सा.का.नि. 266 ( अ ) .-केन्द्रीय सरकार मानव अंग प्रतिरोपण अधिनियम, 1994 ( 1994 का 42) की धारा 24 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, मानव अंग प्रतिरोपण नियम , 1995 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम मानव अंग प्रतिरोपण ( संशोधन ) नियम, 2002 है ।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. मानव अंग प्रतिरोपण नियम, 1995 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 5 में निम्नलिखित परंतुक अंतःस्थापित किया जाएगा अर्थात्:-
" परंतु हटाए गए नेत्रगोलक ( आंख की पुतली ) को निम्नलिखित तीन प्रक्रर्मों में परिरक्षित रखा जाएगा, अर्थात्: - (1 ) अल्पकालिक परिरक्षण ;
(ii ) मध्यमकालिक परिरक्षण ;
(III ) दीर्घकालिक परिरक्षण ,
और परिरक्षण के लिए उपयुक्त मीडिया का उपयोग किया जाएगा " ।
3. उक्त नियमों के नियम 9 में,
(क ) " साधारण अपेक्षाएं " शीर्ष के अधीन क्रम संख्या 7 और उससे संबंधित प्रविष्टि के पश्चात्, निम्नलिखित क्रम संख्याएं और प्रविष्टियां अंतःस्थापित की जाएंगी , अर्थात्: -
" 8. नेत्र विज्ञानी
9. कार्नियल सर्जन। ";

[PART II-SEC . 3 ( i ) ] (ख ) " विभिन्न विभाग " शीर्ष के अधीन क्रम संख्या 17 और उससे संबंधित प्रविष्टि के पश्चात्, निम्मलिखित क्रम संख्या और प्रषिष्टि अंतःस्थापित की जाएंगी , अर्थात्:- " 18. नेत्र विज्ञान विभाग । ";
(ग ) " प्रतिरोपणेत्तर कार्यक्रम दल " शीर्ष के अधीन क्रम संख्या 4 और उससे संबंधित प्रविष्टि के पश्चात् निम्नलिखित क्रम संख्या और प्रविष्टि अंतःस्थापित की जाएगी , अर्थात्:-
" 5. नेत्र दान परामर्शदाता/संताप परामर्शदाता ।" ;
(घ) " आधारित उपस्कर " शीर्ष के अधीन विद्यमान प्रविष्टि को प्रविष्टि 1 के रूप में संख्यांकित किया जाएगा और इस प्रकार संख्यांकित प्रविष्टि 1 के पश्चात् निम्नलिखित प्रविष्टियां अंतः स्थापित की जाएंगी, अर्थात्ः-
" 2. स्लिट लैम्प
3. परावर्तक सूक्ष्मदर्शी
4. शल्य क्रिया सूक्ष्मदर्शी। " ;
(ङ) " प्रतिरोपण कार्यक्रम के लिए अपेक्षित अतिरिक्त उपस्कर " शीर्ष के अधीन क्रम संख्या 6 और उससे संबंधित प्रविष्टि के पश्चात् निम्नलिखित क्रम संख्याएं और प्रविष्टियां अंतःस्थापित की जाएंगी , अर्थात्:-
" 7. आटोक्लेव ( आज्ञापक )
8. यू. वी. लैम्प } वांछनीय । "

NOTIFICATION
New Delhi , the 8th April , 2002
G.S.R. 266 ( E )-In exercise of the powers conferred by sub - section ( 1 ) of Section 24 of the Transplantation ofHumanOrgans Act , 1994 (42 of 1994) , the Central Government hereby makes the following rules further to amend the Transplantation of Human Organs Rules , 1995 , nemely: ---
1. ( 1) These rules may be called the Transplantation of Human Organs (Amendment) Rules , 2002 .
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In rule 5 of the Transplantation of Human Organs Rules , 1995 ( hereinafter referred to as the said rules ) , the following proviso shall be inserted, nemely
"Provided that the eye ball removed shall be preserved in the following three steps , namely :-
(i) short - term preservation;
(ii) medium - term preservation;
( iii) long -term preservation,
and suitable media shall be used for preservation" .
3. In rule 9 of the said rules.-
(a) under the heading " GENERAL REQUIREMENT " , after serial number 7 and the entry relating thereto , the following serial numbers and entries shall be inserted, namely:-
"8. Ophthalmologist
9. Corneal Surgeons ." ;

(b) under the heading " VARIOUS DEPARTMENTS " , after serial number 17 and the entry relating thereto, the following serial number and entry shall be inserted, namely
"18. Department of Ophthalmology." :
( c) under the heading " NON - TRANSPLANTATION PROGRAMME TEAM " , after serial number 4 and the entry relating thereto, the following serial number and entry shall be inserted , namely
" 5. Eye Donation Counsellor/Grief Counsellor. " ;
(d) under the heading " BASIC EQUIPMENT " , the existing entry shall be numbered as entry 1 and after entry 1 as so numbered , the following entries shall be inserted , namely
"2. Slit Lamp
3. Specular Microscope
4. Operating Microscope. " ;
(e) under the heading ADDITIONAL EQUIPMENT REQUIRED FOR " TRANSPLANTATION PROGRAMME" , after serial number 6 and the entry relating thereto the following serial numbers and entries shall be inserted nemely : -
* 7 . Autoclave ( mandatroy )
8 U V. Lamp
Desirable" .
