S.O. 431 (E ) .-Whereas the Chairman, Securities and ExchangeBoard of India vide his order dated January 10 . 2002, passed in exercise ofpowers under sub - section ( 1 ) of section 8 of the Securities Contract ( Regulation) Act read with sub- section ( 3 ) of section 4 of the Securities and Exchange Board of India Act , 1992 , had directed all stock exchanges to amend their Rules , Articlos etc. within a period of two months to give effect to the policy decision taken by the Securities and Exchange Board of India and the Central Government to segregate ownership and trading membership from management of stock exchanges ; and का. आ. 431 ( अ) .-यतः अध्यक्ष, भारतीय प्रतिभूति और विनिमय बोर्ड ने तारीख 10 जनवरी , 2002 के अपने आदेश द्वारा , भारतीय प्रतिभूति और विनिमय बोर्ड अधिनियम, 1992 की धारा 4 की उप- धारा ( 3 ) के साथ पठित प्रतिभूति संविदा ( विनियमन ) अधिनियम की धारा 8 की उप- धारा ( 1 ) के अधीन शक्तियों का प्रयोग करते हुए, पारित, सभी स्टाक एक्सचेंजों को स्टाक एक्सचेंजों के प्रबंधतंत्र से स्वामित्व तथा व्यापारिक सदस्यता को पृथक् करने के लिए भारतीय प्रतिभूति और विनिमय बोर्ड तथा केन्द्रीय सरकार द्वारा लिए गए नीतिगत विनिश्चय को कार्यान्वित करने के लिए दो मास की कालावधि के भीतर उनके नियमों, अनुच्छेदों इत्यादि को संशोधित करने का निदेश दिया था; और
Whereas Bhubaneshwar Stock Exchange has failed to comply with the said order within the time stipulated therein;
यतः भुवनेश्वर स्टाक एक्सचेंज लिमिटेड उक्त आदेश की अनुपालना उसमें नियत समय के भीतर करने में असफल रहा है ।
Now, in exercise of the powers conferred by sub- section ( 2 ) of section 8 of the Securities Contracts (Regulation) Act, 1956 , the Securitics and Exchange Board of India hereby makes the following amendments to the Articles of Association of Bhubaneshwar Stock Exchange , namely:-
अब , प्रतिभूति संविदा ( विनियमन ) अधिनियम, 1956 की धारा 8 की उप - धारा ( 2 ) द्वारा प्रदत शक्तियों का प्रयोग करते हुए, भारतीय प्रतिभूतिऔर विनिमय बोर्ड एतद्द्वारा भुवनेश्वर स्टाक एक्सचेंज लिमिटेड के संगम- अनुच्छेद में निम्नलिखित संशोधन करता है , अर्थात्:-
InArticle 120, în clause ( a) , the following proviso shall be added :
अनुच्छेद 120 में, खण्ड ( क) में, निम्नलिखित परन्तुक परिवर्धित किया जाएगा:
"Provided that no broker member of the exchange shall be an office bearer i.e. President . Vice President or Treasurer of the exchange. "
" परन्तु यह कि एक्सचेंज का कोई दलाल सदस्य एक्सचेंज का पदाधिकारी अर्थात् अध्यक्ष, उपाध्यक्ष अथवा कोषाध्यक्ष नहीं होगा । "
