का.आ. 846 ( अ ) .- केन्द्रीय सरकार, विस्फोटक अधिनियम , 1884 ( 1884 का 4 ) की धारा 14 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, एतद्द्वारा तेल और प्राकृतिक गैस निगम लिमिटेड, एस.आर.बी.सी. , सी एम डी ए बिल्डिंग, 10 वां तल ( ई. ) , 8 , गांधी इरविन रोड, इगमोर, चैन्नई को बेकर ऑयल टूल्स , 6023 , नेविंगटन वोलेषर्ड , ह्यस्टन, टेक्सास, संयुक्त राज्य अमेरिका से चैन्नई हवाई अड्डे पर निम्नलिखित विस्फोटकसामग्री के आयात के लिए विस्फोटक नियमावली, 1983 ( इसे इसके पश्चात् उक्त निममावली कहा गया है ) के नियम 31 के उपनियम (2) के उपबंधों के अनुपालन से छूट देती है, यथा:-

2. उक्त पैराग्राफ 1 में उल्लिखित विस्फोटकों का आयात निम्नलिखित शर्तों के अध्यधीन होगा, नामतः:-
( 1 ) नागरिक विमानन महानिदेशालय और भारतीय अन्तर्राष्ट्रीय हवाई अड्डा प्राधिकरण से आवश्यक स्वीकृति प्राप्त की जाएगी और उक्त प्राधिकरणों द्वारा लगाई गई शर्तों, यदि कोई हो, का पालन किया जाएगा ;
(2 ) अन्तर्राष्ट्रीय वायु परिवहन एसोसिएशन खतरनाक माल विनियम , 1996 की धारा -3 में दिए गए वर्गीकरण के प्रभाग 1.4 के ही अनुरूप विस्फोटकों का आयात किया जाएगा;
(3 ) नियम 31 के उपनियम ( 2 ) के अलावा, उक्त नियम में यथा निहित विस्फोटकों के कब्जे, परिवहन, प्रयोग और आयात से संबंधित सुसंगत उपबंधों का पालन किया जाएगा;
(4) उक्त नियम के अधीन लाइसेंसशुदा विस्फोटक सामग्री के वाहनों की प्रर्याप्त संख्या हवाई अड्डे पर तैयार रखी जाएगी जिससे किविस्फोटक सामग्री को वायुयान के उत्तरते ही शीघ्रता से हटाया जा सके;
(5 ) वायुयान को त्रिमानपत्तन पर दूरस्थ स्थान पर खड़ा किया जाएगा और विस्फोटकों का वायुयान से अतंरण शुरू करने से पहले महानिदेशक, नागरिक विमानन से परामर्श करके पर्याप्त संख्या में सुरक्षा गार्डों का प्रबंध करके वायुयान और विस्फोटक सामग्री

[PART II-SEC. 3 ( ii) ] वाहन के चारों ओर कम से कम 500 वर्गमीटर क्षेत्र को घेर लिया जाएगा । उक्त प्रबंध व्यवस्था तब तक बनी रहेगी जब तक कि अन्तरण पूरा नही हो जाता और अच्छी तरह से बन्द वाहन उक्त स्थान से रवाना नहीं हो जाता;
(6 ) घिरे हुए क्षेत्र के अन्दर कोई धुम्रपान अथवा खुली बत्ती के उपयोग की अनुमति नहीं होगी; तथा
( 7 ) रुपयुक्त विस्फोट सामग्री को ले जा रहे वाहभ उक्त नियम के अधीन लाइसेंसयुक्त भण्डारण मैगजीन की ओर अग्रसर होगें और शास्ते में कोई अनुचित विलम्ब नहीं किया जाएगा और विस्फोटकों के परिवहन के दौराभ उक्त नियमों के सभी उपबंधों और स्थानीय यातायात नियमों और नगर पालिका के विनियमों का पालन किया जाएगा ।

S.O. 846 (E ).- In exercise of the powers conferred by sub - section (2 ) of Section 14 of the Explosives Act , 1884. (4 of 1884 ) , the Central Government hereby exempts the Oil and Natural Gas Corporation Limited , SRBC , CMDA Building, 10th Floor (E) , 8. Gandhi Irwin Road, Egmore , Chennai from the provisions of sub -rule (2) of rule 31 of the Explosives Rules, 1983 (hereinafter referred to as the said rules ) , for import of the following explosives from the Baker Oil Tools , 6023 , Navigation Boulevard, Houston , Texas , United States of America, at Chennai Airport, namely

2 The explosives mentioned in paragraph 1 above shall be imported subject to the following coditions, namely
(1) necessary clearances are obtained from the Director General of Civil Aviation and the Airports Authority of India and conditions , if any, imposed by the said authorities shall be complied with;
(2) explosives conforming only to Division 1 4 of the classification given in section 3 of the International Air Transport Association Dangerous Goods Regulations , 1996 shall be imported;
(3) relevant provisions relating to the possession, transport, use and import of explosives, as contained in the said rules , except sub - rule (2 ) of rule 31 , shall be complied with;
(4) adequate number of explosive vans , licensed under the said rules, shall be kept ready at the airport so that the explosives can be removed expeditiously from the aircraft after its landing;
(5) aircraft shall be parked at a remote place at the airport and an area of at least five hundred square metres around the aircraft and the explosives van shall be cordoned offby providing adequate number of security guards in consultation with the Director General of Civil Aviation before the transfer of explosives from aircraft to the van begins . This arrangement shall continue till such transfer is completed and the van is duly locked and leaves the site;
(6) sınoking or use of naked light shall not be permitted within the cordoned area ; and
(7) vans carrying the explosives shall proceed to the storage magazines licensed under the said rules and no undue delay shall be made on the way and all provisions of the said rules and local traffic rules and municipal regulations shall be complied with during the transportation of the explosives .

(3) नियम 31 के उपनियम ( 2 ) के अलावा, उक्त नियम में यथा निहित विस्फोटकों के कब्जे, परिवहन, प्रयोग और आयात से संबंधित सुसंगत उपबंधों का पालन किया जाएगा;
