आ.अ. 73 ( अ ).- यतः, राज्य सभा में महाराष्ट्र राज्य की विधानसभा के सदस्यों द्वारा निर्वाचित श्री पटेल मुकेशभाई रसिकलाल का स्थान उनकी मृत्यु हो जाने के परिणामस्वरूप उनकी पदावधि, जो 2 अप्रैल, 2008 का सम्मिलित करते हुए उस तारीख तक थी, के अवसान से पूर्व 15 जून, 2002को रिक्त हो गया है ; और
यतः , इस प्रकार हुई रिक्ति को भरने के प्रयोजन से उप -निर्वाचन कराना है,
अतः , अब , लोक प्रतिनिधित्व अधिनियम, 1951 ( 1951 का 43 ) की धारा 147 , धारा 39 की उपधारा ( 1 ) और धारा 56 के अनुसरण में, भारत निर्वाचन आयोग एतद्वारा -
(अ) महाराष्ट्र राज्य की विधानसभा के सदस्यों से यह अपेक्षा करता है कि वे 28 जुलाई, 2002 ( रविवार ) से पूर्व तथा उक्त अधिनियम और तद्धीन बनाए गए नियमों और किए गए पादेशों के उपबन्धों के अनुसार राज्य सभा में उक्त रिक्ति को भरने के प्रयोजन से एक सदस्य निर्वाचित करें;
उक्त निर्वाचन के सम्बन्ध में-
(आ)

(क) नाम निर्देशन करने की अंतिम तारीख
15जुलाई, 2002 ( सोमवार )
:
(ख) नाम निर्देशनों की संवीक्षा की तारीख
16 जुलाई, 2002 ( मंगलवार )
(ग) अभ्यर्थिताएं वापस लेने की अन्तिम तारीख
: 18 जुलाई, 2002 ( बृहस्पतिवार)
: 25 जुलाई, 2002 ( बृहस्पतिवार)
(घ ) वह तारीख जिसको, यदि आवश्यक हुआ तो, मतदान होगा
:
(ङ) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न करा लिया जाएगा
28 जुलाई, 2002 ( रविवार )
नियत करता है; और
( इ ) 900 बजे पूर्वाह्न से 4.00 बजे अपराह्न तक का समय , ऐसे समय के रूप में नियत करता है जिसको यदि आवश्यक हुआ तो , निर्वाचन के लिए उक्त विनिर्दिष्ट तारीख को , मतदान होगा ।

NOTIFICATION
NewDelhi , the 8th July, 2002
O. N. 73 (E). Whereas, the seat of Shri Patel Mukeshbhai Rasiklal in the Council ofStates , elected by the elected members of the Legislative Assembly ofthe State ofMaharashtra, has become vacant on 15th June, 2002, by the reason of his death, before the expiration of his term of office which was upto and including the 2nd April , 2008; and
Whereas , a bye-election is to be held for the purpose of filling the vacancy so caused; Now, therefore, in pursuance of Section 147 , Sub -section ( 1 ) of Section 39 and Section 56 of the Representation ofthe People Act, 1951 (43 of 1951 ) , The Election Commission of India hereby- (A) calles upon the elected members of the Legislative Assembly of the State of Maharashtra to elecet, before 28th July, 2002 (Sunday ) and in accordance with the provisions of the said Act and of the Rules and Orders made thereunder, a person for the purpose offilling the said vacancy in the Council of States;
(B) appoints , with respect to the said election,-
(1) the 15th July, 2002 (Monday) , as the last date for making nominations ;
( i) the 16th July, 2002 (Tuesday ) , as the date for the scrutiny of nominations ;
(iii) the 18th July, 2002 (Thursday) , as the last date for the withdrawal of candidatures ;
( iv) the 25th July, 2002 ( Thursday) , as the date on which a poll shall, if necessary, be taken; and
(v) the 28th July, 2002 ( Sunday) , as the date before which the election
shall be completed; and
(C) fixes the hours from 9.00 A.M. to 4.00P.M. , as the hours during which the poll shall , if necessary, be taken on the date specified above for the election .

आ.अ. 74( अ )-लोक प्रतिनिधित्व अधिनियम, 1951 ( 1951 का 43 ) की धारा 21 के अनुसरण में और धारा 22 की उप- धारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत निर्वाचन आयोग , महाराष्ट्र सरकार के परामर्श से 8 जुलाई, 2002 को भारत के राजपत्र में प्रकाशित राज्य की राज्य सभा के उप- निर्वाचन के सम्बन्ध में, एतद्द्वारा:-
(i ) नीचे की सारणी के स्तम्भ ( 1 ) में विनिर्दिष्ट अधिकारी को रिटर्निंग आफिसर पदाभिहित करता है ; और
( ii ) उक्त सारणी के स्तम्भ ( 2 ) में विनिर्दिष्ट अधिकारी को रिटर्निंग आफिसरों की उनके कृत्यों के निष्पादन में सहायता के लिए सहायक रिटर्निंग आफिसर के रूप में नियुक्त करता है ।

O. N. 74(E) . In pursuance of Section 21 , and in exercise of the powers conferred by Sub - section ( 1 ) of Section 22, of the Representation of the people Act, 1951 ( 43 of 1951 ) , the Election Commission of India , in consultation with theGovernment of the State of Maharashtra, hereby :--
(i) designates the officer, specified in column ( 1 ) of the TABLE below, to be the Returning Officer ; and ( ii) appoints the officer, specified in column (2) of the said Table , to be the Assistant Returning Officer to assist the Returning Officer in the performance of his functions .
in respect of the bye-election to the Council of States , to be held in that State in pursuance of the commission's notification, published in the Gazette of India on 8th July, 2002 :--
