सा.का.नि. 482( अ) , केंन्द्रीय सरकार, कोयला खान भविष्य निधि और प्रकीर्ण उपबंध अधिनियम, 1948 ( 1948 का 46 ) की धारा उङ द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कोयला खान पेंशन स्कीम , 1998 में निम्नलिखित संशोधन करती है , अर्थात्:-
1. ( 1 ) इस स्कीम का संक्षिप्त नाम कोयला खान पेंशन ( संशोधन ) स्कीम, 2002 है ।
(2) यह 31 मार्च , 1998 को प्रवृत्त हुई समझी जाएगी ।
2. कोयला खान पेंशन स्कीम, 1998 के पैरा 4 में, उप पैरा ( 2 क) के पश्चात् निम्नलिखित अन्तःस्थापित किया जाएगा, अर्थात्:-
" ( 2 ख ) ऐसा कोई भूतपूर्व कर्मचारी , जिसने कोयला खान कुटुम्ब पेंशन स्कीम, 1971 के लिए विकल्प नहीं दिया था किन्तु वह कोयला खान भविष्य निधि स्कीम के अन्तर्गत आता था और जो तारीख 1-4-1994 से तारीख 31-3-1998 के भीतर अधिवर्षिता पर सेवानिवृत्त हुआ था, राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से नौ मास की अवधि के भीतर इस स्कीम के उपबंधों के अधीन पेंशन के लिए विकल्प दे सकेगा और उसे पी.एस.- 1 प्ररूप में अपने विकल्प का प्रयोग करने की तारीख से स्कीम का सदस्य बन गया समझा जाएगा:
परन्तु इस उपपैरा के उपबंधों के अधीन विकल्प का प्रयोग करने वाला कोई भूतपूर्व कर्मचारी पेंशन की निधि में नकद रूप में या उसके भविष्य निधि खाते से पेंशननिधि खाते में अन्तरण द्वारा पैरा 3 के खंड ( ख ), ( ग ), (घ) और ( ङ) में विनिर्दिष्ट रकम के समतुल्य बकाया राशि 1 मार्च, 1971 से विकल्प के प्रयोग की तारीख तक बकाया की बाबत :-
( I ) खंड ( ख ) में निर्दिष्ट कोयला खान भविष्य निधि , में रकम को समय - समय पर अनुज्ञेय दर पर;
( II) खंड ( ग ) और ( घ ) में विनिर्दिष्ट बारह प्रतिशत वार्षिक दर पर; और
( III ) खंड (ङ) में विनिर्दिष्ट ऐसी दर पर जिसे केन्द्रीय सरकार कोयला खान कुटुम्ब पेंशन स्कीम, 1971 में अपनी अभिदाय की बाबत ब्याज जमा करें;
ब्याज सहित निक्षिप्त करनी होगी ।

[PART II-SEC. 3 ( i) ] पादटिप्पण: कोयला खान पेंशम स्कीम, 1998 सा.का. नि. 123( अ ) तारीख 5 मार्च, 1998 द्वारा प्रकाशित की गई थी और तत्पश्चात् उससे निम्नलिखित संख्यांकों द्वारा संशोधन किए गए:-

2. सा.का.नि. 218 (अ) तारीख 22 मार्च, 1999
3. सां.का.नि. 689( अ) तारीख 29 अगस्त, 2000

