सा.का.नि. 593 ( अ) .- केन्द्रीय सरकार, सीमाशुल्क अधिनियम, 1962 ( 1962 का 52) की धारा 28ज की उपधारा ( 1 ) और उपधारा (3) तथा धारा 28 झ की उपधारा (7) के साथ पठित धारा 156 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित नियम बनाती है, अर्थात् :--
1. संक्षिप्त नाम, विस्तार और प्रारंभ-- (1 ) इन नियमों का संक्षिप्त नाम सीमाशुल्क (अग्रिग विनिर्णय) नियम , 2002 है ।
(2) इनका विस्तार संपूर्ण भारत पर है ।
(3) ये राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो, -
(क) " अधिनियम " से सीमाशुल्क अधिनियम, 1962 (1962 का 52) अभिप्रेत है :
(ख) " प्राधिकरण " से सीमाशुल्क अधिनियम, 1962 (1962 का 52) की धारा 28 के अधीन गठित अग्रिम विनिर्णयों के लिए प्राधिकरण अभिप्रेत है ;
(ग) "अग्रिम विनिर्णय (सीमा शुल्क) के लिए आवेदन प्ररूप" से इन नियमो श उपाबद्ध प्ररूप अभिप्रेत है ;

[PART II -SEC . 3 (i) ] ( घ) उन शब्दों और पदों के, जो इसमें प्रयुक्त हैं और परिभाषित नहीं हैं किन्तु अधिनियम में परिभाषित हैं, वही अर्थ होंगे जो उनके क्रमशः उस अधिनियम में हैं । 3. आवेदन का प्ररूप और रीति (1) अधिनियम की धारा 28 ज की उपधारा ( 1 ) के अधीन कोई अग्रिम विनिर्णय अभिप्राप्त करने के लिए कोई आवेदन, इन नियमों से उपाबद्ध अग्रिम विनिर्णय (सीमा शुल्क) के लिए आवेदन प्ररूप में किया जाएगा ।
(2) उपनियम (1 ) में निर्दिष्ट आवेदन, उसमें अंतर्विष्ट सत्यापन और ऐसे आवेदन के साथ संलग्न सभी सुसंगत दस्तावेजों को निम्नानुसार हस्ताक्षरित किया जाएगा-
(क) किसी व्यष्टि की दशा में, स्वयं व्यष्टि द्वारा या जहां व्यष्टि भारत में उपस्थित नहीं है, वहां संबद्ध व्यष्टि द्वारा यां इस निमित्त उसके द्वारा सम्यक् रूप से प्राधिकृत किसी व्यक्ति द्वारा , और जहां व्यष्टि अवयस्क है या अपने कृत्यों को करने में मानसिक रूप से अशक्त है, वहां उसके संरक्षक द्वारा या उसकी ओर से कृत्य करने के लिए सक्षम किसी अन्य व्यक्ति द्वारा ;
(ख) किसी हिन्दू अविभक्त कुटुम्ब की दशा में, कुटुम्ब के कर्ता द्वारा और जहां कर्ता भारत में उपस्थित नहीं है या वह अपने कृत्यों को करने में मानसिक रूप से अशक्त है वहां उस कुटुम्ब के किसी अन्य वयस्क सदस्य द्वारा ;
(ग) किसी कंपनी या स्थानीय प्राधिकरण की दशा में , जिसे उसके प्रधान अधिकारी द्वारा यथास्थिति, कंपनी या स्थानीय प्राधिकरण द्वारा ऐसे प्रयोजन के लिए प्राधिकृत किया गया है ;
(घ) किसी फर्म की दशा में, उसके किसी भागीदार द्वारा , जो अवयस्क नहीं है ;
(ङ) किसी संगम की दशा में, संगम के किसी सदस्य या उसके प्रधान अधिकारी द्वारा ; और
(च) किसी अन्य व्यक्ति की दशा में, उस व्यक्ति द्वारा या उसकी ओर से कृत्य करने के लिए किसी सक्षम व्यक्ति द्वारा । [भाग II- खण्ड 3 ( i) ]

