सा.का. नि. 702( अ ) - केन्द्रीय मोटर यान नियम, 1989 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप, जिन्हें केन्द्रीय सरकार, मोटर यान अधिनियम, 1988 (1988 का 59 ) की धारा 64 के खंड ( क) और धारा 110 की उपधारा ( 1 ) के खंड ( छ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , बनाना चाहती है, उक्त अधिनियम की धारा 212 की उपधारा (1 ) की अपेक्षानुसार, ऐसे सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर, उस तारीख से, जिसको भारत के राजपत्र में यथा प्रकाशित इस अधिसूचना की प्रतियां जनता को उपलब्ध करा दी जाती हैं, पैंतालिस दिन की अवधि के अवसान के पश्चात् विचार किया जाएगा ;
इन प्रारूप नियमों के संबंध में , आक्षेप या सुझाव, यदि कोई हो, संयुक्त सचिव (परिवहन) , सड़क परिवहन और राजमार्ग मंत्रालय, परिवहन भवन, नई दिल्ली को भेजे जा सकेंगे ;
ऐसे आक्षेपों या सुझावों पर, जो उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से ऐसी विनिर्दिष्ट अवधि की समाप्ति से पूर्व प्राप्त हों, केन्द्रीय सरकार द्वारा विचार किया जाएगा ;
प्रारूप नियम

इन नियमों का संक्षिप्त नाम केन्द्रीय मोटर यान (... संशोधन) नियम, 2002 है ।

[PART II-SEC . 3 ( i ) ) (2) ये, इन नियमों में जैसा अन्यथा उपबंधित है, उसके सिवाय , राजपत्र में इनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. केन्द्रीय मोटर यान नियम, 1989 में, -
(1) नियम 47 के उपनियम (1 ) में, खंड (ज) के स्थान पर, निम्नलिखित खंड रखा जाएगा, अर्थात्:--
"(G) आयातित यानों की दशा में, अनुज्ञप्ति और बंधपत्र, यदि कोई हो, के साथ सीमा शुल्क निकासी प्रमाणपत्र :
परन्तु यात्री सामान नियम, 1998 के अधीन आयातित यानों से भिन्न, आयातित यानों की दशा में, रजिस्ट्रीकरण प्राधिकारी द्वारा अनुसरण की जाने वाली प्रक्रिया वही होगी जिसका भारत में विनिर्मित यानों के रजिस्ट्रीकरण के लिए अनुसरण किया जाता है, और" ;
नियम 115क में, -
(2)
(i ) उपनियम (4) में, " कृषि ट्रैक्टर और संन्निर्माण उपस्कर यान " शब्दों के स्थान पर, " संन्निर्माण उपस्कर यान " शब्द रखे जाएंगे ;
यह उपबंध 1 जून, 2003 को प्रवृत्त होगा ।
(ii) उपनियम (4) के पश्चात्, निम्नलिखित उपनियम अंतःस्थापित किया जाएगा, अर्थात्:-
"(5) प्रत्येक डीजल चालित कृषि ट्रैक्टर उसके विनिर्माता द्वारा इस प्रकार विनिर्मित और उत्पादित किया जाएगा कि जब उसका आईएसओ 8178-4सी 18 सेति चक्र में वर्णित प्रक्रिया के अनुसार परीक्षण किया जाता है तो, वह उसके द्वारा उत्सर्जित गैस युक्त प्रदूषकों के निम्नलिखित मानकों का, उपनियम (2) में यथाउपबंधित दृश्यमान प्रदूषकों के अतिरिक्त अनुपालन करता है, अर्थात्:--
परीक्षण के दौरान उत्सर्जित कार्बन मोनाआक्साइड (सीओ ) , हाइड्रोकार्बन (एचसी) तथा नाइट्रोजन के आक्साइड (एनओएक्स) और विविक्त द्रव्य (पीएम) के भारित औसत द्रव्यमान ग्राम प्रति किलोवाट घंटों में किस्म अनुमोदन (टीए) और उत्पादन अनुरूपता (सीओपी) परीक्षणों के लिए नीचे सारणी में दी गई सीमाओं से अधिक नहीं होगा, अर्थात्: -- भारत का राजपत्र असाधारण

(i) उक्त सारणी के स्तंभ 2 में उल्लिखित मानक 1 जून, 2003 से लागू होंगे ;
(ii) उक्त सारणी के स्तंभ 3 में उल्लिखित मानक 1 अप्रैल, 2005 से लागू होंगे ;
अनुरूपता के लिए टिप्पण- भारत (ट्रेम) स्टेज 2 मानकों के लिए अनुज्ञात उत्पादन 10 प्रतिशत की संहिता सीमा" ।

NOTIFICATION
New Delhi , the 11th October, 2002
ofthe Motor Vehicles Act , 1989 (59 of 1988), is hereby published as required by sub-section (1) ofsection 212 of the said Act for information of all persons likely to be affected thereby;
and notice is hereby given that the said draft rules will be taken into consideration after the expiry of forty five days from the date on which the copies of this notification , as published in G.S.R. 702(E)-The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise the powers conferred by clause (a) of section 64 and clause (g ) of sub-section ( 1 ) of section 110 theGazette of India , are made available to the public;
Objections or suggestions to these draft rules, if any, may be sent to the Joint Secretary (Transport) , Ministry of Road Transport and Highways , Transport Bhawan, New Delhi;
The objections or suggestions, which maybe received from any person with respect to the said draft rules before the expiry of the period so specified will be considered by the Central Governent;

DRAFT RULES
1. (1 ) These rules may be called the Central Motor Vehicles (-- Amendment ) Rules, 2002 .
(2) They shall come into force on the date of their final publication in the Official Gazette, save as otherwise provided in these rules.
2. In the Central Motor Vehicles Rules , 1989 , -
(1) in rule47, in sub - rule ( 1 ) , for clause ( h ) , the following clause shall be substituted, namely:-
"(h) Custom's clearance certificate in the case of imported vehicles along with the licence and bond , if any:
Provided that in the case of imported vehicles other than those imported under the Baggage Rules , 1998, the procedure followed by the registering authority shall be same as those procedure followed for registering of vehicles manufactured in india , and";
(2) in rule 115A , -
(i ) in sub- rule (4) , for the words , " agriculture tractor and constuction equipment vehicles " , the words " construction equipment vehicles " shall be substituted; This provision shall come into force on 1st June , 2003 .
(ii ) after sub- rule ( 4) , the following sub- rule shall be inserted , namely: -
"(5) Every diesel driven agriculture tractor shallbe so manufactured and produced by the manufacturer that it complies with the following standards of gaseous pollutants emitted by them in addition to those of visible pollutants as provided in sub- rule (2) when tested as per the procedure described in ISO 8178-4 ' C1 ' 8 mode cycle , namely: -
The weighted average Mass of Carbon Monoxide ( CO) , Hydrocarbon (HC) and oxides of nitrogen ( NOx) , and Particulate Matters ( PM ) in gram per kilo watt hour emitted during the test shall not exceed the limits given below in the Table for Type Approval (TA) and Conformity of Production ( COP) tests , namely:-

(i) The norms mentioned in column (2) of the said Table shall be applicable with effect from 1st June , 2003;
(li) The norms mentioned in column (3 ) of the said Table shall be applicable with effect from 1st April , 2005.
Note: Tolerance limit of 10 per cent for Conformity of Production allowed for Bharat (Trem) Stage - Il norms" .
