करने के साथ- साथ दुर्घटना होने के कारणों की जिम्मेदारी तय करने और तीन माह की अवधि के भीतर रिपोर्ट प्रस्तुत करने के लिए नियुक्त किया गया था और जांच न्यायालय की इस अवधि को दिनांक 28-5-2001 और 7-9-2001 और 5-11-2001 की अधिसूचना सं. क्रमशः का.आ. 464( अ) , 863( अ ) और 1095 ( अ ) के द्वारा प्रत्येक बार तीन- तीन माह के लिए बढ़ा दिया गया था । और जबकि जांच- पड़ताल करने और रिपोर्ट प्रस्तुत करने के लिए अवधि बढ़ाना आवश्यक हो गया है ;
अतः , अब , केन्द्र सरकार इस अवधि को 28-2-2002 से 27-5-2002 तक तीन माह की और अवधि के लिए बढ़ाती है , और तदनुसार जांच - पड़ताल करने और रिपोर्ट प्रस्तुत करने के लिए माननीय न्यायमूर्ति श्री गुरूशरण शर्मा की नियुक्ति की अवधि और प्रो. रवीन्द्र नाथ , प्रोफेसर, बनारस हिन्दूविश्वविद्यालय , वाराणसी तथा श्री कमलेश महाय , अध्यक्ष, सी.सी. एल. कोलियरी कर्मचारी संघ, बारकाहाना, की असेसरों के रूप में नियुक्ति की अवधि भी 28-2-2002 से 27-5-2002 तक तीन माह की और अवधि के लिए बढ़ायी जाती है । [फा. सं. एन. 11012/1/2001 - आई.एस.एच.- II ]

MINISTRY OF LABOUR NOTIFICATION New Delhi , the 26th February, 2002 S.O. 241 (E) .-Whereas the Government of India in the Ministry of Labour in their Notification No. S.O. 184 (E) dated 1-3-2001 appointed Hon'ble Justice Sh . Gurusharan Sharma, Judge, High Court of Jharkhand to hold a formal inquiry into the causes and circumstances attending the accident and in addition to fix reponsibility for the causes leading to the accident that occurred in the collieries of Bharat Cooking Coal Limited particularly in Bagdıhi colliery on 2nd day of February, 2001 causing loss of lives and present a report within a period of three months . And subsequently extended this duration of the court of in- quiry thrice for a further period of three months each vide notification No. S.O. 464(E) dated 28-5-2001 , No. S.O. 863 (Ε) dated 7-9-2001 and No. S.O. 1095 (E) dated 5-11-2001 respectively.
And whereas it has become necessary to extend the period within which the inquiry is to be conducted and report presented;
Now, therefore , the Central Government do hereby extend this duration for a further period of three months we.f. 28-2-2002 to 27-5-2002 and, accordingly the period of appointment of Hon'ble Justice Gurusharan Sharma to conduct the inquiry and present the report and the period of appointment of Prof. Ravindra Nath , Professor, Banaras Hindu University, Varanasi and of Sh . Kamlesh Shahay, President , CCL Colliery Karmachari Sangh , Barkahana, as assessors is also extended for a further period of three months w.c.f. 28-2-2002 to 27-5-2002 .
