S.O. 434( E) . Whereas the Chairman, Securities and Exchange Board of India vide his order dated January 10 , 2002, passed in exercise of powers under sub - section ( 1 ) of section 8 of the Securities Contracts (Regulation ) Act read with sub - section ( 3 ) of section 4 of the Securities and ExchangeBoard of India Act, 1992 , had directed all stock exchanges to amend their Rules , Articles etc. within a period of two months to give effect to the policy decision taken by the Securities and Exchange Board of India and the Central Government to segregate ownership and trading का.आ. 434( अ ) .-यतः अध्यक्ष, भारतीय प्रतिभूति और विनिमय बोर्ड ने तारीख 10 जनवरी , 2002 के अपने आदेश द्वारा , भारतीय प्रतिभूति और विनिमय बोर्ड अधिनियम, 1992 की धारा 4 की उप- धारा (3 ) के साथ पठित प्रतिभूति संविदा (विनियमन ) अधिनियम की धारा 8 की उप - धारा ( 1 ) के अधीन शक्तियों का प्रयोग करते हुए, पारित, सभी स्टाक एक्सचेंजों को स्टाक एक्सचेंजों के प्रबंधतंत्र से स्वामित्व तथा व्यापारिक सदस्यता को पृथक् करने के लिए भारतीय प्रतिभूति और विनिमय बोर्ड तथा केन्द्रीय सरकार द्वारा लिए गए नीतिगत विनिश्चय को कार्यान्वित करने के लिए दो मास की कालावधि के भीतर उनके नियमों, अनुच्छेदों इत्यादि को संशोधित करने का निदेश दिया था; और

यतः हैदराबाद स्टाक एक्सचेंज लिमिटेड उक्त आदेश की अनुपालना उसमें नियत समय के भीतर करने में असफल रहा है ।
अब, प्रतिभूति संविदा ( विनियमन ) अधिनियम, 1956 की धारा 8 की उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारतीय प्रतिभूति और विनिमय बोर्ड एतद्द्वारा हैदराबाद स्टाक एक्सचेंज लिमिटेड के संगम- अनुच्छेद में निम्नलिखित संशोधन करता है , अर्थात्: -
Now, in exercise of the powers conferred by sub- section ( 2 ) of section 8 of the Securities Contracts (Regulation) Act, 1956, the Securities and Exchange Board of India hereby makes the following amendments to the Articles of Association of Hyderabad Stock Exchange Limited, namely:-
अनुच्छेद 104 में, निम्नलिखित परन्तुक परिवर्धित किया जाएगा: (क) खण्ड ( i ) में, निम्नलिखित परन्तुक परिवर्धिते किया आएगा:
InArticle 104, the following proviso shall be added: (a) in clause ( i ) , the following proviso shall be added:
" परन्तु यह कि एक्सचेंज का कोई दलाल सदस्य एक्सचेंज का अध्यक्ष नहीं होगा । "
"Provided that no broker member of the exchange shall be the President of the exchange."
(b) in clause (iii) , the following proviso shall be added:
(ख) खण्ड ( iii ) में, निम्नलिखित परन्तुक परिवर्धित किया जाएगा:
"Provided that no broker member of the exchange shall be the Vice President of the exchange."
" परन्तु यह कि एक्सचेंज का कोई दलाल सदस्य एक्सचेंज का उपाध्यक्ष नहीं होगा । "