6. सा.का.नि. 16 ( अ ) तारीख 9 जनवरी , 2002
स्पष्टीकरण ज्ञापन
कोयला खान भविष्य निधि और प्रकीर्ण उपबंध अधिनियम, 1948 ( 1948 का 46 ) की धारा 7 केन्द्रीय सरकार को भविष्यलक्षी रूप से या भूतलक्षी रूप से अधिनियम के अधीन विरचित स्कीम में परिवर्धन, संशोधन या परिवर्तन करने के लिए सशक्त बनाता है ।
2. कोयला खान पेंशन स्कीम, 1998 , तारीख 31 मार्च , 1998 से प्रवृत्त हुई थी । उक्त स्कीम, पेंशन के फायदे उन्हीं कुटुम्ब पेंशन सदस्यों तक निर्बंधित करती है जो 1-4-1994 और 31-3-1998 के बीच अधिवर्षिता पर सेवानिवृत्त हुए थे । बाद में न्यासी बोर्ड , कोयला खान भविष्य निधि ने 9-8-2001 को हुई अपनी 133 वीं बैठक में उन कर्मचारियों की भी पेंशन स्कीम की सदस्यता देने का प्रस्ताव अनुमोदित किया जी कोयला खान कुटुम्ब पेंशन स्कीम , 1971 के अधीन कुटुम्ब पेंशन के सदस्य नहीं थे । सभी कर्मचारियों को अधिक फायदा वाला और समतुल्य बनाने के लिए इस संशोधन को 31 मार्च, 1998 से, भूतलक्षी प्रभाव दिया गया है ।
3. उक्त स्कीम में संशोधन को भूतलक्षी प्रभाव दिए जाने से किसी कर्मचारी के हित पर प्रतिकूल प्रभाव नहीं पड़ेगा ।

NOTIFICATION
New Delhi , the 8th July, 2002
G.S.R. 482 (E) .-In exercise of the powers conferred by section 3E of the Coal Mines Provident Fund and Miscellaneous Provisions Act , 1948 (46 of 1948) , the Central Government hereby makes the following amendments to the Coal Mines Pension Scheme, 1998 , namely :-
1. ( 1) This Scheme may be called the Coal Mines Pension (Amendment ) Scheme , 2002 .
(2) It shall be deemed to have come into force with effect from the 31st day of March , 1998 .
2. In the Coal Mines Pension Scheme , 1998 , in paragraph 4, after sub - paragraph (2A) , the following shall be inserted namely:--
"(2B) An cx -employee who had not opted for the Coal Mines Family Pension Scheme , 1971 but was covered by the Coal Mines Provident Fund Scheme and had superannuated within 1-4-1994 to 31-3-1998 may opt for pension under the provisions of this Scheme within a period of nine months from the date of this notification in the Official Gazette and he shall be deemed to have become the member of the Scheme from the date of his exercising the option in Form PS - 1 :
Provided that an ex-employce exercising the option under the provisions of this sub - paragraph shall have to deposit in the Pension Fund either in cash or by transfer from his Provident Fund account to the Pension Fund the arrears equivalent to the amounts specified in clauses (b) , ( c) , ( d) and (e) of paragraph 3 , alongwith interest from the 1st day of March, 1971 till the date of exercising the option in respect of arrears;
(i) specified in clause (b) at the rate admissible from time to time to the monies in Coal Mines Provident Fund;
(ii) Specified in clauses (c) and (d) , at the rate of twelve percent per annum ; and
(iii) Specified in clause (e) as such rate as the Central Government from time to time, credited interest in respect ofits contribution to the Coal Mines Family Pension Scheme , 1971 "

Foot Note: The Coal Mines Pension Scheme , 1998 was published vide G.S.R. 123 ( E) dated the 5th March, 1998 and subsequently amended vide number:-
1. GSR 268 (E ) , dated the 25th May , 1998
2. GSR 218 (E) , dated the 22nd March , 1999
3. GSR 689 (E ) , dated the 29th August, 2000
4. GSR 256 (E ), dated the 12th April , 2001

ExplanatoryMemorandum
Section 7 of the Coal Mines Provident Fund and Miscellaneous Provisions Act , 1948 ( 46 of 1948 ) empowers the Central Government to add to , amend or vary a Scheme framed under the Act either prospectively or retrospectively.
2. The Coal Mines Pension Scheme, 1998 came into force with effect from the 31st day of March , 1998. The said Scheme restricted the benefit of pension to those Family Pension members who superannuated between 1-4-1994 and 31-3-1998 . Later on, the Board of Trustees , Coal Mines Provident Fund in its 133rd Meeting held on 9-8-2001 approved the proposal to give the membership of Pension Scheme to those employees also who were not the members of Family Pension under Coal Mines Family Pension Scheme , 1971. The amendment is given retrospective effect from 31st March, 1998 in order to make it more beneficial and equitable to all the employees.
3. The amendment to the said Scheme with retrospective effect will not adversely affect the interest of any employee
