का.आ. 400( अ ). राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण, भारत सरकार के रसायन और उर्वरक मंत्रालय द्वारा जारी का.आ. 637 ( अ ) , तारीख 4 सितम्बर, 1997 के साथ पठित औपध ( कीमत नियंत्रण ) आदेश , 1995 के पैरा 9 के उप- पैरा ( 1 ) और ( 2 ) और पैरा 11 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, तथा भारत सरकार के रसायन और उर्वरक मंत्रालय ( राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण ) के आदेश सं. का.आ. 194 ( अ ) , तारीख 11 मार्च, 1998 को जहां तक उसका सम्बन्ध नीचे की सारणी के विनिर्मित पैक से है , उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण के पूर्व किया गया है या करने का लोप किया गया है , नीचे की सारणी के स्तंभ ( 5 ) में विनिर्दिष्ट कीमत को उक्त सारणी के स्तंभ ( 3 ) और ( 4 ) में की क्रमशः तत्स्थानी प्रविष्टियों में विनिर्दिष्ट प्रबलता और पैक आकार सहित उस सारणी के स्तंभ ( 2 ) में की तत्स्थानी प्रविष्टि में विनिर्दिष्ट अनुसूचित विनिर्मितियों में से प्रत्येक की, उत्पाद शुल्क और स्थानीय कर, यदि कोई है , को छोड़कर अधिकतम कीमत के रूप में नियत करती है ।

( क) ये कीमतें विनिर्दिष्ट पैक व समान प्रबलता के पैकों पर उत्पाद शुल्क और स्थानीय कर को छोड़कर अधिकतम कीमत के रूप में नियत की जाती हैं , और कम्पनी किसी छूट का दावा नहीं कर सकती , जब तक उसे छूट के लिये सरकार/ रा.औ.मू.नि.प्रा. से आदेश प्राप्त न हो ।
(ख ) वह पैक जिसकी कम्पोजीशन समान है लेकिन आकार में अन्तर है , वह प्रो - राटा प्राइजिंग आदेश का.आ. 83 ( अ ) दिनांक 27-1-1998 के तहत आयेगी ।
(ग ) अगर कम्पनी, विभिन्न प्रकार की पैकिंग सामग्री या उसमें विशेष लक्षण का दावा करती है तो उसे राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण के पास कीमत के अनुमोदन/नियत कराने के लिये आंना होगा ।

ORDER
New Delhi , the 10th April , 2002
S.O. 400 (E ). In exercise of the powers , conferred by sub - paragraph (1 ) and (2) of paragraph 9 and paragraph 11 of the Drugs ( Prices Control ) Order , 1995 read with S. O. No. 637 ( E ) , dated the 4th September , 1997 issued by the Government of India in the Ministry of Chemicals and Fertilizers , and in supersession of the Order of the Government of India in the Ministry of Chemicals and Fertilizers , (National Pharmaceutical Pricing Authority ) No. S.O. 194 (E ) , dated 11th March, 1998 , in so far as it relates to formulation packs mentioned in the table below, except in respect of things done or omitted to be done before such supersession , the National Pharmaceutical Pricing Authority hereby fixes the prices as specified in column (5 ) of the table below as the ceiling price exclusive of excise duty, and local tax , if any , for scheduled formulation specified in the corresponding entry in column (2) of the said Table with the strength and pack size specified respectively in the corresponding entries in column (3 ) and (4 ) thereof:

Note :
(a) The prices fixed are the maximum ceiling prices (exclusive of excise duty and local taxes if any) for the specified pack and packs of similar strength , and companies cannot claim exemption on any ground therefrom , unless specifically permitted by the Government/NPPA through an order .

3 (b) Pro - rata pricing for packs of same composition but of different sizes will be applicable vide S.O. No. 83 ( E) dated 27.1.1998 .
(c) For different packing material used or any special feature claimed, companies are required to approach NPPA for approval / fixation of specific prices .
