सं. 43/2002-केन्द्रीय उत्पाद शुल्क
सा.का.नि. 591 ( अ ) - केन्द्रीय सरकार , केन्द्रीय उत्पाद शुल्क अधिनियम , 1944 ( 1944 का 1 ) की धारा 5 क की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह समाधान हो जाने पर कि लोक हित में ऐसा करना आवश्यक है , भारत सरकार के वित्त मंत्रालय ( राजस्व विभाग ) की अधिसूचना सं. 6/2002 केन्द्रीय उत्पाद शुल्क, तारीख 1 मार्च, 2002 में निम्नलिखित और संशोधन करती है , अर्थात्: - उक्त अधिसूचना में, -
(i ) सारणी में,
(क) क्रम सं. 136 और उससे संबंधित प्रविष्टियों के पश्चात् निम्नलिखित अन्तःस्थापित किया जाएगा, अर्थात् -

नहीं
कताई के लिए संसाधित, जिसमें काटन समाविष्ट है
(जिसमें कोई अन्य टैक्सटाइल सामग्री सम्मिलित नहीं है) और जिसमें पॉलिस्टर स्टैपल फाइबर का अनुपात खादी और ग्रामोद्योग आयोग या खादी और ग्रामोद्योग आयोग द्वारा अनुमोदित किसी संगठन के स्वामित्वाधीन किसी कारखाने द्वारा विनिर्मित कुल फाइबर अन्र्तवस्तु के भार के आधार
पर 70 प्रतिशत से कम हैं ।
(ख) क्रम सं. 137 के सामने, स्तम्भ ( 3 ) में प्रविष्टि के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्:-
" पॉलिस्टर स्टैपल फाइबर का सूत जिसमें कॉटन अन्तर्विष्ट है ( जिसमें कोई अन्य टैक्सटाइल सामग्री सम्मिलित नहीं है ) और जिसमें पॉलिस्टर स्टैपल फाइबर का अनुपात खादी और ग्रामोद्योग आयोग या खादी और ग्रामोद्योग आयोग द्वारा अनुमोदित किसी संगठन के स्वामित्वाधीन किसी कारखाने द्वारा विनिर्मित या क्रय की गई कुल फाइबर अन्र्तवस्तु के भार के आधार पर 70 प्रतिशत से कम है । "" 2637 G1/2002

[ PART II-SEC . 3 ( i ) ] ( 11 ) उपाबंध में,-
( क) शर्त सं. 23 और उससे संबंधित शर्त के पश्चात् निम्नलिखित अन्तःस्थापित किया जाएगा, अर्थात्:-

" 23क. यदि विनिर्माता निकासी के समय खादी और ग्रामोद्योग आयोग द्वारा इस निमित्त प्राधिकृत किसी अधिकारी से एक प्रमाणपत्र प्रस्तुत करता है कि ये फाइबर केवल पोली वस्त्र के अर्थात् कोई ऐसा कपड़ा जिसमै सूत और पॉलिस्टर अन्तर्विष्ट हैं , जो भारत में हाथ से कते सूतों से हथकरघा पर बुना हुआ होगा , विनिर्माण में प्रयोग के लिए खादी और ग्रामोद्योग आयोग द्वारा अनुमोदित्त किसी संगठन के स्वामित्वाधीन किसी कारखाने द्वारा हाथ से कते सूतों में होंगे ।" ;
(ख ) शर्त सं. 24 और उससे संबंधित शर्त के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्:-

"24. यदि, -
(i ) यह माल खादी और ग्रामोद्योग आयोग या खादी और ग्रामोद्योग आयोग द्वारा अनुमोदित संगठन के स्वामित्वाधीन किसी कारखाने द्वारा क्रय किया गया है और ऐसे माल के लिए संदाय , यथास्थिति, खादी और ग्रामोद्योग आयोग द्वारा या खादी और ग्रामोद्योग आयोग द्वारा अनुमोदित किसी संगठन द्वारा अपने बैंक लेखा से लिखे गए चैक द्वारा किया गया था; और
( ii ) विनिर्माता निकासी के समय खादी और ग्रामोद्योग आयोग द्वारा इस निमित्त प्राधिकृत किसी अधिकारी से कोई प्रमाणपत्र प्रस्तुत करता है कि सूत का उपयोग केवल पोली वस्त्र के निर्माण में अर्थात्कोई कपड़ा जिसमें सूत और पॉलिस्टर, जो भारत में हथकरघा पर हाथ से व्युतित होंगे , किया जाएगा ।

G.S.R. 591 ( E ) . In exercise of the powers conferred by Sub - section ( 1 ) of Section 5A of the Central Excise Act, 1944 ( 1 of 1944 ) , the Central Government , being satisfied that it is necessary in the public interest so to do , hereby makes the following further amendment in the notification of the Government of India, in the Minisrty of Finance (Department of Revenue ) , No. 6/2002 - Central Excise , dated the .1 st March , 2002 , namely: ----

( a) after S.No.136 and the entries relating thereto, the following shall be inserted, namely :--

Ployester staple fibres , carded , combed or otherwise processed for spinning, containing cotton (not containing any other textile material ) and in which the proportion of polyester staple fibre is less than 70 per cent by 'weight of the total fibre content manufac- tured by a factory owned by the Khadi and Village Industries Commission of any organization approved by the Khadi and Village Industnes Commission.

(b ) against S. No. 137 , for the entry in column ( 3 ) , the following shall be substituted , namely :-
Yarn of polyester staple libre containing cotton ( not containing any other textile material ) and inwhich the proportion of polyester staple fibre is less than 70 per cent. by weight of the total fibre content , manufactured or purchased by a factory owned by the Khadi and Village Industries Commission or any organization approved by the Khadi and Village Industries Commission" ;
( ii) in the Annexure ,
( a) after condition No. 23 and the condition relating thereto , the following shall be inserted , namely :-

Ifthe manufacturer produces at the time of clearance a certificate from an officer authorized in this behalf by the Khadi and Village Industries Commission , that these fibres shall be hand spun into yarns by a factory owned by the Khadi and Village Industries Commission or any organization approved by the Khadi and Village Industries Commission , for use only in the manufacture of Poly Vastra, that is to say , any cloth containing cotton and polyester, woven on handloom from yarns hand spun in India. " ;
(b) for condition No. 24 and the condition relating thereto , the following shall be substituted , namely :----

( i ) these goods are purchased by a factroy owned by the Khadi and Village Industries Commission or any organization approved by the Khadi and Village Industries Commission and the payment for such goods is made by cheque drawn by the Khadi and Village Industries Commission or such organization approved by the Khadi and Village Industries Commission , as the case may be , on its own bank account ; and (ii ) the manufacturer produces at the time of clearance a certificate from an officer authorized in this behalf by the Khadi and Village Industries Commission , that the yarn shall be used only in the manufacture of Poly Vastra, that is to say, any cloth containing cotton and polyester, woven on handloom from yarns hand spun inIndia." .

Note:-The principal notification was published in the Gazette of India, Extraordinary , vide notification No. 6/2002 - Central Excise , dated the 1st March, 2002 [ G.S.R. 127 (E ) , dated the 1st March , 20021 and was last amended by notification No.42/2002-Central Excise , dated the 21st August , 2002 [ G.S.R. No. 587(E) , dated the 21st August, 2002 ] .