(3) प्रत्येक आवेदन चार प्रतियों में फाइल किया जाएगा और उसके साथ दो हजार पांच सौ रुपए की फीस होगी ।
(4) प्राधिकरण द्वारा सुनाए गए अग्रिम विनिर्णयों की प्रतियों का प्रमाणीकरण अधिनियम की धारा 28झ की उपधारा (7) के अधीन प्राधिकरण द्वारा सुनाए गए और सदस्यों द्वारा सम्यक् रूप से हस्ताक्षरित अग्रिम विनिर्णय की एक प्रति है, जिसे प्रत्येक आवेदक और मामले पर अधिकारिता रखने वाले सीमाशुल्क आयुक्त को भेजा जाना है, यथास्थिति, आयुक्त, अग्रिम विनिर्णय प्राधिकरण या आयुक्त, अग्रिम विनिर्णय प्राधिकरण द्वारा सम्यक् रूप से प्राधिकृत किसी अन्य अधिकारी द्वारा उसकी मूल प्रति की वास्तविक प्रति के रूप में प्रमाणित की जाएगी ।

[PART II- SIC 3( 1) ] टिप्पण--
1. आवेदन चार प्रतियों में अंग्रेजी या हिन्दी में भरा जाना चाहिए ।
2. आवेदन के साथ अग्रिम विनिर्णय प्राधिकरण के पक्ष में लिखा गया, नई दिल्ली में संदेय , दो हजार पांच सौ रुपए का पाने वाले के खाते में देय मांगपत्र ड्राफ्ट होना चाहिए । ड्राफ्ट की विशिष्टियां मद सं 0 12 से संबंधित स्तंभ में प्रविष्ट की जानी चाहिए ।
3. कृपया कथन करें कि व्यष्टि, हिन्दू अविभक्त कुटुम्ब, कंपनी , फर्म , व्यक्तियों का संगम आदि क्याहैं ।
4. आवेदन की सं० और प्राप्ति का वर्ष अग्रिम विनिर्णय प्राधिकरण के कार्यालय में भरा जाएगा 5. यदि आवेदन में किसी मद का उत्तर देने के लिए स्थान अपर्याप्त पाया जाता है तो , इस प्रयोजन के लिए पृथक सीट का उपयोग किया जा सकता है । प्रत्येक सीट के नीचे आवेदक द्वारा हस्ताक्षर किए जाने चाहिए ।
6. मद सं 0 3 के उत्तर में आवेदक को संयुक्त उद्यम में पक्षकार(रों) की प्रास्थिति, अर्थात् क्या पक्षकार क्या व्यष्टि, हिन्दू अविभक्त कुटुम्ब फर्म , कंपनी, व्यक्तियों का फर्म संगम या कोई अन्य व्यक्ति है, का उल्लेख करना चाहिए ।
7. मद सं 0 6 के लिए , आयकर अधिनियम, 1961 के अनुसार भारत में ' निवास ' के संबंध में उपबंधों के संदर्भ में उत्तर दिया जाना चाहिए ।
8. मद सं 0 7 के संबंध में , प्रश्न, किए जाने वाले प्रस्तावित क्रियाकलाप पर आधारित होने चाहिए , काल्पनिक प्रश्नों पर विचार नहीं किया जाएगा ।
9. मद सं ० 8 के संबंध में आवेदक को सुसंगत तथ्यों का व्यौरवार कथन करना चाहिए और अपने क्रियाकलाप की प्रकृति और प्रस्तावित क्रियाकलाप ( क्रियाकलापों) की संभाव्य तारीख और प्रयोजन भी प्रकट करना चाहिए । आवेदन के साथ प्रस्तुत दस्तावेज में संप्रदर्शित 7

सुसंगत तथ्य(यों) को तथ्यों के कथन में सम्मिलित करना चाहिए , न कि केवल निर्देश द्वारा समाविष्ट किया जाना चाहिए ।
10. मद सं ० 9 के लिए आवेदक को उस/उन प्रश्न (नों) के संबंध में, जिस/ जिन पर अग्रिम विनिर्णय चाहा गया है, विधि या तथ्यों का अपना निर्वचन स्पष्ट रूप से कथित करना चाहिए ।
11. आवेदन, उससे संलग्न सत्यापन, आवेदन के उपाबंधों और उपाबंध 1 और उपाबंध 2 के साथ वाले कथनों और दस्तावेजों के प्रत्येक पृष्ठ पर हस्ताक्षर किए जाने चाहिए ।

NOTIFICATION
New Delhi , the 23rd August , 2002 No. 55/ 2002 - CUSTOMS ( NT )
G.S.R. 593 ( E) . In exercise of the powers conferred by section 156 read with sub - sections ( 1 ) and ( 3 ) of section 28 H , sub- section ( 7 ) of section 28-1 of the Customs Act , 1962 ( 52 of 1962 ) , the Central Government hereby makes the following rules , namely: -
1. Short title , extent and commencement. ( 1 ) These rules may be called the Customs (Advance Rulings ) Rules, 2002 .
They extend to the whole of India . (2)
(3) They shall come into force on the date of their publication in the Official Gazette 2 Definitions. In these rules , unless the context otherwise requires , -
( a) " Act " means the Customs Act , 1962 ( 52 of 1962 ) ;
(b) " Authority " means the Authority for Advance Rulings constituted under section 28F of the Customs Act , 1962 ( 52 of 1962 ) .
( c) "Form- Application for Advance Ruling ( Customs ) " means the form annexed to these rules
( d) Words and expressions used and not defined herein but defined in the Act , shall have the meanings respectively , assigned to them in the Act 8

PART II-SEC. 3 (1) ] 3 Form and manner of application . ( 1 ) An application for obtaining an advance ruling under sub -section ( 1 ) of section 28H of the Act shall be made in Form- Application for Advance Ruling (Customs).
(2) The application referred to in sub - rule ( 1 ) , the verification contained therein and all relevant documents accompanying such application shall be signed, -
(a) in the case of an individual , by the individual himself, or where the individual is absent from India, by the individual concerned or by some person duly authorized by him in this behalf, and where the individual is a minor or is mentally incapacitated from attending to his affairs , by his guardian or by any other person competent to act onhis behalf,
(b) in the case of a Hindu undivided family , by the Karta of that family and , where the Karta is absent from India or is mentally incapacitated from attending to his affairs , by any other adult member of that family;
(c) in the case of a company or local authority , by the principal officer thereof authorized by the company or the local authority, as the case may be , for such purpose,
(d) in the case of a firm, by any partner thereof, not being a minor ;
(e) in the case of an association , by any member of the association or the principal officer thereof, and
(f) in the case of any other person , by that person or some person competent to act on his behalf
(3) Every application shall be filed in quadruplicate and shall be accompanied by a fee of two thousand five hundred rupees
4 Certification of copies of the advance rulings pronounced by the Authority A copy of the advance ruling pronounced by the Authority for Advance Rulings and duly signed by the Members to be sent to each of the applicant and to the Commissioner of Customs under sub - section (7) of section 28-1 of the Act , shall be certified to be true copy of its original by the Commissioner, Authority for Advance Rulings, or any other officer duly authorized by the Commissioner , Authority for Advance Rulings , as the case may be भारत का राजपत्र असाधारण

11 Notes :
1. The application must be filled in English or Hindi in quadruplicate .
2. The application must be accompanied by an account payee demand draft of Rupees two thousand five hundred drawn in favour of Authority for Advance Rulings , payable at New Delhi . Particulars of the draft should be entered in the column pertaining to item number 12 .
3. Please state whether Individual , Hindu undivided family , Company , Firm , an Association of Persons , etc
4. The number and year of receipt of the application will be filled in the Office of the Authority for Advance Rulings
5 If the space provided for answering any item in the application is found insufficient , separate sheets may be used for this purpose . Each sheet must be signed at the bottom by the applicant 6. In reply to item number 3 the applicant must state the status of party( s ) in the joint venture, i.e. whether the party( s ) is an individual , Hindu undivided family firm , company, firm association of persons or any other person . The status should be given in respect of each party .
7. For item number 6 , the reply must be given in the context of the provisions regarding 'residence ' in India as per the Income Tax Act , 1961
8. Regarding item number 7, the question ( s ) should be based on the activity proposed to be under taken, Hypothetical questions will not be entertained .
9. In respect of item number 8 , the Applicant must state in detail the relevant facts and also disclose the nature of his activity and the likely date and purpose of the proposed activity( s ) Relevant facts reflected in document submitted along with the application must be included in the statement of facts and not merely incorporated by reference .
